Notification

No. RPP Pune/Village-Manjri Bk./ITP/TPV-1/4689.–Whereas, the Government in Urban

Development Department, vide its Notification No. TPS-1895/227/C.R. 26/95/UD-13, dated 25th

November 1997 has sanctioned the Regional Plan for the Pune Region (hereinafter referred to as

"the said Regional Plan") with Development Control Regulations under Section 15 (1) of the

Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") which

has Come into force with effect from the 10th February 1998 ;

and whereas, the Government of Maharashtra in Urban Development Department, vide Notification

No. TPS/1804/Pune RP D.C.R./UD-13, dated the 16th November 2005 and addendum No. TPS-1804/

Pune RP D.C.R./UD-13/Addendum, dated the 6th January 2006, has incorporated the regulations for

Development of Special Townships by amending the Sanctioned Development Control Regulations

for the said Regional Plan, under the provisions of sub-section (4) of Section 20 of the said Act,

and it has further amended from time to time ;

and Whereas, in exercise of the powers conferred by sub-section (1) of Section 3 of the

Maharashtra Metropolitan Development Authority Act, 2016 the Government vide Notification of Urban

Development Department No. PRD-3316/CR-54/UD-7, dated 11th July 2016 has established

Metropolitan Region Development Authority to be called "the Pune Metropolitan Region Development

Authority" (hereinafter referred to as "the said Development Authority") for the Metropolitan Area of

Regional Plan more specifically described in the Schedule appended thereto ;

and whereas, the Government to Maharashtra vide its Notification No. TPS-1817/CR-173/17/UD-

13, dated 18th January 2018, appointed the said Development Authority as a "Special Planning

Authority" under Section 40 (1) of Maharashtra Regional and Town Planning, Act, 1966 ;

and whereas, the Government of Maharashtra in the Urban Development Department vide

Notification No. TPS-1816/CR 368/16/part-1/DP-ITP/UD-13 dated 8th March 2019 sanctioned

Development Control Regulations for the Special Planning Authority under the provisions of sub-section

(1AA) (c) of Section 37 of the said Act, in order to incorporate the regulations for Development of

Integrated Townships Project (hereinafter referred to as "the said Regulations") ;

and whereas, the Government has accorded Locational Clearance for the Special Township

Project proposed by Malnad Project Private Limited, (hereinafter referred to as "the said Project

Proponent") at Village Manjri Bk., taluka Haveli, district Pune on land admeasuring 53.86 Ha. vide

Government Notification No. TPS-1817/CR-55/17/UD-13, dated 1st June 2017 (hereinafter referred to

as the "said Project");

and whereas, said Project area came within Pune Metropolitan Region and Pune Metropolitan

Regional Development Authority has sanctioned revised master plan on dated 19th July 2021 with

certain conditions as per Regulation No. 1 of the said Regulations ;

and whereas, the said Project Proponent, vide its letter dated 17th March 2021 and subsequent

letters submitted a proposal as per the provisions of Regulation No. 4.5 of the said Regulation for

the said Project to the Directorate for the grant of revised Locational Clearance by incorporating

additional lands as mentioned in Schedule appended hereto admeasuring area about 7.0727 Ha. from

village Manjri Bk., taluka Haveli, district Pune in the area of the said Project ;

and whereas, as per the said Regional Plan, the said additional lands are included in Agriculctural

and No Development Zone ;

and whereas, as per the documents submitted by the said Project Proponent, the Ownership

and Development Rights of the said additional lands, proposed to be incorporated in the said Project

are acquired ' by the said Project Proponent and the said Project Proponent has also submitted

an Affidavit to that effect as per revenue record ;

and whereas, as per the provisions of Regulation No. A.5 of the said Regulation, the Director

of Town Planning, Maharashtra State, Pune as per the request of said Applicant, may grant to add

or delete any area, not exceeding 50 per cent of the total area under Locational Clearance; .

and whereas, as per the request of the said Project Proponent an area of 7.0727 Ha. of the

said additional lands to be included in project is less than 50 per cent of the total project area under

Locational Clearance of 53.086 Ha. of the said Project ;

and whereas, it is accordingly expedient to designate the area of the said additional lands on

the said Regional Plan under the provisions of sub-section (3) of Section 18 of the said Act as the

additional project area for the said Project ;

and whereas, the said Project Proponent, vide challan No. GRNMH006620413202122E, dated

24th September 2021 defacement No. 0003208635202122, dated 28th September 2021 has deposited

an amount of Rs.28,43,500 through the Assistant Director of Town Planning, Pune Branch, Pune

which is at the rate of 10 per cent of the total premium charges at the stage of Locational Permission

as per the provisions of Regulation No. 4.5 of the said regulation for the said additional lands falling

in zones, other than residential and commercial.

