The Maharashtra Regional and Town Planning Act, 1966

NOTIFICATION

No. TPS-1117/470/CR-205/2017/E.P. Sanction/UD-9.– Whereas, the Manmad Municipal Council,

district Nashik (hereinafter referred to as “the said Planning Authority”) being Planning Authority has

published Third Revised Draft Development Plan of the Manmad Municipal Council (hereinafter referred

to as “the said Development Plan”) under Section 26 of the Maharashtra Regional and Town Planning

Act, 1966 (Mah. Act No. XXXVIl of 1966) (hereinafter referred to as “the said Act”), and published a

Notice to that effect in the Maharashtra Government Gazette, Part 1, Nashik Divisional Supplement,

dated the 16th to 22nd July 2015 on pages 1 and 2 ;

and whereas, after giving hearing to the suggestions / objections received within stipulated time in

respect of the said Development Plan, the Planning Commitee set up under Section 28 (2) of the said

Act, has submitted its Report to the said Planning Authority on 5th March 2016 ;

and whereas, the said Planning Authority has publised the said Development Plan under Section

28 (4) of the said Act for information of the public and published a Notice to that effect in the Maharashtra

Government Gazette, Part 1, Nashik Divisional Supplement, dated the 7th to 13th July 2016 on pages

23 to 27 ;

and whereas, in accordance with the provisions of sub-section (1) of Section 30 of the said Act

the said Planning Authority has submitted the said Development Plan vide its Letter No. ¯ÖÏÖ.×¾Ö.µÖÖê. ´Ö®Ö´ÖÖ›ü

(×ŸÖ.ÃÖã)/Ûú»Ö´Ö 30/2125, dated 14th July 2016 to the Government for sanction ;

and whereas, in accordance with the provisions of Section 31 (1) of the said Act, after making

necessary enquiry and after consulting the Director of Town Planning, Maharashtra State, Pune the

Government has sanctioned the said Development Plan Partly vide Notification No. TPS-1117/470/CR-

205 (A)/2017/UD-9, dated 28th February 2018 with modifications as specified in the Schedule “A”

appended thereto and published a Notice No. TPS-1117/470/CR-205 (B)/2017/UD-9, dated 28th February

2018 in respect of remaining excluded modifications of substantial nature, mentioned and specified as

EP-1 to EP-10 in the Schedule “B” appended thereto for inviting suggestions / objections from public

(hereinafter referred to as “the said Notice”) and appointed Joint Director of Town Planning, Nashik

Division, Nashik as an Officer (hereinafter referred to as “the said Officer”) to hear the suggestions /

objections received from public within a stipulated time and submit a Report to the Government

(hereinafter referred to as “the said Excluded Part”) ;

and whereas, as per the provisions of Section 31 (1) of the said Act, the said Officer, after giving

hearing to the suggestions / objections received within a stipulated time in respect of Draft Development

Plan of the said Excluded Part has submitted his Report vide his Letter No. 110, dated 24th January

2019 to the Government and Director of Town Planning has submitted his Report vide Letter, dated

15th March 2019 ;

and whereas, in accordance with the amended provisions of Section 31 (1) of the said Act the

State Government is required to sanction the Excluded Part of the said Development Plan within one

year from the date of receipt of the Report submitted by the said Officer under Section 31 of the said

Act ;

and whereas, in accordance with the amended provisions of Section 148-A of the said Act in

computing the period in relation to any Development Plan, Regional Plan or Scheme the period or

periods during which any action could not be completed due to enforcement of any Code of Conduct

by the Election Commission of India or the State Election Commission in respect of any Election shall

be excluded ;

and whereas, in accordance with the amended provisions of Section 148-A of the said Act vide

the Maharashtra Regional and Town Planning (Amendment) Act, 2020 (Mah. Act No. XIX of 2020) in

computing the period in relation to any Development Plan, Regional Plan or Scheme under the provisions

of Chapters II, III, IV and V of the said Act, the period or periods during which any action could not be

completed under the said Chapters, due to enforcement of any Guidelines or Lockdown measures by

the Government of India or the State Government as the case may be to prevent the spread of any

pandemic or epidemic or disaster situation arising in the Country or State shall be excluded ;

and whereas, such prescribed time limit is still in existence on excluding the period of enforcement

of code of conduct in respect of Election and Lockdown declared due to spread of Covid-19 Virus in

the State of Maharashtra by the Government from 23rd March 2020.

