भारतीय संिवधान.

ĸमांक.औसुवआ-०३१३/Ō.ĸ.३१/कामगार-१.— भारतीय संिवधाना÷या अनु÷छɂद ३०९ ÷या परंतुकाďदारे Ōदान करĀयात आलेčया

शòतȮचा वापर कȠन आिण या बाबतीत कɁलेले सवɑ िवǐमान िनयम, आदेश िकȽवा संलेख यांचे अिधĸमण कȠन महाराđłाचे राùयपाल

याďदारे महाराđł शासना÷या उǐोग, ऊजाɑ व कामगार िवभागा÷या िनयंŇणाखालील औǐोिगक सुरȦा व आरोôय संचालनालया÷या

आĒथापनेवरील वȫरđठ रसायन शाĒŇȧ, Ōयोगशाळा तंŇȧ, Ōयोगशाळा सहायक या गट-क ÷या पदां÷या सेवाŌवेशाचे िविनयमन करणारे

पुढील िनयम करीत आहेत :—

१.

(१)

या िनयमांना, औǐोिगक सुरȦा व आरोôय संचालनालयातील वȫरđठ रसायन शाĒŇȧ, Ōयोगशाळा तंŇȧ,

Ōयोगशाळा सहायक, गट-क यांचे सेवाŌवेश िनयम-२०२३ असे संबोधĀयात यावे.

(२)

सदर िनयम शासन राजपŇ Ōिसnj झाčया÷या िदनांकापासून अंमलात येतील.

२.

या िनयमांमĄये संदभाɑनुसार दुसरा अथɑ अिभŌेत नसेल तर—

क)

“पदवी” याचा अथɑ, कोणāयाही सांिविधक िवǐापीठाची पदवी, असा आहे ;

ख)

“िवभाग” याचा अथɑ, भारतीय संिवधाना÷या अनु÷छɂद १६६ अąवये बनिवलेčया महाराđł शासन

कायɑिनयमावली÷या पिहčया अनुसूिचमĄये िविनिदɑđट कɁलेला, “उǐोग, ऊजाɑ व कामगार िवभाग”, असा आहे ;

(ग)

“संचालनालय” याचा अथɑ, महाराđł शासना÷या उǐोग, ऊजाɑ व कामगार िवभागा÷या अिधपāयाखालील

“औǐोिगक सुरȦा व आरोôय संचालनालय, महाराđł राùय”, असा आहे ;

(घ)

“शासन” याचा अथɑ, “महाराđł शासन” असा आहे ;

(च) “िनवड सिमती” याचा अथɑ, संचालक, औǐोिगक सुरȦा व आरोôय संचालनालय, महाराđł राùय या

कायाɑलयासाठी दुċयम सेवेतील गट-क ÷या पदांवरील उमेदवारांची िनवड करĀयाकȫरता शासना÷या माąयतेने

गिठत कɁलेली िनवड सिमती, असा आहे.

३.

संचालनालया÷या आĒथापनेवरील “वȫरđठ रसायन शाĒŇȧ, गट-क” या पदावरील िनयुòती पुढील मागाɑने करता

येईल :—

(क)

संचालनालया÷या आĒथापनेवरील Ōयोगशाळा तंŇȧ, गट-क हे पद धारण करणाķया तसेच सदर पदावर िकमान

तीन वषाɑहून कमी नसेल इतकी िनयिमत सेवा झालेčया तसेच या िनयमा÷या पोटिनयम (ख)(दोन) नुसार

शैȦिणक अहɑता धारण करणाķया ďयòतȮमधून ùयेđठता अधीन पाŇता या िनकषावर योôय ďयòती÷या पदोąनतीने

करĀयात येईल.

िकȽवा

(ख) सदर पद पदोąनतीने भरĀयासाठी पाŇ ďयòती उपलĈध नसčयास, िनवड सिमतीकडȴन घेĀयात येणाķया Ēपधाɑāमक

परीȦे÷या िनकाला÷या आधारे िशफारस करĀयात आलेčया, खाली नमूद अटी पूणɑ करणाķया उमेदवारांमधून

नामिनदɨशनाǑारे, जे—

(एक) ३८ वषाɕपेȦा जाĒत वयाचे नाहीत:

परंतु, आरिȦत Ōवगाɑतील उमेदवारां÷या बाबतीत वयोमयाɑदा पाच वषाɕपयɕत िशिथल कɁली जाईल ;

(दोन) सांिविधक िवǐापीठाची िवȧान शाखेतील अॅनािलिटकल कɁिमĒłी िकȽवा एनďहायरąमɞटल सायąस या

िवषयासह पदďयुƫर पदवी धारण करतात ;

आिण

(तीन) कोणāयाही उǐोगामधील/ शासकीय खाāयामधील/ शासनाने Ēथािपत कɁलेčया औǐोिगक उपĸमामधील/

Ēथािनक Ōािधकरणामधील/ महामंडळामधील, रासायिनक िकȽवा Ōदूषणिवषयक Ōयोगशाळɂतील िकमान ३ वषɨ

इतका ŌāयȦ कामाचा अनुभव धारण करतात.

