69.0 meters R.P. Road/1363/2022.– Whereas, the Government has sanctioned the Revised Regional

Plan for Nashik district on dated 21st June 2013 (hereinafter referred to as “ the said Regional Plan”)

under the provisions of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as

“ the said Act”) and has came into force with effect from 16th September 2013 and whereas, Chief

Engineer, Public Works Department, Regional Office, Nashik vide letter No. 885/2020, dated 5th March

2020 has given the recommendation to reduce the width of 69 meters wide (45+12+12) Regional Plan

Road along the Shiv of Mauje Chandshi and Jalalpur, taluka and district Nashik to 30 meters ;

and whereas, the Government vide Resolution No. TPS-1815/CR-49/15/UD-13, dated 6th May

2015 and dated 4th January 2016 (hereinafter referred to as “the said Government Resolution”) has

issued the directives under Section 154 of the said Act, regarding the procedure to be followed under

Section 20 of the said Act, for making changes in the use of land in the areas of Sanctioned Regional

Plans, and for that purpose constituted “Proposal Scrutiny Committee”;

and whereas, the “Proposal Scrutiny Committee” constituted under the said Government

Resolution, is of the opinion that the said 69 meters wide Regional Plan Road is proposed to be 30

meters wide and the land so released from the road alignment shall be included in the adjacent land

use zone, in accordance with the provisions of sub-section (2) of Section 20 of the said Act, subject

to the following conditions (hereinafter referred to as “the Proposed Modification”) :–

(1)

It shall be binding to deposit the premium amount as mentioned in Government Resolution,

dated 4th January 2016. The premium and Scrutiny fee shall be collected from the concerned

land owners before issue of notification under Section 20 (4) of the said Act.

(2)

The land so released from the road alignment shall be included in the adjacent land use

Zone.

(3)

Applicant / Developer shall make necessary self-contained arrangements to provide Water

supply, Waste water treatment, Solid waste disposal / Management while developing the said

land and after development of the said land at his own cost.

(4)

It shall be necessary to develop the concept like Rainwater Harvesting, Water Recycling and

Solar Energy while developing the said land.

(5)

It is binding on the land developer to make available the pure water.

and whereas, as per the provision of sub-section (1) of Section 151 of the said Act, Government

vide Notification No.TPS-1815/CR-49/15/UD-13, dated 11th June 2015 has delegated the powers under

Sections 20 (2), 20 (3) and 20 (4) of the said Act to the concerned Joint Director of Town Planning ;

and whereas, in accordance with the provisions of sub-section (3) of Section 20 of the said Act,

has published, the Notice regarding the Proposed Modification and Assistant Director of Town Planning,

Nashik Branch, Nashik was Appointed to hear the suggestions / objections received within the stipulated

period ;

and whereas, the Appointed Officer i.e. Assistant Director of Town Planning, Nashik Branch has

submitted his report to the Member-Secretary also the Proposal Scrutiny Committee, in the meeting,

dated 27th July 2020 accorded approval to this proposal and directed Member-Secretary to issue the Final

Notification according to sub-section (4) of Section 20, after payment of the premium by the Applicant.

and whereas, the land bearing Gat No. 347/1+348 of Mouje Jalalpur, taluka and district Nashik area

admeasuring about 4565.93 sq. mt. are fronting on the said road under modification and the owner of said

land Mrs. Sunita Shirish Suryavanshi vide his letter dated 20th January 2022 has requested to issue the

notification under Section 20 (4).

and whereas, the Assistant Director of Town Planning, Nashik Branch, Nashik vide his letter No.

2278, dated 1st September 2022 informed this office that, the concerned owner has submitted the required

scrutiny fee and premium amount in the Government Treasury.

Now, therefore, in exercise of the powers conferred by sub-section (4) of Section 20 of the said Act,

Joint Director of Town Planning, Nashik Division, Nashik hereby sanctions the said Modification for the land

shown by the Nashik Branch office on the part plan and for that purpose amends the aforesaid Notification,

dated 21st June 2013 as follows.

In the said Regional Plan, the following new Entry shall be added after the last Entry of the Schedule

of Modifications.

ENTRY

In the Sanctioned Revised Regional Plan, of Nashik district the 69 meters wide Regional Plan Road

shown on the boundary of Chandshi and Jalalpur, taluka and district Nashik is reduced to be 30 meters

wide and the land so released from the road alignment shall be included in the adjacent land use zone as

shown on the part plan, subject to the following conditions.

