ORDER

MAHARASHTRA STAMP ACT.

No.Mudrank.2018/1680/C.R.No.156/M-1 (Dhoran).—Whereas, in order to promote the process of

re-development of old buildings or chawls belonging to the Municipal Corporation of Brihan Mumbai

(hereinafter referred to as “the MCGM”), under regulation 33(7) or 33(9) of the Development Control

Regulations for Brihan Mumbai, the Government of Maharashtra, in the public interest, had decided to

reduce the stamp duty to Rs.1000/-(Rupees One Thousand only), as otherwise chargeable under

clause (g-a) of article 5 of Schedule-I appended to the Maharashtra Stamp Act (LX of 1958),

(hereinafter referred to as “the said Act”), on the instrument of Tripartite Agreement in respect of

re-development of the old buildings or chawls owned by MCGM ;

And whereas, accordingly, in exercise of the powers conferred by clause (a) of section 9 of the

said Act, the Government of Maharashtra, being satisfied that it was necessary to do so in the public

interest, had vide Government Order, Revenue and Forests Department, No. Mudrank.

2018/1680/C.R.No.156/M-1(Dhoran), dated the 20th June 2019 (hereinafter referred to as “the said

Order”), reduced and fixed the stamp duty to Rupees 1000/-(Rupees One Thousand only), as

otherwise chargeable under clause (g-a) of article 5 of Schedule-I appended to the said Act, on the

Tripartite Agreement, executed or being executed in between “the Registered Co-operative Housing

Society of occupants of the MCGM owned old buildings or chawls (hereinafter referred to as “the

Registered CHS”), the developer appointed by the said Registered CHS and the MCGM”, subject to

fulfilment of the conditions specified therein ;

And whereas, a request has been made to amend the said Order for fixing the stamp duty as

Rs.1000/- on the Bipartite Agreement, executed or being executed in between “the developer and the

MCGM”, in respect of re-development of the MCGM owned old buildings or chawls under regulation

33(7) or 33(9) of the Development Control Regulations for Brihan Mumbai ;

NOW, THEREFORE, in exercise of the powers conferred by clause (a) of section 9 of the said

Act, the Government of Maharashtra hereby amends the said Order, as follows, namely :—

In the said Order,—

(a) in the first paragraph of the preamble, for the word, “Tripartite”, the words, “Tripartite or

Bipartite”, shall be Substituted;

re-development of the MCGM owned old buildings or chawls by the said Registered CHS or the

MCGM under regulation 33(7) or 33(9) of the Development Control Regulations of Brihan

Mumbai”, shall be inserted ;

(c) in Condition (2), for the word, “Tripartite”, the words, “Tripartite or Bipartite”, shall be

Substituted ;

(d) in Condition (6), for the word, “Tripartite”, the words, “Tripartite or Bipartite”, shall be

Substituted ;

(e) in Condition (7), for the word, “Tripartite”, the words, “Tripartite or Bipartite”, shall be

Substituted ;

(f)

in Condition (8), for the word, “Tripartite”, the words, “Tripartite or Bipartite”, shall be

Substituted ;

(g) after Condition (8) the following new Conditions shall be added, namely :—

“(9) The Bipartite Agreement should have been executed or should be executed in

between the MCGM and the developer appointed for the re-development of the MCGM

owned old buildings or chawls by the said Registered CHS or the MCGM under regulation

33(7) or 33(9) of the Development Control Regulations of Brihan Mumbai.

(10) Unstamped instruments which are executed on plain papers shall not be eligible

for any benefit under this order; except for the instruments executed by the MCGM.”
