भारतीय संविधान.

क्रमांक एमसीओ-२०२०/प्र.क्र.१३९/नवि-१४.—भारतीय संविधानाच्या अनुच््छछेद ३०९ चे परंतुक आणि महाराष्टट्र नगरपरिषदा,

नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (महा. १९६५ चा ४०) चे कलम ७५अ चे पोोट-कलम (१) व (२) अन्वये प्रदान

करण्यात आलेल्या अधिकारांचा वापर करून आणि या बाबतीत सर््व संबंधित विद्यमान नियम, आदेश किंवा अनुदेश अधिक्रमित करून,

महाराष्ट्रा्राचे राज्यपाल याद्ारे महाराष्टट्र शासनाच्या नगरविकास विभागाच्या प्रशासकीय नियंत्रणाखालील महाराष्टट्र शहरी प्रशासकीय सेवेतील

सह आयुक्त, गट-अ, उपायुक्त, गट-अ/ मुख््ययाधिकारी, गट-अ(निवडश्रेणी), सहायक आयुक्त, गट-अ/ मुख््ययाधिकारी, गट-अ, व

सहायक आयुक्त, गट-ब/ मुख््ययाधिकारी, गट-ब या पदांच्या सेवाप्रवेशाचे विनिमय करणारे नियम करणारे पुढील नियम करीत आहेत :—

१. संक्षिप्त नाव व प्ारंभ: (१) या नियमांना महाराष्टट्र शहरी प्रशासकीय सेवा (सेवा प्रवेश) नियम, २०२३ म््हणून

संबोोधण्यात येईल.

(२) सदर नियम शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून अंमलात येतील.

२. व्याख्या : (१) या नियमांमध्ये संदर््भभानुसार दुसरा अर््थ अपेक्षित नसेल तर,—

(अ)“ नियुक्ती प्राधिकारी ” म््हणजे उमेदवारास शासकीय सेवेतील संबंधित पदावर नियुक्ती देण्यास प्राधिकृत असलेले

सक्षम प्राधिकारी ;

(ब) “ सहायक आयुक्त, गट-अ ” म््हणजे नगरविकास विभाग, शासन निर््णय क्र. एमसीओ-२०१९/प्र.क्र.१५२/

नवि-१४, दिनांक ५ ऑगस्ट, २०२० अन्वये नगरपरिषद प्रशासन संचालनालय अंतर्गत संवर््गगातील पूर्वीचे सहायक संचालक,

गट-अ हे पदनाम धारण करणारे अधिकारी ;

(क) “ सहायक आयुक्त, गट-ब ” म््हणजे नगरविकास विभाग, शासन निर््णय क्र. एमसीओ-२०१९/प्र.क्र.१५२/

गट-ब हे पदनाम धारण करणारे अधिकारी ;

(ड) “ आयोोग ” म््हणजे महाराष्टट्र लोोकसेवा आयोोग ;

(इ) “ पदवी ” म््हणजे सांविधिक विद्ापीठाची पदवी ;

(फ) “ संचालनालय ” म््हणजे नगरविकास विभागाच्या प्रशासकीय नियंत्रणाखालील नगरपरिषद प्रशासन

संचालनालय ;

(ग) “ उपायुक्त, गट-अ ” म््हणजे नगरविकास विभाग, शासन निर््णय क्र. एमसीओ-२०१९/प्र.क्र.१५२/नवि-१४,

दिनांक ५ ऑगस्ट, २०२० अन्वये नगरपरिषद प्रशासन संचालनालय अंतर्गत संवर््गगातील पूर्वीचे उप संचालक, गट-अ हे

पदनाम धारण करणारे अधिकारी ;

(ह) “ पदोोन्नतीसाठी पात्रता ” म््हणजे सामान्य प्रशासन विभागाने पदोोन्नतीच्या पात्रतेबाबत वेळोोवेळी नियम, परिपत्रक

किंवा आदेश या नुसार विहित केलेल्या अटी व शर्तीी या नुसारची पदोोन्नतीसाठीची पात्रता ;

(ई) “ शासन ” म््हणजे महाराष्टट्र शासन ;

(ज) “ सह आयुक्त, गट-अ ” म््हणजे नगरविकास विभाग, शासन निर््णय क्र. एमसीओ-२०१९/प्र.क्र. १५२/

