अिधसूचना

भारताचे संिवधान.

कर्मांक संआसे. 2013/Ģ.कर्.797/सेवा-1.—भारताचे संिवधान याच्या अनुच्छेद 309 च्या परंतुकाǎारे Ģदान करण्यात

आलेÊया अिधकाराचा वापर करून महाराÍटर्ाचे राज्यपाल याǎारे महाराÍटर् शासनाच्या आरोग्य सेवा संचालनालयातील महाराÍटर्

वैǏकीय व आरोग्य सेवा, गट-ब मधील अÎथायी Îवरूपात कायर्रत असलेÊया वैǏकीय अिधकाऱ्यांचे एक वेळचे समावेशन

करण्यासाठी पुढील िनयम करीत आहेत :—

या िनयमांना महाराÍटर् वैǏकीय व आरोग्य सेवेतील वैǏकीय अिधकारी, गट-ब (बी.ए.एम.एस.) (अÎथायी Çहणून

िनयुक्त केलेÊया वैǏकीय अिधकाऱ्यांचे एक वेळचे समावेशन) िनयम, 2018 असे Çहणावे.

या िनयमांमध्ये संदभार्नुसार दुसरा अथर् अपेिक्षत नसेल तर,—

(अ) “अÎथायी वैǏकीय अिधकारी” याचा अथर् जो आरोग्य सेवा संचालनालयांतगर्त महाराÍटर् वैǏकीय व आरोग्य

सेवा यामध्ये वैǏकीय अिधकारी, गट-ब (बी.ए.एम.एस.) Çहणून अÎथायी Îवरूपात िनयुक्त झाला होता व जो सदर िनयम

अंमलात येण्याच्या िदनांकास सेवेत आहे असा आहे ;

(आ) “संचालनालय” याचा अथर् महाराÍटर् शासनाचे सावर्जिनक आरोग्य िवभागांतगर्त आरोग्य सेवा संचालनालय

असा आहे ;

(इ) “शासन” याचा अथर् महाराÍटर् शासन असा आहे ;

(ई) “पद” याचा अथर् महाराÍटर् वैǏकीय व आरोग्य सेवा या संवगार्तील वैǏकीय अिधकारी, गट-ब (बी.ए.एम.एस.)

मधील पद असा आहे ;

(उ) या िनयमांत वापरलेले, परंतु ज्यांची Ëयाख्या केलेली नाही असे शÅद व संज्ञा यांचे अथर्, महाराÍटर् वैǏकीय व

आरोग्य सेवेतील वैǏकीय अिधकारी, गट ब (सेवाĢवेश) िनयम, 2011 या िनयमांमध्ये िदलेÊया अथार्Ģमाणे असतील.

(1) या िनयमांमधील तरतुदींनुसार, असा Ģत्येक अÎथायी वैǏकीय अिधकारी, गट-ब (बी.ए.एम.एस.) जो सदर

िनयमांच्या Ģारंभाच्या िदनांकापासून सेवेत कायर्रत असणाऱ्या 738 अÎथायी वैǏकीय अिधकारी, गट-ब (बी.ए.एम.एस.) यापैकी

आहे, त्याचे या िनयमांच्या Ģारंभाच्या िदनांकापासून संचालनालयांतगर्त महाराÍटर् वैǏकीय व आरोग्य सेवेमधील वैǏकीय

अिधकारी, गट-ब (बी.ए.एम.एस.) या पदावर समावेशन करण्यात येईल :

परंतु अशा कोणत्याही अÎथायी वैǏकीय अिधकाऱ्याचे समावेशन करण्यात येणार नाही ---

(i) जो महाराÍटर् वैǏकीय व आरोग्य सेवेतील वैǏकीय अिधकारी, गट ब (सेवाĢवेश) िनयम, 2011 मधील

तरतुदींनुसार िकमान शैक्षिणक अहर्ता धारण करीत नाही िंकवा त्या िनयमांतगर्त वैǏकीय अिधकारी, गट-ब Çहणून तो

िनयुक्तीसाठी अपातर् ठरला आहे;

(ii) ज्याची अनुसूिचत जाती, अनुसूिचत जमाती, िनरिधसूिचत जमाती (िवमुक्त जाती), भटक्या जमाती, िवशेष

मागास Ģवगर् िंकवा नागिरकांचा इतर मागास वगर् या Ģवगार्साठी आरिक्षत केलेÊया पदावर अÎथायी वैǏकीय

अिधकारी Çहणून िनयुक्ती झाली होती आिण तो सदर जाती, जमाती, Ģवगर् िंकवा यथािÎथती, मागासवगीर्यांच्या

वगार्तील नसेल;

(iii) ज्याचे गोपनीय अहवाल समानधानकारक नसतील.

