अिधसूचना

ĸमांक रािनआ /रापनɻ-२०२२/Ō.ĸ. ९३/का. ११.— ùयाअथȯ, भारतीय संिवधाना÷या अनु÷छɂद २४३-कɁ व २४३-झेड ए अąवये

तसेच राùयातील Ēथािनक Ēवराùय संĒथां÷या संबंिधत कायǐातील तरतुदȮąवये अशा Ēथािनक Ēवराùय संĒथां÷या सवɑ िनवडणुकांचे

अधीȦण, संचालन व िनयंŇण याबाबतचे अिधकार राùय िनवडणूक आयोगास ŌाĆत झाले आहेत ;

आिण ùयाअथȯ, Ēथािनक Ēवराùय संĒथां÷या िनवडणुकांचे पािवʨ राखणे व अशा िनवडणुका मुòत, िन:पȦपातीपणे, Ōभावीपणे

व कायɑȦमतेने पार पाडĀया÷या दृđटीने राजकीय पȦांची नɻदणी व संबंिधत बाबȮची तरतूद āयात करणे गरजेचे आिण आवĐयक असčयाने

राùय िनवडणूक आयोगाǑारे ĸ. एसईसी/एमसी २००९/सी आर-४९/डी.११, िद. ३१ माचɑ २००९ ÷या अिधसूचनेǑारे, राजकीय पȦांची

नɻदणी आदेश, २००९ आिण महाराđł िनवडणूक िचąह (आरȦण व वाटप) आदेश, २००९ काढĀयात आला आहे ;

आिण ùयाअथȯ, राजकीय पȦा÷या आधारावर राùयातील Ēथािनक Ēवराùय संĒथां÷या घेतčया जाणाķया सवɑ िनवडणुकांकȫरता

उòत आदेश लागू असून कɁवळ ĺामपंचायतȮ÷या िनवडणुकांना, जेथे पȦिवरिहत िनवडणुका घेतčया जातात तेथे हे आदेश लागू नाहीत ;

आिण ùयाअथȯ, राùय िनवडणूक आयोगास उòत आदेशाŌमाणे राजकीय पȦाची नɻदणी करĀयापूवȯ महाराđł शासन राजपŇात

पȦाचे नाव आिण पƫा, āयाचे अĄयȦ व āयांना जर िचąह देĀयात येणार असेल तर ते िचąह यांचा अंतभाɑव असलेली सूचना Ōिसǌ कȠन

सवɑसाधारण जनतेकडȴन अशा नɻदणीबाबत हरकती मागिवणे आवĐयक आहे ;

Ōािधकȵत Ōकाशन

महाराđł िजčहा पȫरषदा व पंचायत सिमāया, ĺामपंचायती, नगरपȫरषदा, Ōाथिमक िशȦण आिण

Ēथािनक िनधी लेखापरीȦा अिधिनयम यांखालील (भाग चार-ब मĄये Ōिसǌ करĀयात

आलेले आदेश व अिधसूचना यांďयितȫरòत) आदेश व अिधसूचना.

आिण ùयाअथȯ, महाराđł शासन राजपŇात उपरोòत Ōमाणे अिधसूचना Ōिसǌ कɁलेčया िदनांकापासून ३० िदवसां÷या आत

कोणतीही हरकत ŌाĆत न झाčयास राùय िनवडणूक आयोग अिधसूचनेत ŌĒतािवत कɁčयाŌमाणे राजकीय पȦाची नɻदणी करĀयाकȫरता

सȦम राहील ;

आिण ùयाअथȯ, उòत आदेशाŌमाणे कोणतीही हरकत ŌाĆत झाली, तर ितचा राùय िनवडणूक आयोग िवचार करेल व ती Ȧुčलक

आढळčयास, फɁटाळĀयात येईल व राजकीय पȦाची नɻदणी करĀयात येईल. āयाचŌमाणे राùय िनवडणूक आयोगास अशा हरकतीत

