का.आ. -40.⸺ जबकक, लद्दाख िंघ िाज्य क्षेत्र की िाय है कक समट्टी के तेल की आपूर्ति बनाए
िखने औि उपलब्धता िुर्नश्चित किने के सलए ऐिा किना आिचयक औि िमीिीन है।
अब, इिसलए, आिचयक िस्तु अधधर्नयम, 1955 (1955 का 10) की धािा 3 द्िािा प्रदत्त शश्क्तयों
का प्रयोग किते हुए, भाित ििकाि, िाणिज्य मंत्रालय के आदेश िंख्या का.आ. 3515 ददनांक 05-
लद्दाख, 16 अप्रैल, 2025

10-1968 के िाथ, लद्दाख िंघ िाज्य क्षेत्र का प्रशािन, एतदद्िािा र्नम्नसलणखत आदेश र्नसमित
किता है, यथा-
1. िंक्षक्षप्त शीर्िक औि प्रािंभ
(1) इि आदेश को लद्दाख िंघ िाज्य क्षेत्र िश्ब्िडी िाले समट्टी के तेल (लाइिेंसिंग औि
वितिि) आदेश, 2025 कहा जा िकता है।
(2) यह लद्दाख िंघ िाज्य क्षेत्र के िंपूिि क्षेत्र पि लागू होता है।
(3) यह आधधकारिक िाजपत्र में इिके प्रकाशन की तािीख िे लागू होगा।
2. परिभार्ाएँ.
इि आदेश में, जब तक कक िंदभि िे अन्द्यथा अपेक्षक्षत न हो,
ए. "अंत्योदय अन्द्न योजना (एएिाई)" औि "प्राथसमकता िाले परििाि (पीएिएि)" श्रेिी के
लाभाधथियों का िही अथि होगा जो िाष्ट्रीय खाद्य िुिक्षा अधधर्नयम की धािा 10 के तहत इन
श्रेणियों के परििािों को ददया गया है;
बी. "डीलि" का अथि है कोई भी व्यश्क्त जो थोक या खुदिा िश्ब्िडी िाले केिोसिन तेल की
खिीद, बबक्री या बबक्री या वितिि के सलए भंडािि का व्यििाय किता है;
सी. ककिी भी क्षेत्र में लक्षक्षत िाििजर्नक वितिि प्रिाली के तहत आपूर्ति ककए गए िश्ब्िडी िाले
केिोसिन तेल के बािे में "घोवर्त मूल्य" का अथि है ककिी क्षेत्र के बािे में िमय-िमय पि केंर
ििकाि द्िािा घोवर्त अधधकतम बबक्री मूल्य औि इिमें लद्दाख िंघ शासित प्रदेश के ककिी भी
क्षेत्र के मामले में लद्दाख िंघ शासित प्रदेश के प्रशािन द्िािा र्नधािरित ऐिे अन्द्य शुल्क, दिें,
शुल्क औि कि शासमल होंगे;
डी. "फॉमि" का अथि है लाइिेंि जािी किने के उद्देचय िे इि आदेश के तहत लाइिेंसिंग
प्राधधकिि द्िािा तैयाि औि जािी ककया जाने िाला फॉमि;
ई. "केिोिीन" का अथि है हाइड्रोकाबिन का मध्य आिुत समश्रि जो 1974 के बीआईएि विर्नदेश
िंख्या आईएि-1459 को पूिा किता है, श्जिमें केिोिीन (उपयोग पि प्रर्तबंध औि अधधकतम
मूल्य र्नधािि) आदेश, 1993 के तहत परिभावर्त न्द्यूनतम केिोिीन पि फ्लैशपॉइंट 35 डडग्री
िेश्ल्ियि औि न्द्यूनतम धुंआ बबंदु 18 डडग्री िेश्ल्ियि की महत्त्िपूिि विशेर्ताएं हैं;
एफ. "लाइिेंसिंग प्राधधकिि" का अथि है लद्दाख िंघ िाज्य क्षेत्र के खाद्य नागरिक आपूर्ति एिं
उपभोक्ता मामले विभाग का र्नदेशक या प्रशािन द्िािा इि आदेश के प्रािधानों के तहत
लाइिेंसिंग प्राधधकिि की शश्क्तयों का प्रयोग किने औि कतिव्यों का पालन किने के सलए
नासमत अधधकािी;

जी. "िाििजर्नक वितिि प्रिाली" का अथि है केंर ििकाि या लद्दाख िंघ िाज्य क्षेत्र द्िािा
अनुमोददत वितिि प्रिाली के माध्यम िे घोवर्त मूल्य पि केिोसिन के आिंटन, वितिि, विपिन
या बबक्री की प्रिाली; एच "खुदिा विक्रेता" का अथि है डीलिों के अलािा अन्द्य उपभोक्ताओं को
केिोसिन तेल की आपूर्ति किने का खुदिा व्यापाि किने िाला व्यश्क्त औि
आई. "थोक विक्रेता" का अथि है िह व्यश्क्त जो ककिी अन्द्य डीलि को बेिने के सलए नासमत
तेल कंपनी िे केिोसिन तेल खिीदता है औि इिमें केिोसिन का कािोबाि किने िाली ककिी भी
तेल कंपनी का एजेंट शासमल है, औि लद्दाख िंघ िाज्य क्षेत्र द्िािा िैध लाइिेंि के माध्यम िे
थोक विक्रेता के रूप में मान्द्यता प्राप्त है।
3. "लाइिेंसिंग डीलि".⸺ (1) कोई भी डीलि इि आदेश के प्रािधानों औि लाइिेंसिंग
प्राधधकिि द्िािा इि िंबंध में उिे जािी ककए गए लाइिेंि की शतों औि शतों के अलािा
िश्ब्िडी िाले केिोसिन तेल का ऑडि औि भंडािि नहीं किेगा या आपूर्ति नहीं किेगा।
(2) प्रत्येक व्यश्क्त जो इि आदेश के प्रािंभ में डीलि के रूप में व्यििाय में लगा हुआ है, उिे
इि आदेश के प्रािंभ होने के नब्बे ददनों की अिधध के भीति नए लाइिेंि के सलए लाइिेंसिंग
प्राधधकिि को आिेदन किना होगा, बशते कक र्नम्नसलणखत शतें पूिी हों: -
(i) िंघ िाज्य लद्दाख का र्निािी होना िादहए।
(ii) ककिी मान्द्यता प्राप्त तेल विपिन कंपनी के िाथ एिकेओ डीलिसशप िमझौता होना िादहए
औि थोक लाइिेंिधािी के मामले में, उिके पाि िैध र्नधािरित लाइिेंि होने िादहए।
(iii) एफिीएिएंडिीए विभाग के िाथ थोक विक्रेता/खुदिा विक्रेता के रूप में पंजीकृत होना
िादहए।
(iv) ऐिे व्यििाय को िलाने के सलए लाइिेंसिंग प्राधधकिि की िंतुश्ष्ट्ट के सलए उपयुक्त परििि
औि भंडािि क्षेत्र होना िादहए।
बशते कक उप-खण्ड (2) के अंतगित आने िाले मामलों के िंबंध में, लाइिेंसिंग प्राधधकािी नब्बे
ददन की उक्त अिधध की िमाश्प्त के पचिात् ककन्द्तु उिके बाद तीि ददन के भीति आिेदन पि
वििाि कि िकता है, यदद उिका िमाधान हो जाता है कक आिेदक पयािप्त कािि िे िमय पि
आिेदन किने िे र्निारित हुआ था।
तथावप, ऐिी िमयािधध की िमाश्प्त के पचिात् कोई आिेदन स्िीकाि नहीं ककया जाएगा औि
पूिि आदेशों के तहत जािी लाइिेंि हमेशा के सलए र्निस्त िमझा जाएगा।
(3) उप-खण्ड (2) के अन्द्तगित आिेदन प्राप्त होने पि लाइिेंसिंग प्राधधकािी आिेदक को िुनिाई
का अििि देने तथा सलणखत रूप में पयािप्त कािि दजि किने के पचिात ऐिे आिेदन को
स्िीकाि या अस्िीकाि कि िकता है।

