महाराष्ट्र प्ादेशिक नियोोजन व नगर रचना अधिनियम, १९६६.

क्रमांक आयडीसी २०२०/प्र.क्र. २७७/उ-१४.—जयाअर्थी, महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ चया कलम ४३

चया खंड (१ ब) द्ारे प्रदान करणयात आलेलया अधिकारांचा वापर करून महाराष्ट्र औद्योगिक विकास महामंडळाने (यात यानंतर

जयाचा उललेख “उकत महामंडळ” असा करणयात आला आहे) काढलेलया अधिसूचना क्र. मऔविम/आय.आय.ए.(आयएलपी)/

डी-६००७६/२०२०, दिनांक २२ डिसेंबर २०२० द्ारे “एकात्मिक औद्योगिक क्षेत्र” (एकात्मिक लॉजिस्टिक पार्क) (यात यानंतर

जयाचा उललेख “उकत आयएलपी” असा करणयात आला आहे) महणून, मे. आयुषी ्पेसेस एल.एल.पी. (यात यानंतर जयाचा

उललेख “उकत विकासक” असा करणयात आला आहे.) यांचयाकडून विकसित करणयात येत असलेलया ठाणे जिल्ह्ातील भिवंडी

तालुकयाचया डोोहोोळे गावामधील एकूण १०.८८६ हे.आर इतके क्षेत्र (यात यानंतर जयाचा उललेख “उकत क्षेत्र” असा करणयात आला

आहे) अधिसूचित केलेले आहे.

आणि जयाअर्थी, अशी अधिसूचना काढणयात आलयानंतर महामंडळ हे, महाराष्ट्र प्रादेशिक व नगर रचना अधिनियम, १९६६

(यात यानंतर जयाचा उललेख “उकत अधिनियम” असा करणयात आला आहे) अनवये, उकत “आयएलपी ” यासाठी “ विशेष

नियोोजन प्राधिकरण” झालेले आहे.

आणि जयाअर्थी, शासन निर्णय उद्योग, ऊर्जा व कामगार विभाग क्रमांक आयडीसी २०१८/प्र.क्र. १३५/उद्योग-२, दि. २७ ऑगस्ट

२०१९ द्ारे महाराष्ट्र शासनाने “आयएलपी” चया विकासासंबंधीची कार्यपद्धती विहित करणयात आलेली आहे.

आणि जयाअर्थी, उकत अधिनियमाचया कलम १५१ चया पोट-कलम (१) अनवये प्रदान करणयात आलेलया अधिकारांनुसार

खाजगी जमिनींवरील “एकात्मिक औद्योगिक क्षेत्र”(एकात्मिक लॉजिस्टिक पार्क) चया संबंधित, उकत अधिनियमाचया कलम ४०,

पोट-कलम (३) चया खंड (ड) चया उप खंड (१) अनवये नियोोजन प्र्ताव मंजूर करणयाचा अधिकार, शासकीय अधिसूचना नगर

विकास विभाग क्रमांक टीपीबी ४३१७/प्र.क्र. ५४/२०१७/नवि-११, दि. ०२ जून २०१७ द्ारे प्रधान सचिव (उद्योग) यांना प्रदान

करणयात आला आहे;

आणि जयाअर्थी, उकत महामंडळाने उकत अधिनियमाचया कलम ४० मधये तसेच कलम ११५ चया पोट-कलम (२) मधये

निर्धारित केलेली कार्यपद्धती पार पाडलेली आहे आणि राजय शासनाकडे तयाचया मंजुरीसाठी बृहत आराखडा प्र्ताव सादर केला आहे;

तयाअर्थी, आता उकत अधिनियमाचया कलम ४० चया पोट-कलम (३) चा खंड (ड) तसेच कलम ११५ चे पोट-कलम (३)

याद्ारे प्रदान करणयात आलेलया अधिकारांचा आणि याबाबत तयास समर्थन करणाऱया इतर सर्व अधिकारांचा वापर करून, अपर मुखय

सचिव (उद्योग), उद्योग, ऊर्जा व कामगार विभाग याद्ारे, आराखड्ावर दर्शविणयात आलयाप्रमाणे, उकत क्ेत्ाचया बृहत आराखडा

प्र्तावाला पुढील शर्तीीचया अधिनतेने मंजुरी देत आहे :—

(१) जमिनीचा वापर, सोोई-सुविधांचया जागा, मोोकळया जागा, रस्त्यायाचे ्वरूप यासारखया सदर मंजुरी केवळ प्रस्तावित

प्र्तावांसाठी आहे.

(२) महाराष्ट्र औद्योगिक विकास महामंडळाचया “आयएलपी” विकास नियंत्रण नियमावलीनुसार, महाराष्ट्र औद्योगिक

विकास महामंडळाकडून विनयास/बांधकामाचा आराखडा अंतर्गत प्रवेश मार्ग, तलपृष्ठ निर्देशांक, वाहनतळ वयवस्था इतयादींची

सखोोल छाननी करणयात यावी.

