NOTIFICATION

F.No.F-15/1/2020-COL/158:- By Notification dated 31.12.2021, in supersession of

all previous Orders regarding issuance of trade/dealership/business/shop license, the

Adminstrator, Union Territory of Lakshadweep, was pleased to order that the Revenue

Department, Union Territory of Lakshadweep, shall issue the licenses in terms of the

Guidelines laid down therein. By the above Notification, the Orders dated 26.12.2011 by

the Adminisration which empowered Village Dweep Panchayats for the issuance of license,

stands superseded.

The President of India has promulgated the Lakshadweep Panchayat Regulations, 2022

in supersession of 1994 Regulations. Evidently, 2022 Regulations does not empower

the authorities under the Village Panchayats for issuanc of trade/dealership/business/

shop license etc. In the 1994 Regulations as well, there were no specific empowerment

of Panchayats regarding issuance of lincense and they were empowered only by the

Notification dated 26.12.2011.

In view of the 2022 Panchayat Regulations and on review of th existing system of

issuance of license and in exercise of powers conferred u/s 37 & 106 of Lakshadweep

Panchayat Regulation 2022, the Adminstrator is pleased to issue the following guidelines

to be followed by the Revenue Department while issuing license, in supersession of early

Notofication No. F.No. F-15/1/2020-Col-473 dated 31.12.2021.

Applicant has to file an application in plain paper affixing stamp worth to

Rs. 50/- (Rupees Fifty) only to the Deputy Collector - cum-CEO (SDM) of the

Island concerned.

Certified copies of possession certificate, title deed of the land and building

has to be furnished along with the application.

Certified copy of the permission granted for diversion of land from one purpose to

another obtained from Revenue authority under relevant rules of Land Diversion

Rule, 2003 has to be attached with the application.

If proposed to start business in business in building owned by any other person,

certified copies of possession certificate, title deed of the building owner and his

consent has to be attached with the application.

5.

Certificate of Environmental Clearance has to be produced with the application.

6.

Certificate from Inspector of Weights & Measures showing the correctness of

the weighing/measurement quipments has to be produced with the

application.

7.

License has to be issued initially for a period of one year and to be renewed by

1^st January of every year.

8.

In case of delay in renewing the license an amount of Rs. 100/- (Rupees One

Hundred) only per month has to be remitted as fee for delay.

9.

If any unauthorized items seen stored/selling in the shop, the license will be

cancelled forthwith.

10. The shops within 100 Mts from Educational insitution shall not sell tobacco

products in any form.

11. The License issuing authority shall have the power to revoke the license issued/

renewed and to impose fine of 1000/- (Rupees One Thousand) only on the

ground of any violation of any of the condition imposed in the license.

12. The District Collector, Union Territory of Lakshadweep shall have the power to

issue guidelines in connection with the issunace of trade/dealers/business/

shop license as and when required.

This notification will come into force with effect from 08.02.2023.

This issues with the approval of Hon’ble Adminstrator, Union Territory of Lakshadweep

vide Diary No. 27 dated 08.02.2023.