नवि-१४, दिनांक ५ ऑगस्ट, २०२० अन्वये नगरपरिषद प्रशासन संचालनालय अंतर्गत संवर््गगातील पूर्वीचे सह संचालक,

गट-अ हे पदनाम धारण करणारे अधिकारी ;

(के) “ मर््ययादित विभागीय स््पर््धधा परीक्षा ” म््हणजे शासनाने या संदर््भभात वेळोोवेळी विहित केलेल्या नियमानुसार महाराष्टट्र

नगरपरिषद राज्य सेवेच्या संवर््गगामधील कर््मचाऱ््ययाांांची सहायक आयुक्त, गट-ब किंवा मुख््ययाधिकारी, गट-ब या पदावर

पदोोन्नतीसाठी आयोोगामार्फत घेण्यात येणारी परीक्षा ;

(ल) “ महाराष्टट्र नगरपरिषद राज्य सेवा ” म््हणजे महाराष्टट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी राज्यसेवा

(समावेशन, नेमणुका व सेवेच्या शर्तीी) नियम, २००६ अन्वये समाविष््ट असलेला पदांचा संवर्ग.

(म) “महाराष्टट्र शहरी प्रशासकीय सेवा ” म््हणजे नगरपरिषद मुख््ययाधिकारी संवर््गगातील मुख््ययाधिकारी, गट-अ

(निवडश्रेणी), मुख््ययाधिकारी, गट-अ व मुख््ययाधिकारी, गट-ब आणि नगरपरिषद प्रशासन संचालनालयाच्या अंतर्गत

सह आयुक्त, गट-अ, उपायुक्त, गट-अ, सहायक आयुक्त, गट-अ व सहायक आयुक्त, गट-ब या पदाचा समावेश असलेली

सेवा ;

(२) या नियमांमध्ये वापरलेले परंतु या नियमात परिभाषित न केलेल्या शब्द व अभिव्यक्ती यांना महाराष्टट्र नगरपरिषदा,

नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (महा. १९६५ चा ४०) व महाराष्टट्र महानगरपालिका अधिनियम, १९४९

(महा. १९४९ चा ५९) मध्ये त््ययाांांना ठरवून दिलेला संबंधित अर््थ असेल.

३. सह आयुक्त, गट-अ या पदावर नियुक्ती उपायुक्त, गट-अ किंवा मुख््ययाधिकारी, गट-अ (निवडश्रेणी) या दोोन पदांच्या

एकत्रित सेवा ज््येष््ठठता आधारे संबंधित पदावर तीन वषाांपेक्षा कमी नसेल इतकी सलग नियमित सेवा झालेल्या व पदोोन्नतीसाठी

पात्रता धारण करणाऱ्या योोग्य व्यक््तींच्या पदोोन्नतीने करण्यात येईल.

४. उपायुक्त, गट-अ या पदावर नियुक्ती सहायक आयुक्त, गट-अ किंवा मुख््ययाधिकारी, गट-अ या दोोन पदांच्या एकत्रित

सेवा ज््येष््ठठता आधारे संबंधित पदावर तीन वषाांपेक्षा कमी नसेल इतकी सलग नियमित सेवा झालेल्या व पदोोन्नतीसाठी पात्रता धारण

करणाऱ्या योोग्य व्यक््तींच्या पदोोन्नतीने करण्यात येईल.

५. सहायक आयुक्त, गट-अ/ मुख््ययाधिकारी, गट-अ या पदावरील नियुक््त्ययाया पुढील मार््गगाने करण्यात येतील,—

(अ) (i) मुख््ययाधिकारी, गट-ब या पदावर तीन वषाांपेक्षा कमी नसलेली सलग नियमित सेवा झालेल्या व पदोोन्नतीसाठी

पात्रता धारण करणाऱ्या योोग्य व्यक्तीच्या पदोोन्नतीने ; किंवा

(ii) या अधिसूचनेच्या दिनांकास नगरपरिषद प्रशासन संचालनालयाच्या अंतर्गत सहायक आयुक्त, गट-ब या पदावर

तीन वषाांपेक्षा कमी नसलेली सलग नियमित सेवा असलेल्या व पदोोन्नतीसाठी पात्रता धारण करणाऱ्या योोग्य व्यक्तीच्या

पदोोन्नतीने ;

स््पष््टीकरण : सदर खंड (अ) अंतर्गत पदोोन्नतीच्या प्रयोोजनार््थ दोोन स्वतंत्र ज््येष््ठठता सूची ठेेवण्यात येतील व नियम

७ मध्ये या पदावर पदोोन्नतीसाठी विहित केलेल्या प्रमाणाच्या अधीन ९५:०५ या पदोोन्नतीचे प्रमाणात असेल.

