क्रमांक ससंनि ०३२०/ प्र.क्र.६३/ १३स.—महाराष्टट्र सहकारी संस््था अधिनियम,१९६० (१९६१ चा महा.२४) याच्या कलम

१६५ च्या पोटट-कलम (१) व (२) द्ारे प्रदान केलेल्या अधिकारांचा आणि त्याबाबततीतत त्यास समर््थ करणाऱ्या इततर सर््व अधिकारांचा

वापर करून, महाराष्टट्र सहकारी संस््था (समिततीची निवडणूक) नियम, २०१४ यामध्ये आणखी सुधारणा करण्यासाठी, महाराष्टट्र

शासनाने सुधारणा करण्याचे प्रस््तावितत केलेल्या नियमांचे पुढील प्रारूप, त्यामुळे बाधा पोोहचण्याचा संभव असलेल्या सर््व व्यक््तींच्या

माहिततीकरितता, उक््त अधिनियमाच्या कलम १६५ च्या पोटट-कलम (३) द्ारे आवश्यक असल्याप्रमाणे, याद्ारे, प्रसिद्ध करण््ययातत येतत

आहे; आणि याद्ारे अशी नोटटीस देण््ययातत येतत आहे की, उक््त प्रारूप, महाराष्टट्र शासनाकडून दिनांक ११ नोोव््हेंबर, २०२२ रोोजी किंवा

त्यानंततर विचारातत घेण््ययातत येईल.

२. उपरोोक््त दिनांकापूर्वी, उक््त प्रारूपाच्या बाबततीतत, कोणत्याही व्यक््तीकडून अपर मुख्य सचिव, (सहकार व पणन), सहकार,

पणन व वस्त्रोोद्योोग विभाग, मादाम कामा मार्ग, हुततात्मा राजगुरू चौक, मंत्ालय, विस््तार, मुंबई ४०० ०३२ यांच्याकडे ज्या कोणत्याही

हरकतती किंवा सूचना प्राप््त होततील त्या शासनाकडून विचारातत घेण््ययातत येततील.

प्ारूप नियम

महाराष्टट्र सहकारी संस््था अधिनियम, १९६०.

वापर करून, महाराष्टट्र शासन, महाराष्टट्र शासन राजपत्र, असाधारण, भाग चार-ब, दिनांक **** २०२२ यामध्ये प्रसिद्ध केलेली

शासकीय अधिसूचना, सहकार, पणन व वस्त्रोोद्योोग विभाग, क्रमांक **** दिनांक **** २०२२ अनुसार, हरकतती व सूचना विचारातत

घेततल्यानंततर, याद्ारे, महाराष्टट्र सहकारी संस््था (समिततीची निवडणूक) नियम,२०१४ यामध्ये आणखी सुधारणा करण्यासाठी पुढील

नियम करीतत आहे :—

१. या नियमांस, महाराष्टट्र सहकारी संस््था (समिततीची निवडणूक) (**सुधारणा) नियम,२०२२ असे म््हणावे.

२. महाराष्टट्र सहकारी संस््था (समिततीची निवडणूक ) नियम, २०१४ (यातत यापुढे ज्याचा निर्देश, “ मुख्य नियम ” असा

केला आहे) याच्या नियम ४ मध्ये,—

(अ) खंड (दोोन) मधील, “ब” वर्ग प्रकारातत मोोडणाऱ्या संस््था या शीर््षषाखालील, नोंद (३) ऐवजी पुढील नोंद

दाखल करण््ययातत येईल :—

“(३) रुपये दहा लाख किंवा त्यापेक्ा अधिक भरणा झालेले भाग भांडवल असणाऱ्या सर््व प्राथमि

क कृषि

सहकारी पततसंस््था आणि आदिवासी कृषि सहकारी पततसंस््था.”

(ब) खंड (ततीन) मधील, “क” वर्ग प्रकारातत मोोडणाऱ्या संस््था या शीर््षषाखालील, नोंद (२) आधी, पुढील नोंद

समाविष््ट करण््ययातत येईल :—

“(१)रुपये दहा लाखांपेक्ा कमी भरणा झालेले भाग भांडवल असणाऱ्या सर््व प्राथमि

क कृषि सहकारी पततसंस््था

आणि आदिवासी कृषि सहकारी पततसंस््था.”

