ORDER

No. D.T.P.-D.P. Chikhali(R)-Reservation No. 59-Sec 50-TPV-6-1711-2021.—

Whereas, the Revised Development Plan of original limit of ' B ' class Municipal Council, Chikhali has been

sanctioned under Section 31(1) of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as " the said

Act ") by the Government in Urban Development Department vide Notification No. TPS-2600-102-CR-18B-2000-UD-30,

dated 25^th September 2003 and came into force with effect from 10^th November 2003 (hereinafter referred to as " the said

Development Plan "; and the Chikhali Municipal Council is Planning Authority (hereinafter referred to as " the said

Planning Authority ") for said Development Plan ;

And whereas, in the said Development Plan, Reservation No. 59 is reserved for " Stadium " admeasuring area

8.25 Ha. (hereinafter referred to as " the said Reservation ") and " District Sports Officer, Buldana " is the Appropriate

Authority for the said reservation. (hereinafter referred to as " the said Appropriate Authority ");

And whereas, the said Appropriate Athority vide its letter No. 1989/2016, dated 11^th March 2016 has submitted the

proposal of deletion of the land affected by the said reservation admeasuring 8.25 Ha. from S. No. 145 (Part), 147 (Part)

& 120 (Part) of village Chikhali from the said reservation under Section 50 of the said Act to the Directorate ;

And whereas, the said Planning Authority has given approval for deletion of the said reservation subject to

condition of obtaining no objection certificate from the said Appropriate Authority vide resolution No. 22, dated 29^th July

2006 ;

And whereas, the Chief Officer, Municipal Council, Chikhali vide his letter No. 252/2017, dated 27^th January 2017

has communicated alongwith the above mentioned resolution that, the office of the Municipal Council has no objection

for deletion of the said reservation ;

And whereas, the Sports Department have no provision for purchasing the land for Stadium and such a large

amount of funds can not be available and there one Taluka Krida Sankul is already developed on Zilla Parishad land

admeasuring 2.13 Ha. and hence the said Appropriate Authority has submitted the proposal for deletion of the said

reservation alongwith No Objection Certificate of no requirment of the land of the said reservation to the Directorate vide

its letter No. 1989/2016, dated 11^th March 2016 ;

And whereas, it is now clear that the land under the said reservation is no longer required to the said Appropriate

Authority and the Director of Town Planning, Maharashtra State, Pune is of the opinion that the deletion of the

reservation under Section 50(2) of the said Act should be principally approved ;

And whereas, the Director of Town Planning, Maharashtra State, Pune has already given sanction for part deletion

of land area admeasuring 42400 Sq. m. out of 8.25 Ha. of the said reservation and issued order under Section 50(2) of

the said Act, vide order No. D.T.P.-D.P.Chikhali(R)-Reservation No. 59-Sec 50-TPV-6-591, dated 29^th January 2019 ;

And whereas, Assistant Director of Town Planning, Buldana Branch by its letter No. 2081, dated 23^rd October

2020 communicated that, as per the Government directives dated 20^th April 2016 out of the 5% of amount of premium,

the land owners of the land bearing S. No. 145 (Part) of village Chikhali, area admeasuring 16400 Sq. m. of the said

reservation (hereinafter referred to as " the said land ") Shri. Gajanan Ukharda Wagh and others (hereinafter referred to

as "the said land owners") have deposited 50% amount due to Government into the Government Treasury and 50%

amount due to the Planning Authority into the accounts of Chief Officer, Chikhali Municipal Council at the land rates in

Annual Statement of Rates (ASR) of the year 2017-18 ;

And whereas, though the said land owners have deposited 5% premium amount of the land value of the said land,

as per the land rate prescribed in the Annual Statement of Rates for the year 2017-18 in the year 2020-21, there is no

change in the land rate of the said land prescribed in the Annual Statement of Rates for the year 2017-18 & 2020-21 and

hence premium amount remains same ;

And whereas, the Government in Urban Development Department, vide Resolution No. TPS-1813-3211-CR-508-

UD-13, dated 01^st December 2016 has delegated the powers exercisable by it under Section 50(2) of the said Act to the

Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils/Nagar

Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority ;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune hereby sanctions the part deletion of the

said reservation in respect of the said land as shown in the part plan of the sanctioned said Development Plan u/s 50(2)

of the said Act and for that purpose amends the notification of the said Development Plan, sanctioned dated 25^th

September 2003 as specified in the Schedule herein below :–

After the last entry in the Schedule of Modifications accompanying the notification of the said sanctioned Devel-

opment Plan, the following new entry shall be added :–
