२० ए अंतर्गत प्रापत अधिकारानवये केंद्र शासनाने पारित केलेलया आदेशास अनुसरुन महाराष्ट्र शासन खालीलप्रमाणे जिलहा खनिज

प्रतिष्ान (प्रनयास) नियम,२०१६ मधये सुधारणा करीत आहे :—

१. सदर नियमास महाराष्ट्र जिलहा खनिज प्रतिष्ान (प्रनयास) नियम, (प्रथम सुधारणा ) २०२१ असे महणावे.

२. महाराष्ट्र जिलहा खनिज प्रतिष्ान (प्रनयास) नियम, २०१६ (यापुढे सदर नियमास “मुखय नियम” संबोधले जाईल) मधील

नियम ५ चया उपनियम (१) ते (३) ऐवजी खालीलप्रमाणे उपनियम राहतील :—

(१) प्रतिष्ान प्रनयासाचे वयवसथापन नियामक परिषदेकडे विहित करणयात येईल, जी राजय शासनाकडून नियुकत केलेलया

सर्व विशवसथांची बनलेली असेल. सदर नियामक परिषदेमधये अधयक्ष, सदसय आणि सदसय सचिव यांचा अंतर्भाव खालील

उपनियमानवये विहित केलयानुसार असेल.

(२) संबंधित जिल्ह्ाचे जिल्हाधिकारी हे नियामक परिषदेचे अधयक्ष असतील.

(३) संबंधित जिलहयाचे लोोकसभा सदसय हे नियामक परिषदेचे सदसय असतील, जर संबंधित जिल्ह्ात एकापेक्षा अधिक

लोोकसभा सदसय असतील तर असे सर्व लोोकसभा सदसय नियामक परिषदेचे सदसय असतील. तथापि, सदरचा लोोकसभा मतदारसंघ

जर एकापेक्षा अधिक जिल्ह्यांांमधये येत असलयास संबंधित लोोकसभा सदसय हे सदर लोोकसभा मतदारसंघात अंतर्भूत सर्व जिल्ह्यांांचया

जिलहा खनिज प्रतिष्ांनचया नियामक परिषदेवर सदसय असतील.

(३अ) महाराष्ट्र राजयातील राजयसभा सदसय हे ते निवडतील तया कोोणतयाही एका जिल्ह्ाचया जिलहा खनिज

प्रतिष्ानचया नियामक परिषदेवर सदसय असतील. तयासाठी संबंधित राजयसभा सदसय जया जिल्ह्ाचया जिलहा खनिज

प्रतिष्ानचया नियामक परिषदेवर सदसय महणून नियुकती होोणयास इच्ूक असेल, तया जिल्ह्ाचे नाव शासनाचया खनिकर्म

विभागाचया सचिव/ प्रधान सचिव/ अपर मुखय सचिव यांना कळवतील व संबंधित खनिकर्म विभागाचे सचिव/ प्रधान सचिव/

अपर मुखय सचिव हे राजयसभा सदसयांनी निवडलेलया जिल्ह्ाचया संबंधित जिल्हाधिकारी यांना राजयसभा सदसयांचे नाव

कळवतील.

(३ब) संबंधित जिल्ह्ातील विधानसभा सदसय हे जिलहा खनिज प्रतिष्ानचया नियामक परिषदेचे सदसय असतील.

(३क) विधानपरिषदेचे सदसय हे तयांनी निवडलेलया जिल्ह्ाचया जिलहा खनिज प्रतिष्ानचया नियामक परिषदेचे सदसय

असतील. संबंधित विधानपरिषद सदसय हे जया जिल्ह्ाचया खनिज प्रतिष्ानचया नियामक परिषदेवर सदसय महणून नियुकत

होोणयास इच्छुक असतील, तया जिल्ह्ाचे नाव शासनाचया खनिकर्म विभागाचया सचिव/प्रधान सचिव/अपर मुखय सचिव

यांना कळवतील व संबंधित खनिकर्म विभागाचे सचिव/प्रधान सचिव/अपर मुखय सचिव हे संबंधित विधानपरिषद सदसयांनी

निवडलेलया जिल्ह्ाचया जिल्हाधिकारी यांना संबधित विधानपरिषद सदसयांचे नाव कळवतील.