परंतु असे की, सहायक आयुक्त, गट-ब हे पद धारण करणाऱ्या व्यक््तींची सामाईक ज््येष््ठठता सूची संपुष््टटाटात आल्यावर

आणि सहायक आयुक्त, गट-ब व मुख््ययाधिकारी, गट-ब यांची नियम ६ नुसार सामाईक ज््येष््ठठता सूची ठेेवण्यात येईल ; किंवा

(ब) आयोोगाकडून घेण्यात येणाऱ्या स््पर््धधात्मक परिक्षेच्या निकाला आधारे शिफारस करण्यात आलेल्या व खालील

अर््हता धारण करणाऱ्या उमेदवारामधून नामनिर्देशनाद्ारे :—

(i) वयोमर््ययादा :

(अ) किमान वयोोमर््ययादा : एकोणीस वर्षेे पूर््ण.

(ब) कमाल वयोोमर््ययादा : खुल्या प्रवर््गगातील व्यक््तींसाठी वयाच्या ३८ वर््षषापेक्षा कमी व मागासवर्गीीय प्रवर््गगातील

व्यक््तींसाठी ४३ वषाांपेक्षा कमी ;

(ii) शैक्षणिक पात्रता : सांविधिक विद्ापीठाची पदवी.

६. सहायक आयुक्त, गट-ब किंवा मुख््ययाधिकारी, गट-ब या पदावरील नियुक््त्ययाया पुढील मार््गगाने करण्यात येतील :—

(अ) नगरपरिषद प्रशासन संचालनालयाच्या अंतर्गत आधिक्षक, गट-ब (अराजपत्रित) या पदावर तीन वर्षेे पेक्षा कमी

नसलेली सलग नियमित सेवा असणाऱ्या व पदोोन्नतीसाठी पात्रता धारण करीत असलेल्या योोग्य व्यक्तीच्या पदोोन्नतीने; किंवा

(ब) महाराष्टट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी (समावेशन, नेमणुका व सेवाशर्तीी) नियम, २००६ चे

परिशिष््ट-१ मध्ये नमूद पदावर किमान ५ वषाांची सेवा पूर््ण केलेल्या योोग्य व्यक्तीची आयोोगाकडून संचालित करण्यात येणाऱ्या

मर््ययादित विभागीय स््पर््धधा परीक्षेच्या निकालाच्या आधारे योोग्य व्यक्तीच्या पदोोन्नतीने; किंवा

(क) आयोोगांकडून घेण्यात येणाऱ्या स््पर््धधात्मक परिक्षेच्या निकाला आधारे शिफारस करण्यात आलेल्या व खालील

अर््हता धारण करणाऱ्या उमेदवारामधून नामनिर्देशनाद्ारे,

(i) शैक्षणिक पात्रता : सांविधिक विद्ापीठाची पदवी.;

(ii) वयोोमर््ययादा :—

(अ) किमान वयोोमर््ययादा : एकोणीस वर्षेे पूर््ण.

व्यक््तींसाठी ४३ वषाांपेक्षा कमी.

७. नियम ५ मध्ये नमूद पदांवर पदोोन्नती व नामनिर्देशन याद्ारे नियुक्ती चे प्रमाण अनुक्रमे ७५:२५ असे राहील :

परंतु असे की, पदोोन्नतीने नियुक्ती देण्याकरीता योोग्य उमेदवार उपलब्ध नसतील तर, नियुक्ती प्राधिकाऱ्याच्या सहमतीने त्या

विशिष््ट भरती वर््षषासाठी पदोोन्नती व नामनिर्देशन याद्ारे करावयाच्या नियुक्तीचे प्रमाण शिथिल करून सदर पदे नामनिर्देशनाद्ारे

भरता येतील.

