NOTIFICATION

MAHARASHTRA ELECTRICITY DUTY ACT, 1958.

No. ELD. 2016/CR-9/NRG-1.—Whereas, by the Government Notification, Industries, Energy

and Labour Department, No. ELD. 2015/CR-21/NRG-1, dated the 13th April, 2015, issued in exercise

of the powers conferred by sub-section (1) of section 3 read with PARTS A, B, C, F and G of the

Schedule appended to the Maharashtra Electricity Duty Act (XL of 1958) (hereinafter referred to

as “the said Act”), the Government of Maharashtra has levied the electricity duty in respect of the

consumption of energy in the premises falling under PARTS mentioned in column (2) of the Table

appended to said notification, at the rates mentioned against each of the PART, in column (3) of

the said Table ;

Whereas, the Government of Maharashtra has, vide Government Resolution, Home

Department, No. Dhoran. 1015/C. R. 265/Ports-l, dated the 4th February, 2016, declared the Port

Development Policy, 2016 (hereinafter referred to as “the said Policy”) and under the said Policy,

exemption is given from the payment of electricity duty in respect of the consumption of the energy

by Greenfield Ports during their construction period and Shipyard Projects ;

And whereas, the Government of Maharashtra considers it necessary, in the public interest,

to exempt, the consumption of energy in respect of the class of premises used by the said Projects,

from the payment of whole of the electricity duty payable under PART F and PART G of the Schedule

appended to the said Act.

Now, therefore, in exercise of the powers conferred by section 5A of the Maharashtra

Electricity Duty Act (XL of 1958), the Government of Maharashtra hereby exempts the consumption

of energy in respect of the class of premises used by the Projects mentioned in column (2) of the

TABLE appended hereto, from the payment of whole of the electricity duty payable under PART

F and PART G of the Schedule appended to the said Act, for the period mentioned against each of

the said Projects in column (3) of the said Table.

MAHARASHTRA SLUM AREAS (IMPROVEMENT, CLEARANCE AND REDEVELOPMENT) ACT, 1971.

No. Busampa/2012/C.R. 357/Zopani-2.—Whereas, on representation from the Chief

Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, it appears to the Government

of Maharashtra that in order to enable the said Authority to implement the Slum Rehabilitation

Scheme in relation to the Slum Rehabilitation Area mentioned in the Schedule appended hereto

(hereinafter referred to as “the said Schedule”), it is necessary that the land specified in the said

Schedule (hereinafter referred to as “the said land”), should be acquired ;

And whereas, as required by the proviso to sub-section (1) of section 14 of Chapter V read

with paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the Maharashtra

Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 (Mah.XXVIII of 1971)

(hereinafter referred to as “the said Act”), the Chief Executive Officer, Slum Rehabilitation

Authority, Bandra, Mumbai, has, by his Notice No.SRA /Dy.Coll. /Land Acquisition /C.S.79/Hearing/

2013/1344, dated the 22nd October 2013 served in prescribed manner and also by notice published

by the Additional Collector (Encroachment or Removal), Western Suburban District in the Marathi

Daily Newspaper “Vrattamans” dated the 5th November 2009, and also by affixing in the

conspicuous part in the premises situated in the said land, as provided in section 36 of the said

Act, called upon the persons mentioned in column (6) of the said Schedule, who are the owners of

the said land or any other person interested therein to show cause, within fifteen days from the

date of its publication in the Newspapers, as to why the proposal to acquire the said land for

implementation of the Slum Rehabilitation Scheme for the concerned protected slum dwellers

should not be sent to the State Government for approval ;

And Whereas, the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai,

after considering the objections received in this behalf for the acquisition of the said lands, and

the pleading on behalf of the proposed Co-operative Housing Society of the Slum dwellers, entries

as to the rights in the land record, reservation in development plan and the legitimate request of

the protected slum dwellers, by his representation dated the 16th July 2014 submitted the report

for the acquisition of the said land;

And whereas, as required by the first proviso to sub-section (1) of section 14 of Chapter V

read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the said Act,

on representation from the Chief Executive Officer, Slum Rehabilitation Authority, Bandra,

Mumbai, and after considering his report it appears to the State Government that in order to

enable the Slum Rehabilitation Authority to carry out the development under the Slum

Rehabilitation Scheme in the slum rehabilitation area mentioned in the said Schedule, the said

land should be acquired;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 14 read with

paragraph (A) of sub-clause (i) of clause (c) of section 3D of the said Act, the Government of

Maharashtra hereby declares, by this notice, that it has decided to acquire the said land.

MAHARASHTRA VALUE ADDED TAX ACT, 2002.

No. VAT-1516/C.R. 62/Taxation-1.—In exercise of the powers conferred by sub-section (3D) of

section 8 of the Maharashtra Value Added Tax Act, 2002 (Mah.IX of 2005), the Government of

Maharashtra hereby exempts fully from payment of tax with effect from the 1st April 2016, the

transfer of property in goods, involved in the sizing and warping of yarn, subject to the following

conditions and restrictions :—

(1) The said goods shall be consumed or used in sizing and warping of yarn.

(2) The set off admissible to the dealer,—

(i) in respect of goods referred to at serial no. (1) and consumables and packing materials

used for the sizing and warping of yarn, shall be of tax in excess of the amount calculated at

the rate notified, from time to time by the Central Government for the purposes of sub-

section (1) of section 8 of the Central Sales Tax Act, 1956 (74 of 1956) on the said purchase

price;

(ii) in respect of capital assets used exclusively for the sizing and warping of yarn, shall

be as per rule 52 of the Maharashtra Value Added Tax Rules, 2005.