४.

संचालनालया÷या आĒथापनेवरील “Ōयोगशाळा तंŇȧ, गट-क” या पदावरील िनयुòती, Ōयोगशाळा सहायक

या पदावर िकमान तीन वषɲ िनयिमत सेवा पूणɑ कɁलेčया ďयòतȮमधून ùयेđठता अधीन पाŇता या िनकषावर योôय

ďयòती÷या पदोąनतीने करĀयात येईल.

५.

संचालनालया÷या आĒथापनेवरील “Ōयोगशाळा सहायक,गट-क”, या पदावरील िनयुòती, िनवड सिमतीकडȴन

घेĀयात येणाķया Ēपधाɑāमक परीȦे÷या िनकाला÷या आधारे िशफारस करĀयात आलेčया, खाली नमूद अटी पूणɑ

करणाķया उमेदवारांमधून नामिनदɨशनाǑारे करĀयात येईल, जे—

(एक) ३८ वषाɕपेȦा जाĒत वयाचे नाहीत:

परंतु, आरिȦत Ōवगाɑतील उमेदवारां÷या बाबतीत वयोमयाɑदा पाच वषाɕपयɕत िशिथल कɁली जाईल ;

(दोन) सांिविधक िवǐापीठाची िवȧान शाखेतील मायĸोबायोलॉजी िकȽवा बायोकɁिमĒłी िकȽवा बायोलॉजी (बॉटनी िकȽवा

झूऑलॉजी) िकȽवा कɁिमĒłी या िवषयासह पदवी धारण करतात ;

(तीन) शासन माąयता ŌाĆत संĒथेची वैǐकीय Ōयोगशाळा तंŇȧान पदिवका (िडĆलोमा इन मेिडकल लेबोरेटरी

टɂòनॉलॉजी) धारण करतात ;

आिण

(चार) कोणāयाही रासायिनक िकȽवा रोगिनदान िवषयक Ōयोगशाळɂतील िकमान २ वषɲ इतका कामाचा ŌāयȦ अनुभव

धारण करतात ;

६.

(एक) िनयम ३ आिण ४ मĄये नमूद कɁलेčया पदांवर पदोąनतीने िनयुòत कɁलेčया ďयòतीने, सदर पदांवर पदोąनती

होĀयापूवȯ, शासनाने वेळोवेळी कɁलेčया िनयमांनुसार मराठी आिण िहंदी भाषा परीȦा जर तो आधीच उƫीणɑ

झाला नसेल तर, उƫीणɑ कɁलेली असणे अथवा उƫीणɑ होĀयापासून सूट िमळिवलेली असणे आवĐयक राहील.

(दोन) िनयम ३ आिण ५ मĄये नामिनदɨशनाǑारे नमूद कɁलेčया पदांवर िनयुòत कɁलेčया ďयòतीने, शासनाने वेळोवेळी

कɁलेčया िनयमांनुसार मराठी आिण िहंदी भाषा परीȦा जर तो आधीच उƫीणɑ झाला नसेल तर, िविहत कालमयाɑदेत

उƫीणɑ होणे अथवा उƫीणɑ होĀयापासून सूट िमळिवणे आवĐयक राहील. जोपयɕत तो āया परीȦा उƫीणɑ होत

नाही तोपयɕत तो वािषɑक वेतनवाढीसाठी िकȽवा पुढील पदोąनती÷या पदावर पदोąनतीसाठी पाŇ असणार नाही.

७.

(एक) िनयम ३ आिण ४ मĄये नमूद कɁलेčया पदांवर पदोąनतीने िनयुòत कɁलेčया ďयòतीने, सदर पदांवर पदोąनती

होĀयापूवȯ, शासनाने वेळोवेळी कɁलेčया िनयमांनुसार संगणक हाताळणीबाबतचे ȧान असणे अथवा āयापासून

सूट िमळिवलेली असणे आवĐयक राहील.