Notice

No. NKDN/P.S.C./R.P. Nashik/Section 20 (3)/Mouje Dugaon, taluka Nashik/Gat No. 303/1 and Others/

1361/2022.– Whereas, the Government has sanctioned the Revised Regional Plan for Nashik district on

21st June 2013 (hereinafter referred to as “the said Regional Plan”) under the provisions of Maharashtra

Regional and Town Planning Act, 1966 (hereinafter referred to as “the said Act”) and has came into force

with effect from 16th September 2013, and whereas, in the said Regional Plan, the land admeasuring

about 17.57 Hectares bearing Gat Nos. 303/1, 304/1, 304/2, 305, 306/1 to 6, 308/3 of Mouje Dugaon,

taluka Nashik, district Nashik (hereinafter referred to as “the said land”) is included in “Agriculture Zone;”

and whereas, the Government vide Resolution No. TPS-1815/CR-49/15/UD-13, dated 6th May 2015

and dated 4th January 2016 (hereinafter referred to as “the said Government Resolution”) has issued the

directives under Section 154 of the said Act, regarding the procedure to be followed under Section 20 of

the said Act, for making changes in the use of land in the areas of sanctioned Regional Plans and for that

purpose constituted “Proposal Scrutiny Committee;”

and whereas, the “Proposal Scrutiny Committee” constituted under the said Government Resolution,

is of the opinion that, the said land shall be deleted from “Agriculture Zone” and proposed to be included

in “Residential Zone,” and accordingly it is necessary to modify the said Regional Plan (hereinafter referred

to as “the said Modification”) in accordance with the provisions of sub-section (2) of Section 20 of the said

Act, subject to the following conditions.–

(1)

It shall be binding to deposit the premium amount as mentioned in Government Resolution,

dated 4th January 2016.

(2)

It shall be binding to develop the said land as per the guidelines mentioned in said Government

Resolution and Annexure with it.

(3)

While developing the said land it shall be binding to provide 15 per cent Amenity Space.

(4)

Applicant / Developer shall make necessary self contained arrangements to provide Water

Supply, Waste Water Treatment, Solid Waste Disposal / Management while developing the

said land and after development of the said land at his own cost.

(5)

It shall be necessary to develop the concept like Rainwater Harvesting, Water Recycling and

Solar Energy while developing the said land.

(6)

It shall be binding on Applicant / Developer to plant 250 trees per Hectare, while developing the

land and Plot Holder of sanctioned layout to plant 5 trees per plot. This shall be verified at the

time of final sanction to development.

(7)

This permission does not confirm ownership of the said land. The Applicant will be completely

responsible regarding any issue about ownership of the said land.

(8)

It shall be binding to get “No Objection Certificate” from the Forest Department prior to

development of the said land.

(9)

Conditions mentioned in the letter No. 4927, dated 20th September 2022 of Public Works

Department are binding to the Applicant.

(10) It shall be binding to sale layout Plots / Flats of the said land as per table given below.

(11) If the Group Housing Scheme is proposed in the layout then, Occupancy Certificate shall not be

issued unless all the basic amenities are fully developed in the said land ;

(12) No Development will be permissible in the land having steep slope more than 1 : 5 and in land

which is not suitable for construction. The development of land regarding the internal roads is to

be done according to natural Geography of the land contour etc.

(13) It is seen that the 7/12 extract of Gat No. 304/1 and 308/3 under the proposed contains Co-

owner, hence it will be necessary to submit NOC of the Co-owner before issuing notification

under Section 20 (4).

(14) Conditions mentioned in the letter No. 4631, dated 13th September 2022 of Director Town

Planning, Maharashtra State, Pune are binding to the Applicant.

(15) If the amount of premium is not deposited with a period of one year from the date of the letter

communicating that permission is granted for issuing notification under Section 20 (4).

and whereas, as per the provision of sub-section (1) of Section 151 of the said Act, Government vide

Notification No. TPS-1815/CR-49/15/UD-13, dated 11th June 2015 has delegated the powers under

Sections 20 (2), 20 (3) and 20 (4) of the said Act to the concerned Joint Director of Town Planning.

Now, therefore, in exercise of the powers delegated by the Government in this regard, as per Section

20 (3) of the said Act, the Joint Director of Town Planning, Nashik Division, Nashik by this Notice declares

intention to make the said modification in the said Regional Plan and for the proposed said Modification

invites suggestions / objections from the public in writing within 30 days from the date of Publication of this

Notice in the Maharashtra Government Gazette.

