उद््घघोषणा

महाराष्टट्र महानगरपालिका अधिनिययम.

क्रमांक जामपा-२०२२/प्र.क्र.३३१(१)/नवि-१७.—महाराष्टट्र महानगरपालिका अधिनियमाच्या (१९४९ चा ५९) (यात यापुढे

ज्याचा उल्लेख “उक्त अधिनियम” असा करण्यात आला आहे.) कलम ३ च्या पोट-कलमे (२) आणि (२A) अन््वये असलेल्या

अधिकाराचा वापर करून महाराष्टट्र शासनाने खालील प्रारुप अधिसूचनेचा मसूदा उक्त अधिनियमाच्या कलम ३ च्या पोट-कलम (४)

अन््वये आवश्यक असल्याप्रमाणे निर्गमित करण्याचे प्रस्तावित केले असून याव्दारे परिणाम होण्याचा संभव असलेल्या सर््व व्यक््तींच्या

माहितीसाठी प्रसिद्ध करण्यात येत आहे; आणि याद्ारे अशी नोटीस देण्यात येत आहे की, दिनांक ८ जून २०२३ रोजी किंवा त्यानंतर उक्त

प्रारुप महाराष्टट्र शासनाकडून विचारात घेण्यात येईल ;

२. उक्त मसुद्ाच्या संदर््भभात उक्त कालावधीपूर्वी जिल््हहाधिकारी, जालना यांच्याकडे कोणत्याही व्यक््तींकडून प्राप्त होणाऱ्या

सूचना आणि हरकतींवर शासनाकडून विचार करण्यात येईल.

महाराष्टट्र शासन राजपत्र असाधारण भाग एक-अ–मध््य उप-विभाग, मे ९, २०२३/वैशाख १९, शके १९४५

वापर करून जालना जिल्ह्ातील जालना नगरपरिषदेचे संपूर््ण क्षेत्र एक मोठे नागरी क्षेत्र म््हणून “जालना शहर महानगरपालिका” या नावाने

ओळखले जाणारे महानगरपालिकेचे मोठे नागरी क्षेत्र होण्यासाठी उक्त अधिनियमाच्या तरतदीनुसार अधिसूचना निर्गमित करण्यासाठी

सूचना आणि हरकती मागविल्या होत्या ;

आणि ज्याअर्थीी, उक्त अधिसूचनेच्या संदर््भभात उक्त कालावधीमध्ये जिल््हहाधिकारी, जालना यांच्याकडे प्राप्त झालेल्या हरकती आणि

सूचनांचा शासनाने विचार केला आहे ;

आणि ज्याअर्थीी, भारतीय राज्यघटनेच्या कलम २४३-Q च्या खंड (२) मध्ये नमूद केलेल्या घटकांचा विचार करून, उक्त

अधिनियमाच्या कलम ३ च्या पोट-कलम (२) अंतर्गत जालना जिल्ह्ातील जालना नगरपरिषदेचे संपूर््ण स््थथानिक क्षेत्र हे मोठे नागरी क्षेत्र

घोषित करणे महाराष्टट्र शासनास इष््ट वाटते.

त्याअर्थीी, आता, उक्त अधिनियमाच्या कलम-३ चे पोट-कलम (२) आणि पोट-कलम (२A) याद्ारे प्रदान करण्यात आलेल्या

अधिकारांचा तसेच त्याबाबतीत समर््थ करणाऱ्या इतर सर््व अधिकारांचा वापर करून महाराष्टट्र शासन याद्ारे जालना जिल्ह्ातील जालना

नगरपरिषदेचे संपूर््ण क्षेत्र हे उक्त अधिनियमाच्या उद्ेशाने अधिक मोठे नागरी क्षेत्र, असेल आणि या अधिक मोठ्ा नागरी क्ेत्ासाठी उक्त

अधिनियमाच्या उद्ेशाने “जालना शहर महानगरपालिका” या नावाने ओळखले जाणारी महानगरपालिका असेल, असे विनिर््दिष््टट करीत आहे.

महाराष्ट्रा्राचे राज्यपाल यांच्या आदेशानुसार व नावाने,

PROCLAMATION

Maharashtra Municipal Corporations Act.

No. JMC-2022/C.R.No.331(1)/UD-17.—The following draft of notification which the Government

of Maharashtra proposes to issue in exercise of the powers conferred by sub-sections (2) and (2A)

of section 3 of the Maharashtra Municipal Corporations Act (LIX of 1949) (hereinafter referred to

as “the said Act”), is hereby published, as required by sub-section (4) of section 3 of the said Act, for

the information of all persons likely to be affected thereby; and notice is hereby given that the said

draft will be taken into consideration by the Government of Maharashtra on or after 8th June 2023.

2. Any such objections or suggestions which may be received by the Collector of the District of

Jalna, from any person with respect to the aforesaid draft, before the aforesaid date will be considered

by the Government.

DRAFT NOTIFICATION

No. JMC-2022/C.R.No.331(1)/UD-17.—Whereas, by the Government Notification, Urban

Development Department, No. MNC-2022/ C.R.No.331(1)/UD-17, dated the 9th May 2023, published

in the Maharashtra Government Gazette, dated the 9th May 2023 issued in exercise of the powers

conferred by sub-section (4) of section 3 of the Maharashtra Municipal Corporations Act (LIX

of 1949) (hereinafter referred to as “the said Act”), the Government of Maharashtra has invited

objections and suggestions to its proposal to issue a notification in exercise of the powers conferred by

sub-sections (2) and (2A) of section 3 of the said Act, with a view to specify that the whole of local area

of the Jalna Municipal Council in Jalna District shall be a larger urban area within the meaning of

the said Act and there shall be a Municipal Corporation for such larger urban area to be known as

“the Municipal Corporation of City of Jalna” for the purpose of the said Act ;

And whereas, the objections and suggestions so received by the Collector of the District of Jalna,

pursuant to the said proclamation have been duly considered by the Government of Maharashtra ;

And whereas, having regard to the factors mentioned in clause (2) of article 243-Q of the

Constitution of India, the Government of Maharashtra considered it expidient to declare under sub-

section (2) of section 3 of the said Act, the said whole of the local area of Jalna Municipal Council in

Jalna District to be the larger urban area.

