The Administrator, Union territory of Ladakh hereby formulates the following policy for providing

compensation on account of death of prisoners confined in the Jails of Union territory of Ladakh:

1. This policy may be called “Policy for Compensation on Account of Death of Prisoners, 2024”

2. It shall come into force from the date of publication in the official Gazette.

3. Compensation will be paid to the next of kin or legal heir (s) of prisoners in cases of unnatural

deaths only, provided the death is caused due to any of the following reasons:

Due to quarrel amongst prisoners.

Due to negligence of Medical/Para Medical Officer (s)/official (s).

Rs. 5.0 lakhs

5.

Due to suicide committed by prisoners.

Rs. 5.0 lakhs

4. No compensation will be admissible in the following cases:

i.

In cases of natural deaths including deaths due to illness.

ii.

In case, death occurs during escape from Jail or from lawful custody outside the

Jails.

iii.

In case, the death occurs due to any natural disaster/ calamity.

5. Procedure for grant of compensation: The Superintendent of the concerned Jail shall send a detailed

report along with a copy of the Magisterial inquiry report, postmortem report, final cause of death,

medical history at the time of admission in Jail and details of medical treatment, if any, given to the

prisoner prior to his custodial death, to the Head of Prisons, Union territory, of Ladakh, for onward

submission to the Administration of Union territory of Ladakh for grant of appropriate compensation,

as per the Provisions of Para-3 above.

6. Application of Policy: This policy shall be applicable, as admissible, in respect of prisoners who

suffer unnatural deaths in the Jails of Union territory of Ladakh on or after the date of notification of

this policy.

7. Sanctioning Authority: The Administrative Secretary, Home Department, Union territory of Ladakh

shall be authorized to sanction the above-said amount of compensation.

8. This issues with the concurrence of the Finance Department, UT of Ladakh communicated vide UO

No: SEC/R/23112023/G-32012/203/2023 Dated 28.11.2023.
