MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-1221/1159/CR-81/21/UD-12.— Whereas, the Government of Maharashtra in Urban
Development Department vide its Notification No.TPS-1206/330/ CR-230/06/UD-12, dated the
17th March, 2007 (Published in Government Gazette on 19th April, 2007) promulgated in exercise
of its powers conferred by clause (c) under sub-section (1) of section 40 of the Maharashtra Regional
and Town Planning Act, 1966 (hereinafter referred to as “the said Act”) appointed Mumbai
Metropolitan Region Development Authority (hereinafter referred to as “MMRDA”) established
under the Mumbai Metropolitan Region Development Authority Act, 1974, to be the Special
Planning Authority (hereinafter referred to as “the said Special Planning Authority”) for Bhiwandi
Surrounding Notified Area, which includes the area of 51 villages (revised 60 villages) from
Bhiwandi Tahsil of Thane District (hereinafter referred to as “the said Notified Area”);
And whereas, the Development Plan of the said Notified Area (hereinafter referred to as
“the said Development Plan”) has been sanctioned by the Government in the Urban Development
Department, partly under section 31(1) of the said Act, vide Notification No. TPS-1212/1699/
CR-127/2013/UD-12, dated the 11th March, 2015 and the Excluded Part (EP) of the said
Development Plan has been sanctioned by the Government in Urban Development Department
under section 31(1) of the said Act, vide Notification No.TPS-1216/1169/C.R.162/16/ UD-12, dated
the 4th November, 2016 (hereinafter collectively referred to as “the said Notification”);
Whereas, the Government of Maharashtra has sanctioned the Unified Development Control
and Promotion Regulations (UDCPR) (hereinafter reffered to as “the said UDCPR”) for all the
Regional Plans and Planning Authorities of the state except Municipal Corporation of Greater
Mumbai, other Planning Authorities/Special Planning Authorities/Development Authorities within
the limit of Municipal Corporation of Greater Mumbai, MIDC, NAINA, Jawaharlal Nehru Port
Trust, Hill Station Municipal Councils, Eco-Sensitive Eco-Fragile region notified by MoEF & CC
and Lonavala Municipal Council and Area under CIDCO’s jurisdiction as Planning Authority,
PCNTDA, MIHAN, MADC, MSRDC in Maharashtra under the provisions of the Maharashtra
Regional & Town Planning Act, 1966 (hereinafter refferd to as “the said Act”) vide Notification
No. TPS-1818/CR.238/18/DP.&RP./Sec.37(IAA)(c) & Sec. 20(4)/ UD-13, dated 2nd December 2020
which has come into force with effect from 3rd December 2020;
And whereas, Chapter-10 in the said UDCPR is regarding City Specific Regulations and
Regulation No. 10.13.1 is regarding the Regulation for development of Affordable Housing Scheme
in the said Notified Area (hereinafter referred to as “the said Regulation”);
And whereas, the Government in Urban Development Department has given Directives
under section 37(1) of the said Act, (hereinafter referred to as “the said directives”) to the said
Special Planning Authority, vide dated 6th December 2021 to submit a modification proposal in
the Clause 10.13.1.5(i) of the said Regulation regarding the change of area of the Affordable Housing
Unit from 25.00 sq.mt. carpet area to 30.00 sq.mt. carpet area for the units upto 40% and 50.00
sq.mt. carpet area for the remaining units (hereinafter referred to as “the proposed modification”);
And whereas, as per the said directives, the said Special Planning Authority after following
the legal procedure under sub-section (1) of section 37 of the said Act, has submitted the said
proposed modification proposal to the Government, vide letter dated 25th May 2022;
And whereas, after making necessary enquiries and after consulting the Director of Town
Planning, Maharashtra State, Pune, the Government is of the opinion that it is necessary to sanction
the proposed modification;

Now therefore, in exercise of the powers conferred under sub-section (2) of section 37 of the
said Act, and all other powers enabling it in that behalf, the State Government hereby,
(A) Sanctions the proposed modification as described in the schedule appended herewith.
(B) Fixes, the date of publication of this Notification in Maharashtra Government Gazette
as, the date of coming into force of the sanctioned modification.

The aforesaid sanctioned modification shall be made available for inspection by the general
public during office hours on all working days at the following offices for a period of one month :—
(i) The Metropolitan Commissioner, Mumbai Metropolitan Region Development
Authority, Bandra (East), Mumbai.
(ii) The Joint Director of Town Planning, Konkan division, Konkan Bhavan, Navi Mumbai.
(iii) The Assistant Director of Town Planning, Thane Branch, Thane.

at www.maharashtra.gov.in (Acts & Rules).

Existing Provision
Clause 10.13.1.5(i) – An Affordable
Housing Unit shall be a self-contained
dwelling Unit of 25 sq.mt. carpet area.
However the carpet area of a Housing Unit
shall 160 sq.ft. where the construction
under the Rental Housing Scheme has
already commenced.
Sanctioned Modification
Clause 10.13.1.5(i) – An Affordable
Housing Unit shall be a self-contained
dwelling Unit of 30 sq.mt. carpet area
for 40% units and 50 sq.mt. carpet area
for remaining units. However the carpet
area of a Housing Unit shall 160 sq.ft.
where the construction under the Rental
Housing Scheme has already commenced.