4. लाइिेंि जािी किना। (1) लाइिेंि जािी किने या उिके निीकिि के सलए प्रत्येक आिेदन
लाइिेंसिंग प्राधधकािी को ककया जाएगा।
(2) लाइिेंि के निीकिि के सलए आिेदन िंबंधधत िहायक र्नदेशक को लाइिेंि की िमाश्प्त
र्तधथ िे कम िे कम तीि ददन पूिि ककया जाएगा।
(3) प्रत्येक लाइिेंि लाइिेंसिंग प्राधधकािी द्िािा र्नधािरित प्रपत्र में उिमें उश्ल्लणखत शतों तथा
लाइिेंसिंग प्राधधकािी द्िािा िमय-िमय पि र्नधािरित अन्द्य शतों के अधीन जािी ककया जाएगा।
(4) यदद इि आदेश के अन्द्तगित प्रदान ककया गया लाइिेंि खिाब हो जाता है, खो जाता है या
नष्ट्ट हो जाता है, तो डीलि लाइिेंसिंग प्राधधकािी को तत्काल िूधित किेगा, जो लाइिेंिधािी
द्िािा आिेदन किने पि लाइिेंसिंग प्राधधकािी द्िािा तैयाि की जाने िाली प्रकक्रया के अनुिाि
लाइिेंि की दूििी प्रर्त जािी कि िकता है।
(5) इि आदेश के तहत ददया गया लाइिेंि, जब तक कक पहले िे र्नलंबबत या िद्द न कि
ददया गया हो, तीन िाल तक जािी िहेगा औि लाइिेंिधािी द्िािा िंबंधधत िहायक र्नदेशक को
आिेदन प्रस्तुत किने पि एक बाि में दो िाल के सलए आगे निीकिि ककया जा िकेगा, जो
लाइिेंि की िैधता अिधध की िमाश्प्त िे पहले निीकिि शुल्क के िाथ ककया जाएगा। यदद
लाइिेंिधािी र्नधािरित िमय के भीति निीनीकिि के सलए आिेदन नहीं किता है, तो लाइिेंि
को िमाप्त माना जाएगा औि िश्ब्िडी िाले समट्टी के तेल के ककिी भी आिंटन के सलए उि
पि वििाि नहीं ककया जाएगा।
(6) िंबंधधत िहायक र्नदेशक लाइिेंसिंग प्राधधकिि द्िािा जािी लाइिेंि की िैधता की िमय-
िमय पि जांि किेगा, ताकक िास्तविक लाइिेंिधािी के अलािा ककिी अन्द्य व्यश्क्त द्िािा
लाइिेंि का दुरुपयोग न ककया जा िके।
5. िश्ब्िडी िाले केिोसिन तेल लाइिेंि प्राप्त किने औि िखने के सलए पात्रता।⸺ (1) नए
िश्ब्िडी िाले केिोसिन तेल खुदिा डीलिसशप लाइिेंि के सलए आिेदन किने िाले आिेदक को:
(i) उिे िंघ िाज्य लद्दाख का र्निािी होना िादहए।
(ii) आिेदन दाणखल किते िमय उिके पाि मैदरकुलेट प्रमािपत्र होना िादहए औि उिे िक्षम
प्राधधकािी िे एक प्रमाि पत्र प्रस्तुत किना िादहए कक उिने ककिी अन्द्य व्यििाय की स्थापना
के सलए ििकािी/अधि-ििकािी या ककिी वित्तीय िंस्थान िे ककिी भी प्रकाि का ऋि नहीं सलया
है।
(iii) डीलिसशप के सलए आिेदन किते िमय उिकी आयु 18 िर्ि िे कम औि 45 िर्ि िे अधधक
नहीं होनी िादहए। हालांकक, िोजगाि िृजन योजनाओं में िंघ िाज्य लद्दाख द्िािा र्नधािरित
मानदंडों के अनुिाि आिक्षक्षत श्रेिी के उम्मीदिािों के मामले में आयु में छूट लागू होगी। (iv)
श्जला मश्जस्रेट द्िािा जािी अपना िरित्र औि पूििृत्त प्रमाि पत्र प्रस्तुत किें।

(v) खुदिा व्यापािी के रूप में व्यििाय किने के सलए लाइिेंसिंग प्राधधकािी की िंतुश्ष्ट्ट के
अनुरूप उपयुक्त परििि औि भंडािि क्षेत्र/क्षमता का स्िासमत्ि होना िादहए।
(vi) अन्द्य कोई भी शति पूिी किनी होगी श्जिे लाइिेंसिंग प्राधधकिि या प्रशािन इि उद्देचय के
सलए आिचयक औि प्रािंधगक िमझे।
(vii) नौकिी समलने पि या यदद िह िाहे तो लाइिेंसिंग प्राधधकिि के िमक्ष अपना लाइिेंि
ििेंडि कि दे।
(2) नए िश्ब्िडी िाले केिोसिन तेल थोक डीलिसशप लाइिेंि के सलए आिेदन किने िाले आिेदक
को:
(i) उिे िंघ िाज्य लद्दाख का र्निािी होना िादहए।
(ii) आिेदन दाणखल किते िमय उिके पाि 10+2 का प्रमािपत्र होना िादहए औि िक्षम
प्राधधकािी िे यह प्रमाि पत्र प्रस्तुत किना होगा कक उिने ककिी अन्द्य व्यििाय की स्थापना के
सलए ििकािी/अधि-ििकािी या ककिी वित्तीय िंस्थान िे ककिी प्रकाि का ऋि नहीं सलया है।
(iii) डीलिसशप के सलए आिेदन किते िमय उिकी आयु 18 िर्ि िे कम औि 45 िर्ि िे अधधक
नहीं होनी िादहए, हालांकक, िोजगाि िृजन योजनाओं में िंघ िाज्य लद्दाख द्िािा र्नधािरित
मानदंडों के अनुिाि आिक्षक्षत श्रेिी के उम्मीदिािों के मामले में आयु में छूट लागू होगी।
(iv) श्जला मश्जस्रेट द्िािा जािी अपना िरित्र औि पूििृत्त प्रमाि पत्र प्रस्तुत किें।
(v) ककिी मान्द्यता प्राप्त तेल विपिन कंपनी के िाथ एिकेओ डीलिसशप िमझौता होना िादहए
औि उिके पाि िैध र्नधािरित लाइिेंि होना िादहए।
(vi) थोक विक्रेता के रूप में व्यििाय किने के सलए लाइिेंसिंग प्राधधकिि की िंतुश्ष्ट्ट के
अनुिाि उपयुक्त भंडािि क्षेत्र का स्िासमत्ि होना िादहए। लेककन भंडािि टैंक आबादी िाले क्षेत्र
िे दूि होना िादहए औि उिमें अश्ननशमन औि आपातकालीन िाहनों की पहुंि होनी िादहए।
(vii) थोक विक्रेता के पाि समट्टी के तेल के भंडािि स्थान पि अश्ननशमन उपकिि उपलब्ध
होने िादहए। (viii) अन्द्य कोई भी शति पूिी किें श्जिे लाइिेंसिंग प्राधधकिि या प्रशािन इि
उद्देचय के सलए आिचयक औि प्रािंधगक िमझे। (ix) नौकिी समलने पि या यदद िह ऐिा िाहे
तो लाइिेंसिंग प्राधधकिि के िमक्ष अपना लाइिेंि ििेंडि कि दें। (3) एक व्यश्क्त केिल एक
िश्ब्िडी िाले समट्टी के तेल की डीलिसशप इि शति के िाथ िखेगा कक न तो उिके परििाि के
िदस्यों का िश्ब्िडी िाले समट्टी के तेल का कोई व्यििाय है औि न ही िह ककिी अन्द्य
पेरोसलयम उत्पाद के व्यििाय में शासमल है औि न ही उिका परििाि का कोई िदस्य खाद्य,
नागरिक आपूर्ति औि उपभोक्ता मामले विभाग का कमिािी है। (4) िश्ब्िडी िाले समट्टी के तेल
के वितिि के सलए नए विक्रय केन्द्र, खाद्य, नागरिक औि उपभोक्ता मामले विभाग के िहायक
र्नदेशक द्िािा िंबंधधत श्जला विकाि आयुक्तों के पिामशि िे, जनिंख्या के अनुपात औि

