योजना दि. १२ ऑगसट २००५ पासून अंमलात आलेेली आहेे (यात यापुढे ज्याचा उल्लेेख “उकत एम एम आर डी ए विकास योजना”

असा करण्ात आला आहेे) ;

ज्ाअर्थी, महाराष्ट्र प्ादेशिक नियोजन व नगररचना अधिनियम, १९६६ (यात यापुढे ज्याच निर्देश “ उकत अधिनियम” असा

करण्ात आला आहेे) चेे कलम ११३(१) द्ारेे प्रदान करण्ात आलेेल्ा अधिकारांचा वापर करून शासनानेे नगरविकास, सार्वजनिक

आरोग्य व गृहनिर्माण विभागाची अधिसूचना क्रमांक आरपीबी. ११७१/१८१२४/११३/आय डबल्ू, दिनांक २० मार्च १९७१ द्ारेे, यात

नमूद करण्ात आलेेलेे क्षेत्र हेे नवी मुंबई ह्ा नवीन नगराचेे क्षेत्र म्हणून घोषित केलेे आहेे व सिडकोस नगरविकास, सार्वजनिक आरोग्य

व गृहनिर्माण विभागाची अधिसूचना क्रमांक आरपीबी. १८१२४/II डबल्ू, दिनांक २० मार्च १९७१ अन्वयेे, उकत अधिनियमांच्ा कलम

११३(३अ) नुसार नवी मुंबई या नवीन नगर क्षेत्ासाठी (उकत नवनगरक्षेत्र) नवनगर विकास प्ाधिकरण म्हणून नियुकत केलेे आहेे ;

आणि ज्ाअर्थी, उकत अधिनियमाच्ा कलम ३१(१) द्ारेे प्रदान करण्ात आलेेल्ा अधिकारांचा वापर करून, शासनानेे उकत

नवनगर क्षेत्ासाठी सिडकोनेे सादर केलेेल्ा रचनाबद्ध आराखड्ाच्ा (Structural Plan) सवरूपात असलेेल्ा प्ारूप विकास

योजनेेस ( उकत अंतिम विकास योजना) नगरविकास व सार्वजनिक आरोग्य विभाग अधिसूचना क्रमांक आरपीबी. ११७५/६३५/

यूडी -५, दिनांक १८ ऑगसट १९७९ सह अधिसूचना क्रमांक आरपीबी. ११७५/६३५/यूडी-५, दिनांक १८ जानेेवारी १९८० अन्वयेे मंजुरी

दिलेेली आहेे आणि उकत विकास योजना दिनांक १ मार्च १९८० पासून अंमलात आलेेली आहेे ;

आणि ज्ाअर्थी, महाराष्ट्र महानगरपालिका अधिनियम (यात यापुढे ज्याचा उल्लेेख “उकत महानगरपालिका अधिनियम” असा

करण्ात आला आहेे) चेे कलम ३ च्ा पोट-कलम (४) नुसार महाराष्ट्र शासन नगर विकास विभाग अधिसूचना क्रमांक पनप – २९१४/

वही आय पी सं.क्र. ३०१/प्र.क्र. ३५४/नवि-२३, दि. २६ सपटेंबर २०१६ अन्वयेे पनवेेल नगरपरिषदेचेे संपूर्ण क्षेत्र व २९ महसुली गावांच्ा

क्षेत्ासाठी पनवेेल महानगरपालिकेची स्थापना करण्ात आली असून ती दिनाकं १ ऑकटोबर २०१६ पासून अस्तितवात आली आहेे ;

आणि ज्ाअर्थी, पनवेेल महानगरपालिका हद्ीमध्येे उकत एम एम आर डी ए विकास योजनेेतील ११ महसुली गांवाचा समावेेश

करणेेत आलेेला आहेे ;

आणि ज्ाअर्थी, उकत अंतिम विकास योजना व उकत मंजूर एम एम आर डी ए विकास योजना या एकमेेकांना लागून आहेेत आणि

मंजूर विकास योजनेेतील रस्तेे उकत मंजूर ततकालीन एम एम आर डी ए विकास योजनेेतील तळोजेे मजकूर या महसुली गावाच्ा हद्ीप्यंत

तयार करण्ात आलेेलेे आहेे ;

आणि ज्ाअर्थी, उकत अंतिम विकास योजना व उकत मंजूर एम एम आर डी ए विकास योजनामध्येे Missing Links असल्ानेे

