ORDER

No. D.T.P.-1132-3019-DP-Wardha (Revised) Site No.9-Sec 50 -TPV-2-5504.—

Whereas, the Development Plan of Wardha (Revised) has been sanctioned under section 31(1) of Maharashtra

Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act”) by the Government in Urban Develop-

ment Department vide its Notification No. TPS-2601-1380-CR 60(C)-2002-UD-9, dated 9-1-2004 and came into force

w.e.f. dated 25-2-2004 (hereinafter referred to as "the said Development Plan") and the Wardha Municipal Council,

Wardha is Planning Authority for said Development Plan(hereinafter referrd to as "the said Planning Authority");

And whereas, in the said Development Plan, Site No. 9 is reserved for "Police Station" having area 0.48 Hectare.

(hereinafter referred to as "the said reservation") and "Police Department" has been proposed as the Appropriate

Authority for the said reservation (hereinafter referred to as "the said Appropriate Authority"). The land bearing S.No. 37

(Old S.No. 19) admeasuring area 0.73 Hectare of village. Chinchala (hereinafter referred to as "the said land" is)

included under the said reservation;

And whereas, the land owner Shri. Pradeep Tukaramji Talmale has given a application to the State Government on

27-4-2014 to delete the Reservation of the said land, the said Appropriate Authority vide its letter dated 30-8-2014

communicated to the land owner that the said land is no longer required for the said purpose;

And whereas, the said Planning Authority has submitted to the Directorate of Town Planning vide letter No. 2494,

dated 6-12-2014 through the Town Planner, Wardha, the proposal u/s 50 of the said act for deletion of said reservation

on the said land; and the Superintendent of Police, Wardha vide their Letter No. 3161, dated 15-5-2018 has submitted

their Report to the State Govt. that the said land is no longer required to the Police Department in future too, for the

purpose of Police Station;

And whereas, the Deputy Superintendent of Land Records, Wardha, vide their Letter No. 9907, dated 25-8-2018

communicated to the applicant that the lands under reservation mentioned in the list of reservation sheet No. 6/b, 87

and S.No. 8 in the Development Plan Report i.e. the land under is the new S.No. 37 (Old S.No. 19) as per the new

records and therefore it is now clear from land record department that the said land is reserved for Site No. 9.;

And whereas, meeting was held on dated 23-1-2019 in the Directorate for further enquiry and confirmation; the

land owner requested to delete the reservation on said land u/s 50 as per the Provisions of M.R. & T.P Ac, 1966. As

Appropriate Authority and Planning Authority was not present, report of Appropriate Authority was once again

called vide letter No. 1022, dated 25-2-2019 and Appropriate Authority i.e. Superintendent of Police, Wardha vide letter

No. 1675 dated 2-3-2019 communicated to Directorate that, the said land is no longer required for the purpose of Police

Station in future too, to the Police Department;

And whereas, as per the request of Planning Authority and Appropriate Authority and after making necessary

enquiry it is now clear that, the land under the said reservatiion is no longer required to Police Department, Wardha,

hence the Director of Town Planning, Maharashtra State, Pune is of the opinion that the said proposal of deletion of said

reservation should be sanctioned;

And whereas, the Town Planner, Wardha Branch vide their letter No. 1446, dated 5-8-2019 and communicated

that as per the Government directives dated 20-4-2016, for the said reservation the land owner Shri. Pradeep Tukaramji

Talmale have deposited Rs. 11,40,000/- towards the 50% Government share of 5% premium amount of land value for an

area 0.48 Hectare, as per the rate prescribed in the Annual Statement of Rates (ASR) for the year 2019 in the

Government Treasury on 22-7-2019 through the Town Planner, Wardha Branch and remaining 50% of the 5% premium

amount Rs. 11,40,000/- payable to the Planning Authority, has been deposited;

And whereas, the Government in Urban Development Department, vide Resolution No. TPS-1813-3211-CR-508-

UD-13, dated 1-12-2016 has delegated the powers exercisable by it under Section 50(2) of the said Act to the Director

of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Council/Nagar Panchayat

and for the Development Plans undertaken by Zilla Parishad as a Planning Authority.

Now, therefore, the Director of Town Planning, Maharashtra State, Pune hereby sanctions the deletion the said

reservation in respect of the said land u/s 50(2) of the said Act and for that purpose amends the notification of the said

Development Plan, sanctioned dated 9-1-2004 as follows :–

After the last entry in the Schedule of Modifications accompanying the notification of the said sanctioned

Developement Plan, the following new entry shall be added :–

Whereas, in exercise of the powers conferred by sub-section (1) of section 15 of the Maharashtra Regional and

Town Planning Act, 1966 (hereinafter referred to as "the said Act") and rule 7 of the Maharashtra Regional Planning

Board Rules, 1967 (hereinafter referred to as "the said Rules") and all other powers enabling it in that behalf, the

