महाराष्टट्र कृषी उत्पन्न पणन (विकास व विनियमन) अधिनियम, १९६३.
क्रमांक कृबास-०४२२/प्र.क्र.१९४/२१-स.—महाराष्टट्र कृषी उत््पन्न पपणन (विकास व विनियमन) अधिनियम, १९६३ (१९६४ चा
महा. २०) याच्या कलम ६० च्या पपोट-कलम (१) व पपोट-कलम (२) च्या खंड (ड) व (यु) यांद्ारे प्रदान केलेल्या अधिकारांचा आणि
त्याबाबतीत त्यास समर््थ करणाऱ्या इतर सर््व अधिकारांचा वापपर करून, महाराष्टट्र कृषी उत््पन्न बाजार समित्या (समितीची निवडणूक)
नियम, २०१७ यामध्ये आणखी सुधारणा करण्यासाठी, महाराष्टट्र शासनाने सुधारणा करण्याचे प्रस््ततावित केलेल्या नियमांचे पपुढील प्रारूपप,
त्यामुळे बाधा पपोहचण्याचा संभव असलेल्या सर््व व्यक््तींच्या माहितीकरिता, उक्त अधिनियमाच्या कलम ६० च्या पपोट-कलम (३) द्ारे
आवश्यक असल्याप्रमाणे, याद्ारे, प्रसिद्ध करण्यात येत आहे; आणि याद्ारे अशी नोटीस देण्यात येत आहे की, उक्त प्रारूपप, महाराष्टट्र
शासनाकडून दिनांक ३१ जानेवारी २०२३ रोजी किंवा त्यानंतर विचारात घेण्यात येईल.
२. उपपरोक्त दिनांकास किंवा त््ययापपूर्वी, उक्त प्रारूपपाच्या बाबतीत, कोणत्याही व्यक्तीकडून संचालक (पपणन), पपणन संचालनालय,
महाराष्टट्र राज्य, नवीन मध्यवर्तीी इमारत, ३रा मजला, पपुणे-४११ ००१ यांच्याकडे ज्या कोणत्याही हरकती किंवा सूचना प्राप्त होतील त्या
शासनाकडून विचारात घेण्यात येतील.
प्ारुप नियम

चा महा. २०) याच्या कलम ६० च्या पपोट-कलम (१) व पपोट-कलम (२) च्या खंड (ड) व (यु) यांद्ारे प्रदान केलेल्या अधिकारांचा
आणि त्याबाबतीत त्यास समर््थ करणाऱ्या इतर सर््व अधिकारांचा वापपर करून, महाराष्टट्र शासन, याद्ारे महाराष्टट्र कृषी उत््पन्न बाजार समित्या
(समितीची निवडणूक) नियम, २०१७ यामध्ये सुधारणा करीत आहे :-
१. या नियमांस, महाराष्टट्र कृषी उत््पन्न बाजार समित्या (समितीची निवडणूक) (पहिली सुधारणा) नियम, २०२३, असे
म्हणावे.

२. मुख्य नियमाच्या नियम ७ मध्ये, पपोट-नियम (४) नंतर, पपुढील पपोट-नियम (५) समाविष््ट करण्यात येईल:-
“(५) कृषी पपतसंस््थथा, बहुउद्ेशीय सहकारी संस््थथा व ग्ामपपंचायती यांच्या नव्याने निवडून आलेल्या समितीच्या बाबतीत
किंवा जेव्हा कृषी पपतसंस््थथा, बहुउद्ेशीय सहकारी संस््थथा व ग्ामपपंचायती यांनी व्यवस््थथापपन समितीचे सदस्य स्वीकृत केले असेल
त्याबाबतीत, पपोट-नियम (३) अन्वये प्रसिद्ध केलेल्या मतदारांच्या अंतिम यादीमध्ये ज्या व्यक्तीचे नाव समाविष््ट नाही अशा
कोणत्याही व्यक्तीस, कोणत्याही वेळी पपरंतु, नामनिर्देशन करण्याच्या शेवटच्या दिनांकापपूर्वी पपाच कामकाजाच्या दिवसांच्या
आत, जिल्हा निवडणूक अधिकाऱ्याकडे अर््ज करता येईल; आणि जिल्हा निवडणूक अधिकारी किंवा त्याने प्राधिकृत केलेली
व्यक्ती, चौकशी करील, जर जिल्हा निवडणूक अधिकाऱ्याने प्राधिकृत केलेल्या व्यक्तीने चौकशी केली असेल त्याबाबतीत,
ती व्यक्ती, चौकशीचा अहवाल जिल्हा निवडणूक अधिकाऱ्यास सादर करील. त्यानंतर, जिल्हा निवडणूक अधिकारी, अंतिम
मतदार यादीमध्ये त्यास योग्य वाटेल असे आवश्यक ते बदल करील.”.

NOTIFICATION
Maharashtra Agricultural Produce Marketing (Development and Regulation) Act, 1963.
No. KBS-0422/C.R.194/21-C.—The following draft of rules further to amend the Maharashtra
Agricultural Produce Market Committee (Election to Committee) Rules, 2017, which the Government
of Maharashtra proposes to make in exercise of the powers conferred by sub-section (1) and clauses
(d) and (u) of sub-section (2) of section 60 of the Maharashtra Agricultural Produce Marketing
(Development and Regulation) Act, 1963 (Mah. XX of 1964), and of all other powers enabling it
in that behalf, is hereby published, as required by sub-section (3) of section 60 of the said Act,
for the information of all the persons likely to be affected thereby; and notice is hereby given
that the said draft will be taken into consideration by the Government of Maharashtra on or after
31st January 2023.
2. Any objections or suggestions, which may be received by the Director (Marketing), Directorate
of Marketing, Maharashtra State, New Central Building, 3rd Floor, Pune 411 001, from any person
with respect to the said draft on or before the aforesaid date, will be considered by the Government.
DRAFT RULES
No. KBS0422/C.R.194/21-C.—In exercise of the powers conferred by sub-section (1) and clauses
(d) and (u) of sub-section (2) of section 60 of the Maharashtra Agricultural Produce Marketing
(Development and Regulation) Act, 1963. (Mah. XX of 1964), and of all other powers enabling it in
that behalf, the Government of Maharashtra hereby amends the Maharashtra Agricultural Produce
Market Committee (Election to Committee ) Rules, 2017 namely :—
1. These rules may be called the Maharashtra Agricultural Produce Market Committee
(Election to Committee) (First Amendment) Rules, 2023.
2. In rule 7 of the principal rules, after sub-rule (4), the following sub-rule (5) shall be
inserted, namely :—
“(5) In case of newly elected committee of the Agricultural Credit Societies, Multi-
purpose Co-operative Societies and Village Panchayats or where due to co-option of
members of the Managing Committee by the Agricultural Credit Societies, Multi- purpose
Co-operative Societies and Village Panchayats, any person whose name is not entered in
the final list of voters as published under sub-rule (3), may at any time but not later than
five working days before the last date of making nominations, apply to the District Election
Officer; and the District Election Officer or the person authorized by him, shall conduct
an inquiry, in case the inquiry conduct by the person authorized by the District Election
Officer in this behalf, he shall submit the report of inquiry to the District Election Officer.
Thereafter, the District Election Officer, as he deems fit, may make necessary changes in
the final voter list.”