आिचयक समट्टी के तेल की मात्रा को ध्यान में िखते हुए, एक व्यापक प्रस्ताि प्रस्तुत किने पि
खोले जाएंगे।
(5) िश्ब्िडी िाले समट्टी के तेल के वितिि के सलए नए खुदिा डीलिसशप लाइिेंि देने का
अधधकाि खाद्य, नागरिक आपूर्ति औि उपभोक्ता मामले विभाग के र्नदेशक को िंबंधधत िहायक
र्नदेशक की सिफारिशों पि होगा, श्जिे लाइिेंसिंग प्राधधकिि द्िािा र्नधािरित प्रकक्रया के अनुिाि
उपायुक्त द्िािा विधधित िमथिन ददया जाएगा। हालांकक, लाइिेंि के निीनीकिि का अधधकाि
र्नदेशक के पाि होगा।
(6) लाइिेंि को हस्तांतरित किने का अधधकाि िंबंधधत श्जला विकाि आयुक्त के पिामशि िे
िंबंधधत िहायक र्नदेशक की सिफारिशों पि र्नदेशक को होगा, जहां भी िंभि हो, पात्रता के
अधीन।
(7) लाइिेंिधािक की गंभीि बीमािी/दुघिटना के कािि मृत्यु/अक्षमता के मामले में, श्जिके
परििामस्िरूप पूिि औि स्थायी विकलांगता हो जाती है, जो उिे काम किने औि व्यििाय किने
में अिमथि बना िकती है, डीलिसशप को उिके कानूनी उत्तिाधधकारियों को उन शतों की पूर्ति के
अधीन हस्तांतरित ककया जा िकता है जो उिे इन र्नयमों के तहत लाइिेंि प्राप्त किने में
िक्षम बनाती हैं।
6. िश्ब्िडी िाले समट्टी के तेल के आिंटन के सलए पात्र लाभाधथियों की श्रेणियां। (1) शीतकालीन
क्षेत्र में पूिे िर्ि के सलए एएिाई श्रेिी, (2) दूिदिाज के क्षेत्रों में पूिे िर्ि के सलए पीएिएि श्रेिी
जहां छह महीने या तीन महीने की अिधध के सलए खाद्यान्द्न की शीतकालीन डंवपंग की जाती
है।
(3) शीतकालीन क्षेत्र में केिल िाि शीतकालीन महीनों (ददिम्बि, जनििी, फिििी औि मािि) के
सलए पीएिएि श्रेिी, जो खंड (2) में शासमल नहीं है।
7. िश्ब्िडी िाले समट्टी के तेल के वितिि का आिंटन औि युश्क्तकिि।
(1) िभी पात्र लाभाधथियों को 3 लीटि प्रर्त परििाि प्रर्त माह या उपलब्धता के आधाि पि
प्रशािन द्िािा तय ककए गए पैमाने पि िश्ब्िडी िाले समट्टी के तेल उपलब्ध किाए जाएंगे।
हालांकक, ककिी भी कािि िे वितिि के बाद यदद िश्ब्िडी िाले समट्टी के तेल की आिंदटत
मात्रा बि जाती है तो उिे उि महीने की बित माना जाएगा औि विभाग की पूिि अनुमर्त िे
अगले महीने में उपयोग के सलए आगे बढाया जाएगा।
(2) खाद्य, नागरिक आपूर्ति औि उपभोक्ता मामले विभाग के िहायक र्नदेशक खाना पकाने औि
िोशनी के सलए िास्तविक उद्देचयों के सलए समट्टी के तेल का उपयोग किने िाले िास्तविक
लाभाधथियों का ित्यापन किेंगे। िे श्जले में िास्तविक आिचयकता के आधाि पि िश्ब्िडी िाले
समट्टी के तेल के आिंटन के सलए प्रशािर्नक विभाग िे पूछ िकते हैं। िहायक र्नदेशक

आिंटन मांगते िमय लाभाधथियों द्िािा स्िेच्छा िे िश्ब्िडी िाले समट्टी के तेल को छोड़ने को
भी ध्यान में िख िकते हैं।
(3) िंबंधधत िहायक र्नदेशक द्िािा की जाने िाली मांग के आधाि पि, प्रशािर्नक विभाग
उपलब्धता औि मांग के अनुिाि िश्ब्िडी िाले समट्टी के तेल का आिंटन किेगा।
(4) िश्ब्िडी िाले समट्टी के तेल के रिलीज ऑडि की एक प्रर्त अर्निायि रूप िे, विसभन्द्न बबक्री
बबंदुओं पि समट्टी के तेल के वितिि की र्नगिानी के सलए उपायुक्तों औि श्जला एिएिपी को
भेजी जाएगी ताकक अन्द्य उपयोगों औि रििािों के सलए इिके डायिजिन को िोका जा िके।
(5) िश्ब्िडी िाले समट्टी के तेल का कोटा िंबंधधत र्नदेशक द्िािा ऐिे थोक विक्रेताओं को
आिंदटत ककया जाएगा, श्जनके पाि िैध लाइिेंि है तथा जो लाइिेंसिंग प्राधधकिि द्िािा
र्नधािरित आिचयक शतों को पूिा किते हैं तथा इि आदेश के अनुिाि आिंटन को ककिी भी
िमय इि आदेश में र्नधािरित शतों या प्रशािन या लाइिेंसिंग प्राधधकिि द्िािा िमय-िमय पि
जािी ककए गए ककिी अन्द्य र्नदेश को पूिा न किने पि िोका जा िकता है। िश्ब्िडी िाले समट्टी
के तेल का आिंटन िंबंधधत िहायक र्नदेशकों द्िािा ककया जाएगा, ताकक श्जले में िश्ब्िडी िाले
समट्टी के तेल की आिचयकता को ध्यान में िखते हुए, लाइिेंिधारियों के बीि िमान रूप िे
िुविधाजनक औि प्रभािी वितिि िुर्नश्चित ककया जा िके।
(6) िश्ब्िडी िाले समट्टी के तेल के डीलिों को प्रशािन या लाइिेंसिंग प्राधधकिि द्िािा तय
ककए गए िभी पहलों या िुधािों का पालन किना होगा औि उि प्रयाि के सलए आिचयक िभी
व्यिस्थाएं भी लागू किनी होंगी, ताकक िश्ब्िडी िाले समट्टी के तेल के आिंटन, परििहन औि
वितिि की प्रकक्रया को अधधक विचििनीय, भिोिेमंद औि पािदशी बनाया जा िके।
(7) िश्ब्िडी िाले केिोसिन तेल का परििहन किने िाले टैंकिों की आिाजाही पि नज़ि िखने के
सलए खाद्य, नागरिक आपूर्ति औि उपभोक्ता मामले विभाग, िंघ िाज्य लद्दाख में एक र्नगिानी
िेल की स्थापना की जाएगी। र्नगिानी िेल अपने-अपने डडिीजनों में टैंकिों की आिाजाही पि
नज़ि िखेगा।
(8) िश्ब्िडी िाले समट्टी के तेल का कोटा िश्ब्िडी िाले समट्टी के तेल का परििहन किने िाले
टैंकिों में जीपीएि लगाए जाने के बाद ही जािी ककया जाएगा।
(9) समट्टी के तेल का परििहन किने िाले टैंकि का िंग तेल विपिन कंपर्नयों द्िािा र्नधािरित
ककया जाएगा, श्जिमें डीलि का नाम होगा, औि िश्ब्िडी िाले समट्टी के तेल का परििहन किते
िमय टैंकि के बाहि "िश्ब्िडी िाले समट्टी के तेल" शब्द मोटे अक्षिों में सलखे जाएंगे।
8. िाििजर्नक वितिि प्रिाली के तहत आपूर्ति ककए गए िश्ब्िडी िाले समट्टी के तेल के उपयोग

(1) कोई भी व्यश्क्त िाििजर्नक वितिि प्रिाली के तहत आपूर्ति ककए गए िश्ब्िडी िाले समट्टी
के तेल का उपयोग खाना पकाने औि िोशनी के अलािा ककिी अन्द्य उद्देचय के सलए नहीं
किेगा:
बशते कक केंर ििकाि या िंघ िाज्य लद्दाख आदेश द्िािा ककिी व्यश्क्त को ऐिे िश्ब्िडी िाले
समट्टी के तेल का उपयोग ऐिे अन्द्य उद्देचयों के सलए किने की अनुमर्त दे िकता है जैिा कक
िह उि आदेश में र्नददिष्ट्ट कि िकता है।
(2) िाििजर्नक वितिि प्रिाली के तहत र्नयुक्त कोई भी डीलि या रांिपोटि िाििजर्नक वितिि
प्रिाली के तहत िश्ब्िडी िाले समट्टी के तेल को उि व्यश्क्त के अलािा, श्जिके सलए आपूर्ति
की जाती है, ककिी अन्द्य व्यश्क्त को नहीं बेिेगा, वितरित नहीं किेगा या आपूर्ति नहीं किेगा।
(3) लाइिेंिधािी के पाि उिके खाते में दशािई गई शुद्ध मात्रा िे अधधक कोई िश्ब्िडीकृत
समट्टी का तेल नहीं होना िादहए औि यदद लाइिेंिधािी द्िािा ऐिी ककिी अर्तरिक्त मात्रा का
उधित दहिाब नहीं ददया जाता है, तो उिे जब्त कि सलया जाएगा।
9. प्रभार्य िुल्क।⸺ प्रत्येक लाइिेंि के िंबंध में नीिे र्नददिष्ट्ट शुल्क प्रभायि होगा, यथा:-
1. नया लाइिेंि प्रदान किने के सलए
(i) थोक व्यापािी को रु. 10,000/-
(ii) खुदिा व्यापािी को रु. 3000/-
2. लाइिेंि के निीनीकिि के सलए
(i) थोक व्यापािी को रु. 6000/-
(ii) खुदिा व्यापािी को रु. 2000/-
3. डुप्लीकेट लाइिेंि जािी किने के सलए
(i) रु. 2000/-
10. प्रततभूतत जमा करना।⸺ प्रत्येक व्यश्क्त जो इि आदेश के तहत लाइिेंि प्रदान किने के
सलए आिेदन किता है, उिे लाइिेंसिंग प्राधधकािी के पाि र्नम्नसलणखत दिों पि प्रर्तभूर्त जमा
किनी होगी:-
(1) थोक व्यापािी को लाइिेंि प्रदान किने के सलए 30,000/- रुपये
(2) खुदिा व्यापािी को लाइिेंि प्रदान किने के सलए 10,000/- रुपये
11. लाइसेंस र्ा तनदेिों की ितों और तनर्मों का उल्लंघन। ⸺
(1) कोई भी व्यापािी लाइिेंि की ककिी भी शति या र्नयम का उल्लंघन नहीं किेगा या इि
आदेश के प्रािधानों के तहत जािी र्नदेशों का उल्लंघन नहीं किेगा औि यदद कोई व्यापािी उक्त
र्नयमों, शतों या इि आदेश के ककिी प्रािधान का उल्लंघन किता है, तो लाइिेंि के णखलाफ की
जा िकने िाली ककिी भी अन्द्य काििाई पि प्रर्तकूल प्रभाि डाले बबना, उिका लाइिेंि
लाइिेंसिंग प्राधधकािी द्िािा सलणखत आदेश द्िािा िद्द या र्नलंबबत ककया जा िकता है:

बशते कक इि खंड के तहत कोई आदेश तब तक नहीं ददया जाएगा, जब तक कक डीलि को, जैिा
भी मामला हो, अपना मामला पेश किने औि लाइिेंि के प्रस्तावित िद्द या र्नलंबन के णखलाफ
िुनिाई का उधित अििि नहीं ददया गया हो।
(2) कोई भी व्यापािी िश्ब्िडी िाले समट्टी के तेल को िंभालने के सलए ककिी भी अनधधकृत
व्यश्क्त को अपनी डीलिसशप को ककिाए पि नहीं देगा। उक्त डीलिसशप के िंिालन में
लाइिेंिधािी की ककिी अस्थायी अक्षमता की श्स्थर्त में, लाइिेंिधािी द्िािा अपना विििि
उपलब्ध किाकि तथा उिके आििि की श्जम्मेदािी लेते हुए, लाइिेंसिंग प्राधधकािी की पूिि
अनुमर्त िे, उिकी अक्षमता की अिधध तक के सलए, जोकक एक िर्ि िे अधधक नहीं होनी
िादहए, िहायक को र्नयुक्त ककया जा िकता है।
(3) यदद लाइिेंसिंग प्राधधकिि को यह िंतुश्ष्ट्ट हो जाती है कक डीलि ने ददए गए लाइिेंि की
शतों का दुरुपयोग ककया है तथा िह जनदहत के विरुद्ध कायि कि िहा है, तो लाइिेंि िद्द किने
तथा लाइिेंिधािी को हमेशा के सलए प्रर्तबंधधत किने का अधधकाि लाइिेंसिंग प्राधधकिि के
पाि िुिक्षक्षत है।
(4) डीलि के लाइिेंि के र्नलंबन या िद्दीकिि के मामले में, उपायुक्त/एिडीएम, िहायक
र्नदेशक, एफिीएिएंडिीए िे रिपोटि प्राप्त किने के पचिात लाइिेंसिंग प्राधधकिि द्िािा मामले
पि र्नििय सलए जाने तक लाभाधथियों को िश्ब्िडी िाले केिोसिन तेल की र्नबािध आपूर्ति
िुर्नश्चित किने के सलए िैकश्ल्पक व्यिस्था किेंगे।
(5) श्जले में विसभन्द्न स्तिों पि लक्षक्षत िाििजर्नक वितिि प्रिाली के सलए एनएफएिए के तहत
गदित ितकिता िसमर्तयों को भी अपने अधधकाि क्षेत्र में िश्ब्िडी िाले केिोसिन तेल के वितिि
पि र्नयसमत जांि िखने तथा डीलिों द्िािा ऐिे वितिि में ककिी भी प्रकाि की
अर्नयसमतता/वििलन को िोकने के सलए िशक्त बनाया जाएगा।
(6) सशकायतों के िाििजर्नक वितिि के सलए लक्षक्षत तंत्र िे िंबंधधत सशकायतों को प्राप्त किने
के सलए एनएफएिए के तहत स्थावपत सशकायत र्निािि तंत्र लक्षक्षत िमूहों के बीि िश्ब्िडी
िाले केिोिीन तेल के वितिि िे िंबंधधत कायि भी किेगा। सशकायतों/सशकायतों का र्नपटान
एनएफएिए के तहत स्थावपत तंत्र में र्नधािरित प्रकक्रया के अनुिाि ककया जाएगा।
12. खातों का िखिखाि।⸺ प्रत्येक डीलि को िश्ब्िडी िाले समट्टी के तेल की दैर्नक प्राश्प्तयों
औि र्नपटान के स्टॉक का पूिा लेखा-जोखा अलग िे िखना होगा औि इिे अद्यतन िखना होगा
तथा अपने व्यििाय के स्थान पि र्निीक्षि के सलए उपलब्ध किाना होगा, िाथ ही ऐिी अन्द्य
जानकािी भी उपलब्ध किानी होगी, श्जिकी उिे लाइिेंसिंग प्राधधकिि या प्रशािन या लाइिेंसिंग
प्राधधकिि द्िािा इि िंबंध में नासमत ककिी अन्द्य अधधकािी द्िािा आिचयकता हो।

13. स्टॉक की श्स्थर्त का प्रदशिन।⸺ प्रत्येक डीलि को अपने व्यििाय परििि के ककिी प्रमुख
स्थान पि प्रर्तददन व्यििाय शुरू किने िे पहले प्रािंसभक शेर्, िश्ब्िडी िाले समट्टी के तेल की
कीमत, पात्र लाभाधथियों की आिंदटत िूिी, यदद लागू हो, तथा स्टॉक प्रदसशित किना होगा।
14. िुिक्षा जमा की जब्ती। (i) इि आदेश के प्रािधानों पि प्रर्तकूल प्रभाि डाले बबना, यदद
लाइिेंसिंग प्राधधकािी को यह विचिाि हो जाता है कक ककिी डीलि ने इि आदेश के ककिी
प्रािधान या लाइिेंि की ककिी शति या ििकाि द्िािा ददए गए र्नदेशों का उल्लंघन ककया है, तो
डीलि को प्रस्तावित जब्ती के विरुद्ध अपना मामला बताने का उधित अििि प्रदान किने के
पचिात सलणखत आदेश द्िािा उिकी िुिक्षा जमा पूिी या आंसशक रूप िे जब्त कि ली जाएगी।
ऐिे आदेश की एक प्रर्त डीलि को भेजी जाएगी।
(ii) यदद ककिी भी िमय उिकी िुिक्षा जमा की िासश खंड 10 में र्नददिष्ट्ट िासश िे कम हो
जाती है, तो लाइिेंसिंग प्राधधकािी द्िािा ऐिा किने के सलए कहे जाने पि डीलि को उि िासश
की पूर्ति के सलए तत्काल अर्तरिक्त िुिक्षा जमा किनी होगी।
15. अपील। लाइिेंि देने या निीनीकिि किने िे इंकाि किने या लाइिेंि िद्द किने या
र्नलंबबत किने या उिके द्िािा जमा की गई िुिक्षा जब्त किने के लाइिेंसिंग प्राधधकिि के
आदेश िे व्यधथत कोई भी व्यश्क्त ऐिे आदेश की प्रर्त प्राप्त होने की र्तधथ िे तीि ददनों के
भीति प्रशािर्नक िधिि, खाद्य, नागरिक आपूर्ति औि उपभोक्ता मामले विभाग, लद्दाख यूटी या
प्रशािन द्िािा इि िंबंध में र्नयुक्त ककिी अन्द्य अधधकािी के िमक्ष सलणखत रूप में अपील कि
िकता है, श्जिका र्नििय अंर्तम होगा। 16. समट्टी के तेल की खिीद या बबक्री पि प्रर्तबंध। (1)
कोई भी थोक व्यापािी लाइिेंि प्राप्त खुदिा व्यापािी के अलािा ककिी अन्द्य व्यश्क्त को िश्ब्िडी
िाले समट्टी के तेल की आपूर्ति नहीं किेगा या आपूर्ति नहीं किाएगा। (2) कोई भी व्यापािी थोक
व्यापािी के अलािा ककिी अन्द्य व्यश्क्त िे उप खंड (1) के अधीन िश्ब्िडी िाले समट्टी के तेल
को प्राप्त नहीं किेगा या प्राप्त नहीं किाएगा। (3) कोई भी व्यापािी िक्षम अधधकािी द्िािा
र्नधािरित मूल्य िे अधधक कीमत पि ककिी भी उपभोक्ता को िश्ब्िडी िाले समट्टी के तेल को
नहीं बेिेगा।
17. िूिना मांगने की शश्क्त। प्रत्येक डीलि, जब लाइिेंसिंग प्राधधकिि/ििकाि द्िािा िामान्द्य
या विशेर् र्नदेशों के तहत अपेक्षक्षत हो, तो िह िश्ब्िडी िाले समट्टी के तेल के वितिि िे
िंबंधधत िूिना का विििि ित्यतापूििक औि अपने ििोत्तम ज्ञान के अनुिाि, उि तिीके िे
देगा, जैिा अपेक्षक्षत हो।
18. छूट। इि आदेश में कुछ भी प्रशािर्नक खाते पि िश्ब्िडी िाले समट्टी के तेल की खिीद
औि भंडािि पि लागू नहीं होगा।