Government of Maharashtra has sanctioned final Regional Plan of Wardha Region vide Notification No. TPS-1816-994-

CR-516-16-UD-13, dated 1st January 2018 (hereinafter referred to as "the said Notification");

And whereas, as per modification No. M-22 of the said Notification (hereinafter referred to as "the said Modifica-

tion") the Designated ad proposed Growth Centres and the proposed Peripheral Areas are mention in the Regional Plan

report for which the detail planning proposals are to be prepared is sanctioned as submitted by the respective Regional

Planning Board;

And whereas, as per the said modification of the said Notification, the detail planning proposals for the above

proposed Growth Centres and Peripheral Areas are to be prepared, publised and submitted to the Director of Town

Planning, Maharashtra State, Pune by the Regional Planning Board under the provisions of Maharashtra Rigional and

Town Planning Act, 1966 for final sanction;

And whereas, in the said sanctioned Wardha Regional Plan five designated Growth Centres i.e. Anji, Alipur,

Pavnar, Waygoan, Talegoan Growth Centres and four designated Peripheral Areas, i.e. Wardha, Hinganghat, Arvi,

Pulgoan Peripheral Areas are sanctioned; (hereinafter referred to as "the said Growth Centres & Peripheral Plan");

And whereas, the Regional Planning Board for the Wardha Region after carrying out the necessary surveys and

preparing the existing-land-use Map of the Growth Centres and Peripheral Areas, published a Draft Plan of the said

Growth Centres and Peripharal Areas in accordance with provisions of sub-section (1) of Section 16 of the said Act, and

a notice to that effect was publised in the Extra Ordinary Maharashtra Government Gazette Nagpur Divisional

Supplement dated 11-04-2018 for inviting objections and suggetions from the general public;

And whereas, the Regional Planning Board for the Wardha Region after considering the report of the Regional

Planning Committee apointed by it under sub-senction (3) of Section 10 of the said Act, for the proposed of hearing any

suggetions and objections received in respect of the Draft Growth Centres and Peripheral Areas Plan, modified the said

Draft Plan in accordance with the provisions of Section 16 of the said Act and submitted such modified Draft Plan

together with the report of the Regional Planning Committee and connected documents, Plans, Maps Charts and

Report for approval to the Director of Town Planning, Maharashtra State, Pune under sub-section (1) of Section 15 and

sub-section (4) of Section 16 of the said Act Region Vide Letter No. 2039, Dated 22-11-2018;

And whereas, the powers in respect of sanctions to the said Growth Centres and Peripheral Plans under Section

15(1) and 15(2) of the said Act are delegated to Director of Town Planning, Maharashtra State, Pune vide Government

Notification No.TPS-1816/994/CR-516/16/Delegation of Powers/UD-13, dated 01-01-2018;

SM-59- Other Modification

(i) The Schedule B of the Government Notification No. TPS-1816-994-CR-516-16-UD-13, dated 1-1-2018 sanction-

ing the said final Regional Plan along with modification sanctioned thereafter will be applicable to the Growth Centre and

Peripheral Plans mutatis-multandis except Modification No. M7 (d).

(ii) Residential Zone is sanctioned as Residential Zone with payment of premium - The residential and other

development as per sanctioned DCPR vide notification dated 21-11-2013 as amended from time to time for Residential

Zone shall be permissible in this zone.

Development permission, in this zone shall be granted on payment of premium of the total area of land under

development permission. Such premium shall be calculated considering 15% rate of the said land as prescribed in the

Annual Statement of Rates of the year granting such development permission (without considering the guidelines

therein). Such premium shall be deposited in the concerned Authority/Branch Office of the Town Planning Department

for crediting the same into the Government Treasury. Such premium charges shall be recovered at the time of tentative

approval of the development permission However, such premium may be modified by Government of Director of Town

Planning as and when required :

Provided that while granting development permission, where more than 50% of area of the Survey Number/Gat

Number is covered within the proposed Residential Zone then the remaining whole of such Survey Number/Gat Number

situated in Agricultural/N.D. Zone within one ownership shall be considered for development on payment of premium as

above :

Provided also that for the areas which are converted into Municipal Councils/Nagar Panchayats within the

Regional Plan (under the provision of Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act,

1965), such premium shall be calculated considering 5% rate of the said land as prescribed in the Annual Statement of

Rates of the year while granting such residential development (without considering the guidelines therein). Out of this

premium, 50% premium shall be deposited with the concerned Planning Authority and remaining 50% shall be

deposited in the local branch office of Town Planning.

(iii) The width of classified Road shall be considered while granting development permission as mention in

Modification No. M-11 of Notification No. TPS-1816/994/CR-516/16/UD-13, dated 01-01-2018 whether shown on said

Growth centre and Peripheral Plans or not.

All the proposed width of roads mentioned in Modification No. 11 shall be

earmarked on Growth Centre and Peripheral Plans, if not already earmarked.

