आिण ùयाअथȯ, राùय शासनाची अशी खाŇी झाली आहे की, उòत िवƫीय संĒथा आिण āयांचे संचालकांकडȴन ठɂवीदारांना āयां÷या

ठɂवी परत करĀयाची शòयता नाही Ċहणून राùय शासनाला अशा ठɂवीदारां÷या िहतसंबंधाचे रȦण करावे लागेल ;

आिण ùयाअथȯ, यासोबत जोडलेčया अनुसूचीत िविनिदɑđट कɁलेली मालमƫा उòत िवƫीय संĒथेकडȴन आिण āयां÷या संचालकांकडȴन

āयाचŌमाणे उòत िवƫीय संĒथेकडȴन गोळा कɁलेčया ठɂवȮमधून संपािदत करĀयात आलेली आहे असे अिभकिथत आहे ;

āयाअथȯ, आता, महाराđł ठɂवीदारां÷या (िवƫीय संĒथामधील) िहतसंबंधाचे संरȦण अिधिनयम, १९९९ (२००० चा महा.१६)

(यात यापुढɂ ùयाचा “उòत अिधिनयम” असा िनदɨश करĀयात आला आहे) या÷या कलम ४ चे पोट-कलम (१) व कलम ५ व कलम

८ याǑारे Ōदान करĀयात आलेčया अिधकारांचा वापर कȠन महाराđł शासन याǑारे,—

NOTIFICATION

No. MPI-4021/C.R.146/Pol-12,—Whereas complaints have been received from number of

depositors against (1) Nirmal Infrahome Corporation Ltd. Raipur, Chhattisgarh, Branch - Vikram

Plaza, Shop No.1, Opposite Nadgiri petrol pump, Vijapur Road, Solapur (2) NICL India Ltd, Palash

area, Nav Dour Sanchar Colony, Gulmohor, Bhopal, Madhya Pradesh (hereinafter referred to “as

the said Financial Establishments”) and so also Directors/Promoters/Partners of the said Financial

Establishments complaining that they have defaulted to return the said deposits made by the

depositors after maturity;

And whereas, an offence has been registered against the accused at Vijapur Naka Police Station,

Solapur City vide CR No. 467/2017, under sections 409, 420, 120 B, 34 of IPC read with section

3 and 4 of MPID Act, 1999;

And whereas, the State Government is satisfied that the said Financial Establishments and

their Directors are not likely to return the deposits to the depositors and hence the Government has

to protect the interest of depositors;

And whereas, the properties specified in the Scheduled appended hereto are alleged to have

been acquired by the said Financial Establishments and their Directors from and out of the deposits

collected by the said Financial Establishments;

Now, therefore in exercise of the powers conferred by sub-section(1) of section 4, section 5 &

section 8 of the Maharashtra Protection of Interest of Depositors (in Financial Establishment) Act,

1999 (Mah. XVI of 2000) (hereinafter referred to as the said Act) the Government of Maharashtra

hereby;

(a) attaches the properties of the said Financial Establishments and properties in the

name of their Directors / Promoters / Partners, Managers, Employees and their relatives as

specified in the Schedule; and

(b) appoints the Sub Divisional Officer, Solapur No.2, Solapur to be the Competent

Authority to exercise control over the properties attached of the said Financial Establishments

and their Directors / Promoters / Partners, Managers, Employees and their relatives.

The Public Prosecutor in designated Court appointed under the said Act shall render necessary

assistance to the Competent Authority in filing the application before the Special Court.