Now, therefore, the Director of Town Planning, Maharashtra State, Pune under the provisions

of Regulation No. 4.5 of the said Regulations for Development of Integrated Township Project hereby

grants permission to add the area 7.0727 Ha. of the said additional area, more specifically described

in "Schedule" appended hereto, in the area of the said Project for which Locational Clearance has

already been granted, subject to the following terms and conditions.–

Terms and Conditions of the Integrated Township Project.–

(I) Conditions of Ownership.–

1. Ownership / Development Rights of said additional lands together with the area under the

said Project shall be with the said Project Proponent. While applying for Letter of Intent, it is obligatory

on the said Project Proponent to submit to the concerned authority the extracts of original certified

documents of the registered Memorandum of Understanding (MoU), registered documents of joint

venture, original measurement plans, documents proving the ownership rights, development rights.

2. Part area of lands shall be included in the said Project after obtaining measurement plan

issued by the Deputy Superintendent of Land Records. If such lands are not remain contagious with

the lands under the said Project, then area of land stand deleted from the project area.

3. Collector, Pune should take appropriate action regarding "New Tenure" lands which are included

in the said Project before granting final sanction to the Master Lay-out Plan.

4. Collector, Pune shall verify and take appropriate action in respect of lands which are included

in the said Project having entries regarding bank encumbrances and names in the Other Right's

column of 7/12 extract, before granting final sanction to the Master Lay-out Plan.

5. If any document of ownership of lands included in the area of the said Project, is found false

in future or if any judicial proceedings arise regarding the said Project in future then, it shall be the

sole responsibility of the said Project Proponent to deal with those proceedings at his risk and cost.

In such case Locational Clearance shall be deemed to be cancelled for that lands.

(II) Conditions regarding Environment and Others.–

1. The Project Proponent shall obtain the Environmental Clearance from the Ministry of

Environment, Forest and climatic change (MoEF and CC) and from the Appropriate Competent

Authority before obtaining the Building Permission within the lands to be incorporated in the area

of the said Project. Also the terms and conditions of the Notifications issued by the Ministry of

Environment, Forest and Climate Change for the Environment Impact Assessment Act, 1986 from

time to time shall be binding on the said Project Proponent.

2. The Project Proponent shall be responsible for making provision for safe disposal of Solid

Waste and effluents within the said Project at his own risk and cost, as per the criteria and norms

decided by the Maharashtra Pollution Control Board and also subject to the provisions and rules

under the relevant Act in this regard.

3. The terms and conditions imposed by the Irrigation Department and other concerned

department of the State Government from time to time shall be binding on the said Project Proponent.

The existing nallas / water courses, etc. in the area of the said Project shall not be closed.

4. It shall be binding on the said Project Proponent to provide water supply for the development

of the said Project as per the provisions of Regulation No. 10.5. (a) of the said Regulations at their

own cost and responsibility. The conditions prescribed by Irrigation Department in these regards; from

time to time are binding on the said Project Proponent.

5. It shall be binding on the said Project Proponent to provide electricity supply for the

development of the said Project as per the provisions of Regulation No. 10.5. (c) of the said Regulation

at their own cost and responsibility. Also the concerned Authority shall obtain from the Project

Proponent, necessary permissions and also the firm commitment of electricity supply for the entire

area of the said Project from the concerned power supply company before the approval of the Master

Plan as per the provisions of Regulation No. 6.5 of the said Regulation.

6. The Project Proponent shall submit certificate regarding the lands of Maharashtra Industrial

Development Corporation are not included in Intergrated Township.

(III) Regarding Development.–

1. The said Project Proponent shall provide access road of required width as per regulation

but minimum 9 mtrs. free of cost to the lands owned by other private persons, which are surrounded

by the area under the said Project.

2. It is binding on the said Project Proponent to protect the easement rights of the existing public

roads passing through the area of the said Project.

3. It shall be binding on Project Proponent to construct CD work on Nalla included in the area

of the said Project with the permission of concern department and to keep distance from River, Nallas,

Canal, Lake and Other water bodies within the area of the said Project required as per the said

regulation.

4. No construction of any type shall be allowed on the lands having slope equal to or more

than 1 : 5 in the said project, whether such lands are specifically marked as such on the said

Regional Plan or not. Also No development activity shall be permissible and no development involving

cutting/levelling/filling shall be allowed on such lands.

5. The said Project Proponent shall have to plan and earmark the lands at suitable location

within the area of the said Project for public purpose reservations and also for basic infrastructure

required for the population to be accommodated within the said Project, as per the said Regulation

and shall plan and develop the same at his own cost.

(IV) Other Terms and Conditions.–

1. The terms and conditions mentioned in the Government Notifications dated 10th December

2007 and 22nd December 2016 for the original Locational Clearance of the said Project along with

all the terms and conditions mentioned in this Notification shall be applicable for the area of the

said Project.

2. In case of breach of any of the terms and conditions by the said Project Proponent the powers

/ rights of cancellation of the Locational Clearance granted vide this notification are reserved with

Government.

3. The regulation for Development of Integrated Township Project sanctioned by the Government

vide notification dated 8th March 2019 and as amended from time to time are applicable for the

said project.

4. The details of the said additional lands incorporated within the said Project are given in

"Schedule" appended hereto. Also the plan showing the boundaries of the said Project is appended

hereto.