(दोन) िनयम ३ आिण ५ मĄये नामिनदɨशनाǑारे नमूद कɁलेčया पदांवर िनयुòत कɁलेčया ďयòतीने, शासनाने वेळोवेळी

कɁलेčया िनयमांनुसार संगणक हाताळणीबाबतचे ŌमाणपŇ ŌाĆत कɁलेले नसेल तर, िविहत कालमयाɑदेत सदर

ŌमाणपŇ धारण करणे अथवा ते सादर करĀयापासून सूट िमळिवणे आवĐयक राहील. जोपयɕत तो सदर

ŌमाणपŇ धारण करत नाही तोपयɕत तो वािषɑक वेतनवाढीसाठी िकȽवा पुढील पदोąनती÷या पदावर पदोąनतीसाठी

पाŇ असणार नाही.

८.

(एक) िनयम ३ आिण िनयम ५ येथे नमूद कɁलेčया पदावर नामिनदɨशनाǑारे िनयुòत होणाķया ďयòतीने, महाराđł नागरी

सेवा (लहान कȱटȲȾबाचे Ōितȧापन) िनयम, २००५ मधील तरतुदीनुसार व āयाबाबत वेळोवेळी करĀयात येणाķया

िनयमांनुसार, िनयुòती÷या वेळी लहान कȱटȲȾबाचे Ōितȧापन सादर करणे आवĐयक राहील. अąयथा, ती ďयòती

सदर पदावर िनयुòतीसाठी पाŇ ठरणार नाही.

(दोन) लहान कȱटȲȾबाचे Ōितȧापन सादर करताना āयामĄये दोन पेȦा अिधक अपāये िनयुòती÷या वेळɂस हयात असčयास

संबंिधत उमेदवार शासकीय िनयुòतीसाठी अपाŇ राहील.

(तीन) एखादी ďयòती शासन सेवेत िनयुòत झाčयानंतर āया ďयòतीस दोन पेȦा अिधक अपāये असčयाचे िसnj झाले

तर ती ďयòती शासकीय सेवेतील सदर पदावरील िनयुòतीसाठी अपाŇ राहील.

९.

वȫरđठ रसायन शाĒŇȧ, Ōयोगशाळा तंŇȧ, Ōयोगशाळा सहायक ही पदे संचालनालया÷या आĒथापनेवर अȬĒतāवात

असčयाने, िनयम ३, ४ आिण ५ येथे नमूद कɁलेčया पदांवर िनयुòत होणाķया ďयòती संचालनालया÷या मुंबई

कायाɑलयातच कायɑरत राहतील.

१०.

शासकीय सेवेतील िनयुòतीसाठी या िनयमांǑारे िविहत करĀयात आलेčया अटी व शतȰची पूतɑता करणे आवĐयक

आहे. सदर िनयमांनुसार शासकीय सेवेत िनयुòती झाčयानंतर, संबंिधत शासकीय कमɑचाķयास, शासकीय सेवे÷या

कालावधीत, महाराđł नागरी सेवा िनयम, तसेच सेवािवषयक बाबȮसंदभाɑत राùय शासनाने वेळोवेळी अिधिनयम/

अिधसूचना/ शासन िनणɑय/ शासन आदेशाǑारे िनगɑिमत कɁलेले अąय िनयम लागू राहतील.

NOTIFICATION

CONSTITUTION OF INDIA.

No.DISH-0313/CR-31/Lab-1.— In exercise of the powers conferred by the proviso to

Article 309 of the Constitution of India and in supersession of all existing rules, orders, instruments

made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules

regulating recruitment to the posts of Senior Chemist, Laboratory Technician, Laboratory Assistant,

Group-C on the establishment of the Directorate of Industrial Safety and Health under the Industries,

Energy and Labour Department of the Government of Maharashtra namely :—

1.

(1)

These rules may be called “the Senior Chemist, Laboratory Technician, Laboratory

Assistant, Group-C in the Directorate of Industrial Safety & Health (Recruitment)

Rules, 2023.

(2)

These rules shall come into force on the date of publication of these rules in the

Government Gazette.

2.

In these rules unless the context requires otherwise —

(a)

“Degree” means a degree of a Statutory University;

(b)

“Department” means the Department of Industries, Energy and Labour Department

of the Government of Maharashtra specified in the First Schedule appended to

the Maharashtra Government Rules of Business made under article 166 of the

Constitution of India;

(c)

“Directorate” means the Directorate of Industrial Safety & Health, Maharashtra under

the control of the Industries, Energy and Labour Department of the Government of

Maharashtra;

(d)

“Government” means the Government of Maharashtra.

(e)

“Selection Committee” means the Selection Committee constituted with the approval

of the Government for selection of the candidates for Group-C posts in the office of

the Director;

3.

