अिधसूचना

महाराđł दाȟबंदी अिधिनयम.

ĸमांक सीएलआर-०६२१/Ō.ĸ.९०/राउशु-३.– ùयाअथȯ, महाराđł देशी मǐ िनयम, १९७३ मĄये आणखी सुधारणा करĀयासाठी

पुढील िनयम ताāकाळ अंमलात आणĀयात यावेत आिण Ċहणून महाराđł दाȟबंदी अिधिनयम, १९४९ (१९४९ चा २५ वा) मधील कलम

१४३ ÷या पोट-कलम (३) ÷या परंतुकाǑारे तरतुद कɁčयाŌमाणे पूवɑ ŌिसĄदीिशवाय हे िनयम करĀयात यावेत, असे महाराđł शासनास वाटते ;

āयाअथȯ, आता, महाराđł दाȟबंदी अिधिनयम, (१९४९ चा २५ वा) मधील कलम १४३ ÷या पोट-कलम (२) ÷या खंड

(ख), (छ) आिण (ज १) Ǒारे Ōदान करĀयात आलेčया अिधकारांचा आिण याबाबत महाराđł शासनास समथɑ करणाķया इतर सवɑ

अिधकारांचा वापर कȠन महाराđł शासन, याǑारे महाराđł देशी मǐ िनयम, १९७३ मĄये पुढील िनयम करीत आहे :–

१. या िनयमांना “महाराđł देशी मǐ िनयम (ितसरी सुधारणा) िनयम, २०२१” असे संबोधĀयात यावे.

२. महाराđł देशी मǐ िनयम, १९७३ ÷या िनयम २५ मĄये,–

(एक) खंड (ब) मĄये, दुसķया परंतुकानंतर, खालील परंतुक समािवđट करĀयात यावे, जसे की,–

“परंतु, Ēथलांतरीत होणाķया अनुȧĆतीŌाĆत दुकानांची संóया ही चंŉपूर िजčǡात िदनांक ३१ माचɑ,२०१५ रोजी

अȬĒतāवात असलेčया अनुȧĆतीŌाĆत दुकानां÷या एकȳण संóये÷या ३० टòòयापेȦा जाĒत असता कामा नये.”;

(दोन) खंड (क) मĄये,–

(अ) पिहčया परंतुकामधील, “चंŉपूर िजčहा वगळȴन” हे शĈद वगळĀयात यावेत ;

(ब) दुसķया परंतुकानंतर, पुढील परंतुक समािवđट करĀयात यावे, जसे की,–

“परंतु, आणखी असे की, चंŉपूर िजčǡा÷या बाबतीत Ēथलांतरीत होणाķया अनुȧĆतीŌाĆत दुकानांची

संóया ही िदनांक ३१ माचɑ, २०१५ रोजी चंŉपूर िजčǡात अȬĒतāवात असलेčया अनुȧĆतीŌाĆत दुकानां÷या

एकȳण संóये÷या १५ टòòयापेȦा जाĒत असता कामा नये.”.

NOTIFICATION

No. CLR-0621/C.R.90/Excise-3.— Whereas, the Government of Maharashtra considers that the

following rules further to amend the Maharashtra Country Liquor Rules, 1973, should be brought

into force with immediate effect and therefore, the rules should be made without previous publication

as provided by the proviso to sub-section (3) of section 143 of the Maharashtra Prohibition Act, 1949

(XXV of 1949) ;

Now, therefore, in exercise of the powers conferred by clauses (b), (g) and (h1) of sub-section (2)

of section 143 of the Maharashtra Prohibition Act and of all other powers enabling it in that behalf,

the Government of Maharashtra hereby makes the following rules further to amend the Maharashtra

Country Liquor Rules, 1973, as follows, namely :—

These rules may be called the Maharashtra Country Liquor (Third Amendment)

Rules, 2021.

In rule 25 of the Maharashtra Country Liquor Rules, 1973,—

(i) in clause (b), after the second proviso, following proviso shall be added, namely :-

“Provided also that, the number of licensed shops for such shifting shall not

exceed 30% of the total existing licensed shops in Chandrapur District as on the 31st

March, 2015.”;

(ii) in clause (c),—

(a) in the first proviso, the words “other than Chandrapur district” shall be deleted;

(b) after the second proviso, the following proviso shall be added, namely :—

“Provided also that, in case of Chandrapur district the number of licensed

shops for shifting shall not exceed 15% of the total licensed shops existing in the

Chandrapur District as on 31st March 2015.”.
