No. SPP-2021/U.O.R.-19/D-XIV.–– In exercise of the powers conferred by sub-section (8) of the

Section 24 of the Code of Criminal Procedure, 1973 (Act No. II of 1974), the Government of

Maharashtra, hereby appoints Adv. Umeshchandra Yadav-Patil, as "Special Public Prosecutor" for

conducting the case in the Sessions Court, Ahmednagar, which is arising out of C. R. No. 478/2020

registered at Supa Police Station, District Ahmednagar.

The fees of Adv. Umeshchandra Yadav-Patil, as Special Public Prosecutor shall be paid by Home

Department as per the fee schedule agreed by the Home Department.

His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law

Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

The Government reserves the right to revoke/modify/annul the order without assigning

any reasons.

R. P. Road/330/2021.– Whereas, the Government has sanctioned the Revised Regional Plan for Nashik

district on dated 21st June 2013 (hereinafter referred to as “ the said Regional Plan”) under the provisions

of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as “ the said Act”) and has

came into force with effect from 16th September 2013 and whereas, in the said Regional Plan, the 69

meters wide (45+12+12) Regional Plan Road along the Shiv of Mouze Chandshi and Jalalpur, taluka and

district Nashik is proposed.

and whereas, the Government vide Resolution No. TPS-1815/CR-49/15/UD-13, dated 6th May 2015

and dated 4th January 2016 (hereinafter referred to as “the said Government Resolution”) has issued the

directives under Section 154 of the said Act, regarding the procedure to be followed under Section 20 of

the said Act, for making changes in the use of land in the areas of Sanctioned Regional Plans, and for that

purpose constituted “Proposal Scrutiny Committee”;

and whereas, the “Proposal Scrutiny Committee” constituted under the said Government Resolution,

is of the opinion that said 69 meters wide Regional Plan Road is proposed to be 30 meters wide and the

land so released from the road alignment shall be included in the adjecent land use zone in accordance

with the provisions of sub-section (2) of Section 20 of the said Act, subject to the following conditions.

(hereinafter referred to as “the proposed modification”) :

(1)

It shall be binding to deposit the premium amount as mentioned in Government Resolution,

dated 4th January 2016. The premium and Scrutiny fee shall be collected from the concerned

land owners before issue of notification under Section 20 (4) of the said Act.

(2)

The land so released from the road alignment shall be included in the adjacent land use zone.

(3)

Applicant / Developer shall make necessary self-contained arrangements to provide water

supply, waste water treatment, solid waste disposal / management while developing the said

land and after development of the said land at his own cost.

(4)

It shall be necessary to develop the concept like Rainwater Harvesting, Water Recycling and

Solar Energy while developing the said land.

(5)

It is binding on the land developer to make available the pure water.

and whereas, as per the provision of sub-section (1) of Section 151 of the said Act, Government vide

Notification No. TPS-1815/CR-49/15/UD-13, dated 11th June 2015 has delegated the powers under

Sections 20 (2), 20 (3) and 20 (4) of the said Act to the concerned Joint Director of Town Planning ;

and whereas, in accordance with the provisions of sub-section (3) of Section 20 of the said Act, Joint

Director of Town Planning, Nashik Division, Nashik vide Notice No. NKDN/P.S.C./R.P. Nashik/Sect. 20 (3)/

Mouze Chanshi and Jalalpur, taluka Nashik/69.00 meters R. P. Road/383, dated 23rd March 2020 has

published, the Notice regarding the Proposed Modification and Assistant Director of Town Planning, Nashik

Branch, Nashik was Appointed to hear the suggestions / objections received within the stipulated period ;

and whereas, the Appointed Officer i.e. Assistant Director of Town Planning, Nashik Branch has

submitted his report to the Member-Secretary also the Proposal Scrutiny Committee, in the meeting,

dated 27th July 2020 accorded approval to this proposal and directed Member-Secretary to issue the

Final Notification according to sub-section (4) of Section 20, after payment of the premium by the Applicant.

and whereas, the Plot Nos. 1, 2 and 12 of the final sanctioned layout and which is non agricultural

land bearing Gat Nos. 338, 340, 341 of Mouje Jalalpur, taluka and district Nashik are fronting on the said

road under modification and the owner of said land Mr. Arun Rajendra Patil vide his letter dated 4th November

2020 has requested this office to issue the notification under Section 20 (4).

and whereas, the Assistant Director of Town Planning, Nashik Branch, Nashik vide his letter No. 396,

dated 4th February 2021 informed this office that, the concerned owner has submitted the required scrutiny

fee, premium and fees of the paper publication in the Government Treasury.

Now, therefore, in exercise of the powers conferred by sub-section (4) of Section 20 of the said Act,

Joint Director of Town Planning, Nashik Division, Nashik hereby sanctions the said Modification for the

land shown by the Nashik Branch Office on the part plan and for that purpose amends the aforesaid

Notification, dated 21st June 2013 as follows.

In the said Regional Plan, the following new Entry shall be added after the last Entry of the Schedule

of Modifications.

ENTRY

In the Sanctioned Revised Regional Plan of Nashik, Nashik district the 69 meters wide Regional Plan

Road shown on the boundary of Mouze Chandshi and Jalalpur, taluka and district Nashik is reduced to be

30 meters wide and the land so released from the road alignment shall be included in the adjacent land

use zone as shown on the Part Plan, subject to the following conditions.

The land so released from the road alignment shall be included in the adjacent land use zone.

(2)

Applicant / Developer shall make necessary self-contained arrangements to provide water

supply, waste water treatment, solid waste disposal / management while developing the said