३. मुख्य नियमांच्या नियम ७७ ऐवजी, पुढील नियम दाखल करण््ययातत येईल :—

“७७. पदाधिकाऱ््ययाांांची निवडणूक—समिततीच्या सदस््ययाांांची निवड झाल्यानंततर लगेचच अशा कोणत्याही संस््थेच्या

पदाधिकाऱ््ययाांांची निवडणूक, मावळत्या समिततीची मुदतत समाप््त होोण्यापूर्वी घेण््ययातत येईल :

परंततु, जर अधिनियमाच्या ततरततुदींन््वये समिततीची मुदतत वाढविली असेल ततर किंवा जेव्हा अधिनियमाच्या कलम ७८,

७८अ, किंवा ११०अ अन््वये नियुक््त केलेल्या प्रशासकाची किंवा अधिनियमाच्या कलम ७७अ अन््वये नियुक््त केलेल्या

प्राधिकृतत अधिकाऱ्याची मुदतत समाप््त झाल्यानंततर निवडणुका घेततल्या जातत असततील त्या बाबततीतत, अशा कोणत्याही

संस््थेच्या पदाधिकाऱ््ययाांांची निवडणूक, तिच्या उप-विधींमध्ये ततरततूद केल्याप्रमाणे, निकाल जाहीर झालेल्या ततारखेपासून पंधरा

दिवसांच्या आतत, घेण््ययातत येईल. या प्रयोोजनार््थ घेततलेली समिततीची सभा, राज्य सहकारी निवडणूक प्राधिकरणाने प्राधिकृतत

केलेल्या अधिकाऱ्याच्या अध््यक्षततेखाली घेण््ययातत येईल.”

NOTIFICATION

Maharashtra Co-operative Societies Act, 1960.

No. Sasani-0320/ C.R.63/13C.—The following draft of rule further to amend the Maharashtra

Co-operative Societies (Election to Committee) Rules, 2014 (hereinafter referred to as “the principal

Rules”), which the Government of Maharashtra proposes to make in exercise of the powers conferred

by sub-sections (1) and (2) of section 165 of the Maharashtra Co-operative Societies Act, 1960

(Mah. XXIV of 1961), and of all other powers enabling it in that behalf, is hereby published, as

required by sub-section (3) of section 165 of the said Act, for the information of all the persons likely

to be affected thereby; and notice is hereby given that the said draft will be taken into consideration

by the Government of Maharashtra on or after the 11th November, 2022.

2. Any objections or suggestions, which may be received by the Additional Chief Secretary

(Co-operation and Marketing), Co-operation, Marketing and Textile Department, Madam Cama Marg,

Hutatma Rajguru Chowk, Mantralaya, Annex, Mumbai 400 032, from any person with respect to

the said draft before the aforesaid date, will be considered by the Government.

DRAFT RULES

Maharashtra Co-operative Societies Act, 1960.

No. Sasani-0320/ C.R.63/13C.—In exercise of the powers conferred by sub-sections(1) and (2) of

section 165 of the Maharashtra Co-operative Societies Act, 1960 (Mah.XXIV of 1961), and of all other

powers enabling it that behalf, the Government of Maharashtra hereby, after considering objections

and suggestions, pursuant to the Government Notification, Co-operation, Marketing and Textiles

Department, No.****, dated the **** of **** 2022, published in the Maharashtra Government Gazette,

Extraordinary, Part IV-B, dated the *** 2022, makes the following rules further to amend to the

Maharashtra Co-operative Societies (Election to Committee) Rules, 2014, namely :—

1. These rules may be called the Maharashtra Co-operative Societies (Election to

Committee) (**Amendment ) Rules, 2022.

2. In rule 4 of the Maharashtra Co-operative Societies (Election to Committee) Rules, 2014

(hereinafter referred to as the principal Rules),—

(a) in clause ( II ), under the heading “Type “B” Societies”, for entry (3) the following

entry shall be substituted, namely:—

“(3) All primary Agricultural Co-operative Credit Societies and Adiwasi

Agricultural Co-operative Credit Societies having paid up share capital of ten lakh

rupees or more.”;

(b) in clause ( III ), under the heading “Type “C” Societies”, before entry (2) the following

entry shall be inserted, namely :—

“(1) All primary Agricultural Co-operative Credit Societies and Adiwasi

Agricultural Co-operative Credit Societies having paid up share capital less than ten

lakh rupees.”

3. For rule 77 of the principal Rules, the following rule shall be substituted, namely :—

“77. Election of office bearers.— As soon as the members of the committee are elected, the

election of office bearers of any such society shall be held before the expiry of the term of the

outgoing committee :

Provided that, if the term of committee is extended under the provisions of the Act or where

the elections are held after the expiry of the term of the administrator appointed under sections

78, 78A or 110A of the Act or authorized officer appointed under section 77A of the Act, then the

election of office bearers of any such society shall be held within a period of fifteen days from

the date of declaration of result as provided in its bye-laws. The meeting of the committee for

this purpose shall be presided over by officer authorized by the SCEA.”.
