महाराष्ट्र महामार्ग अधिनियम.

क्रमांक खाक्ेस-२०२१/प्र.क्र. ११५/ रसते-८.— जयाअर्थी, महाराष्ट्र राजय रसते विकास महामंडळ मर्यादित हे महाराष्ट्र महामार्ग

अधिनियम (१९५५ चा ५५) याचया कलम ४ चया परंतुकाचया तरतुदींनुसार (यात यापुढे जयाचा निर्देश “उकत अधिनियम” महणून करणयात

आला आहे) यशवंतराव चवहाण द्ुतगती मार्ग क्षमतावाढ प्रकलप महणून ओळखलया जाणाऱया राजय महामार्ग (विशेष) क्र. ३ (A) यासाठी

(यात यापुढे जयाचा निर्देश “उकत महामार्ग” असा करणयात आला आहे) महामार्ग प्राधिकरण आहे ;

आणि जयाअर्थी, महाराष्ट्र राजय रसते ‍विकास महामंडळ मर्यादित महामार्ग प्राधिकरणाने उकत महामार्गाचया संदर्भात महामार्ग प्राधिकरण

महणून महाराष्ट्र शासनाला विनंती केली आहे की, यासोबत जोडलेलया अनुसूचीत उल्लेखित जमीन (यात यापुढे जिचा निर्देश “उकत जमीन”

असा करणयात आला आहे) उकत महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन यांसाठी आवशयक एक सार्वजनिक

प्रयोजन महणून उकत अधिनियमाचया तरतुदींअंतर्गत उकत महामार्ग प्राधिकरणासाठी, महाराष्ट्र शासनाकडून अधिग्रहित करणयात येईल ;

आणि जयाअर्थी, महाराष्ट्र शासनाची खात्ी पटली आहे की, एका सार्वजनिक प्रयोजनासाठी उकत जमीन ही उकत महामार्गाचे

किंवा तयाचया काही भागाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन यासाठी आवशयक आहे आणि महणून उकत महामार्ग

प्राधिकरणासाठी, पूर्वोकत प्रयोजनांकरिता, उकत जमीन संपादित करणे शासनास इष्ट वाटते ;

तयाअर्थी, आता, महाराष्ट्र महामार्ग अधिनियम, १९५५ (१९५५ चा ५५) याचया कलम १५ चया पोट-कलम (२) व (३) व कलम

१७ द्ारे प्रदान करणयात आलेलया अधिकारांचा, आणि याबाबतीत तयास समर्थ करणाऱया इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र

शासन, याद्ारे,—

(एक)  उकत महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन करणे यांसाठी उकत महामार्ग प्राधिकरणासाठी

उकत जमिनीचे संपादन करणयाची घोषणा करीत आहे ;

(दोन)  विनिर्दिष्टष्ट करीत आहे की, उकत अधिनियमाचया कलम ७ अंतर्गत निर्गमित केलेलया अधिसूचनेला प्रतिसाद महणून

जयांचया हरकती व सूचना यापूर्वीीच विचारात घेतलया आहेत किंवा महामार्ग प्राधिकरणाकडून सुनावणी झाली आहे अशा वयकतींखेरीज

उकत जमिनीशी हितसंबंधित कोणतीही वयकती, ही अधिसूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झालयाचया दिनांकापासून

एकवीस दिवसांचया आत संबंधित भूसंपादन अधिकारी तथा उपविभागीय अधिकारी, मावळ- मुळशी, जिलहा पुणे यांचयाकडे उकत

महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन यासाठीचया प्रयोजनांसाठी उकत जमिनीचया वापराबाबत लेखी व

तयाचया कारणांसह आक्ेप घेऊ शकते.

SUPPLEMENTARY NOTIFICATION

Maharashtra Highways Act.

No. PPP-2021/CR-115/Road-8. -Whereas, the Maharashtra State Road Development Corporation

Limited is the Highway Authority for the State Highway (Special) No. 3(A) to be known as the

Capacity Augmentation Project of Yashwantrao Chavhan Expressway (hereinafter referred to as

“the said Highway”) as per the provisions of the proviso to section 4 of the Maharashtra Highway

Act (LV of 1955) (hereinafter referred to as “the said Act”) ;

And whereas, the Maharashtra State Road Development Corporation Limited, being the Highway

Authority, in respect of the said Highway, has requested the Government of Maharashtra that, the

land mentioned in the Schedule appended hereto (hereinafter referred to as “the said land”), required

by it for the building, maintenance, management or operation of the said Highway, being for the

public purpose, be acquired by the Government of Maharashtra for the said Highway Authority

under the provisions of the said Act ;

And whereas, the Government of Maharashtra is satisfied that, for a public purpose, said land

is required for the building, maintenance, management or operation of the said Highway or part

thereof and therefore considers it expedient to acquire the said land for the aforesaid purposes for

the said Highway Authority ;

Now, therefore, in exercise of the powers conferred by sub-sections (2) and (3) of section 15 read

with section 17 of the Maharashtra Highways Act (LV of 1955), and of all other powers enabling it

in this behalf, the Government of Maharashtra hereby,—

(i)  declares its intention to acquire the said land for the said Highway Authority for the

building, maintenance, management or operation of the said Highway;

(ii)  specifies that any person interested in the said land, other than the persons whose

objections or suggestions have already been considered or heard by the Highway Authority in

response to the notification issued under section 7 of the said Act, may, within twenty-one days

from the date of publication of this notification in the Maharashtra Government Gazette, object to

the use of the said land for the purposes of the building, maintenance, management or operation

of the said Highway, in writing and stating the grounds thereof, to the Sub-Divisional Officer,

Maval-Mulshi, District Pune, being the concerned Land Acquisition Officer.
