MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

No. DP-Thane/Mouje-Majiwade/ITP/CR-120/21/TPV-3/525.— Whereas, the Government in

Urban Development Department, vide its Notification No.TPS-1297/1319/C.R.148/97/UD-12, dated

4th October, 2019 has sanctioned the Development Plan for the Thane City (hereinafter referred

to as “the said Development Plan”) with Development Control Regulation under section 31 (1) of

the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as “the said

Act”) which has come into force with effect from the 22nd November, 1999 ;

And whereas, the Government of Maharashtra in the Urban Development Department vide

Notification No. TPS-1204/Thane DP DCR/UD-12, dated 25th May 2006 sanctioned Development

Control Regulations for the Thane Municipal Corporation under the provisions of sub-section

37(2) of the said Act, in order to incorporate the regulations for Development of Special Townships

Project (hereinafter referred to as “the said Regulations”) ;

And whereas, the Government of Maharashtra in the Urban Development Department vide

Notification No. TPS-1219/CR-109/19/UD-12, dated 16th September 2019 has been sanctioned

Regulations of Integrated Township Project for the Thane Municipal Corporation under the

provisions of sub-section (1AA)(C) of section 37 of the said Act (hereinafter referred to as “the

said Integreted Township Regulations”) ;

And whereas, the Government in Urban Development Department has declared and grants

Location Clearance for the Special Township Project proposed by M/s. Kapstone Constructions

Pvt. Ltd. (hereinafter referred to as “the said Project Proponant”) in Mouje Majiwade, Taluka

and District-Thane on land admeasuring area of 48.2001 Ha. (119.13 Acre), vide Government

Notification No.CMS/TPS-1207/220/CR-541/08/UD-12, dated 24th August 2009 and thereafter

Government in Urban Development Department has rectified area of Special Township Project

as to 45.133 Ha. approximataly vide Corrigendum No. TPS 1212/ANS-114/C.R.2/13/UD-12, dated

14th January 2013 and thereafter Government has rectified area of said Township as to 47.3218

Ha. approximataly vide Corrigendum No. TPS-1212/ANS-114/C.R.2/13/UD-12, dated 19th April

2018 (hereinafter referred to as the “said Notified Special Township Project”) ;

And whereas, said notified Special Township Project area came within the Planning Authority

of Thane Municipal Council (hereinafter referred to as the “said Planning Authority”); and the

said Planning Authority vide letter No. 5047, dated 29th January 2020 has sanctioned revised

master plan of the said notified Integrated Township Project with certain terms and conditions

as per the said Regulations (hereinafter referred to as the “said notified Integrated Township

Project”) ;

And whereas, the Government in Urban Development Department vide its Notification No.

TPS-1818/C.R.336/18/Section 37(1AA)(C) and Section 20(4)/UD-13, dated 2nd December 2020 has

sanctioned Unified Development Control and Promotion Regulations (hereinafter referred to

as”the said UDCPR”) ;

And whereas, the said UDCPR includes the regulations for the Development of Integrated

Township Project (hereinafter referred to as “the said Regulations for Development of Integrated

Township Project”) ;

And whereas, the said Project Proponant, now vide its letter dated 10th May 2021 and

subsequent letters submitted a proposal as per the provisions of Regulation No. 14.1.1.4(v) of the

said Regulation to the Directorate for the grant of revised Locational Permission by incorporating

additional land admeasuring area about 0.8014 Ha. mentioned in Schedule-A attached herewith

from Mouje Manjiwade, Taluka and District - Thane (hereinafter referred to as “the said additional

lands”) in the area of the said Integrated Township Project ;

And whereas, the said additional lands are included in “Proposed Road, Site No.1, Town

Centre, Houses for dishouses and existing Pipe Line” Zone in the said Development Plan as per

regulation No.14.1.1.7(i) the said regulation, Premium charges are not required to incorporate

the said additional lands in the said Integrated Township Project ;

And whereas, as per the documents submitted by the said Project Proponant, the Ownership

and Development Rights of the said additional lands proposed to be incorporated in the said

notified Integrated Township Project are acquired by the said Project Proponant and the said