८. नियम ६ मध्ये नमूद पदांवर पदोोन्नती, मर््ययादित विभागीय परीक्षा व नामनिर्देशन याद्ारे नियुक्तीचे प्रमाण अनुक्रमे

०५:२०:७५ असे राहील:

परंतु असे की, पदोोन्नतीने नियुक्ती देण्याकरिता योोग्य उमेदवार उपलब्ध नसतील तर नियुक्ती प्राधिकाऱ्याच्या सहमतीने त्या

भरता येतील.

९. नियम ३ अथवा ४ मधील नमूद दोोन्ही पदांसाठी ज््येष््ठठता सूची एकत्रित करताना एकत्रित ज््येष््ठठता सूचीतील ज््येष््ठठता

क्रमांक हा संबंधित पदावरील नियुक्तीच्या दिनांकानुसार निर््धधारित होोईल. तसेच, दोोन्ही पदांवरील दोोन अधिकाऱ््ययाांांच्या नियुक्तीचा

दिनांक एकच असल्यास वयाने ज््येष््ठठ असलेल्या अधिकाऱ्यास ज््येष््ठठता यादीत प्राधान्य देण्यात येईल.

भाग चार-अ-२१–१अ

१०. नियम ५ अथवा ६ मधील नमूद पदांवर नामनिर्देशनाने नियुक्त होणारी व्यक्ती ही दोोन वषाांच्या कालावधीकरिता

परिविक्षाधीन राहील. सदर परिविक्षाधीन कालावधी कमाल एका वर््षषाने वाढविता येईल व या पदावर नियुक्त होणाऱ्या व्यक्तीने

सदर परिविक्षाधीन कालावधी यशस्वीपणे पूर््ण करणे आवश्यक आहे. एखाद्ा व्यक्तीने विहित कालावधीत परिविक्षाधीन कालावधी

यशस्वीपणे पूर््ण न केल्यास अथवा नियुक्त झालेल्या पदासाठी तोो अयोोग्य असल्याचे आढळल्यास सदर व्यक्तीच्या सेवा समाप्त

होोण्यायोोग्य असतील.

११. नियम ५ अथवा ६ मधील नमूद पदांवर नामनिर्देशनाने नियुक्त होणाऱ्या व्यक्तीने एकत्रित परीविक्षा प्रशिक्षण कार््यक्रमाच्या

अंतर्गत प्रशिक्षण पूर््ण करून, विहित केलेली असल्यास विभागीय परीक्षा उत्तीर््ण होणे आवश्यक आहे.

१२. (१) सदर पदावर पदोोन्नतीने नियुक्ती होोण्यापूर्वी मराठी व हिंदी भाषेची परीक्षा उत्तीर््ण झाले अथवा त्यापासून सूट

मिळाली असल्याची बाब वगळता, नियम ३ अथवा ४ मधील नमूद पदांवर पदोोन्नतीने नियुक्त होणाऱ्या व्यक्तीने, महाराष्टट्र शासनाने

वेळोोवेळी विहित केल्यानुसार मराठी व हिंदी भाषेची परीक्षा उत्तीर््ण होणे आवश्यक आहे.

(२) सदर पदावर पदोोन्नतीने नियुक्ती होोण्यापूर्वी मराठी व हिंदी भाषेची परीक्षा उत्तीर््ण झाले अथवा त्यापासून सूट मिळाली

असल्याची बाब वगळता, नियम ५ अथवा ६ मधील नमूद पदांवर पदोोन्नतीने नियुक्त व्यक्तीने, महाराष्टट्र शासनाने वेळोोवेळी विहित

केल्यानुसार मराठी व हिंदी भाषेची परीक्षा उत्तीर््ण होणे आवश्यक आहे. सदर परीक्षा उत्तीर््ण झाल््ययाशिवाय पुढील वार््षषिक वेतनवाढ

अथवा पदोोन्नतीच्या पुढील पदावर पदोोन्नतीने नियुक्त होोण्यासाठी सदर व्यक्तीला पात्र समजण्यात येणार नाही.

१३. (१) सदर पदावर नामनिर्देशनाने नियुक्ती होोण्यापूर्वी संगणक अर््हता प्रचालन प्रमाणपत्र धारण करण्यापासून सूट मिळाली

असल्याची बाब वगळता, नियम ३ अथवा ४ मधील नमूद पदांवर नामनिर्देशनाने नियुक्त होणाऱ्या व्यक्तीने, महाराष्टट्र शासनाने

वेळोोवेळी विहित केलेल्या नियम अथवा आदेशानुसार विहित संगणक अर््हता प्रचालन प्रमाणपत्र धारण करणे आवश्यक आहे.