(2) या िनयमांखाली ज्या अÎथायी वैǏकीय अिधकाऱ्यांचे समावेशन होईल, ते समावेशनानंतर त्यांच्या िनयुक्तीच्या

िदनांकापासून िकमान दहा वषȃ आिदवासी व गर्ामीण क्षेतर्ात Ģथम काम करतील. सदर अÎथायी वैǏकीय अिधकारी

समावेशनानंतर त्यांच्या िनयुक्तीच्या िदनांकापासून िकमान सहा वषȃ उच्च िशक्षणासाठी Ģितिनयुक्तीवर जाण्यासाठी पातर् ठरणार

नाहीत.

4. वैǏकीय अिधकारी, गट ब (बी.ए.एम.एस.) यांच्या सेवेच्या अटींचे िनयमन करणाऱ्या सवर् िनयमांमध्ये व आदेशांमध्ये

काहीही नमूद केलेले असेल तरी—

(एक) अÎथायी वैǏकीय अिधकाऱ्यांचे, ज्या संवगार्तील पदांसाठी समावेशन झाले आहे त्या संवगार्तील पदासाठी

लागू असलेÊया वेतनǛेणीच्या िकमान Îतरावर, Ģारंिभक मूळ वेतन िनिÌचती करण्यात येईल.

(दोन) त्यांचे सेवािनवृǄी वेतन व सेवािनवृǄीिवषयक लाभ शासनाच्या नवीन “ पिरभािषत अंशदान िनवृǄी वेतन

योजनेतील ” अटी व शतीर्ंĢमाणे राहतील.

(तीन) समावेशनानंतर अÎथायी वैǏकीय अिधकाऱ्यांची आपसातील सेवाजेÍठता ही त्यांच्या अÎथायी नेमणुकीच्या

Ģारंिभक िदनांकापासून िनिÌचत करण्यात येईल.

(चार) अÎथायी वैǏकीय अिधकाऱ्यांची समावेशनापूवीर्ची सेवा ही वेतन, सेवािनवृǄी वेतन, रजा, सेवांतगर्त

आÌवािसत Ģगती योजनेसाठी, िवशेषज्ञ िंकवा अन्य पदावरील पदोन्नतीसाठी िवचारात घेतली जाणार नाही.

5. समावेशनापूवीर् अÎथायी वैǏकीय अिधकाऱ्यािवरूǉ कोणतीही चौकशी सुरू झाली नाही िंकवा चौकशी Ģलंिबत आहे,

याबाबत पडताळणी करण्यात येईल. तथािप, त्यांच्या चौकशीच्या अहवालावर समावेशनानंतर िनणर्य घेण्यात येईल आिण असा

िनणर्य अÎथायी वैǏकीय अिधकाऱ्यांवर बंधनकारक राहील.

समावेशनानंतर अÎथायी वैǏकीय अिधकाऱ्यांची खाली ठरवून िदलेÊया आरोग्य कȂ दर् व रूग्णालयांमध्ये ĢाथÇय

कर्मानुसार पदÎथापना करण्यात येईल :—

(i) आिदवासी क्षेतर्ातील Ģाथिमक आरोग्य कȂ दर्.

(ii) िबगर आिदवासी क्षेतर्ातील Ģाथिमक आरोग्य कȂ दर्.

अÎथायी वैǏकीय अिधकाऱ्यांचे समावेशन करताना शासनाने या िनयमांमध्ये लागू केलेÊया अटी व शतीर् मान्य

असÊयाचे हमीपतर्, या िनयमांना जोडलेÊया हमीपतर्ाच्या ĢारूपाĢमाणे, Ģत्येक अÎथायी वैǏकीय अिधकाऱ्यांकडून भरून घेण्यात

येईल. ज्या अÎथायी वैǏकीय अिधकाऱ्यांना शासनाने ठरवून िदलेÊया सदर अटी व शतीर् मान्य नाहीत, अशा अÎथायी वैǏकीय

अिधकाऱ्यांचे समावेशन करण्यात येणार नाही.