Now, therefore, in exercise of the powers conferred by sub-sections (2) and (2A) of section 3 of the

said Act, and of all other powers enabling it in that behalf, the Government of Maharashtra hereby

specifies that the whole of local area of the Jalna Municipal Council in Jalna District shall be a

larger urban area within the meaning of the said Act and there shall be a Municipal Corporation for

such larger urban area to be known as “the Municipal Corporation of City of Jalna” for the purpose

of the said Act.

क्रमांक जामपा-२०२२/प्र.क्र.३३१(२)/नवि-१७.—महाराष्टट्र नगरपरिषदा, नगरपंचायती आणि औद्योगिक नगरी अधिनियम,

१९६५ (१९६५ चा महाराष्टट्र चाळीस) (यात यापुढे ज्याचा उल्लेख “उक्त अधिनियम” असा करण्यात आला आहे.) चे कलम ३,

पोट-कलम (३) आणि कलम ६ यांच्या तरतुदीनुसार महाराष्टट्र शासन उक्त अधिनियमाच्या कलम ६ चे पोट-कलम (१) चे खंड (ड)

अन््वये असलेल्या अधिकारांचा वापर करून जालना जिल्ह्ातील जालना नगरपरिषदेचे संपूर््ण स््थथानिक क्षेत्र, नगरपरिषद क्षेत्र म््हणून बंद

करण्याच्या उद्ेशाने अधिसूचना काढण्याचा उद्ेश घोषित करीत आहे ;

२. उक्त उद्‍घोषणेच्या संदर््भभात ज्या कोणत्याही व्यक््तींचे कोणतेही आक्ेप असतील ते त््ययाांांनी लेखी स््वरुपात त््ययाांांच्या कारणांसह,

ही उद्घोषणा राजपत्रात प्रसिद्ध झाल्याच्या तारखेपासून तीस दिवसांच्या आत जिल््हहाधिकारी, जालना यांच्याकडे सादर करणे आवश्यक

राहील ;

३. उक्त कालावधीमध्ये प्राप्त झालेल्या अशा कोणत्याही आक्ेपांचा शासनाकडून विचार करण्यात येईल.

क्षेत्र, नगरपरिषद क्षेत्र म््हणून बंद करण्याच्या उद्ेशाने अधिसूचना निर्गमित करण्यासाठी हरकती आणि सूचना मागविण्याकरिता शासन

उद्‍घोषणा, नगरविकास विभाग क्र. मनपा-२०२२/प्र.क्र. ३३१(२)/नवि-१७, दिनांक ९ मे २०२३ अन््वये महाराष्टट्र शासन राजपत्र

मध्ये दिनांक ९ मे २०२३ रोजी प्रसिद्ध केली होती ;

आणि ज्याअर्थीी, महाराष्टट्र शासनाने उक्त अधिनियमातील कलम ६, पोट-कलम (१) मधील तरतुदींनुसार जालना नगरपरिषद

यांच्याशी सल्लामसलत केली आहे ;

आणि ज्याअर्थीी, अधिसूचनेत नमूद कालावधीत जिल््हहाधिकारी, जालना यांच्याकडे विहीत कालावधीत प्राप्त झालेल्या हरकती

आणि सूचनांचा महाराष्टट्र शासनाने विचार केला आहे.

त्याअर्थीी, आता, महाराष्टट्र शासन, उक्त अधिनियमाच्या कलम ६ पोट-कलम (१) खंड (ड) तसेच त्याबाबतीत समर््थ करणाऱ्या

इतर सर््व अधिकारांचा वापर करून उक्त अधिनियमाच्या उद्ेशाने जालना जिल्ह्ातील जालना नगरपरिषदेचे संपूर््ण स््थथानिक क्षेत्र हे

नगरपालिका क्षेत्र असल्याचे बंद करण्याचे याव्दारे घोषित करीत आहे.

PROCLAMATION

Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965.

No. JMC-2022/C.R.No.331(2)/UD-17.—In pursuance of the provisions of sub-section (2) of section

6 read with sub-section (3) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats

and Industrial Townships Act, 1965 (Mah.XL of 1965) (hereinafter referred to as “the said Act”),

the Government of Maharashtra hereby announces its intention to issue a notification, in exercise

of the powers conferred by clause (d) of sub-section (1) of section 6 of the said Act, with a view to

declare that the whole of local area of the Jalna Municipal Council in Jalna District shall cease to

be a municipal area within the meaning of the said Act ;

2. Any person who entertains any objection to the said proclamation is hereby required to submit

the same in writing with the reasons therefore, to the Collector, District Jalna, within a period of

thirty days from the date of publication of this proclamation in the Maharashtra Government Gazette ;

3. Any such objection which may be received during the said period will be considered by the

Government.

DRAFT NOTIFICATION

of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra

hereby declares that the whole of local area of the Jalna Municipal Council in Jalna District, shall

cease to be a municipal area within the meaning of the said Act.
