UD-30:- Whereas, the Bhoom Municipal Council (Dist.
Osmanabad) (hereinafter referred to as “the said
Planning Authority”) being the Planning Authority within
its jurisdiction vide its Resolution No.l, dated 25 August
2014 declared its intention under section 23, read with
section 34 of the Maharashtra Regional & Town Planning
Act, 1966 (Maharashtra Act No. XXXVII of 1966)
(hereinafter referred to “the Said Act”) to prepare Draft
Development Plan of Bhoom (Additional Area) for the
area within the limits of the Bhoom Municipal Council
(hereinafter referred to as “the said Development Plan”)
and notice of such declaration was published in the
Maharashtra Government Gazette, Aurangabad Division
supplement dated the 4 September, 2014;
And whereas, the said Planning Authority after carry
out survey of the entire land within the jurisdiction of
the said Planning Authority as required under section 25
of the Said Act, published a notice in Official Gazette,
dated 30- 05 March/April, 2017 on page No. 16 to 17
for inviting objections or suggestions to the Draft
Development Plan of Bhoom, prepared by it under sub-
section (1) of Section 26 of the said Act.;
And whereas, after considering the suggestions and
objections received on the said Development Plan, the
Planning Committee, set up under section 28 (2) of the
said Act has submitted its report to the Planning authority;
And whereas, the said Planning Authority published
the said Development Plan so modified for information
of the public under sub-section (4) of Section 28 of the
said Act by a notice published in the Maharashtra
Government Gazette, Aurangabad Division supplement,
dated 8-14 February 2018 on page Nos. 3 to 5;
And whereas, in accordance with the provisions of
sub-section (1) of Section 30 of the said Act, the said
Planning Authority has submitted the said Development
Plan to the Government of Maharashtra for sanction
Vide its Marathi letter No.282, dated 20 February 2018;
And whereas, in accordance with sub-section (1) of
Section 31 of the said Act, after necessary enquiries
and after consulting the Director of Town Planning,
Maharashtra State, the State Government has sanctioned
a part of the said Development Plan with modifications
as specified in SCHEDULE-A vide notification No.
TPS-3418/1881/CR-176(A)/SM/2018/UD-UD-30,
date- 26 July, 2019 excluding proposals involving
substantion modifications as specified in

And whereas, the substantial modifications proposed
by the Government are excluded from the aforesaid
sanctioned plan and are shown on the plan verged in
Pink colour and marked as excluded part i.e. as EP-1,
EP-2, ——— etc; Now, therefore, in exercise of the
powers conferred under Section 31(1) of the said Act
and all other powers enabling it on that behalf, the
Government ofMaharashtra hereby:-
a) Gives notice inviting suggestions and objections
from any person in respect of the proposed substantial
modifications as specified in the SCHEDULE-B
appended hereto, within a period of 30 days from the
date of publication of this notice in the Official Gazette.
b) Appoints the Joint Director of Town Planning,
Aurangabad Division, Aurangabad as the “Officer” under
Section 31 (2) of the said Act, to hear all suggestions and
objections as stated in (a) above and to submit his report
thereupon to the Government for further necessary action.
02. Only the suggestions or objections regarding
substantial modifications mentioned in SCHEDULE-B,
that may be given to the Joint Director of Town Planning,
Aurangabad Division, Aurangabad, having his office on
following address :-

Division, Aurangabad shall consider suggestions or
objections regarding substantial modifications mentioned
in SCHEDULE-B which may be received within the
stipulated period of 30 days from the date of publication
of this notice in the Official Gazette.
03. Copy of the said notice along with SCHEDULE-
B and the plan showing the proposed substantial
modifications shall be made available for inspection to
general public at the following offices during office hours
on all working days.