Now therefore, after consulting the Director of Town Planning, Maharashtra State, Pune and after

making necessary enquiries in exercise of the powers conferred by Section 31 (1) of the said Act and

all other powers enabling it in that behalf, the Government passes following Order –

(A) The Draft Development Plan of the said Excluded Part of Manmad Municipal Council, district

Nashik is sanctioned with modifications as specified in the Schedule “A” appended hereto.

(B) The date of one month after the date of publication of this Notification in the Maharashtra

Government Gazette, is fixed as the date of coming into force of the said Development Plan of

Excluded Part of Manmad Municipal Council, district Nashik, as described in the Schedule “A” appended

hereto.

The Plan showing Development Plan of the said Excluded Part of substantial nature as sanctioned

by the Government vide this Notification shall be kept open for inspection by the General Public during

office hours of working days for a period of one month from the date of coming into force of this

Development Plan, in the office of the Chief Officer, Manmad Municipal Council, Manmad, district

Nashik.

NOTIFICATION

No. TPS-1117/471/CR-206/2017/E.P. Sanction/UD-9.– Whereas, the Nandgaon Municipal Council,

district Nashik (hereinafter referred to as “the said Planning Authority”) being Planning Authority has

published Second Revised Draft Development Plan of the Nandgaon Municipal Council (hereinafter

referred to as “the said Development Plan”) under Section 26 of the Maharashtra Regional and Town

Planning Act, 1966 (Mah. Act No. XXXVIl of 1966) (hereinafter referred to as “the said Act”), and

published a Notice to that effect in the Maharashtra Government Gazette, Part 1, Nashik Division

Supplement, dated the 10th to 16th September 2015 on pages 7 and 8 ;

and whereas, after giving hearing to the suggestions / objections received within stipulated time

in respect of the said Development Plan, the Planning Committee set up under Section 28 (2) of the

said Act, has submitted its Report to the said Planning Authority on 3rd March 2016;

and whereas, the said Planning Authority has publised the said Development Plan under Section

28 (4) of the said Act for information of the public and published a Notice to that effect in the Maharashtra

Government Gazette, Part 1, Nashik Division Supplement, dated the 1st to 7th September 2016 on

pages 3 to 5 ;

and whereas, in accordance with the provisions of sub-section (1) of Section 30 of the said Act

the said Planning Authority has submitted the said Development Plan vide its letter No. 625/2016 on

dated 8th September 2016 to the Government for sanction ;

and whereas, in accordance with the provisions of Section 31 (1) of the said Act, after making

necessary enquiry and after consulting the Director of Town Planning, Maharashtra State, Pune the

Government has sanctioned the said Development Plan Partly vide Notification No. TPS-1117/471/CR-

206 (A)/2017/UD-9, dated 19th March 2018 with modifications as specified in the Schedule “A” appended

thereto and published a Notice No. TPS-1117/471/CR-206 (B)/2017/UD-9, dated 19th March 2018 in

respect of remaining excluded modifications of substantial nature, mentioned and specified as EP-1 to

EP-6 in the Schedule “B” appended thereto for inviting suggestions / objections from public (hereinafter

referred to as “the said Notice”) and appointed Joint Director of Town Planning, Nashik Division, Nashik

as an Officer (hereinafter referred to as “the said Officer”) to hear the suggestions / objections received

from public within a stipulated time and submit a Report to the Government also published Corrigendum

vide No. TPS-1117/471/CR 206/2017/UD-9, dated 1st September 2018 in respect of EP 2-A as specified

in the Annexure-I appeded thereto (hereinafter referred to as “the said Excluded Part”) ;

and whereas, as per the provisions of Section 31 (1) of the said Act, the said Officer, after giving

hearing to the suggestions / objections received within a stipulated time in respect of Draft Development

Plan of the said Excluded Part has submitted his Report vide his letter No. 109, dated 24th January

2019 to the Government and Director of Town Planning has submitted his Report vide letter, dated

15th March 2019 ;

and whereas, in accordance with the amended provisions of Section 31 (1) of the said Act, the

State Government is required to sanction the Excluded Part of the said Development Plan within one

year from the date of receipt of the Report submitted by the said Officer under Section 31 of the said

Act ;

and whereas, in accordance with the provisions of Section 148-A of the said Act in computing the

period in relation to any Development Plan, Regional Plan or Scheme the period or periods during

which any action could not be completed due to enforcement of any Code of Conduct by the Election

Commission of India or the State Election Commission in respect of any Election shall be excluded ;