Project Proponant has also submitted an Affidavit to that effect as per Revenue record;

And whereas, as per the Regulation No.14.1.1.4(v) of the said Regulation, the Director of

Town Planning, Maharashtra State, Pune as per the request of said Project Proponant, may grant

any adjacent land to add or delete any area, of the project not exceeding 50 % of the total area of

the Integrated Township Project under Locational Clearance ;

And whereas, as per the request of the said Project Proponant the area of the said additional

lands to be added is less than 50 % of the total area of the said notified Integrated Township

Project ;

And whereas, it is accordingly expedient to designate the area of the said additional lands to

be incorporated on the map of the said Development Plan under the provisions of sub-section (2)

of section 44 of the said Act as the additional project area for the said notified Integrated Township

Project ;

Now, therefore, the Director of Town Planning, Maharashra State, Pune under the Regulation

No. 14.1.1.4(v) of the said Regulation for Development of Integrated Township Project hereby

grants permission to add the area 0.8014 Ha.mentioned in Shedule-A attached herewith the

following terms and conditions :—

“Terms and Conditions of the Integrated Township Project”:

(I) Conditions of Ownership :

(1) Ownership / Development Rights of said additional lands together with the area under

the said notified Integrated Township Project shall be with the said Project Proponent. While

applying for Letter of Intent, it is obligatory on the said Project Proponent to submit to the

concerned authority the extracts of original certified documents of the registered Memorandum

of Understanding, registered documents of joint venture, original measurement plans, documents

proving the ownership rights, development rights.

(2) Part area of lands shall be included in the said notified Integrated Township Project

after obtaining measurement plan issued by the Deputy Superintendent of Land Records. If such

lands are not remain contagious with the lands under the said Project, then area of land stand

deleted from the notified Integrated Township project area.

(3) Collector, Thane should take appropriate action regarding “New Tenure” lands which

are included in the said notified Integrated Township Project before granting final sanction to

the Master Lay-out Plan.

(4) Collector, Thane shall verify and take appropriate action in respect of lands which are

included in the said notified Integrated Township Project having entries regarding bank

encumbrances and names in the Other Right’s column of 7/12 extract, before granting final sanction

to the Master Lay-out Plan.

(5) If any document of ownership of lands included in the area of the said notified Integrated

Township Project, is found false in future or if any judicial proceedings arise regarding the said

notified Integrated Township Project in future then, it shall be the sole responsibility of the said

Project Proponent to deal with those proceedings at his risk and cost. In such case Locational

Clearance shall be deemed to be cancelled for that lands.

(6) In the area of the said notified Integrated Township Project, Survey No. 14 / D, 14 / E,

14/F and 53/2/2 from Mauje Majivade, Tal. and Dist. Thane, admeasuring total area 3600 sq.m. is

in the name of Thane Municipal Corporation, Therefore, with the approval from Commissioner

the Assistant Director of Town Planning Thane Municipal Corporation vide letter No.3574, dated

27th December 2021 has conveyed their no objection to include this area in the said notified

Integrated Township Project. Considering the same, this area has been included in the said notified

Integrated Township Project.

(II) Conditions regarding Environment and Others :

(1) As per Ministry of Environment, Forests and Climate Change, Central Government,

New Delhi, Notification No. SO4293 (E) dated 14th October 2021, the area around Thane Creek

Flamingo Sanctuary in Mumbai Suburban District is 0 to 3.89 km. The perimeter area has been

notified as Thane Creek Flamingo Sanctuary Eco Sencetive Zone. Therefore, the Project Proponent

shall obtain the Environmental Clearance from the Ministry of Environment, Forest and climatic

change (MoEF and CC) and from the Appropriate Competent Authority before obtaining the

Building Permission within the lands to be incorporated in the area of the said notified Integrated

Township Project. Also the terms and conditions of the notifications issued by the Ministry of

Environment, Forest and Climate Change for the Environment Impact Assessment Act, 1986

from time to time shall be binding on the said Project Proponent.

(2) The Project Proponent shall be responsible for making provision for safe disposal of

Solid Waste and effluents within the said notified Integrated Township Project at his own risk

and cost, as per the criteria and norms decided by the Maharashtra Pollution Control Board and

also subject to the provisions and rules under the relevant Act in this regard.

