महाराष्टट्र मुद्ांक अधिनियम, १९५८.

क्रमांक मुद्ांक-२०२१/१६/प्र.क्र.२०/म-१(धोरण).—ज्याअर्थी, महाराष्टट्र शासनाने, शासन निर््णय, ग्ामविकास विभाग, क्रमांक

प्र.आ.यो. २०२१/ प्र.क्र. ८१/योजना-१०, दिनांक २२ ऑगस््ट, २०२२ अनुसार, प्रधानमंत्री आवास-योजना सर््वाांसाठीी घरे (नागरीी)

या धर्तीवर पंडित दीीनदयाळ उपाध्याय जागा खरेदीी अर््थसहाय्य योजनेअंतर्गत पात्र भूमिहीीन लाभार््थ्ययाच्या बाबतीीत निवासीी प्रयोजनासाठीी

जमिनीीचीी खरेदीी करण्याकरिता मुद्ांक शुल्क कमीी करून ते रुपये १०००/- ( रुपये एक हजार फक्त) इतके निश््चचित करण्याचे ठरविले

आहे;

त्याअर्थी, आता, महाराष्टट्र मुद्ांक अधिनियम,१९५८ (१९५८ चा ६०) (यात यापुढे ज्याचा निर्देश, “उक्त अधिनियम” असा केला

आहे) याच्या कलम ९ च्या खंड (अ) द्ारे प्रदान केलेल्या अधिकारांचा वापर करून, महाराष्टट्र शासन, जनहितार््थ तसे करणे आवश््यक

असल्याचीी खात्री पटटल्याने, याद्ारे, महाराष्टट्र शासनाच्या ग्ामविकास विभागाच्या, पंडित दीीनदयाळ उपाध्याय जागा खरेदीी अर््थसहाय्य

योजनेअंतर्गत मान्यता दिलेल्या क्ेत्ांमध्ये स््थथित असलेल्या जमिनीीच्या संबंधात, यासोबत जोडलेल्या अनुसूचीीमध्ये विनिर््दिष््ट केलेलीी

जागा खरेदीी करण््ययासाठीी जमीीन मालक आणि आर््थथिकदृष्ट्ा दुर््बल घटटकातीील (इडब््ल्ययूयूएस) किंवा अल्प उत्पन्न गटट (एलआयजीी)

प्रवर््गगातीील लाभार्थी यांच्यामधीील व््यवहाराच्या पहिल्या संलेखावर, उक्त अधिनियमास जोडलेल्या अनुसूचीी- एकच्या अनुच््छेद २५ च्या

खंड (ब) अन््वये अन््यथा आकारणीीयोग्य असलेले मुद्ांक शुल्क, पुढीील शततींच्या अधीीन राहून, कमीी करून ते रुपये १०००/- (एक

हजार रुपये फक्त) मर््ययादेपर्यंंत निश््चचित करीीत आहे :-

शर्ती—

(१) या आदेशान््वये, ज्याला मुद्ांक शुल्क कमीी केल्याचा लाभ मिळाला आहे तो आर््थथिकदृष्ट्ा दुर््बल घटटकातीील

(इडब््ल्ययूयूएस) किंवा अल्प उत्पन्न गटट (एलआयजीी) प्रवर््गगातीील भूमिहीीन पात्र लाभार्थी, इतर कोणत्याहीी आदेशानुसार किंवा

धोरणानुसार मुद्ांक शुल्कात सवलत किंवा सूटट मिळण््ययासाठीी पात्र असणार नाहीी.

(२) जेव्हा हा आदेश, महाराष्टट्र शासन राजपत्रात प्रसिद्ध होण्याच्या दिनांकापूर्वीी आर््थथिकदृष्ट्ा दुर््बल घटटकातीील

(इडब््ल्ययूयूएस) किंवा अल्प उत्पन्न गटट (एलआयजीी) प्रवर््गगातीील कोणत्याहीी भूमिहीीन पात्र लाभार््थ्ययाने अगोदरच मुद्ांक शुल्क प्रदान

केलेले असेल त्याबाबतीीत, कोणताहीी परतावा दिला जाणार नाहीी.

(३) या आदेशान््वये, ज््ययासाठीी मुद्ांक शुल्कात कपात मंजूर केलीी आहे, आणि ज्याने उक्त्त धोरणाचीी प्रयोजने किंवा उद्दिष््टे

यांचीी पूर््ता करण्यात कसूर केलीी आहे किंवा उक्त धोरणात किंवा या आदेशात विनिर््दिष््ट केलेल्या शततींपैकीी कोणत्याहीी शततींचे किंवा

विशेष विनियमांचे उल्लंघन केले आहे तो आर््थथिकदृष्ट्ा दुर््बल घटटकातीील (इडब््ल्ययूयूएस) किंवा अल्प उत्पन्न गटट (एलआयजीी)

प्रवर््गगातीील कोणताहीी भूमिहीीन पात्र लाभार्थी, जणू काहीी सुरुवातीीपासूनच मुद्ांक शुल्कामध्ये कपात केलेलीी नव्हतीी असे समजून,

संपूर््ण मुद्ांक शुल्क व कोणतीीहीी असल््ययास, शास््ततीी प्रदान करण््ययास पात्र असेल.