Ōथमदशɑनी सāय वाटले, तर ती अजɑदारास कळिवĀयात येईल आिण āयावर āयाचे अिभŌाय मागिवĀयात येतील आिण अिभŌाय ŌाĆत

झाčयावर, आयोग उपलĈध अिभलेखा÷या आधारावरील गुणवƫेवर िनणɑय घेईल िकȽवा,संबंिधत पȦांचे Ċहणणे ऐकȳन āयानंतर िनणɑय घेईल

व राùय िनवडणूक आयोगाचा असा िनणɑय अंितम राहील ;

आिण ùयाअथȯ, Ŗी. चरण सोिवंदा वाघमारे, यां÷या अĄयȦ, ŌĒतािवत “ जनिवकास फाउȾडɂशन ” पȦाचा मुóय

कायाɑलयाचा पƫा :- Ǒारा, चरण सोिवंदा वाघमारे, गुंज हॉटɂल एंड ȫरसोटɓ ÷या खाली, तुमसर कȵषी उāपąन बाजार सिमती

जवळ, भंडारा रोड, मांगली, ता. तुमसर, िज. भंडारा, िपन ४४१ ९१२ यांनी राùय िनवडणूक आयोगाकडɂ,“ जनिवकास फाउȾडɂशन”

अशा नावाने राजकीय पȦ नɻदणीसाठी अजɑ कɁला आहे ;

आिण ùयाअथȯ, उपरोȬčलिखत पȦ हा माąयताŌाĆत राđłीय िकȽवा माąयताŌाĆत राùयĒतरीय पȦ नसčयाने अशा पȦासाठी कोणतेही

िचąह राखून ठɂवणे आवĐयक नाही ;

आिण ùयाअथȯ, राùयातील Ēथािनक Ēवराùय संĒथा÷या कोणāयाही िनवडणुकीत माąयताŌाĆत राजकीय पȦ यांनी उĉया कɁलेčया

उमेदवाराďयितȫरòत उĉया रािहलेčया कोणāयाही उमेदवारास उपरोȬčलिखत आदेशाŌमाणे आयोगाǑारे मुòत िचąहे Ċहणून िविनिदɑđट कɁलेčया

िचąहांपैकी एका िचąहाची िनवड करता येईल व āयाचे वाटप करता येईल अशी तरतूद आहे ;

आिण ùयाअथȯ, मुòत िचąहापैकी एकाच िचąहाची िनवड अनेक उमेदवारांनी कɁली असेल व अशा अनेक उमेदवारांपैकी कɁवळ

एक उमेदवार नɻदणीकȵत राजकीय पȦाǑारे उभा कɁला असेल आिण उवɑȫरत अपȦ उमेदवार असčयास, िनवडणूक िनणɑय अिधकारी ते

मुòत िचąह āया नɻदणीकȵत राजकीय पȦा÷या उमेदवारास देईल आिण इतर कोणासही नाही, आिण जर या अनेक उमेदवारांपैकी दोन िकȽवा

अिधक नɻदणीकȵत राजकीय पȦांचे उमेदवार असतील आिण उवɑȫरत अपȦ उमेदवार असčयास िनवडणूक िनणɑय अिधकारी िचʸा टाकȳन

कोणāया नɻदणीकȵत राजकीय पȦा÷या उमेदवारास ते मुòत िचąह ǐायचे ते ठरवील आिण ùया उमेदवाराची िचǁी येईल, āया उमेदवारास

āया मुòत िचąहाचे वाटप करेल आिण इतर कोणासही नाही ;

आिण ùयाअथȯ, राùय िनवडणूक आयोगाने उपरोòत पȦास राजकीय पȦ Ċहणून नɻदणी करणेपूवȯ सदर नɻदणीबाबत सवɑसाधारण

जनतेकडȴन हरकती मागिवणे आवĐयक आहे ;

आता āयाअथȯ, राùय िनवडणूक आयोग, महाराđł, सदर अिधसूचना महाराđł शासन राजपŇात Ōिसǌ झाčया÷या

िदनांकापासून ३० िदवसांचे आत सदर नɻदणीबाबत सवɑसाधारण जनतेकडȴन कोणतीही हरकत असčयास, ती परĒपर

आयोगा÷या कायाɑलयाकडɂ दाखल करावी असे जाहीर करीत आहे.

