महाराष्टट्र शैक्षणिक संस्स््था (अध्यापक संवर््गगातील आरक्षण) अधिनियम, २०२१.

क्रमांक मकूप-१०२२/प्र.क्र.५२/६-ए.—ज्याअर्थी, राज्य शासनाकडून स््थथापन केलेल्या चालवलेल्या किंवा अनुदान दिलेल्या

विवक्षितत शैक्षणिक संस््थथाांांमधील अध्यापक संवर््गासाठी अनुसूचितत जातती, अनुसूचितत जमातती, निरधिसूचितत जमातती (विमुक््त जातती),

भटक्या जमातती, विशेष मागासवर््ग, इततर मागास वर््ग आणि आर््थथिक दृष्ट्ा दुर््बल घटक यांमधील व्यक््तींची सरळ सेवा प्रवेशाद्ारे

नियुक््ती करतताना पदे आरक्षितत ठेवण्यासाठी आणि संबंधितत किंवा ततदानुषंगिक बाबींसाठी ततरततूद केली आहे ;

ज्याअर्थी, शैक्षणिक संस््थथाांांमध्ये अध्यापकांच्या सरळ सेवा प्रवेशाद्ारे नियुक््ती करण्यासाठी विषयनिहाय आरक्षणाऐवजी संवर््गनिहाय

आरक्षण धोरण राबविण््ययातत येतत आहे ;

ज्याअर्थी, महाराष्ट्र शैक्षणिक संस््थथा अध्यापक संवर््गाततील आरक्षण अधिनियम, २०२१ (२०२२ चा १७) (यातत यापुढे

ज्याचा निर्देश, “उक््त अधिनियम” असा केला आहे) याच्या कलम ३ चे पोट-कलम (१) हे राज्य शासनास, एखाद्ा शैक्षणिक

संस््थथेमध्ये अध्यापक संवर््गाततील मंजूर संख्येमधून सरळ सेवा प्रवेशाततील पदांच्या आरक्षणाची मर््ययाादा व रीतत विनिर््ददिष्ट करण्याचे

अधिकार प्रदान करतते.

त्याअर्थी, आतता, शैक्षणिक संस््थथा (अध्यापक संवर््गाततील आरक्षण) अधिनियम, २०२१ (२०२२ चा १७) याच्या कलम ३

च्या पोट-कलम (१) द्ारे प्रदान केलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन, याद्ारे असे विनिर््ददिष्ट करीतत आहे की,—

१.  राज्य शासनाने स््थथापन केलेल्या चालवलेल्या किंवा अनुदान दिलेल्या शैक्षणिक संस््थथामधील सर््व विषयांमधील

अध्यापक संवर््गाततील (समान वेततनश्रेणीततील) मंजूर पदे एकत्रितत करण््ययातत येततील व खाली नमूद केलेल्या रीततीने संवर््गनिहाय

आरक्षण लागू राहील :—

(एक)  प्रत्येक कृषी विद्ापीठ (सर््व विभाग, केंद्र, उपकेंद्र, घटक महाविद्ालये, कृषी विद्ालये मिळून) अध्यापक

संवर््गाततील सर््व मंजूर पदांची एक बिंदु नामावली ठेवावी.

(दोन)  कृषी विद्ापीठे अधिनियम, १९८३ (१९८३चा महा. ४१) अन््वये कृषी विद्ापीठ म््हणून घोषितत केलेली,

आणि राज्य शासनाकडून चालविली जाणारी किंवा अनुदान मिळणारी प्रत्येक संस््थथा, अध्यापक संवर््गाततील सर््व मंजूर

पदांची एक बिंदु नामावली ठेवावी.

(ततीन)  एखादी सोसायटी किंवा विश््वस््त संस््थथा किंवा खाजगी व््यवस््थथापन मंडळ यांच्याकडून चालवलेल्या मग

त्या राज्य शासनाकडून प्रत््यक्ष किंवा अप्रत््यक्षपणे अनुदान मिळतत असणाऱ्या असोतत, महाविद्ालये किंवा संस््थथा किंवा

महाविद्ालयांचा गट यांच्या बाबततीतत, अध्यापक संवर््गाततील सर््व मंजूर पदांची एक बिंदू नामावली ठेवावी.