(3) The terms and conditions imposed by the Irrigation Department and other concerned

department of the State Government from time to time shall be binding on the said Project

Proponent. The existing nallas / water courses, etc. in the area of the said notified Integrated

Township Project shall not be closed.

(4) It shall be binding on the said Project Proponent to provide water supply for the

development of the said notified Integrated Township Project as per Regulation No.14.1.1.10.v(a)

of the said Regulations at their own cost and responsibility. The conditions prescribed by Irrigation

Department in these regards, from time to time are binding on the said Project Proponent.

(5) It shall be binding on the said Project Proponent to provide electricity supply for the

development of the said notified Integrated Township Project as per the Regulation No. 14.1.1.10.

v(c) of the said Regulation at their own cost and responsibility. Also the concerned Authority

shall obtain from the Project Proponent, necessary permissions and also the firm commitment of

electricity supply for the entire area of the said notified Integrated Township Project from the

concerned power supply company before the approval of the Master Plan as per Regulation

No.14.1.1.6 of the said Regulation.

(III) Regarding Development :

(1) The said Project Proponent shall provide access road of required width as per said

Regulation but minimum 9 m. free of cost to the lands owned by other private persons, which are

surrounded by the area under the said notified Integrated Township Project.

(2) It is binding on the said Project Proponent to protect the easement rights of the existing

public roads passing through the area of the said notified Integrated Township Project.

(3) It shall be binding on Project Proponent to construct CD work on Nalla included in the

area of the said notified Integrated Township Project with the permission of concern department

and to keep distance from River, Nallas, Canal, Lake and other Water bodies within the area of

the said notified Integrated Township Project required as per the said for Development of

Integrated Township Project regulation.

(4) No construction of any type shall be allowed on the lands having slope equal to or more

than 1:5 in the said project, whether such lands are specifically marked as such on the Development

plan or not. Also No development activity shall be permissible and no development involving

cutting/levelling/filling shall be allowed on such lands.

(5) The said Project Proponent shall have to plan and earmark the lands at suitable location

within the area of the said notified Integrated Township Project for public purpose reservations

and also for basic infrastructure required for the population to be accommodated within the said

Project, as per the said Regulation and shall plan and develop the same at his own cost.

(6) It shall be binding on the said Project Proponant to comply the respective regulations

and the directives / clarification issued by the Government in concern with this regulations from

time to time for the Development of the Development Plan Reservations within the boundary of

the said notified Integrated Township Project.

(IV) Other Terms and Conditions :

(1) The terms and conditions mentioned in the Government Notifications dated 24th August

2019 for the original Locational Clearance of the said notified Integrated Township Project

alongwith all the terms and conditions mentioned in this notification.

(2) In case of breach of any of the terms and conditions by the said Project Proponent the

powers / rights of cancellation of the Locational Clearance granted vide this notification are

reserved with Government.

(3) The provisions mentioned in Regulation No. 14.1.1 and 14.1.2 of the Unified Development

Control and Promotion Regulation shall be applicable for the said area.

(4) The provisions mentioned in Regulation No. 14.1.1.7 (V) of the Unified Development

Control and Promotion Regulation regarding the share of local/Planning authority shall be

applicable for the said area.

(5) This Notification shall come into force on the date of its publication in the Maharashtra

Government Gazette.

(6) The details of lands incorported within the said Project are given in Schedule “A” appended

hereto. Also the plan showing the boundaries of the said Integrated Township Project is appended

hereto.

The details of the said additional lands incorporated within the said Project and the plan

shall be made available for the inspection of the general public, during office hours on all working

days at the following offices :—

(1) Commissioner, Thane Municipal Carporation.

(2) The Collector, Thane.

(3) Joint Director of Town Planning, Kokan Division, Navi Mumbai.

(4) Deputy Director of Town Planning, Urban Research Cell, Pune.

This notification shall also be published on the website of Directorate of Town Planning and

Valuation www.dtp.maharashtra.gov.in

(5) Assistant Director of Town Planning, Thane Branch.