19. प्रिेश, तलाशी, जब्ती आदद की शश्क्तयाँ। (1) लाइिेंसिंग प्राधधकिि या प्रशािन या
लाइिेंसिंग प्राधधकिि द्िािा इि िंबंध में अधधकृत कोई अन्द्य अधधकािी, ऐिी िहायता के िाथ,
श्जिे िह उधित िमझे, र्नम्न कि िकता है: -
(1) ककिी स्थान, परििि, िाहन, नाि या ककिी अन्द्य िाहन के स्िामी, अधधभोगी या ककिी अन्द्य
व्यश्क्त िे, श्जिके बािे में उिके पाि यह विचिाि किने का कािि है कक इि आदेश के
प्रािधानों या इिके तहत जािी ककए गए ककिी लाइिेंि की शतों का उल्लंघन ककया गया है,
ककया जा िहा है या ककया जाने िाला है, कोई भी पुस्तक या लेखा या अन्द्य जानकािी प्रस्तुत
किने की मांग कि िकता है;
(2) ककिी भी स्थान या परििि, िाहन, नाि या ककिी अन्द्य िाहन में प्रिेश किना, उिका
र्निीक्षि किना या उिे तोड़ना औि उिकी तलाशी लेना, श्जिके बािे में उिके पाि यह विचिाि
किने का कािि है कक इि आदेश के प्रािधानों या इिके तहत जािी ककए गए ककिी लाइिेंि की
शतों का उल्लंघन ककया गया है, ककया जा िहा है या ककया जाने िाला है;
(3) ऐिे उल्लंघनों िे िंबंधधत लेन-देन को दशािने िाले ककिी भी दस्तािेज के अंश या प्रर्तयां
लेना या लेना/लेना तथा उन्द्हें उि व्यश्क्त को िापि किना, श्जििे िे जब्त ककए गए थे;
(4) इि आदेश के प्रािधानों या इिके तहत जािी लाइिेंि की शतों के उल्लंघन में िश्ब्िडी िाले
समट्टी के तेल के ककिी भी स्टॉक औि समट्टी के तेल को ले जाने में इस्तेमाल ककए गए
िाहनों, नािों या अन्द्य िाहनों की तलाशी लेना, जब्त किना औि हटाना औि उिके बाद िश्ब्िडी
िाले समट्टी के तेल के स्टॉक औि िाहनों, नािों या अन्द्य िाहनों को अदालत में पेश किने औि
ऐिे पेश ककए जाने तक उनकी िुिक्षक्षत असभिक्षा के सलए आिचयक िभी उपाय किना या किने
के सलए अधधकृत किना;
(5) तलाशी औि जब्ती किने िाला अधधकािी तुिंत िंबंधधत उपायुक्त औि खाद्य, नागरिक
आपूर्ति औि उपभोक्ता मामले विभाग को इि आदेश के तहत उिके द्िािा जब्त ककए गए
िश्ब्िडी िाले समट्टी के तेल के स्टॉक की िूिना देंगे औि
(6) तलाशी औि जब्ती िे िंबंधधत धािा 103 भाितीय नागरिक िुिक्षा िंदहता, (बीएनएिएि)
2023 के प्रािधान, यथािचयक परिितिनों के िाथ, इि आदेश के तहत तलाशी औि जब्ती पि
लागू होंगे।
20. अनुदेि जारी करने की िक्तत। प्रशािन या लाइिेंसिंग प्राधधकिि िमय-िमय पि ऐिे
अनुदेश जािी कि िकता है, जो इि आदेश िे अिंगत न हों, क्योंकक िे इि आदेश के प्रािधानों
को लागू किने के प्रयोजनाथि आिचयक िमझते हैं।
21. िमीक्षा।⸺ यह िुर्नश्चित किने के सलए कक िश्ब्िडी िाले केिोसिन तेल उपलब्ध किाने
की योजना के उद्देचय भाित ििकाि औि िंघ िाज्य लद्दाख द्िािा िमय-िमय पि जािी
मानदंडों/ददशार्नदेशों के तहत लक्षक्षत औि िास्तविक लाभाधथियों तक ही पहुँिें औि वितिि की

प्रकक्रया को िुविधाजनक औि प्रभािी तिीके िे औि अधधक िुव्यिश्स्थत किने के सलए, िंघ
िाज्य लद्दाख आिचयकता पड़ने पि इि आदेश के प्रािधानों की िमीक्षा कि िकता है, श्जिमें
िश्ब्िडी िाले केिोसिन तेल में प्रदान ककए जाने िाले लाभाधथियों की पात्रता भी शासमल है।
22. सशधथल किने की शश्क्त।⸺ प्रशािन ऊपि उश्ल्लणखत ककिी भी शति में छूट दे िकता है
यदद िह िीक िमझे औि बड़े पैमाने पि जनता के दहत में या िामान्द्य या विशेर् आदेश द्िािा
इि आदेश के तहत लाभ प्राप्त किने के सलए ककिी भी व्यश्क्त या व्यश्क्तयों के िगि को
शासमल कि िकता है।
23. र्नििन औि िंिक्षि⸺ (1) लद्दाख यूटी केिोसिन तेल (लाइिेंसिंग) आदेश, 2025, औि
इि विर्य पि अन्द्य आदेश इिके द्िािा र्निस्त ककए जाते हैं, या
ख. कोई अधधकाि, हक या दार्यत्ि अश्जित, उपाश्जित या उपगत; या
ग. ऐिे अधधकाि, हक या दार्यत्ि के िंबंध में आिंभ, िंिासलत या जािी िखी गई कोई जांि या
कोई अन्द्य विधधक कायिाही; या
घ. उक्त आदेशों के अधीन अधधिोवपत कोई शाश्स्त, इन र्नयमों के िंगत उपबंधों के अधीन की
गई, ली गई, अश्जित, उपाश्जित, उपगत, आिंभ, िंिासलत, जािी या अधधिोवपत मानी जाएगी।

तनर्म एिं ितें
1. लाइसेंस के शलए अक्ननिमन एिं आपातकालीन सेिा विभाग से अनापवि प्रमाण-पत्र
प्रस्तुत करना होगा तथा दुगयम एिं दूर-दराज के क्षेत्रों में कार्यकारी मक्जस्रेट द्िारा
लाइसेंस के संचालन हेतु संबंधित सहार्क तनदेिक को अक्नन सुरक्षा आिश्र्कताओं का
अनुपालन सुतनक्श्चत करना होगा।
2. लाइसेंसिारी केरोशसन तेल की दैतनक बबक्री रक्जस्टर बनाए रखेगा, क्जसमें तनम्नशलखखत
दिायर्ा जाएगा: -
(क) प्रत्र्ेक ददन का प्रारंशभक िेष;
(ख) िह स्रोत जहां से केरोशसन तेल प्राप्त ककर्ा जाता है, क्जसमें मात्रा का उल्लेख हो;
(ग) ददन के दौरान वितररत/जारी की गई मात्रा; तथा
(घ) प्रत्र्ेक ददन का अंततम िेष।