5. This Notification shall come into force on the date of its publication in the Maharashtra

Government Gazette.

The details of the said additional lands incorporated within the said Project and the plan shall

be made available for the inspection of the general public, during office hours on all working days

at the following offices.–

(1) Metropolitan Commissioner and Chief Executive Officer, Pune Metropolitan Region Development

Authority, Pune.

(2) The Collector, Pune.

(3) Joint Director of Town Planning, Pune Division, Pune.

(4) Deputy Director of Town Planning, Urban Reserch Cell, Pune.

(5) Assistant Director of Town Planning, Pune Branch, Pune.

No. TPS/WS-09/151/2021.–Whereas, the Revised Development Plan of the Pimpri-Chinchwad New

Town Development Authority has been sanctioned by the Government of Manarashtra Urban Development

Department vide Notification No. TPS-1893/1413/UD-13, dated 28th November 1995 and the Government

of Maharashtra Urban Development Department vide Order No. PCM/1697/934/CR-89/UD-22, dated 15th

November 1997 brought the area under the planning control of Pimpri-Chinchwad New Town Development

Authority under the planning control of Pimpri-Chinchwad Municipal Corporation (hereinafter referred to

as "the said Development Plan") ;

and whereas, in the said Development Plan, land from village Bhosari, bearing S. No. 210 which

admeasures about 1.43 Ha has been reserved under R. No. 405, "Garden" and along the boundary of

the said reservation a 12.00 mtrs. wide road North-South is proposed. The possession of land

admeasuring 14382.70 sq. mtrs. has been taken by the Municipal Corporation through Land Acquisition

on 7th October 2005 and in this reservation, in Survey No. 210, a road has been constructed to the

west of the Corporation's main gutter and due to relocation of this road, the area of reservation about

2244.00 sq. mtrs. which got reduced an equivalent area under the Residential Zone was handed over to

PCMC in Sr. No. 211/1 vide Gift Deed Doc. No.Haveli-17-08752, dated 30th September 2009 by the

concerned land owner (Hereinafter referred to as "said land") ;

and whereas, accordingly the General Body of Pimpri-Chinchwad Municipal Corporation has passed

the resolution vide Resolution No. 659, dated 29th July 2021 that in Village Bhosari, the road towards

the North-South direction to be realigned to the west side of the along Municipal Gutter and due to this

realignment of the road the area of the reservation which got reduced the equivalent area which is in

possession of PCMC in Sr. No. 211/1 accordingly the boundaries of the reservation to be changed as

per Section 37 of the Maharashtra Regional and Town Planning Act, 1966 to conduct hearing to the

concerned regarding the notice application and to complete the related statutory process and submit

the proposal for change to the Government for approval. Authorization is being given to the Commissioner,

Pimpri-Chinchwad Municipal Corporation, Pimpri-18 (hereinafter referred to as "the subject matter of

the Resolution") ;

and whereas, Pimpri-Chinchwad Municipal Corporation has now decided to initiate the modification

as per the said resolution in the said Development Plan so as to change the Boundaries of R. No. 405,

Garden in the said land (as shown in the map ABCD) and accordingly to reserve the land admeasuring

about 2244.00 sq.mtrs. for Garden which was taken in possession and also to realign the road adjacent

to this Reservation No. 405, Garden in the approved development plan (as shown in the map) as per

the provision laid down under Section 37 of the Maharashtra Regional and Town Planning Act, 1966 to

include the area under the 12 mtrs. wide road in the Residential Zone as per the subject of the said

resolution (hereinafter referred to as "said modification") ;

and therefore, copy of said modification is kept open for public inspection on all working days during

office hours in the office of Deputy Director of Town Planning, Pimpri-Chinchwad Municipal Corporation,

Pimpri, Pune - 411018.

Any person, who has any suggestion and / or objection to the said modification may communicate

the same in writing to the Commissioner, Pimpri-Chinchwad Municipal Corporation, Pimpri, Pune - 411018

within a period of one month from the date of publication of this notice in the Maharashtra Government

Gazette.

The suggestion and / or objection received to the Pimpri-Chinchwad Municipal Corporation regarding

the said modification in the prescribed time period will be considered before the modification proposal is

submitted to the Government for sanction.

list of landholders and/or occupiers of said

WUA's shall be displayed on the notice board of

the offices of concerned Grampanchayat, Tahasil

Office, Irrigation Section, Sub-Division and

Division and other prominent public places.

I, Engi. Shashikant Sharanappa Gaikwad,

Executive Engineer also hereby declare that no

water shall be supplied by the Appropriate Authority

to an individual or occupier of such land and the

system of supply of water through Water User

Associations shall be binding on all the holders

and the occupiers of the lands under Maharashtra

Management of Irrigation System by Farmers Act-

2005.

Any Person affected by this Notification or part

thereof, may file an appeal before Superintending

Engineer, Satara Irrigation Project Circle, Satara

within 30 days from the date of publication of this

Notification in the Maharashtra Government

Gazette.