(२) सदर पदावर नामनिर्देशनाने नियुक्ती होोण्यापूर्वी संगणक अर््हता प्रचालन प्रमाणपत्र धारण करण्यापासून सूट मिळाली

असल्याची बाब वगळता, नियम ५ अथवा ६ मधील नमूद पदांवर नामनिर्देशनाने नियुक्त होणाऱ्या व्यक्तीने, महाराष्टट्र शासनाने

सदर प्रमाणपत्र धारण केल््ययाशिवाय पुढील वार््षषिक वेतनवाढ अथवा पदोोन्नतीच्या पुढील पदावर पदोोन्नतीने नियुक्त होोण्यासाठी

सदर व्यक्तीला पात्र समजण्यात येणार नाही.

१४ . (१) नियम ५ अथवा ६ मधील नमूद पदांवर नामनिर्देशनाने नियुक्त होोण्यासाठी शिफारस होणाऱ्या व्यक्तीने, महाराष्टट्र

नागरी सेवा (छोोटेे कुटुंब घोोषणापत्र) नियम, २००५ अथवा शासनाने वेळोोवेळी विहित केलेल्या नियम आदेश अथवा संलेखानुसार

छोोट्ा कुटुंबाबाबत घोोषणापत्र सादर करणे आवश्यक आहे.

(२) छोोटेे कुटुंब घोोषणापत्र सादर करण्याच्या दिनांकास दोोन अपत््ययाांांपेक्षा जास्त असणारी व्यक्ती शासकीय सेवेत नियुक्ती

मिळण्यास अपात्र असेल.

(३) शासकीय सेवेत नियुक्ती मिळाल्यानंतर एखाद्ा व्यक्तीस नियुक्तीच्या वेळेेस अथवा त्यानंतर दोोन पेक्षा जास्त अपत्ये

असल्याचे सिद्ध झाल्यास शासन सेवेतील सदर पदावर कार््यरत राहण्यासाठी अपात्र ठरविण्यात येईल.

१५. कोणत्याही शासकीय सेवकाची शासकीय सेवेत नियुक्ती झाल्यानंतर शासनाने वेळोोवेळी जारी केलेले नियम, आदेश

अथवा निर््णय यामधील अटी व शर्तीी संबंधित शासकीय सेवकास लागू असतील.

१६. नियम ३, ४, ५ व ६ मधील नमूद पदांवर नियुक्त होणारी व्यक्ती ही महाराष्टट्र राज्यात कुठेेही बदली होोण्यास पात्र

असेल.

NOTIFICATION

Constitution of India.

No. MCO-2020/C.R.139/UD-14.— In exercise of the powers conferred by proviso to article 309

of the Constitution of India read with sub-sections (1) and (2) of section 75A of the Maharashtra

Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah. XL of 1965) and

in supersession of all the existing rules, orders or instruments issued in this behalf, the Governor of

Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of Joint

Commissioner, Group-A, Deputy Commissioner, Group-A/Chief Officer, Group-A(Selection Grade),

Assistant Commissioner, Group-A/ Chief Officer, Group-A and Assistant Commissioner, Group-B/

Chief Officer, Group-B in the Maharashtra Urban Administrative Service under the administrative

control of the Urban Development Department, namely :—

1. Short title and commencement.—(1) These rules may be called the Maharashtra Urban

Administrative Service (Recruitment) Rules, 2023.

(2) These rules shall come into force from the date of publication in the Official Gazette.

2. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) “Appointing Authority” means authority competent to appoint a candidate on the

concerned post in the Government Service;

(b) “Assistant Commissioner, Group-A” means officers holding the post previously

designated as Assistant Director, Group-A in the cadre under the Directorate of Municipal

Administration as per the Urban Development Department, Government Resolution

No. MCO-2019/C.No.152/UD-14, dated the 5th August 2020;

designated as Assistant Director, Group-B in the cadre under the Directorate of Municipal

Administration as per the Urban Development Department, Government Resolution

No. MCO-2019/C.No.152/UD-14, dated the 5th August 2020;

(d) “Commission” means the Maharashtra Public Service Commission;

(e) “Degree” means degree of a statutory university;