30 :- Whereas, the Bhoom Municipal Conucil Dist.
Osmanabad (hereinafter referred to as “the said
Planning Authority” ) being the Planning Authority within
it’s jurisdiction vide its Resolution No. 1. dated 25
August 2014 declared its intention under section 23,
read with section 34 of the Maharashtra Regional &
Town Planning Act 1966 (Maharashtra Act no.
XXXVII of 1966) (hereinafter referred to“the Said
Act’) to prepare Draft Development plan of Bhoom
(Additional Area ) for the area within the limits of the
Bhoom .Municipal Council (hereinafter referred to as
“the said Development Plan’) and notice of such
declaration was published in the Maharashtra
Government Gazette Aurangabad Division supplement
dated the 4th September, 2014;
And whereas, the said Planning Authority after
carrying out survey of the entire land withinthe jurisdiction
of the said Planning Authority as required under section
25 of the said Act, published a notice in Official Gazette,
dated the 30th - 5th March/April, 2017 on page No. 16
to 17 for inviting objection or suggestions to the Draft
Development Plan of Bhoom prepared by it sub section
(1) of section 26 of the said Act;
And whereas, after considering the suggestions and
objections received on the said Development plan, the
Planning Committee, set up under section 28(2) of the
said Act has submitted its report to the said Planning
Authority;
And whereas, the said Planning Authority published
the said Development plan so modified for information
of the public under sub-section (4) of Section 28 of the
said Act by a notice published in the Maharashtra
Government Gazette. Aurangabad Division supplement,
dated 8-14 February, on page Nos. 3 to 5;
And whereas, in accordance with the provisions of
sub-section 30 of the said Act, the said Planning
Authority has submitted the said Development Plan to
the Government of Maharashtra for sanction Vide its
Marathi letter No.282, dated the 20th February, 2018;
And whereas, in accordance with sub-section (1)
of section 31 of the said Act, aher making necessary
enquiries and after consulting the Director of Town
Planning, Maharashtra State, the State Government has
decided to sanction part of the said Development Plan
with modifications shown in SCHEDULE-A ( as SM-
1, SM-2]—etc.) excluding the substantial modification
shown in SCHEDULE-B ( as EP-1. EP-2—etc,)
appended with Notice No. TPS-3418/1881/

Now therefore, in exercise of the powers conferred
by sub-section (1) of Section 31 of the Said Act and of
all other powers enabling it on that behalf, the
Government of Maharashtra hereby:-
A. Extends the period prescribed under Section 31
(1) of the said Act, for sanctioning the said Development

plan from date 20 August, 2018 up to the inclusive of
the date of this Notification.
B. Sanctions the said draft Development plan for
Bhoom Municipal Council along with modifications as
specified in Schedule of Modifications namely
SCHEDULE-A appended hereto, excluding the
proposals under substantial modifications as specified
in SCHEDULE-B appended with Notice No. TPS-
3418/1881/C.R.176(B)/EP PUBLISH/2018/UD-30,
dafc-26 July , 2019;
C. The date after 30 days of publication of this
Notification in the official Gazette will be the date on
which the Said Sanctioned Development plan (partly),
called the Final Development Plan of Bhoom (Additional
Area) Municipal Council shall come into force.
01. The aforesaid Part Final Development Plan of
Bhoom (Additional Area) sanctioned by the State
Government shall be kept open for inspection by the
public during office hours on all working days for a
period of one year from the date of coming into force
of this Notification, in the office of the Bhoom Municipal
Council, Dist. Osmanabad .
02. The reservations / allocations / designations which
do not appear in the Schedule-A and Schedule-B
appended hereto, are hereby sanctioned for the respective
purposes as designated in the Development Plan.
03. Areas of reserved sites mentioned in the report
of the Development Plan are approximate and subject
to actual measurement on site as per boundaries shown
on the Final Development plan.
04. On cease of Existing public Semi Public use
shown in the Development Plan on the private lands /
rented premises or the Public Semi Public zone which
had been shown inadvertently due to draftsman error,
the use as per adjoining major land use zone shall be
permitted with prior approval of Divisional Joint
Director of Town Planning,
05. Draftsman’s errors which are required to be
corrected as per actual situation on site or as per survey
records, sanctioned layout, etc. shall be corrected by
the Chief officer , Bhoom Municipal Council, Dist.
Osmanabad after due verification and with prior
approval of the Director of Town Planning,
Maharashtra State, Pune.
06. Those open spaces from sanctioned layouts that
are earmarked as existing open spaces (in Green color )
on Development plan are subject to changes if respective
layouts are revised. Tf the layout is revised and if open
space is shown elsewhere in Residential Zone, then the
existing open space in the layout as shown on the
Development Plan be treated as Residential Zone.
07. Reservation lapsed under 127 of the Act - if any
reservation in the earlier sanctioned Development is
lapsed in pursuance, of-notice under Section 127 of
the MRTP Act, 1966 or as directed by the Hon’ble
high Court / Supreme Court in respect of such notice,
then the corresponding reservation shall stand lapsed
in the revised Development plan to the extent of area
covered in the said notice.
08. The Standardized Development Control and
Promotion Regulations for A class, B class and C class
Municipal Council of the Maharashtra State as
sanctioned by the Government vide Notification
No.TPS-1812/157/CR-71/2013/Reconstruction/
3442/DP/UD-13 dated 21/11/2013 and as amended
from time to time shall be applicable to the said
Development Plan.
This Notification shall also be made available on
Govt. website www.maharashtra.gov.in (Acts/rules)