अÎथायी वैǏकीय अिधकाऱ्यांचे समावेशन करताना कोणत्याही िविशÍट जाती, जमाती, Ģवगर् िंकवा वगार्मध्ये अनुशेष

आढळÊयास, सदर अनुशेष, महाराÍटर् राज्य लोकसेवा [अनुसूिचत जाती, अनुसूिचत जमाती, िनरिधसूिचत जमाती (िवमुक्त

जाती), भटक्या जमाती, िवशेष मागास Ģवगर् आिण नागिरकांचा इतर मागास वगर् यांच्यासाठी आरक्षण] अिधिनयम, 2001 (सन

2004 चा महाराÍटर् अिधिनयम कर्मांक 8) मधील तरतुदींनुसार आिण त्याखाली बनिवण्यात आलेÊया िनयमांनुसार, भिवÍयात

होणाऱ्या सेवाभरतीच्या वेळी भरून काढण्यात येईल.

महाराÍटर् वैǏकीय व आरोग्य सेवेतील, वैǏकीय अिधकारी, गट-ब (सेवाĢवेश) िनयम, 2011 आिण शासकीय

कमर्चाऱ्यांच्या सेवेच्या अटींचे िनयमन करणाऱ्या इतर सवर् िनयमांतील तरतुदी, या िनयमांतील तरतुदींशी िवसंगत नसतील

तेथवर, या िनयमांखाली समावेशन झालेÊया अÎथायी वैǏकीय अिधकाऱ्यांना लागू राहतील.

2. महाराÍटर् वैǏकीय व आरोग्य सेवेतील वैǏकीय अिधकारी, गट-ब (बी.ए.एम.एस.) (अÎथायी Çहणून िनयुक्त

केलेÊया वैǏकीय अिधकाऱ्यांचे एक वेळचे समावेशन) िनयम, 2018 मध्ये िवहीत केलेÊया तरतुदी माझ्यावर बंधनकारक

आहेत, याची मला जाणीव आहे.

3. मी शासनाची पाच वषȃ सेवा न केÊयास रु.50,000 िंकवा शासन ठरवेल तेवढी रक्कम दंड Çहणून भरण्यास तयार

आहे.

4. सदर समावेशन हे एक वेळचे असून त्यानुसार मी पदÎथापना झालेÊया िठकाणी 15 िदवसांत रुजू न झाÊयास मला

समावेशनाचा अिधकार राहणार नाही.

5. माझे समावेशन झालेÊया िदनांकापूवीर् मी केलेÊया सेवेचे मला कोणतेही अनुषंिगक लाभ िमळणार नाहीत याची मला

पूणर् कÊपना आहे. त्यामुळे या बाबत शासनाकडे समावेशनापूवीर्चे अÎथायी सेवेतील कोणतेही लाभ पूवर्लक्षी Ģभावाने

िमळण्याची मी मागणी करणार नाही.

NOTIFICATION

CONSTITUTION OF INDIA.

No. SAS.2013/CR 797/SER-1.—In exercise of the powers conferred by the proviso to article 309

of Constitution of India, the Governor of Maharashtra is hereby pleased to make the following rules for

one time absorption of the Medical Officers appointed on ad-hoc basis on the post of Medical Officers,

Group B (B.A.M.S.) in the Maharashtra Medical and Health Services in the Directorate of Health

Services under the Public Health Department of the Government of Maharashtra, namely :-

1. These Rules may be called the Medical Officer, Group B (B.A.M.S.) in the Maharashtra

Medical and Health Services (One time Absorption of Medical Officers appointed on ad-hoc basis)

Rules, 2018.

2. In these rules, unless the context otherwise requires.–

(a) “ad-hoc Medical Officer” means a Medical Officer, who was appointed on ad-hoc basis on

the post of Medical Officer, Group B (B.A.M.S.), in the Maharashtra Medical and Health Services

under the Directorate and who is in the service, on the date of commencement of these rules ;

(b) “Directorate” means the Directorate of Health Services under Public Health Department of

Government ;

(d) “Post” means the post of Medical Officers, Group B (B.A.M.S.), in the Maharashtra

Medical and Health Services in the Directorate ;

(e) Words and expressions used in these rules but not defined shall have the same meaning

respectively assigned to them in the Medical Officer, Group-B in Maharashtra Medical and Health

Services (Recruitment) Rules, 2011.