(३) महाराष्ट्र प्रदुषण नियंत्रण मंडळाने नमूद केलेलया शर्तीी आणि संबंधित प्राधिकरणाकडील पर्यावरणविषयक परवानगी

(लागू असलयास) बंधनकारक राहील.

(४) बांधकाम आराखड्ाला मंजुरी देताना, उकत विकासक सार्वजनिक बांधकाम विभाग, महावितरण (म.रा.वि.म.)

इतयादी विभागांकडून जेथे जेथे आवशयक असेल तेथे तेथे ना-हरकत प्रमाणपत्र घेईल.

(५) प्रस्तावित सोोई-सुविधांची जागा आणि मोोकळी जागा यामधये करणयात येणारे वापर महाराष्ट्र औद्योगिक विकास

महामंडळाचया आयएलपी विकास नियंत्रण नियमावलीचया आवशयकतेनुसार असतील.

(६) उकत विकासक, भूमि अभिलेख विभागाकडील, नियोोजन प्र्तावानुसार सीमांकन आराखडा प्रापत करील.

(७) उकत अधिनियमाचया कलम ४० चया पोट-कलम (३) चा खंड (ड) तसेच कलम ११५ चे पोट कलम (३)

यानवये मानयता मिळालयाचया दिनांकापासून प्र्ताव तातकाळ अंमलात येतील.

नियोोजन प्र्ताव दर्शविणारा आराखडा सामानय जनेतचया निरीक्षणासाठी महाराष्ट्र औद्योगिक विकास महामंडळाचया कार्यालयांमधये

कार्यालयीन वेळेत उपलब्ध करून देणयात येईल.

INDUSTRIES, ENERGY AND LABOUR DEPARTMENT

Order

Maharashtra Regional and Town Planning Act, 1966.

No. IDC 2020/C.R.277/IND-14.—Whereas, Maharashtra Industrial Development Corporation

(hereinafter referred to as ‘the said Corporation’) vide Notification No. MIDC/IIA(ILP)/D60076/2020

dated the 22nd December, 2020 issued in exercise of powers conferred by clause (1B) of section 43

of the Maharashtra Industrial Development Act, 1961 has notified total area of 10.886 Hectare are

from village Dohole of Taluka Bhiwandi in District Thane (hereinafter referred to as ‘the said Area’)

for being developed by M/s. AYUSHI SPACES LLP. (hereinafter referred to as ‘the said Developer’)

to be an ‘Integrated Logistic Park’ (hereinafter referred to as ‘the said ILP’) ;

And whereas upon such notification, the Corporation has become the ‘Special Planning Authority’

for the said ILP under the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred

to as ‘the said Act’) ;

And whereas, the Government of Maharashtra vide Government Resolution, Industry, Energy

and Labour Department No.IDC/2018/C.R.135/Industry-2, dated the 27th August, 2019 has laid

down the procedure regarding development of the ILP ;

And whereas, in pursuance of the powers conferred under sub-section (1) of section 151 of the

said Act, the power to approve Planning Proposals under sub-clause (1) of clause (d) of sub-section

(3) of section 40 of the said Act regarding ‘Integrated Industrial Area’ (Integrated Logistic Park) on

private lands has been delegated to Principal Secretary (Industries) vide Government Notification,

Urban Development Department No. TPB 4317/CR-54/2017/UD-11, dated the 2nd June 2017 ;

And whereas, the said corporation has completed the procedure laid down in section 40 read

with sub-section (2) of section 115 of the said Act and submitted the Master Plan proposal to the

State Government for its approval ;

Now, therefore, in exercise of the powers conferred by clause (d) of sub-section (3) of section 40

read with sub-section (3) of section 115 of the said Act and of all other powers enabling him in this

behalf, the Additional Chief Secretary (Industries) of Industry, Energy and Labour Department

hereby grant approval to the Master Plan proposal of the said Area as shown on plan, subject to

following conditions, namely :—

(1) This sanction is only for the planning proposals like proposed land use, amenity spaces,

open spaces, road pattern.

(2) Detailed scrutiny of layout/building plans, internal means of access, FSI, parking etc.

should be done by MIDC according to MIDC’s ILP DCR.

(3) Conditions mentioned by MPCB (Maharashtra Pollution Control Board) and

Environmental Clearance from the respective authority shall be binding (if applicable).

(4) While sanctioning building plans, the said Developer shall take NOC from PWD,

Mahavitaran (MSEB) etc. Departments wherever necessary.

(5) Users provided in proposed amenity space and open space shall be as per requirement

of MIDC’s ILP DCR.

(6) The said developer shall obtain demarcation plan as per planning proposals from the

land record department.

(7) The proposals shall immediately came into effect from date of approval under clause

(d) if sub-section (3) of section 40 read with sub-section (3) of section 115 of the said Act.

The plan showing the planning proposal shall be made available for inspection for general public

during office hours in offices of MIDC.