NOTIFICATION
The Maharashtra Resional & Town Plannins Act,
1966 :
No.TPS-3019/685/CR-84/2019/UD-30:-Whereas,
the Government of Maharashtra vide Notification No.
TPS- 3087/22/CR-1/PART-II/UD-12, dated 7th
October, 1991 in exercise of the powers conferred by
section 40 of the Maharashtra Regional & Town
Planning Act, 1966 (hereinafter referred to as the “said
Act”) and all other powers enabling it in this behalf,
appointed City & Industrial Development Corporation
(CIDCO) as Special Planning Authority (hereinafter
referred to as “the said Planning Authority” for Waluj
Notified Area (hereinafter referred to as “the said
Notified Area”);
And whereas, the Development Plan of said Notified
Area has been sanctioned partly by the Government
under section 31 of the said Act, vide Notification No.
TPS- 3000/4484/CR-235 (A)/2000/UD-30, Dated 14th
August, 2001 (Excluding Development Control Rules)
and has come into force with effect from the 1st October,
2001. The remaining part of the Development Plan has
been sanctioned by the Government vide Notification
No. TPS- 3001/1498/CR-288 (A) 2001/UD-30, dated
23rd July, 2002 and has come into force with effect
from 16th September, 2002 (hereinafter referred to as
“the said Development Plan);
And whereas, in the said Development Plan, the land
admeasuring area 0.38 Hect, 0.565 Hect. and 0.65 Hect.
of Gut No.l-8(part) , 19 (part) and 20 (part) respectively
of Mouja Golwadi, (hereinafter referred to as “the said
land”), are the part of Reservations “Site. No. 4/109 -
Play Ground “ and “ Site No.4/110- Primary and
Secondary school “ as specified in the Schedule
(hereinafter referred to as the said Reservations);
And whereas, the said land has not been acquired by
the said Planning Authority within ten years from the
date on which the said Development Plan came into
force; And whereas, the owners of the said land had
issued a notices dated 26.12.2016 under sub-section (1)
of section 127 of the said Act to the said Planning
Authority, being the Appropriate Authority, informing that
the said land has not been acquired by the said Planning
Authority, within the stipulated period;
And whereas even after service of the said notice as
aforesaid, the said land has not been acquired within a
neriod of twenty four months from the date of the service
of such notice
And whereas, said owner has requested the
Government to issue notification to the effect that the
said reservations on the said land under the provisions
of section 127 (2) of the said Act. Since, the Appropriate
Authority has not acquired the said land within two year,
from the date of notice served under section 127, the
said reservations on the said land have lapsed as per
provisions of section 127 of the said Act;
And whereas as required under sub- section (2) of
section 127 of the said Act, it is necessary to issue an
order that the reservations of the said land have lapsed;
Now, therefore, in exercise of the powers conferred
by sub-sections (2) of section 127 of the said Act and of
all other powers enabling it in that behalf, the Government
of Maharashtra hereby notifies that part of the
reservations “Site. No. 4/109 - Play Ground “ and “ Site
No.4/110- Primary and Secondary school “ to the extent
of the said land, as specified in the schedule hereunder,
stands lapsed and the said land shall be available to the
owner for the purpose of development as otherwise
permissible in the case of adjacent land under the said
Development Plan.
A copy of the part plan snowing the detail of area
under reservations which have lapsed vide this order is
available in the office of the Chief Administrator, New
Town, CIDCO Aurangabad during office hours on all
working days for inspection of public for one month.

The Maharashtra Regional and Town Planning
Act, 1966
No. TPS-3416/66/C.R.57/2016/UD-30 : Whereas the Second
Revised Development Plan of Tulajapur Town Dist.-
Osmanabad has been partly sanctioned by the Government
under section 31 of the Maharashtra Regional and Town
Planning Act, 1966 (Maharashtra Act No, XXXVII of 1966)
(hereinafter referred to as “the said Act”) vide Notification
No. TPS 3410/295/CR-126(A)/2010/UD-30, dated 14th October,
2010 and has come into force with effect from the llth
November, 2010 and the modifications of substantial nature,
pertaining to the Excluded part of the Development Plan have
also been sanctioned vide Notification No. TPS-3413/CR-
298/2013/UD-30, dated 11th September, 2014 and the same
have come into force with effect from the dated 11th October,
2014. (hereinafter referred to as “the said development Plan”);
And whereas, in the said Development Plan, 12.00 M wide
D.P. Road is shown from Dr. Babasaheb Ambedkar Statue to
Kamanves Dulya Maroti Mandir (hereinafter referred to as
“the said Development Plan Road “);
And whereas, Tulajapur Municipal Council vide its General
Body Resolution No. 638 dated. 10 November, 2014 resolved
to modify the said 12.00 M wide sanctioned D.P. Road by
proposing equal 6.00 M width from Centre of existing
road on both sides as 12.00 M wide D. P. Road (hereinafter
referred to as “the proposed Modification”) by following all
the legal formalities stipulated under section 37(1) of the said
Act and submitted the proposal to the Government vide letter
dated 16 December, 2015 for sanction;
And whereas, after making necessary enquiries and
consulting the Director of Town Planning, Maharashtra State,
the Government is of opinion that the Proposed Modification