3. (1) Subject to the provisions of these rules, every ad-hoc Medical Officer, Group B (B.A.M.S.)

among 738 ad-hoc Medical Officers, Group B (B.A.M.S.) who is in service on the date of

commencement of these rules shall, with effect from such date of commencement, be absorbed on the

post of Medical Officer, Group B (B.A.M.S.) in the Maharashtra Medical and Health Services under the

Directorate ;

Provided that, no such ad-hoc medical officer shall be absorbed on the said post-

(i) if he does not possess the minimum academic qualifications, specified in the

Medical Officer, Group B, in Maharashtra Medical and Health Services (Recruitment) Rules,

2011 or is otherwise disqualified for appointment on the post thereunder;

(ii) if any post reserved for the persons belonging to the Scheduled Castes, Scheduled

Tribes, De-notified Tribes (Vimukt Jatis), Nomadic Tribes, Special Backward Category or

Other Backward Classes to which he was appointed as ad-hoc Medical Officer, if he is found

that he is not belonging to such caste, tribe, category or class, as the case may be;

(iii) unless his confidential reports are satisfactory.

(2) The ad-hoc Medical Officers, who are absorbed under these rules, shall, after absorption,

work at least for a period of ten years from the date of their appointment orders, issued after

absorption under these rules, at first in tribal and rural areas. Such ad-hoc Medical Officers upon

absorption shall not be eligible to be deputed for higher studies for a period of six years from the date

of such appointment orders.

4. Notwithstanding anything contained in all other rules and orders regulating conditions of

service of Medical Officers, Group B (B.A.M.S.)-

(i) The initial basic pay of such ad-hoc Medical Officer upon absorption shall be fixed at the

minimum of the pay scale applicable to the post ;

(ii) As regards pension and other retirement benefits they shall be governed by the terms

and conditions as stipulated in the new Defined Contribution Pension Scheme of Government ;

(iii) the inter-se seniority of such ad-hoc Medical Officers upon absorption shall be fixed on

the basis of their date of initial appointments as ad-hoc medical officers ;

(iv) the service rendered by such ad-hoc Medical Officers prior to the date of absorption shall

not be considered for the purposes of pay, pension, leave and grant of promotion as a specialist

or on any other post under the Assured Career Progression Scheme.

5. Before making absorption ad-hoc Medical Officers, it shall be verified that there is no any

inquiry initiated or pending against him. However, the decision on the inquiry report shall be taken after

absorption and such decision shall be binding on the ad-hoc medical officer.

6. After absorption of the ad-hoc medical officer shall be posted in the health centres and

hospitals as per the priority specified below-

(i) the Primary Health Centres in Tribal areas,

(ii) the Primary Health Centres in non-tribal areas.

7. While making absorption, an undertaking in the Form appended to these rules from such ad-

hoc Medical Officers regarding the acceptance of terms and conditions laid down by the Government

in these rules shall be obtained. The ad-hoc Medical Officers to whom the said terms and conditions

are not acceptable, shall not be considered for absorption.

8. While making absorption of the ad-hoc Medical Officers if any backlog is noticed in particular

caste, tribes, category or class, the same shall be carried forward in future recruitments as per the

provisions of the Maharashtra State Public Services Reservation for Schedules Castes, Scheduled

Tribes, De-notified Tribes (Vimukt Jatis), Nomadic Tribes, Special Backward Category and Other

Backward Classes Act, 2001 (Mah.VIII of 2004) and the rules made thereunder.

9. The provisions of the Medical Officers, Group B in Maharashtra Medical and Health Services,

(Recruitment) Rules, 2011 and all other rules regulating the conditions of services of Government

Servants in so far as they are not inconsistent with the provisions of these rules, shall apply to such

ad-hoc medical officers absorbed under these rules.

Rs. _____________. I am consciously submitting this undertaking at my own will without influenced

by any external pressure, as required by Rule 7 of the Medical Officer, Group B (B.A.M.S.) in the

Maharashtra Medical and Health Services (One time Absorption of Medical Officers appointed on ad-

hoc basis) Rules, 2018.

2. I am fully aware that all the provisions, contained in the Medical Officer, Group B (B.A.M.S.) in

the Maharashtra Medical and Health Services (One time Absorption of Medical Officers appointed on

ad-hoc basis) Rules, 2018, are binding on me.

3. If I fail to do service for five years for Government, I shall pay Rs.50000 or any cost as fixed

by the Government.

4. I am fully aware that this is one time absorption and if I fail to join at the appointed place in the

15 days after the date of appointment order, I shall lose the right of absorption under the Medical

Officer, Group B (B.A.M.S.) in the Maharashtra Medical and Health Services (One time Absorption of

Medical Officers appointed on ad-hoc basis) Rules, 2018.

5. I am fully aware that I shall not get any consequential benefits of service I rendered on ad-hoc

basis prior to the absorption. Therefore I shall not demand any benefits retrospectively or otherwise of

service I rendered on ad-hoc basis prior to this absorption.