पनवेेल महानगरपालिका क्षेत्ातील वाहतूक सोयीची व दळणवळण सुकर होण्ासाठी नवीन जोड रस्तेे तयार करणेे गरजेचेे आहेे ;

आणि ज्ाअर्थी, महाराष्ट्र महानगरपालिका अधिनियमाचेे कलमेे २०५, २०६ व २०९ अन्वयेे महानगरपालिका क्षेत्ामध्येे नवीन रस्तेे

तयार करणेे, रसत्याची रूंदी निश्ित करणेे व रस्त्यांची सुधारणा करणेचा अधिकार महानगरपालिकेला आहेे ;

आणि ज्ाअर्थी, वरील संदर्भ उकत करण्ासाठी पनवेेल महानगरपालिकेच्ा सर्वसाधारण सभेेनेे ठराव क्र. १९० दि. ०५ सपटेंबर

२०१९ अन्वयेे आयुकत, पनवेेल महानगरपालिका यांना प्ाधिकृत केलेे आहेे ;

आणि ज्ाअर्थी, परिशिष्टष्ट ‘अ’ व परिशिष्टष्ट ‘ब’ मध्येे नमूद केलेेल्ा मौजेे- तळोजा मजकूर या महसुली गावाच्ा स. नं. १३१ पासून

तेे मौजेे- घोट या महसुली गावाच्ा स. नं. ६६ प्यंत १५.०० मी. रंदीचा नवीन सार्वजनिक रसता आखणेे व तयार करण्ाबाबत महाराष्ट्र

महानगरपालिका अधिनियमाचेे कलमेे २०५, २०६ व २०९ अन्वयेे या कार्यालयाचेे जाहीर प्रकटन जा. क्र. पमपा/नरवि/रस्तेे/२६-२१/

प्र.क्र.०६/२०३३/२०२१, दि. ०८ ऑकटोबर २०२० अन्वयेे महाराष्ट्र शासनाचे असाधारण राजपत्र क्र. ७९, दि. ०८ ऑकटोबर २०२१

व दि. ०९ ऑकटोबर २०२१ च्ा दै. रामप्रहार, दै. नवाकाळ, दै. किल्लेे रायगड व दै. नवराष्ट्र या वृत्तपत्ात प्रसिद्धीद्धी देेऊन वरील प्रकटन

शासनाचया राजपत्रात प्रसिद्ध झालेेल्ा दिनांकापासून ३० दिवसांच्ा आत नागरिकांकडून हरकती व सूचना मागविण्ात आलेेल्ा

आहेेत ;

आणि ज्ाअर्थी, वरील रसत्ाच्ा आखणीबाबत नागरिकांकडून विहित मुदतीत कोणत्ाही हरकती व सूचना प्ापत झाल्ा नाहीत ;

आणि ज्ाअर्थी, नवीन सार्वजनिक रसत्याची आखणी व संरेेखांकनमध्येे किरकोळ बदल करून करण्ास अंतिम मान्यता देेण्ात

आली आहेे ;

त्ाअर्थी, मी गणेेश देेशमुख, आयुकत, पनवेेल महानगरपालिका मला प्ापत अधिकारांन्वयेे खालील परिशिष्टष्ट ‘अ’ मध्येे विनिर्दिष्टष्ट

केलेेल्ा नवीन जोड रसत्याची आखणी व परिशिष्टष्ट ‘ब’ मध्येे नकाशात दर्शविल्याप्रमाणेे रसत्याचेे संरेेखांकन मंजूर करीत आहेे. सदर

परिशिष्टष्ट ‘अ’ व परिशिष्टष्ट ‘ब’ च्ा प्रति नागरिकांच्ा पाहणी करीता सहाय्यक संचालक, नगररचना विभाग, पनवेेल महानगरपालिका

यांचेे कार्यालयात कार्यालयीन दिवशी व कार्यालयीन वेेळेत नागरिकांच्ा अवलोकनार्थ १ महिन्ांच्ा कालावधीसाठी उपलब्ध राहील.