The suggestions/objections shall be addressed to the Assistant Director of Town Planning, Nashik

Branch, 2nd Floor, Zilla Krushi Audyogik Sahakari Sangh Ltd., Nashik, near NDCC Bank, Dwarka Chowk,

Nashik. The Plan showing the proposed said Modification is kept open for inspection to the public during

Office hours in their Office. Regarding the proposed said Modification, Assistant Director of Town Planning,

Nashik Branch, Nashik is appointed as the “Officer” to hear the suggestions / objections received within

the stipulated period and after following legal procedure, the “Officer” shall submit the Report thereon to

the Member Secretary.

for Nashik district on dated 21st June 2013 (hereinafter referred to as “ the said Regional Plan”) under

the provisions of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as “the

said Act”) and has came into force with effect from 16th September 2013 and whereas, Chief Engineer,

Public Works Department, Regional Office, Nashik vide letter No. 885/2020, dated 5th March 2020 has

given the recommendation to reduce the width of 69 meters wide (45+12+12) Regional Plan Road

along the Shiv of Mauje Chandshi and Jalalpur, taluka and district Nashik to 30 meters ;

and whereas, the Government vide Resolution No. TPS-1815/CR-49/15/UD-13, dated 6th May

2015 and dated 4th January 2016 (hereinafter referred to as “the said Government Resolution”) has

issued the directives under Section 154 of the said Act, regarding the procedure to be followed under

Section 20 of the said Act, for making changes in the use of land in the areas of Sanctioned Regional

Plans, and for that purpose constituted “Proposal Scrutiny Committee”;

and whereas, the “Proposal Scrutiny Committee” constituted under the said Government

Resolution, is of the opinion that, the said 69 meters wide Regional Plan Road is proposed to be

30 meters wide and the land so released from the road alignment shall be included in the adjacent land

use zone, in accordance with the provisions of sub-section (2) of Section 20 of the said Act, subject

to the following conditions (hereinafter referred to as “the Proposed Modification”) :–

It shall be binding to deposit the premium amount as mentioned in Government Resolution,

dated 4th January 2016. The premium and Scrutiny fee shall be collected from the concerned

land owners before issue of notification under Section 20 (4) of the said Act.

(2)

The land so released from the road alignment shall be included in the adjacent land use

Zone.

(3)

Applicant / Developer shall make necessary self-contained arrangements to provide Water

vide Notification No.TPS-1815/CR-49/15/UD-13, dated 11th June 2015 has delegated the powers under

has published the Notice regarding the Proposed Modification and Assistant Director of Town Planning,

Nashik Branch, Nashik was Appointed to hear the suggestions / objections received within the stipulated

period ;

and whereas, the Appointed Officer i.e. Assistant Director of Town Planning, Nashik Branch has

submitted his report to the Member-Secretary, also the Proposal Scrutiny Committee, in the meeting,

dated 27th July 2020 accorded approval to this proposal and directed Member-Secretary to issue the Final

Notification according to sub-section (4) of Section 20, after payment of the premium by the Applicant.

and whereas, the land bearing Gat No. 349/3/1 of Mouje Jalalpur, taluka and district Nashik, area

admeasuring about 2036.78 sq. mtrs. are fronting on the said road under modification and the owner of the

said land Mr. Shirish Kishor Suryavanshi vide his letter dated 20th January 2022 has requested this office

to issue the notification under Section 20 (4).

and whereas, the Assistant Director of Town Planning, Nashik Branch, Nashik vide his letter

No. 2277, dated 1st September 2022 informed this office that, the concerned owner has submitted the

required scrutiny fee and premium amount in the Government Treasury.

Now, therefore, in exercise of the powers conferred by sub-section (4) of Section 20 of the said Act,

Joint Director of Town Planning, Nashik Division, Nashik hereby sanctions the said Modification for the land

shown by the Nashik Branch office on the part plan and for that purpose amends the aforesaid Notification,

dated 21st June 2013 as follows.

In the said Regional Plan, the following new Entry shall be added after the last Entry of the Schedule

of Modifications.

ENTRY

In the Sanctioned Revised Regional Plan of Nashik district, the 69 meters wide Regional Plan Road

shown on the boundary of Chandshi and Jalalpur, taluka and district Nashik is reduced to be 30 meters

wide and the land so released from the road alignment shall be included in the adjacent land use zone as

shown on the part plan, subject to the following conditions.

Conditions :–

(1)

The land so released from the road alignment shall be included in the adjacent land use zone.

(2)

Applicant / Developer shall make necessary self-contained arrangements to provide Water

supply, Waste water treatment, Solid waste disposal / management while developing the said

land and after development of the said land at his own cost.

(3)

It shall be necessary to develop the concept like Rainwater Harvesting, Water Recycling and

Solar Energy while developing the said land.

(4)

It is binding on the land developer to make available the pure water.

In case of Non-Compliance, Layout Approval and Non-Agricultural Permission shall liable to be

cancelled.

general public during office hours on all working days at the following offices –