२.  वर नमूद केल्याप्रमाणे संवर््गनिहाय आरक्षण हे, संवर््गाततील एकूण मंजूर पदांची संख्या विचारातत घेऊन प्रचलितत

आरक्षण धोरणांन््वये विहितत केलेल्या टक््केवारीनुसार निश््चचितत करण््ययातत यावे.

३.  संवर््गाततील एकूण मंजूर पदांची संख्या व कार््यरतत असलेली पदे विचारातत घेऊन, अध्यापक संवर््गाची बिंदू नामावली

पदांच्या गोषवाऱ्यासह विहितत केलेल्या नमुन््ययातत ठेवण््ययातत यावी. उक््त अधिनियमाच्या ततरततुदीनुसार संवर््गामधील आरक्षण हे,

संवर््गाततील एकूण मंजूर पदांच्या संख्येस लागू होणार आहे. रिक््त पदांच्या बाबततीतत, बिंदू नामावलीची ततपासणी करून, रिक््त

पदांचे प्रवर््गनिहाय आरक्षण निश््चचितत करण््ययातत यावे व सदर बिंदूनामावलीस सक्षम प्राधिकरणाची मान््यतता घेण््ययातत यावी.

AGRICULTURE, ANIMAL HUSBANDRY, DAIRY DEVELOPMENT AND

FISHERIES DEPARTMENT

NOTIFICATION

Maharashtra Educational Institutions (Reservation in Teachers’ Cadre) Act, 2021.

No. MKP 1022/ C.R.52/6-A.—WHEREAS, the Government of Maharashtra has provided for the

reservation of posts in appointments by direct recruitment of persons belonging to the Scheduled

Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Special Backward

Category, Other Backward Classes and Economically Weaker Sections to teachers’ cadre in certain

Educational Institutions established, maintained or aided by the State Government and for the

matters connected therewith or incidental thereto ;

AND WHEREAS, the policy of cadre-wise reservation instead of subject-wise reservation for

appointment of teachers by direct recruitment in the Educational Institutions, is being implemented ;

AND WHEREAS, sub-section (1) of section 3 of the Maharashtra Educational Institutions

(Reservation in Teachers’ Cadre) Act, 2021 (Mah. XVII of 2022) (hereafter referred to as “the said

act”), empowers the State Government to specify the extent and the manner for reservation of posts

in direct recruitment out of the sanctioned strength in teachers’ cadre in an educational institution.

NOW, THEREFORE, in exercise of the power conferred by sub-section (1) of section 3 of the

Maharashtra Educational Institutions (Reservation in Teachers’ Cadre) Act, 2021 (Mah. XVII of

2022), the Government of Maharashtra hereby specifies that,—

1.  All sanctioned posts in teachers’ cadre (in the same scale of pay), in all subjects in the

Educational Institutions established, maintained or aided by the State Government, shall be

combined and the cadre-wise reservation shall be made applicable in the following manner,

namely :-

(i)  Each Agricultural University (including all departments, centre, sub-centres,

constituent colleges, Agricultural Schools) shall maintain a single roster of all sanctioned

posts in teachers’ cadre.

(ii)  An institution declared as Agricultural University under section of Maharashtra

Agricultural Universities Act, 1983 (Mah. XLI of 1983) and maintained by or receiving

aid from the State Government, shall maintain a single roster of all sanctioned posts in

teachers’ cadre.

(iii)  In case of Non-Government aided colleges, an institution or college or a group of

institutions or colleges maintained by a society or trust or private management body and

receiving aid from the State Government, whether directly or indirectly, shall maintained

a single roster of all sanctioned posts in teachers’ cadre.

2.  Cadre-wise reservation as mentioned above, shall be determined after considering the

total number of sanctioned posts in the cadre and as per the percentage of reservation prescribed

under the prevailing reservation policy.

3.   The roster in the teachers’ cadre along with the summary of posts shall be maintained in

the prescribed format, after considering the total number of sanctioned posts and occupied posts

in the cadre. The cadre-wise reservation shall be applicable to the total number of sanctioned

posts in the cadre as per the provisions of the said Act. The cadre-wise reservation in respect

of the vacant posts shall be determined after verification of the roster. Such roster shall be

approved by the competent authority.