3. लाइसेंसिारी अपने खातों को दैतनक आिार पर पूरा करेगा तथा अधिकाररर्ों द्िारा
तनरीक्षण के शलए इसे तैर्ार रखेगा।
4. लाइसेंसिारी तनम्नशलखखत कार्य नहीं करेगा-
(क) लद्दाख संघ राज्र् क्षेत्र, केरोशसन तेल लाइसेंशसंग आदेि 2025 के तहत जारी लाइसेंस
के अलािा अन्र् केरोशसन तेल प्राप्त करने, आपूततय करने र्ा भंडारण करने के शलए कोई
लेनदेन नहीं करेगा।
(ख) खाद्र्, नागररक आपूततय और उपभोतता मामले विभाग, लद्दाख द्िारा समर्-समर् पर
ददए गए आदेि के अनुसार आपूततय के शलए रखे गए केरोशसन तेल के स्टॉक को आपूततय
करने से नहीं रोकेगा।
5. लाइिेंिधािी ऐिे रिटनि प्रस्तुत किेगा तथा केिोसिन तेल की प्राश्प्त औि खुदिा बबक्री िे
िंबंधधत ऐिी पुस्तकें, खाते औि अन्द्य असभलेख िखेगा, जैिा कक लाइिेंसिंग प्राधधकािी या
खाद्य, नागरिक आपूर्ति औि उपभोक्ता मामले विभाग में अधधकृत प्रर्तर्नधध िमय-िमय
पि र्निीक्षि के दौिान र्नदेश दे िकते हैं।
6. लाइिेंिधािी ऐिे र्नदेशों का पालन किेगा औि उनका पालन किेगा, जैिा कक लाइिेंसिंग
प्राधधकािी द्िािा िमय-िमय पि ददया जा िकता है।
7. लाइिेंि की ककिी भी शति का उल्लंघन लाइिेंसिंग प्राधधकािी द्िािा जािी ककए गए
र्नदेशों के अनुिाि ककया जाता है, तो उिके णखलाफ की जाने िाली ककिी भी अन्द्य
काििाई के पूिािग्रह के बबना उिका लाइिेंि िद्द या र्नलंबबत ककया जा िकता है।
8. लाइिेंि िक्षम प्राधधकािी को विचलेर्ि के सलए उिके स्टॉक औि केिोसिन तेल के नमूने
का र्निीक्षि किने की अनुमर्त देने के सलए बाध्य होगा।
9. कोई कानूनी बाधा नहीं है औि आिेदक डडपो धािक नहीं है, या उिका नाम डडपो धािक
िे िंबंधधत नहीं है या श्जिका लाइिेंि िद्द/र्नलंबबत ककया गया है।

10. लाइिेंिधािी र्नदेशक, खाद्य, नागरिक आपूर्ति एिं उपभोक्ता मामले को फामि-िी पि
विसभन्द्न खुदिा विक्रेता धािकों को केिोसिन तेल के स्टॉक, ििीदों की वििििी प्रस्तुत
किेगा।
11. लाइिेंिधािक को प्रशािन द्िािा िमय-िमय पि जािी र्नदेशों के अनुिाि िभी आिचयक
औपिारिकताएं पूिी किने के बाद ही समट्टी के तेल की आपूर्ति प्राप्त होगी।
12. इन शतों का उल्लंघन किने पि लाइिेंि के र्नलंबन/िद्दीकिि िदहत काििाई की जाएगी।
13. लाइिेंिधािक को िाशन काडि के काउंटिफॉयल में समट्टी के तेल का कोटा औि ली जाने
िाली िासश का उल्लेख किना होगा, श्जिके कािि उिका लाइिेंि र्नलंबबत/िद्द ककया जा िकता
है।
14. लाइिेंिधािक को अपने आउटलेट के प्रमुख स्थानों पि आि.टी. धािक को आपूर्ति ककए जाने
िाले समट्टी के तेल की दि औि पैमाने को प्रदसशित किना होगा।
15. लाइिेंिधािक को नौकिी समलने की श्स्थर्त में उिे अपना लाइिेंि लाइिेंसिंग प्राधधकिि के
पाि जमा किना होगा।

NOTIFICATION.
Ladakh, the 10th April, 2025
S.O.-40.⸺ Whereas, the Union territory of Ladakh is of the opinion that it is necessary and
expedient to do so for maintaining supplies and securing availability of kerosene oil.
Now, therefore, in exercise of the powers conferred by Section 3 of the Essential
Commodities Act, 1955 (10 of 1955) read with Government of India, Ministry of Commerce
Order No. S.O. 3515 dated 05-10-1968, the Administration of Union territory of Ladakh, hereby
makes the following order, namely-
1. Short title and commencement.⸺
(1) This Order may be called the Union
territory of Ladakh Subsidized Kerosene Oil (Licensing & Distribution) Order, 2025.
(2) It extends to the whole of the Union territory of Ladakh.
(3) It shall come into force from the date of it’s publication in the Official Gazette.
2. Definitions.⸺ In this order, unless the context otherwise requires,
A. "Antodaya Anna Yojana (AAY)" & "Priority House Hold (PHH)" category
beneficiaries shall have the same meaning as assigned to the household of these
categories under section 10 of the National Food Security Act;
B."Dealer" means any person carrying business in purchase, sale or storage for sale or
distribution of Subsidized Kerosene Oil, either wholesale or retail;
C. "Declared Price" about Subsidized Kerosene oil supplied under Targeted Public
Distribution System in any area means the maximum selling price declared by the
Central Government from time to time about an area and shall include such other
charges, rates, duties, and taxes prescribed by the Administration of UT of Ladakh, in
the case of any area in Union territory of Ladakh;
D "Form" means a form to be devised and issued by the Licensing Authority under this
order for the purpose of issuance of license;
E "Kerosene" means middle distillate mixture of hydrocarbons meeting BIS
specification No.IS-1459 of 1974 with important characteristics of a flashpoint at the
minimum Kerosene of 35°C and smoke point at a minimum of 18 price), as defined in
the order of the Kerosene (Restriction on Use & Fixation of Ceiling Price) Order, 1993;

F "Licensing Authority" means the Director, Department of Food Civil Supplies &
Consumer Affairs, Administration of UT of Ladakh or an officer designated by the
Administration to exercise the powers and perform the duties of Licensing Authority
under the provisions of this Order;
G "Public Distribution System" means the system of allocation, distribution,
marketing, or selling of kerosene at declared price through a distribution system
approved by the Central Government or Union territory of Ladakh;
H "Retail dealer" means a person carrying on retail business of supplying Kerosene
Oil to consumers other than dealers and
I "Wholesale dealer" means a person who buys Kerosene Oil from designated oil
company to sell it to any other dealer and includes an agent of any oil company dealing
in kerosene, and recognized by the Union territory of Ladakh as a wholesale dealer
through a valid license.
3."Licensing dealers".⸺ (1) No dealer shall obtain order and store terms or supply
Subsidized kerosene oil except under the provision of this Order and the terms and
condition of the license issued to him on this behalf by the Licensing Authority.
(2) Every person who is engaged in the business as a dealer at the commencement of
this Order shall apply to the Licensing Authority for the grant of fresh license within a
period of ninety days of the commencement of this order subject to fulfillment of
following conditions: -
(i) Should be a domicile of Union territory of Ladakh.
(ii) Should be having SKO dealership agreement with any recognized Oil Marketing
Company and should be in possession of valid prescribed licenses, in case of wholesale
licensee.
(iii) Should be registered as a wholesaler/retailer with the Department of FCS&CA.
(iv) Should possess a suitable premises and storage area to the satisfaction of the
Licensing Authority for carrying on such business.
Provided that in respect of the cases falling under sub-clause (2), the Licensing
Authority may entertain an application after the expiry of the said period of ninety days
but not later than thirty days thereafter, if it is satisfied that the applicant was
prevented by sufficient cause from applying in time.
However, after the expiry of such time, no application shall be entertained and
the license issued under the previous orders shall be deemed as lapsed forever.
(3) Upon the receipt of the application under sub-clause (2) above the Licensing
Authority may accept or reject such application, after giving the applicant an
opportunity of being heard and for sufficient reasons to be recorded in writing.
4. Issue of license. ⸺
(1) Every application for issuance of a license or renewal
thereof shall be made to the Licensing Authority.
(2) An application for renewal of a license shall be made to Assistant Director
concerned, not less than thirty days before the date on which license expires.
(3) Every license shall be issued in the prescribed Form by the Licensing Authority
subject to the conditions mentioned therein and such other conditions as the Licensing
Authority may prescribe from time to time.

(4) If a license granted under this order is defaced, lost, or destroyed, the dealer(s)
shall forthwith inform the Licensing Authority, who may, on application by the licensee,
issue a duplicate license as per the procedure to be devised by the Licensing Authority.
(5) The license granted under this order, unless previously suspended or cancelled,
shall continue up to three years and shall be further renewable for two years at a time
on submission of an application by a licensee to the Assistant Director concerned which
shall be made before the expiry of the validity period of license accompanied by the
renewal fee. In case the licensee does not apply for renewal within the stipulated time,
the license shall be treated as lapsed and shall not be entertained for any allocation of
Subsidized Kerosene Oil.
(6) The Assistant Director concerned shall verify the validity of license issued by the
Licensing Authority, periodically, so as to avoid the misuse of the license by any person
other than actual licensee.
5. Eligibility for obtaining and holding Subsidized Kerosene Oil License.⸺
(1) The applicant applying for a fresh Subsidized Kerosene Oil Retail Dealership
License shall:
(i) He/she should be the domicile of UT of Ladakh.
(ii) He/she should be possessing matriculate certificate at the time of filing of
application and shall furnish a certificate from the competent authority that he/she has
not availed any type of loan from Government/Semi-Government or any financial
institutions for establishment of any other business.
(iii) Not be less than 18 year of age and not more than 45 years of age at the time of
applying for the dealership. However, relaxation in age in case of reserved category
candidates shall be applicable, as per norms laid down by the Union territory of Ladakh
in the employment generation schemes.
(iv) Furnish his/her character and antecedent certificate issued by District Magistrate.
(v) Possess a suitable premises and storage area/capacity to the satisfaction of the
licensing authority for carrying on business as a retail dealer.
(vi) Fulfill any other conditions which the Licensing Authority or the Administration may
consider necessary and relevant for the purpose.
(vii) Surrender his/her license before the Licensing Authority on getting a job or if
he/she so desires.
(2) The applicant applying for a fresh Subsidized Kerosene Oil Wholesale Dealership
License shall:
(i) He/she should be the domicile of UT of Ladakh.
(ii) He/she should be possessing 10+2 certificate at the time of filing of application and
shall furnish a certificate from the competent authority that he/she has not availed any
type of loan from Government/Semi-Government or any financial institutions for
establishment of any other business.
(iii) Not be less than 18 year of age and not more than 45 years of age at the time of
applying for the dealership, however, relaxation in age in case of reserved category
candidates shall be applicable, as per norms laid down by the Union territory of Ladakh
in the employment generation schemes.
(iv) Furnish his/her character and antecedent certificate issued by District Magistrate.