(f) “Directorate” means the Directorate of Municipal Administration under the

administrative control of Urban Development Department;

(g) “Deputy Commissioner, Group-A” means officers holding the post previously

designated as Deputy Director, Group-A in the cadre under the Directorate of Municipal

Administration as per the Urban Development Department, Government Resolution

No. MCO-2019/C.No.152/UD-14, dated the 5th August 2020;

(h) “Eligibility for promotion” means the eligibility for promotion in accordance with

the terms and conditions specified for promotion in rules, resolutions or orders issued in

this behalf by the General Administration Department, from time to time;

(i) “Government” means the Government of Maharashtra;

(j) “Joint Commissioner, Group-A” means officers holding the post previously

designated as Joint Director, Group-A in the cadre under the Directorate of Municipal

Administration as per the Urban Development Department, Government Resolution

No. MCO-2019/C.No.152/UD-14, dated the 5th August 2020;

(k) “ Limited Departmental Competitive Examination” means the examination

conducted by the Commission for promotion to the post of Assistant Commissioner, Group-B

or Chief Officer, Group-B from amongst the employees belonging to the cadres in the

Maharashtra Municipal State Services in accordance with the rules framed in this regard

by the Government, from time to time;

(l) “ Maharashtra Municipal State Services ” means the cadres of the posts included

as per the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships

State Service (Absorption, Recruitment and conditions of service) Rules, 2006;

(m) “ Maharashtra Urban Administrative Service ” means the service consisting of

the posts of Chief Officer, Group-A (Selection Grade), Chief Officer, Group-A and Chief

Officer Group-B from the Municipal Council Chief Officer Cadre and Joint Commissioner,

Group-A, Deputy Commissioner, Group-A, Assistant Commissioner, Group-A and Assistant

Commissioner, Group-B under the Directorate of Municipal Administration.

(2) The words and expressions used in these rules but not defined shall have the same

meaning respectively assign to them in the Maharashtra Municipal Corporations Act (Mah. LIX

of 1949) and the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships

Act, 1965 (Mah. XL of 1965).

3. Appointment to the post of Joint Commissioner, Group-A, shall be made by promotion

of suitable person having eligibility for promotion and having not less than three years regular

and continuous service on the post of Deputy Commissioner, Group-A or Chief Officer, Group-A

(Selection Grade) on the basis of common seniority, as per the common seniority list of persons

holding the said post.

4. Appointment to the post of Deputy Commissioner, Group-A or Chief Officer, Group-A

(Selection Grade), shall be made by promotion of suitable person having eligibility for promotion

and having not less than three years regular and continuous service on the post of Assistant

Commissioner, Group-A and Chief Officer, Group-A on the basis of common seniority, as per

the common seniority list of persons holding the said post.

5. Appointment to the post of Assistant Commissioner, Group-A and Chief Officer, Group-A

shall be made either,—

(a) (i) by promotion of suitable person having eligibility for promotion and having not

less than three years regular and continuous service on the post of Chief Officer, Group-B; or

(ii) by promotion of suitable person having eligibility for promotion and having not less

than three years regular and continuous service on the post of Assistant Commissioner,

Group-B working under the Directorate of Municipal Administration on the date of issue

of this notification;

Explanation.—For the purposes of promotion under the said clause (a), two separate

seniority lists shall be maintained and promotion to the said post shall be in the ratio of 95:05

of the ratio of promotion provided under rule 7:

Provided that, after the common seniority list of the persons holding the post of Assistant

Commissioner. Group-B is exhausted and thereafter, common seniority list of the Assistant

Commissioner, Group-B and Chief Officer, Group-B to be appointed under rule 6 shall be

maintained; or

(b) by nomination from amongst the candidates recommended by the Commission, on

the basis of result of competitive examination conducted therefor, who fulfills the following

criteria, namely :—

(i) Age Limit :—

(a) Lower Age Limit.- Nineteen years completed.

(b) Upper Age Limit.- Not more than thirty-eight years of age for the persons

not belonging to reserved categories and upto forty-three years for the persons

for the persons belonging to reserved categories.

(ii) Educational Qualifications:- Degree of a statutory university.

