NOTIFICATION

LEGAL METROLOGY ACT, 2009.

No. LM- 2020 /C.R. 145 / C. P. 3.— The following draft of rules further to amend the Maharashtra

Legal Metrology (Enforcement) Rules, 2011, which the Government of Maharashtra propose to

make in exercise of the powers conferred by sub-section (1) and clause (c) of sub-section (2) of

section 53 read with sub-section (2) of section 23 of the Legal Metrology Act, 2009 (1 of 2010), in its

application to the Government of Maharashtra and of all other powers enabling it in that behalf

and after consultation with the Central Government as required by sub-section (1) of section 53 of

the said Act, 2009 is hereby published as required by sub-section (4) of section 53 of said Act, for

information of all persons likely to be affected thereby; and notice is hereby given that the said

draft rules will be taken into consideration by the Government of Maharashtra on or after the

2ndSeptember 2021.

Any objections or suggestions which may be received by the Secretary, Food, Civil Supplies

and Consumer Protection Department, Annex Building, Madam Cama Marg, Hutatma Rajguru

Chowk, Mumbai 400 032 from any person with respect to the said draft, within the said period

will be considered by the Government.

DRAFT RULES

These rules may be called the Maharashtra Legal Metrology (Enforcement) (First

Amendment) Rules, 2021.

In Rule 6 of the Maharashtra Legal Metrology (Enforcement) Rules, 2011 (hereinafter

referred to as “the Principal Rules”),-

(a) for sub rule (1), the following sub-rule shall be substituted, namely:-

“ (1) Every manufacturer or repairer of, or dealer in, weight or measure shall make an online

application for the issue of a license to the Controller or such Legal Metrology Officer, as may be

authorized by him in this behalf, in the appropriate form and procedure as may be specified by the

Controller;

Provided that, no license to repair shall be required by a manufacturer to repair the

weight or measure manufactured by him and used in other State, however, the manufacturer

has to inform in advance to the concerned Legal Metrology Officer about the repairing:

Provided also that, a person who bonafide repairs any weight or measure owned or

possessed by him shall not be required to obtain a license referred in this sub rule:

Provided further that, no license shall be issued unless the applicant has passed technical

ability test as may be specified by the Controller”;

(b) for sub-rule (2), the following sub-rule shall be substituted, namely ;—

“(2) Every manufacturer or repairer of, or dealer in, weight or measure shall make an online

application for auto renewal of license at least thirty days before the expiry of the validity of

license to the Controller or such Legal Metrology Officer, as may be authorized by him in this

behalf, in the appropriate form and procedure as may be specified by the Controller.”;

(c)

in sub-rule (4), for words “period not exceeding five calendar years”, the words “period

not exceeding ten calendar years”, shall be substituted;

(d)

in of sub-rule (5),-

(i) in the first proviso, the words “per year” the words “for first year” shall be

substituted;

(ii) in the second proviso, for the words “per year” the words for “first year” shall be

substituted;

(iii) after second proviso, the following proviso shall be added, namely:-

Provided further that, in case of any server or portal issue or in case of natural calamity,

the time- limit specified in the first and second proviso shall be extended by the Controller.”;

(e)

in sub rule (6) the words “or for the issue of a duplicate license” shall be deleted;

(f)

in sub-rule (9) the words “or equipments or tools, etc.” shall be deleted.

For rule 11 of the Principal Rules, the following rule shall be substituted, namely:-

“11. Records to be maintained by manufacturers, etc.-

Every manufacturer or repairer of, or dealer in, weight or measure shall maintain records

online in the appropriate format as may be specified by the Controller and also submit such

periodical reports online in the appropriate format as may be specified by the Controller.”

In rule 14 of the Principal Rules, sub-rule (4) shall be deleted.

SCHEDULE – II-A appended to the Principal Rules shall be deleted.

SCHEDULE – II-B appended to the Principal Rules shall be deleted.

In SCHEDULE – IV appended to the Principal Rules, for entries (i),(ii) and (iii) the

following entries shall be substituted, namely :-

“(i) Manufacturer

Rs. 8000 per year.

(ii) Repairer

Rs. 3000 per year.

(iii) Dealer

Rs. 1500 per year.”

For SCHEDULE V appended to the Principal Rules, the following Schedule shall be

substituted, namely :-
