उक्त अिधिनयमाचे कलम 37(1कक)(ग) अन्वये अिधसूचना .

Ďमांक िटपीबी-4321/Ģ.Ď.12/2021/निव-11.–ज्याअथȓ, महाराष्Ę Ģादेिशक व नगररचना अिधिनयम, 1966 (यापुढे ज्याचा उल्लेख

“उक्त अिधिनयम” असा करणेत आलेला आहे.) च्या तरतुदींनुसार बृहन्मुंबई महानगरपािलका त्यांचे अिधकारक्षेĝाकिरता (यापुढे ज्याचा उल्लेख

“उक्त महानगरपािलका” असा करणेत आलेला आहे.) िनयोजन Ģािधकरण आहे;

आिण ज्याअथȓ, उक्त अिधिनयमाच्या कलम 31, पोट-कलम (1) अन्वये Ģाप्त अिधकारांचा वापर कǘन राज्य शासनाने अिधसूचना

Ďमांक िटपीबी-4317/629/Ģ.Ď.118/2017/िव.यो./निव-11, िदनांक 8 मे 2018 (यापुढे याचा उल्लेख “उक्त अिधसूचना” असा करण्यात

आलेला आहे) ǎारे बृहन्मुंबई ĢाǗप िवकास योजना-2034 सह िवकास िनयंĝण व Ģोत्साहन िनयमावली-2034 (यापुढे ज्याचा उल्लेख “उक्त

िनयमावली 2034” असा करणेत आलेला आहे) ला उक्त अिधसूचनेसोबतचे ‘पिरिशष्ट-ब’ मध्ये दशर्िवलेले सारभूत स्वǗपाचे फेरबदल

(ई.पी.) वगळून उक्त अिधसूचनेसोबतचे ‘पिरिशष्ट-अ’ मध्ये दशर्िवलेल्या सुधारणेसह मंजूरी िदली आहे. आिण ज्याअथȓ, शासनाने उक्त

अिधसूचनेस समĎमांकाचे शुǉीपĝक िदनांक 22 जून 2018 रोजी िनगर्िमत केले असून त्यानुसार उक्त िनयमावली -2034, िदनांक 1 सप्टेंबर

2018 पासून अंमलात आली आहे. आिण ज्याअथȓ, त्यानंतर उक्त अिधसूचनेस शासनाने समĎमांकाचे शुǉीपĝक व पुरकपĝ िदनांक 29 जून,

2018 रोजी पािरत केले असून सदर शुǉीपĝक व पुरकपĝ महाराष्Ę शासनाच्या राजपĝात िदनांक 30 जून, 2018 रोजी Ģिसǉ करण्यात

आले आहे;

आिण ज्याअथȓ, शासनाने िदनांक 21 सप्टेंबर 2018 रोजीच्या अिधसूचनेǎारे उक्त िनयमावली-2034 मधील सारभूत स्वǗपाचे बदल

ईपी-1 ते ईपी-168 ला (ठरािवक ईपी व िनणर्याथर् Ģलंिबत ठेवलेल्या ठरािवक तरतुदी वगळून) मंजूरी Ģदान केली आहे;

आिण ज्याअथȓ, शासन नगरिवकास िवभागास ई.पी. मंजूरीच्या िदनांक 21 सप्टेंबर 2018 रोजीच्या शासन अिधसूचनेमध्ये आिण उक्त

िनयमावलीच्या मंजूर तरतुदीमध्ये इतर काही टंकलेखनाच्या ĝुटी व चूका असल्याचे िनदशर्नास आले आहे आिण शासनाने अपेिक्षल्यानुसार

आयुक्त, बृहन्मुंबई महानगरपािलका यांचे अिभĢाय त्यांचेकडील िदनांक 6 नोव्हेंबर 2018 रोजीचे पĝान्वये नगरिवकास िवभागास Ģाप्त झाले

आहे. आिण ज्याअथȓ, आयुक्त, बृहन्मुंबई महानगरपािलका यांनी केलेल्या िवनंतीनुसार उक्त िनयमावलीस शासन नगरिवकास िवभागाने

िदनांक 12 नोव्हेंबर 2018 रोजी शुǉीपĝक िनगर्िमत केले आहे. आिण ज्याअथȓ, काही सुधारणा हया सारभूत स्वǗपाच्या असून उक्त

िनयमावलीतील काही मंजूर तरतुदींच्या अथर्बोधाची स्पष्टता कǗन सुसंगती आणणे आिण उक्त िनयमावली ही सवर्समावेशकिरत्या लागू