(iv) All village/shiv roads whether shown or not shown on the Plan are widen to 15.00 mtr. equally on both sides

from centre line of the existing road.

(v) The proposed Regional Plan roads and proposed roads in this plan shall be handed over free from all encum-

brances to the satisfaction of Authority or Collector in lieu of FSI thereof, at the time of development permission/layout

u/s 18 of MRTP Act, 1966. Such 100% FSI on land so surrender to the Authority/Collector may be utilised on remaining

plot either on prorate basis on all plots or on certain plot on which landowner desires.

(vi) At the time implementation if the alignment of classified road varies from the alignment shown on the Growth

Centre and Peripheral Plans, then alignment as modified shall prevail and the alignment on the Growth Centre and

Peripheral Plans shall be treated as stand modified to that effect. The area release due to such deviation shall be

considered as included in adjoining zone.

(vii) All existing roads which are shown or not on the said Growth Centre and Peripheral Plan, shall be treate as an

existing road.

(viii) If any non-confirming use existing prior to date of notification because of the activity existed there-on, such

lands shall be deemed to have been shown in the adjoining Predominant Zone after such activity ceases to exist and

thereupon, the development shall be permissible as per the adjoining Predominant Zone.

(ix) The layout alredy approved/development permission already granted in NDZ/Agricultural Zone and which are

valid as per the provisions of DCPR shall be entitled for development subject to use and FSI as per earlier permission.

However, there is no bar to take revised permission under these regulations.

Now, therefore, in exercise of the powers conferred by sub-Section (1) of section 15 of the said Act and Rule 7 of

the Maharashtra Regional Planning Board Rules, 1967 (hereinafter referred to as "the said Rules") and all other powers

enabling it in that behalf, the Director of Town Planning, Maharashtra State, Pune hereby;

(a) Accord sanctions to the said draft Growth Centre and Peripheral Plans for the said Wardha Region as submitted

with certain Modifications as specified in Annexure–A appended hereto. This shall be a part of final Regional Plan

of Wardha Region.

(b) Fixes the date after 60 days from the publication of this Notification in the Maharashtra Government Gazette to be

the date on which the said Notification shall come into force.

This Notification shall also be published on the webside of Directorate of Town Planning www.dtp.maharashtra.gov.in

Whereas, the Government in Urban Development Department vide its Notification No. TPS-2299-1001-CR-111-

UD-9, dated 28-06-2002 has Partly Sanctioned he Revised Development Plan of Brahmapuri (hereinafter referred to as

the "said Development Plan") under Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966

(Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has come into force with effect from date

26-08-2002;

And whereas, in the said Development Plan, the land admeasuring 1.01 Hectare, from S.No. 76 of Mouje

Dhelhanwadi, is reserved for "Site No. 56 - High School" (hereinafter referred to as "the said Reservation"); for which

Appropriate Authority is Brahmapuri Municipal Council (hereinafter referred to as "the said Appropriate Authority");

And whereas, the land under said Reservation has not acquired by the said Appropriate Authority within ten years

from the date of the said Development Plan came into force;

And whereas, the owner of S. No. 76 (hereinafter referred to as "the said Land") had served a Notice under Section

127(1) of the said Act, on the said Appropriate Authority, vide their letter dated 11-01-2013;

And whereas, from the reports submitted by Municipal Council, Brahmapuri on date 08-05-2019 and Town Plan-

ner, Chandrapur Branch Office vide Letter No. 1155 on date 07-06-2019 and the Joint Director of Town Planning, Nagpur

Division, Nagpur vide Letter No. 1387 on date 23-09-2019, it is clear that, the said Appropriate Authority, has not

acquired or no steps as contemplated in the Section 127(1) of the said Act, has commenced for its acquisition within

the period of twelve months from the receipt of the aforesaid notice;

And whereas, in accordance with the provision of Section 127(1) of the said Act, the part of the said Reservation,

pertaining to the said land, has lapsed and it is a accordingly expedient to notify such lapsing under Section 127(2) of

the said Act;

And whereas, the Government in Urban Development Department, under Section 151 of the said Act, vide Reso-

lution No. TPS-1813-3211-CR-508-UD-13, dated 1-12-2016 has delegated the powers exercisable by it under Section

127(2) of the said Act in respect of Development Plants of all Municipal Councils/Nagar Panchayats and for the Devel-

opment Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra

State, Pune.

Now, therefore, in exercise of the powers delegated by the Government, in respect of sub-section (2) of Section

127 of the said Act and of all other powers enabling it in that behalf, the Director of Town Planning, Maharashtra State,

Pune hereby notifies that the said Reservation of "Site No. 56 - High School" is lapsed in respect of said Land (as

specified in the schedule herein below) and the said land shall become available to the land owners for the purpose of

development as otherwise, permissible in the case of adjacent land, under the said Development Plan.