(v) Have SKO dealership agreement with any recognized Oil Marketing Company and
should be in possession of valid prescribed licenses.
(vi) Possess a suitable premises area storage have to the satisfaction of the Licensing
Authority for carrying on business as a wholesales dealer. But the storage tank must be
away from the populated area and shall have the access to fire and emergency
vehicles.
(vii) The wholesale dealer must have fire-fighting equipment available at the Kerosene
Oil storing place.
(viii) Fulfill any other conditions which the Licensing Authority or the Administration may
consider necessary and relevant for the purpose.
(ix) Surrender his/her license before the licensing authority on getting a job or if he or
she so desires.
(3) One person shall hold only one Subsidized Kerosene Oil Dealership with the
condition that neither his/her family members have any business in Subsidized
Kerosene Oil nor is involved in any other petroleum product business nor his/her family
member is an employee of the Department of Food, Civil Supplies and Consumer
Affairs.
(4) The new sale points for Subsidized Kerosene Oil distribution shall be opened on the
submission of a comprehensive proposal to be made by the Assistant Director of the
Department of Food, Civil and Consumer Affairs in consultation with respective District
Development Commissioners, taking into consideration the proportion of population and
quantum of kerosene oil required.
(5) The authority for grant of new Retail Dealership license for distribution of Subsidized
Kerosene Oil shall be the Director, Department of Food, Civil Supplies and Consumer
Affairs on the recommendations of Assistant Director concerned duly endorsed by the
Deputy Commissioner as per the procedure to be prescribed by the Licensing Authority.
However, the authority for the renewal of a license shall be with the Director.
(6) The authority for transferring a license shall be the Director on the
recommendations of concerned Assistant Director in consultation with the concerned
District Development Commissioner wherever feasible, subject to eligibility.
(7) In case of death/incapacitation due to serious illness/accident of the licensee
thereby resulting in total and permanent disability, which may disable him/her to work
and carry on the business, the dealership may be transferred to his/her legal heirs
subject to fulfillments of conditions that enable him/her to obtain a license under these
rules.
6. The categories of beneficiaries eligible for allocation of Subsidized
Kerosene Oil.⸺
(1) AAY category for the entire year in winter zone,
(2) PHH category for the entire year in remote areas where winter dumping of food
grains for a period of six months or three months is done.
(3) PHH category in winter zone for four winter months only (December, January,
February & March), not covered in clause (2).
7. Allocation and rationalization of distribution of Subsidized Kerosene Oil.⸺

(1) All the eligible beneficiaries shall be provided subsidized Kerosene oil at the scale of
3 liters per family per month or as decided by the Administration depending upon the
availability. However, any allocated quantity of Subsidized Kerosene oil if left after
distribution on any account shall be treated as a saving for the month and shall be
carried forward for utilization in the subsequent month with prior permission of the
department.
(2) The Assistant Directors of the Department of Food, Civil Supplies, and Consumer
Affairs shall verify the actual beneficiaries using the Kerosene Oil for bona-fide purposes
for cooking and illumination. They may ask the Administrative Department for allocation
of Subsidized Kerosene Oil, based on the actual requirement in the district. The
Assistant Directors may also take into account the beneficiaries voluntarily giving up
Subsidized Kerosene Oil while asking for the allocation.
(3) On the basis of the requisition to be made by the respective Assistant Director, the
Administrative Department shall allocate the Subsidized Kerosene Oil as per the
availability and requisition.
(4) A copy of the release order of Subsidized Kerosene Oil shall invariably, be forwarded
to Deputy Commissioners and District SSPs for monitoring the distribution of kerosene
oil at the different sale points to prevent its diversion for other uses and leakages.
(5) The Subsidized Kerosene Oil quota shall be allocated to such wholesale dealers by
the respective Director, who possesses a valid license and qualify the required
conditions prescribed by the Licensing Authority and as per this order and allocation can
be stopped at any point of time for non-fulfilling of the conditions laid down in this
order or any other instructions issued from time to time by the Administration or the
Licensing Authority. The allocation of Subsidized Kerosene Oil shall be made by the
respective Assistant Director(s) so as to ensure convenient and effective distribution
equally amongst the licensees, on district basis as far as possible, keeping in view the
requirement of Subsidized Kerosene Oil in the district.
(6) The Subsidized Kerosene oil dealers shall have to adhere to all the initiatives or
reforms, decided by the Administration or the Licensing Authority and also put in place
all such arrangements as may be required towards that effort, so as to make the
process of allocation, transportation and distribution of Subsidized Kerosene Oil more
credible, dependable and transparent.
(7) A Monitoring Cell to track the movement of tankers transporting Subsidized
Kerosene Oil shall be established in the Department of Food, Civil Supplies and
Consumer Affairs, Union territory of Ladakh. The Monitoring Cell shall track the
movement of tankers in their respective divisions.
(8) The quota of Subsidized Kerosene Oil shall be released only after GPS is installed in
the tankers transporting the Subsidized Kerosene Oil.
(9) The colour of the tanker transporting Kerosene Oil shall be as prescribed by the Oil
Marketing Companies, highlighting the name of the Dealer, and the words Subsidized
Kerosene Oil" shall be written on the body of the tanker boldly, while transporting
Subsidized Kerosene Oil.
8. Restriction on use of Subsidized Kerosene Oil supplied under Public
Distribution System.⸺

(1) No person shall use Subsidized Kerosene Oil, supplied under the Public Distribution
System for any purpose, other than cooking and illumination:
Provided that the Central government or Union territory of Ladakh may by order
permit any person to use such Subsidized Kerosene Oil for such other purposes as it
may specify in that order.
(2) No dealer appointed under the Public Distribution System or transporter shall sell,
distribute or supply Subsidized Kerosene Oil under the public distribution system to any
person other than the person for whom the supplies are meant.
(3) The licensee shall not have in his possession or under his control any Subsidized
Kerosene Oil over the net quantity revealed by his account and if any such excess
quantity is not properly accounted for by the licensee, it will be liable to seizure.
9. Fee chargeable.⸺
The fee specified below shall be chargeable in respect of
each license, namely: -
1. For grant of a new license
(i) to a wholesale dealer Rs. 10,000/-
(ii) to a retail dealer Rs. 3000/-
2. For renewal of license
(i) to a wholesale dealer Rs. 6000/-
(ii) to a retail dealer Rs.2000/-
3. For the issue of duplicate
(i) license Rs. 2000/-
10. Deposit of security.⸺
Every person who applies for a grant of license
under this order shall have to deposit the security with the Licensing Authority at the
following rates:-
(1) for grant of license to Wholesale dealer Rs. 30,000/-
(2) for grant of license to a Retail dealer Rs. 10,000/-
11. Contravention of the terms and conditions of license or directions. ⸺
(1) No dealer shall contravene any of the terms or conditions of the license or the
directions issued under the provisions of this order and if any dealer contravenes any of
the said terms, conditions, or any provision of this order, then without prejudice to any
other action that may be taken against the license, his license may be cancelled or
suspended by an order in writing by the Licensing Authority:
Provided that no order shall be made under this clause, unless the dealer, as the
case may be, has been given a reasonable opportunity of presenting his case and of
being heard against the proposed cancellation or suspension of the license.
(2) No dealer shall sublet his dealership to any unauthorized person for handling the
Subsidized Kerosene Oil. In case of any temporary disability of the licensee in operating
the said dealership, the helper can be engaged for the period of such disability not
exceeding one year at a time with the prior permission of the Licensing Authority, by
providing his details and taking the responsibility of his conduct, by the licensee.
(3) The Licensing Authority reserves the right to cancel the license and debar the
licensee forever, if it is established to its satisfaction that the dealer has misused the
terms and conditions of the license granted and is acting in a way that goes against the
public interest.