होण्याची बाब िवचारात घेता सावर्जिनक िहताच्या दृष्टीने उक्त िनयमावलीमध्ये सुधारणा करणे आवश्यक आहे, अशी शासन नगरिवकास

िवभागाची खाĝी झाली आहे;

आिण ज्याअथȓ, उपरोक्त पिरȎस्थती व वस्तुȎस्थती िवचारात घेता आिण उक्त अिधिनयमाचे कलम 37 च्या पोट कलम (1कक) अन्वये

Ģाप्त अिधकार आिण त्या संदभɕतील सवर् शक्तींचा वापर कǘन उक्त िनयमावली-2034 चे काही िविनयमांमध्ये फ़ेरबदल करण्यासाठी

महाराष्Ę शासनाने िदनांक 13 नोव्हेंबर 2018 रोजीची सूचना (यापुढे िजचा उल्लेख “उक्त सूचना” असा केलेला आहे) Ģिसǉ केली होती व

त्यातील पिरिशष्टामध्ये नमूद फ़ेरबदलावर (यापुढे याचा उल्लेख “Ģस्तािवत फ़ेरबदल” असा केलेला आहे) नागिरकांच्या हरकती/सूचना

मागिवल्या होत्या आिण Ģाप्त हरकतीं/सूचना संदभɕत संबंिधत व्यक्तींना तसेच िनयोजन Ģािधकरणास सुनावणी देऊन शासनास अहवाल सादर

करणेसाठी उप संचालक, नगररचना, बृहन्मुंबई (यापुढे त्यांचा उल्लेख “उक्त अिधकारी ” असा केलेला आहे ) यांची िनयुक्ती केली होती;

आिण ज्याअथȓ उक्त िदनांक 13 नोव्हेंबर 2018 रोजीची सूचना महाराष्Ę शासन राजपĝामध्ये (असाधारण भाग 1- कोकण िवभागीय

पुरवणी) (यापुढे याचा उल्लेख “शासकीय राजपĝ” असा केलेला आहे.) िदनांक 14 नोव्हेंबर 2018 रोजी Ģिसǉ झालेली आहे आिण उक्त

अिधकारी यांनी त्यांचा अहवाल िदनांक 27 ऑगस्ट 2019 रोजीचे पĝाǎारे संचालक, नगररचना, महाराष्Ę राज्य, पुणे यांचेमाफ़र्त कलम

37(1कक) खालील वैधािनक कायर्वाही पुणर् कǘन शासनास सादर केलेला आहे;

आिण ज्याअथȓ, उक्त अिधकारी यांचा अहवाल िवचारात घेता व संचालक, नगररचना, महाराष्Ę राज्य, पूणे यांचेशी सल्लामसलत

केल्यानंतर Ģस्तुत फेरबदलातील िविनयम 15(2)(c) वरील िनणर्य Ģलंिबत ठेवण्याचे व उवर्िरत फेरबदल ठरािवक सुधारणेसह मंजूर करणे

आवश्यक असल्याचे शासनाचे मत झालेले आहे;

आता त्याअथȓ, उक्त अिधिनयमाच्या कलम 37(1कक)(ग) अन्वये Ģाप्त अिधकार व त्या संदभɕतील सवर् शक्तींचा वापर कǘन शासन

याǎारे :---

(अ) उक्त Ģस्तािवत फेरबदलामधील िविनयम 15(2)(c) वगळून उवर्िरत फेरबदलास, सोबतच्या पिरिशष्टामध्ये नमूद

केल्याĢमाणे ठरािवक सुधारणेसह मंजूरी देत आहे.

(ब) सदरची अिधसूचना शासकीय राजपĝामध्ये Ģिसǉ झालेचा िदनांक हा उक्त फ़ेरबदल अंमलात आलेचा िदनांक असेल.

(क) बृहन्मुंबई महानगरपािलकेस उक्त िनयमावली-2034 चे मंजूरी सोबतच्या फ़ेरबदलाचे पिरिशष्टामध्ये शेवटच्या नोंदीनंतर

सोबत जोडलेले पिरिशष्ट समािवष्ट करणेचे िनदȃश देत आहे.

सदर अिधसूचना महाराष्Ę शासनाच्या www.maharashtra.gov.in (कायदे /िनयम ) या वेबसाईटवर देखील उपलब्ध करण्यात यावी.

NOTIFICATION

Maharashtra Regional and Town Planning Act, 1966.

Sanction to Modification in the Development Control and Promotion Regulations-2034 for

Greater Mumbai under Section 37(1AA)(c) of the said Act.

