Ďमांक आयसीई-०२२०/Ģ.Ď.18/ कामगार-६.—कामगार भरपाई अिधिनयम, १९२३ (१९२३ चा ८), महाराÍĘ रा¶यास लागू

असताना, ¾या´या कलम २ ´या पोट-कलम (३) ´या तरतुदȒअनुसार, महाराÍĘ शासन, याǎारे,उ¯त अिधिनयमास जोडलेÊया

अनुसूची-दोनमÁये सुधारणा कर½यासाठी अिधसूचना काढ½याचा शासनाचा उLjेश घोिषत करीत असून, ¾याचे Ģाǘप यासोबत

जोडलेले आहे; आिण याǎारे अशी नोटीस दे½यात येत आहे की, महाराÍĘ शासन राजपĝामÁये ही नोटीस Ģिसlj झाÊया´या

िदनांकापासून तीन मिहÂयांचा कालावधी समाÃत झाÊयानंतर, उ¯त Ģाǘप, शासनाकडून िवचारात घे½यात येईल.

2. उ¯त Ģाǘपा´या बाबतीत, उपरो¯त तीन मिहÂयां´या कालावधीत, महाराÍĘ शासनाचे Ģधान सिचव (कामगार), उǏोग,

ऊजɕ व कामगार िवभाग, मादाम कामा माग«, हुता¾मा राजगुǘ चौक, मंĝालय, मुंबई ४०० ०३२ यां´याकडे जे कोणतेही आ©ेप व

सूचना ĢाÃत होतील ¾या शासनाकडून िवचारात घे½यात येतील.

आिण ¶याअथȓ, उ¯त तीन मिहÂयां´या कालावधीत, उ¯त ĢÎतावा´या बाबतीत, शासनाकडे कोणतेही आ©ेप व सूचना

ĢाÃत झालेÊया नाहीत;

आिण ¶याअथȓ, महाराÍĘ दुकाने व आÎथापना (नोकरीचे व सेवाशतȔचे िविनयमन) अिधिनयम, २०१७ (२०१७ चा महा.१५)

या´या कलम २ ´या खंड (४) ´या अथȝतग«त, महाराÍĘ दुकाने व आÎथापनांमÁये नोकरीस असलेÊया Ëय¯तȒ´या बाबतीतील

Ëयवसाय धोकादायक आहे, अशी खाĝी पटÊयावर, महाराÍĘ शासनास, उ¯त अिधिनयमा´या अनुसूचीमÁये सुधारणा करणे इÍट

वाटते.

¾याअथȓ, आता, उ¯त अिधिनयमा´या कलम २ ´या पोट-कलम (३) ǎारे Ģदान केलेÊया अिधकारांचा वापर कǘन,

महाराÍĘ शासन, याǎारे, उ¯त अिधिनयमा´या अनुसूची- दोनमÁये पुढीलĢमाणे सुधारणा करीत आहे :—

उ¯त अिधिनयमा´या अनुसूची- दोनमÁये, (अकरा नऊ) नंतर पुढील नȗद जादा दाखल कर½यात येईल :—

“(ठ) ¶यांना महाराÍĘ दुकाने व आÎथापना ( नोकरीचे व सेवाशतȔचे िविनयमन ) अिधिनयम,२०१७ (२०१७ चा महा.१५)

या´या तरतुदी लागू आहेत अशा कोण¾याही दुकानांमÁये ȋकवा आÎथापनांमÁये, Ģ¾य©पणे ȋकवा कोण¾याही अिभकरणाǎारे,

कोण¾याही सं°येत नोकरीस असलेले.”.

NOTICE

EMPLOYEE’S COMPENSATION ACT, 1923.

No. ICE- 0220/C.R.18/Lab-6.— In pursuance of the provisions of sub-section (3) of section 2 of the Employee’s

Compensation Act, 1923 (8 of 1923 ), in its application to the State of Maharashtra, the Government of Maharashtra

hereby announces its intention to issue a notification to amend the Schedule II to the said Act, the draft of which is

appended hereto; and notice is hereby given that the said draft will be taken into consideration by the Government

after expiry of a period of three months from the date of publication of this Notice in the Maharashtra Government

Gazette.

2. Any objection or suggestion with respect to the said draft which may be received within the aforesaid period

of three months, by the Principal Secretary (Labour) to the Government of Maharashtra, Industries, Energy and

Labour Department, Mantralaya, Madam Cama Marg, Hutatma Rajguru Chowk, Mumbai 400 032, will be

considered by the Government.

DRAFT NOTIFICATION

No. ICE- 0220/C.R.18/Lab-6.— Whereas, by Notice No. ICE- 0220/C.R.18/Lab-6 Industries, Energy and

Labour Department dated the 21st January 2021 published in the Maharashtra Government Gazette, Part IV-A, and

Extraordinary, dated the 21st January 2021 the Government of Maharashtra has invited objections and suggestions to

issue a notification to amend Schedule II to the Employee’s Compensation Act, 1923 (8 of 1923), in its application

to the State of Maharashtra, within a period of three months from the date of publication of the said Notice in the

Maharashtra Government Gazette ;

And whereas, no objection or suggestion in respect of the said proposal, has been received by the Government

within the said period of three months ;

And whereas, the Government of Maharashtra, on being satisfied that the occupation in respect of the persons

employed in the Shops and Establishments within the meaning of clause (4) of section 2 of the Maharashtra Shops

hazardous, considers it expedient to amend Schedule to the said Act.

Now, therefore, in exercise of the powers conferred by sub-section (3) of section 2 of the said Act, the

Government of Maharashtra hereby amends Schedule II to the said Act, as follows :—

In Schedule II to the said Act, after (XIix) the following entry shall be added, namely :—

“(L) employed in any capacity, directly or through any agency in any shop or establishment to which the

provisions of the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act,

2017 ( Mah. XV of 2017) applies.”