(4) In case of suspension or cancellation of the license of the dealer, the Deputy
Commissioner/ SDM after obtaining a report from the Assistant Director, FCS&CA shall
make an alternate arrangement for ensuring uninterrupted supply of subsidized
kerosene oil to the beneficiaries till the time Licensing Authority decides the matter.
(5) The Vigilance Committees set up under NFSA for the Targeted Public Distribution
System at the different levels in the District shall also be empowered to keep a regular
check on the distribution of Subsidized Kerosene Oil in their areas of jurisdiction and
ensure prevention of any diversion/irregularity in such distribution by the dealers.
(6) The Grievance Redressal Mechanism set up under NFSA for receiving the complaints
Grievances relating Redressal to the Mechanism Targeted for Public disposing
Distribution of complaints System shall relating also to act the as distribution of
Subsidized Kerosene Oil amongst the targeted groups. The complaints/grievances shall
be disposed of as per the procedure laid down in the mechanism set up under NFSA.
12. Maintenance of accounts.⸺
Every dealer shall maintain a complete account
of stock of the daily receipts and disposal of Subsidized Kerosene Oil separately and
keep it up-to-date and make it available for inspection at the place of his business,
along with such other information as he may be required by the Licensing Authority or
such other officer as may be designated by the Administration or the Licensing
Authority in this behalf.
13. Display of stock position.⸺
Every dealer shall display at a conspicuous
place of his business premises, the opening balance, price of Subsidized Kerosene Oil,
allocated list of eligible beneficiaries, if applicable, and stock before the commencement
of business every day.
14. Forfeiture of security deposit.⸺ (i) Without prejudice to the provisions of this
order, if the Licensing Authority is satisfied that any dealer has contravened any of the
provisions of this order or any of the terms and conditions of the license or the
directions conveyed by Government, his/her security deposit shall be forfeited, whole or
a part thereof, by an order in writing after providing the dealer a reasonable
opportunity of stating his case against the proposed forfeiture. A copy of such order
shall be forwarded to the dealer.
(ii) The dealer shall, if the amount of his security deposit at any time, falls short of the
amount specified in clause 10 shall forthwith deposit further security to make up that
amount on being required by the Licensing Authority to do so.
15. Appeal.⸺
Any person aggrieved by the order of the Licensing Authority
refusing to grant or renewal of license or cancellation or suspending his license, or
forfeiting the security deposited by him, may within thirty days from the date of the
receipt of a copy of such order, prefer an appeal in writing before the Administrative
Secretary, Food, Civil Supplies, and Consumer Affairs Department, Ladakh UT or any
other officer as may be appointed by the Administration in this behalf, whose decision
thereon shall be final.
16. Restriction on purchase or sale of kerosene oil.⸺ (1) No wholesale dealer
shall supply or cause to be supplied Subsidized Kerosene Oil to any person other than a
licensed retail dealer.

(2) No dealer shall obtain or cause to be obtained Subsidized Kerosene subject to sub
clause (1) from any person other than the wholesale dealer.
(3) No dealer shall sell Subsidized Kerosene Oil to any consumer, at a price higher than
the price fixed by the competent authority.
17. Power to call for information.⸺ Every dealer shall, when so required, by-
general or special directions by the Licensing Authority/Government, furnish truthfully
and to the best of his knowledge, such particulars of information relating to Subsidized
Kerosene Oil distribution in such a manner, as may be required.
18. Exemption.⸺ Nothing in this order shall apply to purchases and storage of
Subsidized Kerosene Oil on the Administration account.
19. Powers of entry, search, seizure, etc.⸺
(1) The Licensing Authority or
any other officer authorized by the Administration or the Licensing Authority in this
behalf, with such assistance, as he/she deems fit, may: -
(1) require the owner, occupier, or any other person in charge of any place, premises,
vehicles, boat, or any other conveyance in which he has reason to believe that any
contravention of the provisions of this order or the conditions of any license issued
there under has been, is being or is about to be committed, to produce any books or
accounts or other information;
(2) Enter, inspect or break open and search any place or premises, vehicle, boat, or any
other conveyance in which he has reason to believe that any contravention of the
provisions of this order or the conditions of any license issued there under, has been, is
being or is about to be committed;
(3) Take or cause to be take/extracts from or copies of any documents showing
transactions relating to such contraventions and return the same to the person from
whom they were seized;
(4) Search, seize, and remove any stocks of Subsidized Kerosene Oil and the vehicles,
boats, or other conveyance used in carrying kerosene oil in contravention of the
provisions of this order, or of the conditions of the license issued there under and
thereafter take or authorize taking of all measures necessary for securing the
production of stocks of Subsidized Kerosene Oil and the vehicles, boats or other
conveyance so seized in a court and for their safe custody, pending such production;
(5) The officer conducting search and seizure shall immediately inform the concerned
Deputy Commissioner and Department of Food, Civil Supplies & Consumer Affairs, the
stock of Subsidized Kerosene Oil seized by him under this order and
(6) The provisions of Section 103 Bharatiya Nagarik Suraksha Sanhita, (BNSS) 2023
relating to searches and seizures shall, mutatis mutandis, apply to search and seizure
under this order.
20. Power to issue instructions.⸺
The Administration or the Licensing Authority
may from time to time issue such instructions, not inconsistent with this order, as it
may consider necessary for the purpose of implementing the provisions of this order.
21. Review.⸺
To ensure that the objectives of the scheme for providing
Subsidized Kerosene Oil reaches only to the targeted and Bonafide beneficiaries under
the norms/guidelines issued by the Government of India and Union territory of Ladakh
from time to time and to further streamline the process of distribution in a convenient &

effective manner, the Union territory of Ladakh may review the provisions of this order
as and when required, including the eligibility of beneficiaries to be provided in the
Subsidized Kerosene Oil.
22. Power to relax.⸺
The Administration may relax any of the conditions
mentioned above if it deems fit and in the interest of the public at large or by a general
or special order include any person or class of persons to avail benefits under this
order.
23. Repeal and savings.⸺
(1) The Ladakh UT Kerosene Oil (Licensing)
Order, 2025, and other orders on the subject are hereby repealed,
(2) Notwithstanding such repeal,
a. anything done or any action taken; or
b. any right, entitlement or liability acquired, accrued or incurred; or
c. any inquiry or any other legal proceeding initiated, conducted or continued in respect
of such right, entitlement or liability; or
d. any penalty imposed under the said orders, shall be deemed to have done, taken,
acquired, accrued, incurred, initiated, conducted, continued or imposed under the
corresponding provisions of these rules.

Terms and Conditions
1. The license is subject to the production of No Objection Fire Certificate from the
Fire and Emergency Service Department and in case of inaccessible and far-flung
areas, the Executive Magistrate ensuring observance of the Fire Safety
requirements to the Assistant Director concerned operationalizing the license.
2.That licensee shall maintain daily Sale Register of kerosene oil indicating the
following: -
(a) the opening balance on each day;
(b) the source from where Kerosene Oil is received mentioning quantity;
(c) the quantities delivered/issued during the day; and
(d) the closing balance on each day.
3.The licensee shall complete his accounts on daily basis and keep it ready for
inspection by the authorities.
4.The licensee shall not-
(a) Enter into any transaction for obtaining supplying or stocking other
kerosene oil except under the license issued under the Ladakh UT, Kerosene
Oil Licensing Order 2025.
(b) Withhold for supplying stock of kerosene oil kept for supply as per the
scale as ordered by the Department of Food, Civil Supplies and Consumer
Affairs, Ladakh from time to time.

5.The licensee shall furnish such returns and maintain such books, accounts and
other records relating to receipt and retail scale of kerosene oil by him, as the
Licensing Authority or authorized representative in the Department of Food, Civil
Supplies and Consumer Affairs may direct from time-to-time inspections.
6.The licensee shall observe and carry out such instructions, as may be time to time
given by the Licensing Authority.
7.Contravention of any condition of the license are instructions issued by the
Licensing Authority, his license liable to be cancelled or suspended without
prejudice to any other action that be taken against him.
8.The license shall be bound to allow the Competent Authority to inspect his stock
his sample of kerosene oil for analysis.
9.That there is no legal impediment and the applicant is not a depot holder, or
his/her
name
relative
a
depot
holder
or
whose
license
has
been
cancelled/suspended.
10.The licensee shall submit to the Director, Food, Civil Supplies and Consumer
Affairs, a return on Form-C of stocks, receipts retail sale of kerosene oil to
different RT holders.
11.The licensee shall receive supply of Kerosene Oil only after completing all the
formalities required by him/her as per the instructions of the Administration
issued from time to time.
12.Any
violations
of
these
conditions
shall
entail
action
including
suspension/cancellation of license.
13. The licensee shall be bound to fill up the counterfoil of the ration cards
indicating the quota of Kerosene Oil and amount charged falling, which the
license shall be liable to suspended/cancelled.
14. The licensee shall be bound to display the rate and scale of Kerosene Oil to be
supplied to RT holder at conspicuous places of his/her outlet.
15. In the event of license holder getting job he/she should deposit his/her license
with Licensing Authority.