No.TPB-4321/CR-12/2021/UD-11.— Whereas, the Municipal Corporation of Greater Mumbai

is the Planning Authority for the area within its jurisdiction (hereinafter referred to as “the said

Corporation”) as per the provision of Maharashtra Regional and Town Planning Act, 1966

(hereinafter referred to as “the said Act”) ;

And whereas, in exercise of the powers conferred by sub-section (1) of Section 31 of the said

Act, the State Government vide Notification No. TPB-4317/629/CR-118/2017/DP/UD-11, dated 8th

May 2018 (hereinafter referred to as “the said Notification”) has accorded sanction to the Draft

Development Plan-2034 of Greater Mumbai alongwith the Development Control and Promotion

Regulations-2034 for Greater Mumbai (hereinafter referred to as “the said Regulations”) with

modifications shown in SCHEDULE-A appended to the said Notification excluding the substantial

modifications as shown in SCHEDULE-B appended to the said Notification. And whereas,

Government has issued a corrigendum of even number dated 22nd June, 2018 as per which the

said Regulations have come into force from 1st September 2018. And whereas, thereafter

Government has issued a Corrigendum and Addendum of even number dated 29th June, 2018 to

the said Notification, which is published in Government Gazette dated 30th June, 2018 ;

And whereas, the Government of Maharashtra vide Notification dated 21st September 2018

has sanctioned EP-1 to EP-168 (Excluding certain EP and provisions which were kept in abeyance)

in the said Regulations ;

And whereas, the Government of Maharashtra vide Notification dated 12th November 2018

has issued a corrigendum in respect of some typographical errors and mistakes and also to clarify

and co-relate certain provisions of said Regulations for its proper interpretation ;

And whereas, Government in Urban Development Department has noticed that there are

some typographical errors and mistakes in the Notification dated 21st September 2018 sanctioning

the E.P. and in the sanctioned provisions of said Regulations and the Government has called

remarks of the Commissioner, Municipal Corporation of Greater Mumbai, which are received vide

letter dated 6th November 2018. And whereas, as per the request of the Commissioner, Municipal

Corporation of Greater Mumbai a corrigendum dated 12th November 2018 is issued by the

Government in Urban Development Department to the said Regulations. And whereas, certain

corrections which are of substantial nature and cannot be included in corrigendum. And whereas,

the Govt., in the Urban Development Department is satisfied that to clarify and co-relate certain

provisions of the said Regulations for its proper interpretation and in the applicability of the said

Regulations in a comprehensive manner in the public interest it is expedient to modify the said

Regulations ;

And whereas, after considering the above facts and circumstances and in exercise of the

powers conferred by sub-section (1AA) of section 37 of the said Act and all other powers enabling in

that behalf, Government of Maharashtra has published a Notice dated 13th November, 2018

(hereinafter referred to as “the said Notice”) for inviting objections/suggestions from the general

public with regard to the modifications in some of the Regulations of the said Regulations as stated

in the Schedule in the said Notice (hereinafter referred to as “the proposed modification”) and

appointed the Deputy Director of Town Planning, Greater Mumbai as the officer (hereinafter

referred to as “the said officer”) to submit a report on the objections/suggestions received in respect

of the proposed modification to the Government after giving hearing to the concerned persons and

the said Authority ;

And whereas, the said Notice dated 13th November, 2018 was published in the Maharashtra

Government Gazette (Extra-Ordinary Part 1- Kokan Division supplement) (hereinafter referred to

as “the official Gazette”) dated 14th November 2018 and the said officer has submitted his report to

the Government vide letter dated 27th August 2019 through the Director of Town Planning,

Maharashtra State, Pune after completing the legal procedure as stipulated under Section 37(1AA)

of the said Act ;

And whereas, after considering the report of the said officer and after consulting the Director

of Town Planning, Maharashtra State, Pune, the Government is of the opinion that decision in

respect of modification in Regulation 15(2)(c) is to be kept in abeyance and remaining proposals in

the proposed modification are required to be sanctioned with certain changes ;

Now therefore, in exercise of the powers conferred upon it under section 37(1AA)(c) of the said

Act, the Government hereby :-

(A) Sanctions the proposed modification excepting regulation 15(2)(c), with certain changes as

described more specifically in the Schedule appended herewith ;

(B) Fixes the date of publication of this Notification in the Official Gazette as the date of

coming into force of this modification.

Modifications sanctioning the said regulations, after the last entry, the Schedule referred to at (A)

above shall be added.

This Notification shall also be made available on the Government of Maharashtra website

www.maharashtra.gov.in (Acts & Rules).