6. Appointment to the post of Assistant Commissioner, Group-B or Chief Officer, Group-B

shall be made either,—

(a) by promotion of suitable person having eligibility for promotion and having not less

than three years regular and continuous service on the post of Superintendent, Group-B

(Non-Gazetted) under the Directorate of Municipal Administration; or

(b) by promotion of suitable person who have completed minimum five years’ service on

any post in the Services mentioned in Appendix I appended to the Maharashtra Municipal

Councils, Nagar Panchayats and Industrial Townships State Services (Absorption,

Recruitment and Conditions of Service) Rules, 2006 and on the basis of result of the Limited

Departmental Competitive Examination conducted by the Commission; or

competitive examination conducted by the Commission.—

(i) Education Qualifications :—Degree of statutory university;

(ii) Age Limit :—

(a) Lower Age Limit.—Nineteen years completed.

(b) Upper Age Limit.—Not more than thirty-eight years of age for the persons

not belonging to reserved categories and upto forty-three years for the persons

for the persons belonging to reserved categories.

7. The appointment to the post mentioned in rule 5 shall be made by promotion and

nomination in the ratio of 75:25, respectively :

Provided that, if the suitable candidates for appointment by promotion shall not be

available, then, with the concurrence of the Appointing Authority, the ratio of the appointments

by promotion and nomination for that recruitment year shall be relaxed and the said posts may

be filled up by nomination.

8. The appointment to the post mentioned in rule 6 shall be made by promotion, Limited

Departmental Examination and nomination in the ratio of 05:20:75 :

Provided that, if the suitable candidates for appointment by promotion shall not be

available, then, with the concurrence of the Appointing Authority, the ratio of the appointments

by promotion and nomination for that recruitment year shall be relaxed and the said posts may

be filled up by nomination.

9. While consolidating the seniority lists of two posts, as mentioned in rules 3 or 4, the

seniority number in the consolidated seniority list shall be determined according to the date

of appointment on the concerned posts, if the date of appointment of two officers on two posts

is one and same, the seniority number should first be given to the person who is senior by age.

10. A person appointed to the post mentioned in rule 5 or 6 by nomination shall be on

probation for a period of two years. The probation period may be extended upto a maximum

period of one year. A person shall be required to complete the probation period successfully. If

a person does not complete the probation period successfully within the stipulated period or is

not found suitable for the post, then a person shall be liable to be terminated from the service.

11. A person appointed to the post mentioned in rule 5 or 6 by nomination shall be required

to complete the training under the Combined Probationary Training Program (CPTP) and pass

the prescribed Departmental Examination (if any).

12. (1) A person appointed to the post mentioned in rule 3 or 4 by promotion shall be

required to pass the Marathi and Hindi languages examinations as per the rules made in that

behalf by the Government, from time to time, unless he has already passed or has been exempted

from passing those examinations, before promotion to the said post.

(2) A person appointed to the post mentioned in rule 5 or 6 by nomination shall pass

the Marathi and Hindi languages examinations as per the rules made in that behalf by the

Government, from time to time, within the prescribed time limit after appointment, unless he

has already passed or has been exempted from passing those examinations. He shall not be

eligible for annual increment or promotion to the next promotional post until he passes those

examinations.

13. (1) A person appointed to the post mentioned in rule 3 or 4 by promotion shall possess

a Certificate of Computer Operations prescribed by rules or orders issued in that behalf by the

Government, from time to time, unless he has exempted therefrom before promotion to the said

post.

(2) A person appointed to the post mentioned in rule 5 or 6 by nomination shall possess a

Certificate of Computer Operations prescribed by the Government, from time to time, within

the prescribed time limit after appointment, unless he has been exempted from possessing such

Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or

promotion to the next promotional post until he possess the same.

14. (1) A person recommended for appointment by nomination to the post mentioned in rule

5 or 6 shall submit a Declaration of Small Family as per the provisions of the Maharashtra Civil

Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments

issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of

Small Family shall be disqualified for the appointment in the Government service.

(3) After appointment of a person in the Government service, if it is proved that he has

more than two children at the time of appointment or thereafter, then he shall be disqualified

for continuing on the said post in the Government service.

15. The terms and conditions specified by the Government, subsequent to the appointment

of any Government servant in any rules, orders or resolutions issued by the Government, from

time to time, shall also be applicable to the Government servant.

16. A person appointed to the post mentioned in rule 3, 4, 5 or 6 shall be liable for transfer

anywhere in Maharashtra.
