NOTIFICATION

No. TPB 4317/552/CR-38/2018/UD-11.—Whereas the Development Plan of ‘R’ Ward of Greater

Mumbai (hereinafter referred to as “the said Plan”) has been sanctioned by the Government under section

31(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as “the said Act”)

vide Urban Development Department’s Notification No. TPB 4392/6279/(RDP)/UD-11 dated 04/5/1993 to

come into force with effect from 13th July 1993 and excluded parts have been sanctioned vide Notification

dated 29th April 94 to come into force from 14th June 1994 ;

And whereas, the land admeasuring about 19.69 Ha.on land bearing CTS No.471(pt) of village Kandivali,

CTS No. 1(pt) of village Valnai and CTS No. 7(pt) of village Malvani, CTS No. 226(pt) village Malad (North)

and lands under nallas of Mumbai Suburban District (hereinafter referred to as “the said land”)forms part of

larger reservations of Recreation Grounds (RG), Police Station (PS), Post Office (PO), D.P. Roads,

Playgrounds (PG), Secondary School (S S), Municipal Primary School (M P), DattaMandir and allied

activities falls partly in I-3 zone and partly in Residential Zone as per the proposals of the said plan ;

And whereas, the Mumbai Metropolitan Region Development Authority (hereinafter referred to as “the

said Authority”) is implementing Mumbai Metro Master Plan ;

And whereas, the said Authority has requested that the reservations on the said land i.e. Recreation

Grounds (RG), Police Station (PS), Post Office (PO), D.P. Roads, Playgrounds (PG), Secondary School

(S S), Municipal Primary School (M P), Datta Mandir and allied activities on the land bearing CTS No. 7(pt)

of village Malvani, CTS No. 471(pt) of village Kandivali, CTS No.226(pt) of village Malad (North) and CTS

No. 1(pt) of Valnai and on nalla land, falls partly in Residential Zone and partly in I-3 Zone, that the

reservations/designations on the said land should be deleted and the said land be reserved for reservation

of “MRTS Car Depot/Workshop, allied facilities and commercial”;

And whereas, considering the request of the said authority Government was of the opinion that the

reservations/designations on the said lands should be deleted and the said land be reserved for “MRTS

Car Depot/Workshop and allied facilities, commercial” (hereinafter referred to as “the proposed modification”);

And whereas, in exercise of the powers contained in sub-section (1AA) of section 37 of the said Act,

Government had issued the Notice bearing No.TPB-4308/2993/CR-331/2008/UD-11, dated 10th August,

2009 for inviting suggestions/objections from any person with respect to the proposed modification and

appointed Deputy Director of Town Planning, Greater Mumbai as the officer (hereinafter referred to as “the

said officer”) to submit a report on the suggestions/objections received in respect of the proposed modification

to the Government after giving hearing to the concerned persons and the Municipal Corporation of Greater

Mumbai ;

And whereas, the said notice was published in the Maharashtra Government Gazette (Ordinary) dated

3rd – 9th September, 2009 and the said officer has submitted his report through the Director of Town Planning,

Maharashtra State vide letter dated 19th November 09 ;

And whereas, the Government in Urban Development Department vide Notification No.No.TPB 4315/

523/CR-24/2013/UD-1, dated 21st July 2016, has reserved the land admeasuring about 16.40 Hectare,

bearing CTS No.6A(pt.)of village Malvani (herein after referred to as “ the Malvani Depot”), adjacent to said

land for Metro Car Depot, allied users and commercial ;

And whereas, the said Authority vide letter dated 7th July 2017, requested the Government that, the

area of the said land admeasuring about 2.18 Ha., affected by alignment of Metro Rail approaching to Malvani

Depot should be reserved and the balance area from proposed Metro Car Depot reservation should be

excluded ;

And whereas, after considering the Report of the said Officer on the request of the Authority and after

consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the

proposed modification is required to be sanctioned with some changes with conditions;

Now therefore, in exercise of the powers conferred upon it under section 37(1AA)(c) of the said Act,

the Government hereby :—

(A) Sanctions the said proposed modification with changes as more specifically described below

and rest of proposal is refused to sanction, keeping sanctioned Development Plan proposal as it is.

(B) Fixes the date of publication of this Notification in the Official Gazette, as the date on which

the said modification shall come into force;

(C) Directs the Municipal Corporation of Greater Mumbai that, in the Schedule of Modifications

appended to the Notification sanctioning the said Development Plan, after the last entry a new entry

as per (A) above shall be added.

Sanctioned Modification

“The area admeasuring about 2.18 Ha., of C.T.S. No. 7(part) of village Malvani, C.T.S. No. 226(part)

of village Malad and C.T.S.No.(1) of village Valnai, affected by alignment of Metro Rail is reserved for

“ Metrorail Alignment ” and the part reservations of Recreation Grounds, Play Grounds, and Secondary

School on the such land is deleted accordingly, as more particularly shown on the plan attached herewith.”

Condition :—Necessary prior approval from Competent Authority in respect of CRZ Regulations shall

be taken by the implementing agency.

A Notification and Plan showing the sanctioned modification is kept open for inspection by the general

public during the office hours on all working days at the following Places :—

(1) Office of the Deputy Director of Town Planning., Greater Mumbai, having his office at ENSA

Hutments, E-Block, Azad Maidan, MahapalikaMarg, Mumbai 400 001.

(2) Office of the Chief Engineer (Development Plan) Municipal Corporation of Greater Mumbai,

Mahapalika Marg, Mumbai 400 001.

This Notification shall also be available on the Govt. of Maharashtra website : www.maharashtra.gov.in
