Registration Act, 1908

No.RGN2019/UOR.50/C.R.No.780/M-1(Policy).- Whereas, the Government of Maharashtra

has, vide Government Resolution, Public Works Department, No.PPP-2016/C.R.467/Roads-8,

dated the 19^th August 2016, declared the Maharashtra State Road Development Corporation

Limited. (hereinafter referred to as “ the said Highway Authority”) as the Implementing Agency

for the “Nagpur-Mumbai Super- Communication Expressway”;

And whereas, the Government of Maharashtra has, vide Government Resolution, Public

Works Department, No.PPP-2016/C.R.251/Roads-8, dated the 24^th March 2017, nomenclatured

the “Nagpur-Mumbai Super-Communication Expressway” as the “Maharashtra Samruddhi

Mahamarg”;

And whereas, the Government of Maharashtra has, decided to exempt the Registration

fees payable on the instruments related to financial agreements or documents , executed or being

executed between, “the said Highway Authority, the NAGPUR-MUMBAI SUPER

COMMUNICATION EXPRESSWAY LIMITED (hereinafter referred to as “the said

Expressway Ltd”) and the Financial Institutions” in respect of the Maharashtra Samruddhi

Mahamarg;

Now, therefore, in exercise of the powers conferred by clause (a) of section 78 of the

Registration Act, 1908 (XVI of 1908) (hereinafter referred to as “the said Act”), in its

application of the State of Maharashtra, and of all other powers enabling it in this behalf, the

Government of Maharashtra hereby amends the Table of Fees prepared under section 78 and

published

under Government Notification,

Revenue and Forests Department, No.

RGN.1558/67731-N, dated the 17^th July 1961 (hereinafter referred to as “the said Notification”)

as required by section 79 of the said Act, as follows;-

In the said Notification in the Table of Fees in Article-I, after Note 67 the following shall be

added, namely:-

“Note 68 :- No Registration fees shall be chargeable on the instruments related to financial

agreements or documents as specified in column (2) of the Appendixhereto and any other

financial agreements or documents executed or being executed between the Highway

Authority, the said Expressway Ltd. and the Financial Institutions in respectof the Maharashtra

Samruddhi Mahamarg, subject to the condition that in case of breach of any of the conditions

specified by the Government, vide the Government Orders or Resolutions or Notifications

issued, from time to time, for the “Maharashtra Samruddhi Mahamarg”, the said Expressway

Ltd. shall be liable to pay the whole of the registration fee and penalty, if any.

Maharashtra Samruddhi Mahamarg;

Now, therefore, in exercise of the powers conferred by clause (a) of section 9 of

the Maharashtra Stamp Act (LX of 1958), the Government of Maharashtra, being

satisfied that it is necessary to do so in the public interest, hereby remits the stamp duty

in whole chargeable on the instruments related to financial agreements or documents as

specified in column (2) of the Appendix hereto and any other financial agreements or

documents executed or being executed between the Highway Authority, the said

Expressway Ltd. and the Financial Institutions in respect of the Maharashtra

Samruddhi Mahamarg, subject to the condition that in case of breach of any of the

conditions specified by the Government, vide the Government Orders or Resolutions or

Notification issued, from time to time, for the “Maharashtra Samruddhi Mahamarg”,

the said Expressway Ltd. shall be liable to pay the whole of the stamp duty and

penalty, if any.