PANVEL MUNICIPAL CORPORATION

Public Notice

Maharashtra Municipal Corporation Act, 1949 Sections 205, 206 & 209

No. PMC/TPD/ROADS/26-21/S.No. 06/2464 /2021.—Whereas the Ambarnath – Kulgaon

Badlapur & Surrounding Notified area Development Plan has been sanctioned by the Government

of Maharashtra in Urban Development Department vide Notification No. TPS – 1204/941/CR – 1630/

UD -12, dated 25th July 2005 and it has came into force with effect from 12th August 2005 (hereinafter

referred as the said MMRDA Development plan);

And Whereas, the Government, in exercise of the powers conferred by section 113(1) of the

Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as “said Act”) has

designated site for New – Town of Navi Mumbai( hereinafter referred to as “Said New Town”)

vide Urban Development and Public Health Department’s (UD and PH) Notification No. RPB.

1171/18124/I.W., dated the 20th March 1971 and CIDCO has been appointed as New Town

Department Authority (NTDA) for the said New Town Under Section 113(3A) of the said Act vide

Urban Development and Public Health Department’s Notification No. RPB. 117/18124/II.W., dated

the 20th March 1971;

And whereas, the Government in exercise of the Powers conferred by section 31(1) of the said

Act vide UD and PHD’s Notification No.RPB. 1175/635/UD-5, dated the 18th January 1980 has been

sanctioned the Draft Development Plan (hereinafter referred to as said Final Development Plan)

in the form of structural plan submitted by CIDCO for the said New Town area and the said Final

Development Plan came into force with effect from 1st March 1980 ;

And whereas, the Government in exercise of the power conferred by section 3 of the

Maharashtra Municipal Corporation Act, 1949 (hereinafter referred to as the “said MMC Act”)

vide the Urban Development Department Notification No. PNP.2014/VIP No. 301/CR. 354/UD/23

dated the 26th September 2016 constituted the Panvel Municipal Corporation for the areas of

whole area of Panvel Municipal Council & 29 revenue villages specified therein, which came

into force with effect from 1st October 2016 ;

And whereas; the said MMRDA Development Plan’s 11 revenue villages has been included

in the Panvel Municipal Corporation Area;

And whereas, the said Final Development Plan & said MMRDA Developed Plan are adjacent

to each other and the roads already developed in the said Sanctioned Development plan are

upto the boundary limit of Taloje Majkur revenue village in said earstwhile MMRDA Development

Plan;

And whereas there are Missing links in the said Final Development Plan & the said

MMRDA Development Plan it has become expedient to connect the Missing Links by preparing

new roads so as to enable the traffic Smoothly & to make the conveniently traffic within the

Panvel Municipal Corporation;

And whereas, as per the provisions of the said MMC Act, Sections 205, 206, & 209 empowers

the Municipal Corporation to prepare the new roads, to decide the width of the roads and to

improve the roads within the Municipal Corporation Area;

And whereas, the Panvel Municipal Corporation vide General Body Resolution No. 190

dated 5th September 2019 delegated the powers under sections 205, 206 & 209 of the said MMC

Act to Commissioner, Panvel Municipal Corporation;

And whereas, Panvel Municipal Corporation has published the Notice vide No. PMC/TPD/

Roads/26-21/S.No.06/2033/2021, dated 8th October 2021 in Maharashtra Government Extra-

Ordinary Gazette No. 79, dated 8th October 2021 and published in Daily Ramprahar and Daily

Navakal, Daily Kille Raigad and Daily Navrashtra newspapers on 9th October 2021 for inviting

suggestions and objections to the said proposed draft alignment of New Public 15.00 M wide Road

from S.No.131 of Taloja Majkur Revenue Village to S.No. 66 of Ghot Revenue Village as shown

in the Annexure ‘A’ and Annexure ‘B’ with the provisions contained in the Sections 205, 206 and

209 of Maharashtra Municipal Corporation Act, 1949 from the public thereof within 30 days

from the date of publication of the notice in Maharashtra Government Extra-Ordinary Gazette ;

And whereas, no any suggestions and objections received from public within prescribed

period;

And whereas, proposed alignment of New Public Road has been sanctioned with some minor

correction;

Therefore, as per the powers delegated by Panvel Municipal Corporation to the

Commissioner, Panvel Municipal Corporation and in exercise of the powers, I, Ganesh Deshmukh,

Commissioner, Panvel Municipal Corporation hereby sanctions the alignment of proposed new

road as mentioned in the Annexure ‘A’ and plan appended hereto Annexure ‘B’ showing the

alignment of new road is kept open for the inspection of general public on all working days and

in working hours in office the of the Assistant Director of Town Planning, Panvel Municipal

Corporation for a period of one month.

Layout and make a new public street/road from S.No.131 of Mouje Taloja Majkur revenue village

to S.No.66 of Mouje Ghot revenue village.