Appointment to the post of “Senior Chemist, Group C” on the establishment of

Directorate shall be made either—

(a)

By promotion of a suitable person on the basis of seniority subject to fitness from

amongst the persons holding the post of “Laboratory Technician, Group-C” at the

Establishment of the Directorate having not less than three years of regular service

on that post and possesses the educational qualification mentioned in sub-clause (ii)

of clause (b);

(b)

If the eligible candidate is not available for promotion, then by nomination of

candidates recommended by selection committee on the basis of result of competitive

examination conducted by it, who fulfil the conditions mentioned below,—

(i)

are not more than 38 years of age:

Provided that, the age limit shall be relaxed upto five years in case of the candidates

belonging to the reserved category;

(ii)

Possess a post graduate Degree of a Statutory University in Science in Analytical

Chemistry or Environmental Science;

AND

(iii)

have at least three years of actual work experience in Chemical or Pollution related

laboratory in any Industry or Department of Government or Government established

Industrial Undertaking or Local Authority or Statutory Corporation.

4.

Appointment to the post of “Laboratory Technician, Group C” on the establishment

of Directorate shall be made by Promotion on the basis of seniority subject to fitness

from amongst the persons holding the post of Laboratory Assistant, Group C at the

Establishment of the Directorate having not less than three years of regular service

on that post.

5.

Appointment to the post of “Laboratory Assistant, Group C” on the establishment of

Directorate shall be made, By Nomination of candidates recommended by selection

committee on the basis of result of competitive examination conducted by it, who fulfil

the conditions mentioned below—

(i)

are not more than 38 years of age:

Provided that, the age limit shall be relaxed upto five years in case of the candidates

belonging to the reserved category;

(ii)

Possess a Degree of Statutory University in Science in Microbiology or Biochemistry

or Biology (in Botony or Zoology) or Chemistry;

(iii)

has completed a Diploma in Medical Laboratory Technology (DMLT) from the

Government recognized Institute.

AND

(iv)

have at least two years of actual work experience in Chemical or Pathological

Laboratory.

6.

(1)

A person appointed to the posts mentioned in rules 3 and 4 by promotion shall pass

the Marathi and Hindi Languages examinations, as per the rules made in that behalf

by the Government, from time to time, unless he has already passed or has been

exempted from passing those examinations before getting promoted to the said posts.

(2)

A person appointed to the posts mentioned in rules 3 and 5 by nomination shall

pass the Marathi and Hindi Languages examinations, as per the rules made in that

behalf by the Government, from time to time, within prescribed time limit after

appointment unless he has already passed or has been exempted from passing those

examinations. He shall not be eligible for annual increment or for the promotion to

the next promotional post, until he passes those examinations.

7.

(1)

A person appointed to the posts mentioned in rules 3 and 4 by promotion shall possess

a knowledge of Computer Operations prescribed by the Government, from time to

time, unless he has been exempted therefrom before getting promoted to the said posts.

(2)

A person appointed to the posts mentioned in rules 3 and 5 by nomination shall possess

a knowledge of Computer Operations prescribed by the Government, from time to

time, within prescribed time limit after appointment unless he has been exempted

from possessing such certificate in knowledge of Computer Operations, otherwise, he

shall not be eligible for annual increment or for the promotion to the next promotional

post, until he possess such certificate.

8.

(1)

A person appointed to the posts mentioned in rules 3 and 5 shall submit a declaration

of Small Family as per the provisions of the Maharashtra Civil Services (Declaration

of Small Family) Rules, 2005 or any other rules, orders or any instruments issued in

this behalf, by the Government, from time to time, otherwise, he shall not be eligible

for appointment to the post.

(2)

A person having more than two children on the date of submission of Declaration

of Small Family, shall be disqualified for the appointment in Government Service.

(3)

After appointment of a person in the Government Service, if it is proved that he

has more than two children, then he shall be disqualified for the appointed post in

Government Service.

9.

The posts of Senior Chemist, Laboratory Technician and Laboratory Assistant,

Group-C are on the establishment of the Directorate. Therefore, the persons

appointed to the posts mentioned in Rules 3, 4 and 5 shall be working in the Mumbai

office of the Directorate, only.

10.

The terms and conditions prescribed by these rules must be fulfilled for appointment

to the Government Service. After being appointed in the Government service as per

the said rules, Maharashtra Civil Service Rules and other rules issued by the State

Government from time to time through Acts/Notifications/Government Decisions/

Government Orders shall be applicable to the concerned Government employee during

the period of Government service.