Now, therefore in exercise of the powers conferred on it
under subsection (2) of section 37 of the said Act, the
Government ofMaharashtra hereby sanctions the said
proposed modification with following condition and for that
purpose amends the above said notification dated the 14th
October, 2010 as follows :-
“In the Schedule of modification appended to the
notification sanctioning the said Development Plan, the
following new entry shall be added after the last entry-
ENTRY
“The 12.00 M wide sanctioned Development Plan. Road
passing from Dr. Babasaheb Ambedkar Statue to Kamanves
Dulya Maroti Mandir is modified by proposing equal 6.00 M
width from Centre of existing road on both sides as 12.00 M
wide D. P. Road as shown on plan.”
Condition :- It will be binding on the Municipal Council to
collect Premium from concerned land owner, whose lands are
now included in the Developable Zone due to the change in
alignment of the Said Road.
This notification shall also be available on the Government
“website www.maharashtra.gov.in (Acts & Rules).

The Maharashtra Regional & Town Planning Act, 1966.
No. TPS- 3115/284/CR-248/2015/UD-30:- Whereas, the
Development Plan of Basmathnagar (Revised), Dist- Hingoli
has been sanctioned by the Government vide Urban
Development Department Notification No. TPS-3199/ 513/
C.R.81/99/ UD-30, Dated 24th February, 2000 and has come
into force with effect from the 30th June,2000. (hereinafter
referred to as “the said Development plan”),
And whereas, in the said Development Plan, the land
admeasuring 5.04 Hectors bearing Survey No 160(Pt)
ofMouje Basmath, Dist- Hingoli, (hereinafter referred to as
“the said land “) is included Agricultural Zone;
And whereas, the Basmatnagar Municipal Council, after
following all the legal formalities stipulated under section
37(1) of the Maharashtra Regional and Town Planning Act,
1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter
referred to as “the said Act”) has submitted to the Government
for its sanction a proposal for modification of the said
Development Plan, to delete the said land from Agricultural
Zone and include the same in Residential Zone (hereinafter
referred to as “the proposed Modification “);
And whereas, after making necessary enquiries and
consulting the Director of Town Planning, Maharashtra State,
Pune, the Government is of opinion that the proposedc
Modification should be sanctioned on certain conditions;
And whereas, the Land Owners of the said land has
deposited Rs.27,72,000/- towards the 50% Government share
of 5% premium amount as per the rate of the said land as
prescribed in the Annual Statement of Rates (ASR) for the
year 2019-20, in the Government Treasury vide chalan
dt.02.08.2019 through the Assistant Director of Town Planner,
Hingoli and the remaining 50% of the 5% premium amount of
Rs.27,72,000/- has been deposited with the Municipal Council,
Basmat;
Now, therefore, in exercise of the powers conferred on it
under sub-section (2) of section 37 of the said Act, the
Government of Maharashtra hereby sanctions the proposed
Modification in the said Development Plan and for that
purpose amends the above said Notification dated the 24th
February, 2000 as follows:-

Modifications appended to the Notification sanctioning the
said Development Plan, the/allowing new entry shall be added
after the last entry-

“The land bearing Survey No I60(Pt) admeasuring 5.04
Hector of Mouje Basmath, Dist. Hingoli, is deleted from
Agricultural Zone and included in Residential Zone, as shown
on Plan, subject to the following conditions :-
Condition No. 1 : Chief Officer, Municipal Council shall be
verify necessary ApproachRoad for the said land under
modification.
Condition No. 2 : In the layout of the said land under
modification, 10% area shall be kept as Amenity Space, with
the 10 % compulsory Open Space of the total area.lt shall be
compulsory to develop such Amenity Space within 3 years
by the Land Owner/Developer.
Condition No. 3 :
In the layout of the said land under
modification, land under 30 Mtr. wide Development Plan Road
shall be compulsorily handed over to the Municipal Council
against FSI/TDR by the land owner.

the occupancy certificate shall not be given unless basic

In case of non- compliance, Layout Approval and Non-
Agricultural permission shall be liable to be cancelled.
A copy of the part plan showing the aforesaid sanctioned
modification shall be available in the office of the Chief Officer,
Municipal Council, Basmathnagar, during office hours on all
working days for inspection of public for a period of one
month.
This Notification shall also be available on the Govt.
website www.maharashtra.gov.in