(३ड) जिलहा खनिज प्रतिष्ानचया नियामक परिषदेवर खालील अधिकारी हे पदसिधद सदसय असतील :—

(ऐ) मुखय कार्यकारी अधिकारी जिलहा परिषद

- पदसिधद सदसय

(बी) नगरपालिका/नगरपरिषद/महानगरपालिका यांचया हद्ीत खाण बाधित

- पदसिधद सदसय

क्षेत्र असलयास सदर स्थानिक सवराजय संसथेचे प्रशासकीय प्रमुख

(सी) जिलहा वयवसाय व प्रशिक्षण अधिकारी

- पदसिधद सदसय

(डी) जिलहा आदिवासी विकास अधिकारी

- पदसिधद सदसय

(ई) जिलहा आरोोगय अधिकारी

- पदसिधद सदसय

(एफ) कार्यकारी अभियंता, जिलहा परिषद

- पदसिधद सदसय

(जी) जिलहा महिला व बालविकास अधिकारी

- पदसिधद सदसय

(एच) महावयवसथापक, जिलहा उद्योग केंद्र

(३ई) जिलहा खनिकर्म अधिकारी हे नियामक परिषदेचे पदसिधद सदसय सचिव असतील.

३. मुखय नियमांचया नियम ८ चया उप-नियम (३) ऐवजी खालील उपनियमाचा समावेश करणयात येत आहे :—

(३अ) वयवसथापकीय समितीमधये खालील सदसयांचा समावेश असेल,

NOTIFICATION

Mines and Minerals (Development and Regulation) Act, 1957.

No. DMF-0621/C.R. No. 57/Ind-9.—In exercise of the powers conferred by sub-section (3) of section

9B and sub-section (4) of section 15 of the Mines and Minerals (Development and Regulation) Act,

1957 (67 of 1957), in it’s application to the State of Maharashtra and in pursuance to the directions

issued by the Government of India under section 20A of the said Act, the Government of Maharashtra

hereby makes the following rules to amend the Maharashtra District Mineral Foundation (Trust)

Rules, 2016, namely :—

1. These rules may be called the Maharashtra District Mineral Foundation (Trust) (First

Amendment) Rules, 2021.

2. In rule 5 of the Maharashtra District Mineral Foundation (Trust) Rules, 2016 (hereinafter

referred to as “the principal Rules”), for sub-rules (1) to (3) the following sub-rules shall be

substituted, namely :—

“(1) The management of the District Mineral Foundation Trust shall vest in the

Governing Council, which shall consist of all the Trustees of the Trust appointed by the

State Government. The Governing Council shall consist of the Chairman, members and

Member-Secretary as specified in the following sub-rules.

(2) The District Collector of the District shall be the Chairman of the Governing Council.

(3) The Member of the House of the People (Lok Sabha) in a district shall be the member

of the Governing Council.

In case, there are more than one Member of the House of the People (Lok Sabha) in a

district, then all such Members of the House of the People (Lok Sabha) in a district shall

be the members of the Governing Council. In case, the constituency of one Member of the

House of the People (Lok Sabha) falls in more than one district, then the Member of the

House of the People (Lok Sabha) shall be a member of the Governing Council of District

Mineral Foundation of all such districts.

(3A)

The Member of Council of States (Rajya Sabha) from a State shall be the member

of the Governing Council of District Mineral Foundation of one district selected by them.

The Member of Council of States (Rajya Sabha) shall intimate the name of the district

selected by them to the Secretary/ Principal Secretary/ Additional Chief Secretary (Mining),

Industries, Energy and Labour Department, who in turn shall inform the concerned District

Collector.

(3B)

The Members of Legislative Assembly in the district shall be the members of

the Governing Council.

(3C)

The Members of Legislative Council shall be the members of the Governing

Council of the District Mineral Foundation Trust of one district selected by them. The

Members of Legislative Council shall intimate name of the district selected by them to the

Secretary/ Principal Secretary/ Additional Chief Secretary (Mining), Industries, Energy

and Labour Department,, who in turn shall inform the concerned District Collector.

(3D) The following officers shall be the Ex-Officio Members of the Governing Council:-

(a) Chief Executive Officer, Zilla Parishad.

Ex-Officio Member.

(b) Administration Officer of the Municipal Corporation or

Municipal Council, if the mine affected areas are within

the limits of Municipal Corporation or Municipal Council.

Ex-Officio Member.

3. In rule 8 of the principal Rules, after sub-rule (3), the following sub-rule shall be added,

namely :—

“(3A) The Managing Committee shall consist of the following Members :—

(a)

The District Collector of the District

Chairman.

(b)

Chief Executive Officer, Zilla Parishad.

Ex-Officio Member.

(c)

District Vocation Training Officer

Ex-Officio Member.

(d)

District Tribal Welfare Officer

Ex-Officio Member.

(e)

District Health Officer

Ex-Officio Member.

(f)

Executive Engineer, Zilla Parishad

Ex-Officio Member.

(g)

District Women and Child Development Officer

Ex-Officio Member.

(h)

General Manager, District Industries Center (DIC)

Ex-Officio Member.

(i)

One representative of Pollution Control Board

Ex-Officio Member.

(j)

One representative of Mine Operating Agency or

Mine Lessee in the District

Member.

(k)

One representative of Non-Government

Organization’s (NGO’s) in the District

Member.

Member-Secretary.”.