स््पष््टटीकरण—

या आदेशाच्या प्रयोजनार््थ, “व््यवहाराचा पहिला संलेख” याचा अर््थ, जमीीन मालक आणि आर््थथिकदृष्ट्ा दुर््बल घटटकातीील

(इडब््ल्ययूयूएस) किंवा अल्प उत्पन्न गटट (एलआयजीी) प्रवर््गगातीील भूमिहीीन पात्र लाभार्थी (पंडित दीीनदयाळ उपाध्याय जमीीन खरेदीी

आर््थथिक सहाय्य योजना क्ेत्ांतर्गत मान्यता दिलेल्या क्ेत्ांमध्ये (यात यापुढे ज्याचा निर्देश, “उक्त क्षेत्र” असा केला आहे”) स््थथित

असलेल्या जमिनीीच्या बाबतीीत, यात यापुढे ज्याचा निर्देश, “मूळ खरेदीीदार” असा केला आहे) यांच्यामध्ये निष््पपापादित केलेला

पहिला दस्तऐवज, असा आहे. यामध्ये, उक्त क्ेत्ामध्ये स््थथित असलेल्या जमिनीीच्या जमीीन मालकाकडून जमीीन खरेदीी करणारा

मूळ खरेदीीदार व त्यानंतरचा खरेदीीदार यांच्यामध्ये निष््पपापादित केलेल्या संलेखाचा किंवा दस्तऐवजांचा समावेश होणार नाहीी. अशा

प्रकारे, उक्त क्ेत्ातीील मूळ खरेदीीदार ते पुढीील खरेदीीदार यांच्यामधीील खरेदीीचा पुढीील व््यवहार, या आदेशान््वये, मुद्ांक शुल्कात

कपात करण््ययासाठीी पात्र असणार नाहीी.

Order

Maharashtra Stamp Act.

No. Mudrank-2021/16/C.R.20/M-1(Policy).— Whereas, the Government of Maharashtra has

vide Government Resolution, Rural Development Department, No. Pra aayo-2021/C.R.81/Yojana-10,

dated the 22nd August 2022 decided to reduce and fix the stamp duty to rupees 1000/-(Rupees One

Thousand Only) for the purchase of the land for residential purpose in respect of eligible landless

beneficiary under the Pandit Deendayal Upadhyay Land Purchase Economic Assistance Scheme on

the lines of Pradhan Mantri Awas- Yojana Housing For All (Urban) ;

Now, therefore, in exercise of the powers conferred by clause (a) of section 9 of the Maharashtra

Stamp Act (LX of 1958) (hereinafter referred to as “the said Act”), the Government of Maharashtra,

being satisfied that it is necessary to do so in the public interest, hereby reduces and fixes the stamp

duty to the extent of rupees 1000/- (Rupees One Thousand only) as otherwise chargeable under

clause (b) of Article 25 of Schedule-I appended to the said Act, on the first instrument of transaction

between the land owner and the beneficiary belonging to Economically Weaker Section (EWS) or

Lower Income Group (LIG) category for land purchase as specified in the Schedule appended hereto,

relating to the land located in the areas as approved under the Pandit Deendayal Upadhyay Land

Purchase Economic Assistance Scheme, of the Rural Development Department, Government of

Maharashtra, subject to the following conditions, namely :—

Conditions :—

(1) The eligible Landless beneficiary of Economically Weaker Section (EWS) or Lower

Income Group (LIG) category which availed the reduction under this Order shall not be entitled

for concession or remission of stamp duty as per any other Order or policy.

(2) No refund shall be granted where stamp duty has already been paid by any eligible

landless beneficiary of Economically Weaker Section (EWS) or Lower Income Group (LIG)

category prior to the date of publication of this Order in the Maharashtra Government Gazette.

(3) Any eligible landless beneficiary of Economically Weaker Section (EWS) or Lower

Income Group (LIG) category for which the reduction in the stamp duty is granted under this

Order, and which fails to fulfill the purpose or objectives of the said policy or commits breach

of any of the conditions or special regulations as specified in the said policy or this Order, shall

be liable to pay the whole stamp duty and penalty, if any, as if there was no reduction in stamp

duty from the beginning.

Explanation—

For the purposes of this Order, “the first instrument of transaction” means, the first

document executed between the land owner and the eligible landless beneficiary belonging to

Economically Weaker Section (EWS) or Lower Income Group (LIG) category (hereinafter referred

to as “the original purchaser’s”), in respect of land located in the areas as approved under Pandit

Deendayal Upadhyay Land Purchase Economic Assistance Scheme area (hereinafter referred

to as “the said areas”). It does not include the instrument or document/s executed between the

original purchaser from the land owner and the subsequent purchaser of a land located in the

said area. Thus, within the said area a further transaction from the original purchaser to the

next purchaser is not eligible for the reduction in the stamp duty under this Order.