STATE ELECTION COMMISSION, MAHARASHTRA

NOTIFICATION

No.SEC/RPP-2022/CR-93/D-11.— Whereas, the superintendence, direction and control of

all elections to the Panchayats and Municipalities in the State are vested in the State Election

Commission, Maharashtra by virtue of Article 243-K and 243-ZA of the Constitution of India, and

the provisions of the relevant State law as applicable to such Panchayats and Municipalities ;

And whereas, with a view to provide, in the interest of sanctity of elections to the local bodies,

and in the interest of conduct of such elections, in a free, fair, effective and efficient manner, for the

registration of political parties and for matters connected therewith; the Registration of Political

Parties Order, 2009 and Maharashtra Election Symbols (Reservation and Allotment ) Order, 2009

has been made by the State Election Commission, Maharashtra vide the State Election Commission,

Maharashtra, Notification No. SEC/MC-2009/CR-49/D-11, dated the 31st March 2009 ;

And whereas, the said Order applies to all elections held to local bodies in the State on party

basis except elections to Village Panchayats where elections are held on partyless basis ;

And whereas, before registering a Political Party under this Order, it is necessary to publish

a notice in the Maharashtra Government Gazette indicating therein , the name and address of the

political party, its President and the symbol proposed to be allotted, if any, and calling for objections,

if any, for such registration from the general public ;

And whereas, as per the said Order , if no objection is received within 30 days from the date of

publication of such notification in the Maharashtra Government Gazette, it shall be competent for

the State Election Commission to register the Political Party, as proposed in the notification;

And whereas, if any objection is so received, the State Election Commission may consider the

same and in case it is found to be without substance, it may reject the same and register the political

party. If on the other hand, the State Election Commission considers that the objection is prima facie

genuine, then the same shall be communicated to the applicant and his remarks shall be called for.

After receipt of the remarks, the Commission may either decide the matter on merits on the basis

of the records available or it may give personal hearing to the parties concerned and take a decision

thereafter. The decision of the State Election Commission shall be final ;

And whereas, Shri. Charan Sovinda Waghmare, President of proposed “ Janvikas

Foundation ” having main office address:- C/o. Charan Waghmare, Below Gunj Hotel Resorts,

Near Tumsar Krushi Utpanna Bajar Samiti (APMC), Bhandara Road, Mangali, Tal. Tumsar,

Dist. Bhandara, Pin 441 912 has applied to the State Election Commission for registering

“ Janvikas Foundation ”as a political party ;

And whereas, the said party being neither a recognised National Party nor a State Party, it is

not imperative to reserve symbol to it from the list of free symbols ;

And whereas, as per the aforesaid Order a candidate at an election to local bodies in the State,

other than a candidate set up by a recognised political party shall choose and shall be allotted one

of the symbols specified as free symbols by the Commission ;

And whereas, as per the said Order if the same free symbol has been chosen by several candidates

at such election, then, if of those several candidates only one is a candidate set up by registered

political party and all the rest are independent candidates, the returning officer shall allot that free

symbol to the candidate set up by the registered political party and to no one else, and if of those

several candidates two or more candidates are set up by different registered political parties and

the rest are independent candidates, the returning officer shall decide by lot to which of the two or

more candidates set up by the different registered political parties that free symbol shall be allotted

and allot that symbol to the candidate on whom the lot falls and to no one else ;

And whereas, it is necessary for the State Election Commission to call for objections, if any, from

the general public for registration of the said party as a political party ;

Now, therefore, the State Election Commission, Maharashtra, hereby calls for objections,

if any, for such registration of the said party from the general public which are to be

submitted directly to the Commission within 30 days from the date of publication of this

notiﬁcation in Maharashtra Government Gazette.
