NOTIFICATION

MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT, 1961.

No. IDC. 2021/(C.R.343)/IND 14.—In exercise of the powers conferred by clause (g) of section

2 of the Maharashtra Industrial Development Act, 1961 (Mah. III of 1962), the Government of

Maharashtra hereby declares the areas mentioned in the Schedule Village Khadpoli, Taluka

Chiplun, District Ratnagiri appended hereto to be an “Industrial Area”, for the purposes of the

said Act.

अन्वये महाराष्Ę शासनाने सदर अिधसूचनेच्या अनुसूचीत उल्लेिखलेल्या क्षेĝात महाराष्Ę औǏोिगक िवकास अिधिनयम, 1961

(1962 चा महा. तीन) (यापुढे ज्याचा उल्लेख “उक्त अिधिनयम” असा करण्यात येईल) चे कलम सहा, िदनांक 2 ऑगस्ट 1996

रोजी अंमलात आणले होते व उक्त अिधिनयमाच्या आधारे मौजे िंशदे, तालुका खेड, िज. पुणे येथील उक्त अनुसूचीत नमूद केलेले

क्षेĝ अिधिनयमाच्या कलम 2, खंड (ग) अन्वये औǏोिगक क्षेĝ म्हणून जाहीर केलेले आहे ;

आिण ज्याअथȓ, उपिवभागीय अिधकारी जुन्नर, उपिवभाग खेड, िज. पुणे यांनी उक्त अिधिनयमातील कलम 32 च्या

पोट-कलम (1) नुसार, भाग 1 पुरवणी, पृष्ठ Ď. 2944 ते 2960 वर िदनांक 21 ऑगस्ट 2008 च्या महाराष्Ę शासनाच्या

राजपĝात नोटीस Ďमांक Ď. सजल/भूस/एसआर-25/1996, िदनांक 8 ऑगस्ट 2008 Ģिसध्द कǗन, उक्त औǏोिगक

क्षेĝासाठी भूसंपादन ĢिĎया सुǗ केली आहे आिण उक्त कलम 32 च्या पोट-कलम (4) नुसार उक्त नोटीसेत नमूद केलेले क्षेĝ

सवर्भार मुक्त होवून राज्य शासनाच्या ठायी िनहीत झाले आहे ;

आिण ज्याअथȓ, यासोबत जोडलेल्या अनुसूचीत उल्लेिखलेल्या मौजे िंशदे, तालुका खेड, िज. पुणे येथील जिमनी

अिधसूचनेच्या अनुसूचीत उल्लेिखलेल्या क्षेĝात (यापुढे ज्याचा उल्लेख “उक्त क्षेĝ” असा करण्यात येईल) औǏोिगक क्षेĝाच्या

िवकासासाठी आवश्यक नाहीत असे महाराष्Ę शासनाचे मत झाले आहे.

त्याअथȓ आता, उक्त अिधिनयमाच्या कलम 32 च्या पोट-कलम (4) मधील परंतुक व इतर अिधकारांचा वापर कǗन राज्य

शासन उक्त जमीन संपादनातून काढून घेत आहे आिण असे घोिषत करीत आहे की, ही सूचना महाराष्Ę शासन राजपĝात

Ģिसǉ झाल्यानंतर कलम 32 च्या पोट-कलम (1) नुसार नोिटस Ģिसǉ होण्याच्या लगतपूवȓ उक्त जमीन िजच्याकडे िनहीत होती

त्या व्यȎक्तकडे ती त्यावेळी अȎस्त्वात असतील असे भारांना अिधन राहून पूवर्लक्षी Ģभावासह पुनȌनिहत होईल.

NOTIFICATION

MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT, 1961.

No. IDC. 2021/(C.R.637)/IND 14.— Whereas, by the Government Notification, Industries,

Energy and Labour Department No. IDC 2196/(2774)/IND 14, dated the 1st August 1996, issued

in exercise of the powers conferred by sub-section (3) of section 1 of the Maharashtra Industrial

Development Act, 1961 (Mah. III of 1962) (hereinafter referred to as “the said Act”), the

Government of Maharashtra has appointed the 2nd August 1996, to be the date from which the

provisions of Chapter VI of the said Act shall take effect in certain areas of village Shinde in

Taluka Khed of District Pune mentioned in the Schedule appended to the said notification and

declared those areas as an industrial area under clause (g) of section 2 of the said Act ;

And whereas, as per the provisions of the said Act, the Sub Divisional Officer Junnar,

Sub Division Khed, District Pune has by issuing notice No. सजल/भूस/एसआर-25/1996 dated 8th

August 2008, published in the Maharashtra Government Gazette, Part I Supplementary, Pune

Divisional Supplement, Ordinary dated 21st August 2008, on pages 2944 to 2960, under

sub-section (1) of section 32 of the said Act, initiated the process for the acquisition of lands in the

said industrial area, and as such, the lands mentioned in the said notice have vested absolutely in

the State Government free from all encumbrances under sub-section (4) of said section 32 ;

And whereas, the actual possession of the land mentioned in the Schedule appended hereto

(hereinafter referred to as “the said area”) is not taken by or on behalf of the State Government

and it has appeared to the State Government that the said land is no more required for the

purpose of the said Act.

Now, therefore in exercise of the powers conferred by the proviso to sub-section (4) of section

32 of the said Act and of all other powers enabling it in that behalf, the Government of

Maharashtra hereby withdraws the said land from acquisition and declares that, on the

publication of this Notice in the Maharashtra Government Gazette, the said land shall re-vest

with retrospective effect in the person in whom it was vesting immediately before the publication

of the notice under sub-section (1) of said section 32, subject to such encumbrances, if any, as may

be subsisting at that time.
