निययोजन व नगररचना अधिनिययम, १९६६ चे कलम ३१(१) नुसार (ययापुढे ययाचा उल््ललेख "उक्त अधिनिययम" असा केला आहे.) शासन

निर्णयय क्र.टिपीएस-१२९७/१३१९/सीआर-१४८/९७/नवि- १२, दिनांक ४ ऑक््टोबर, १९९९ अन््वयये मंजूर केली असून, ती दिनांक २२

नोव््हेंबर १९९९ पासून अंमलात आहे. तसेच सुधारीत विकास ययोजनेतील वगळलेल््या क्ेत्ाची (Excluded portion) विकास ययोजना

शासन निर्णयय क्र. टिपीएस-१२०१/२७४/सीआर-२८/२००१/नवि-१२, दिनांक ३ एप्रिल, २००३ अन््वयये शासनाने उक्त अधिनिययमानुसार

मंजूर केली असून ती दिनांक १४ मे, २००३ पासून अंमलात आहे (ययापूढे "उक्त मंजूर विकास ययोजना" असा उल््ललेख केला आहे.) ;

आणि ज््याअर्थी, ठाणे महानगरपालिका प्ारूप विकास निययंत्रण निययमावलीत काही बदल करून शासनाने निर्णयय क्र.टिपीएस

१२९४/१२५९/सीआर-२२२/९४/नवि- १२, दि. २८ एप्रिल १९९५ अन््वयये उक्त अधिनिययमाचे कलम ३१(१) अन््वयये विकास निययंत्रण

निययमावली मंजूर केली होती व सदर निययमावली दिनांक १ जून १९९५ पासून अंमलात आली होती ;

आणि ज््याअर्थी, तत््ककालीन मंजूर विकास निययंत्रण निययमावलीतील तरतुदीनुसार ठाणे महानगरपालिका हद्ीमध््ये ४४ नागरी पुनरुत््थथान

आराखडे (ययु. आर. पी.) अधिसूचित करून दिनांक ५ मे २०१८ रोजीच््या शासन राजपत्रामध््ये प्रसिद्ध करण््यात आले आहेत ;

आणि ज््याअर्थी, शासन निर्णयय क्र. टिपीएस १८१८/प्र.क्र. २३६/१८/कलम ३७ (१कक) (ग) व कलम २०(४)/ नवि-१३,

दिनांक २ डिसेंबर २०२० अन््वयये शासनाने एकत्रिकृत विकास निययंत्रण व प्ोत्साहनपर निययमावली, मंजूर केली आहे आणि उक्त विकास

निययंत्रण निययमावली दिनांक ३ डिसेंबर २०२० पासून अंमलात आली असून सदर निययमावली ठाणे महानगरपालिकेस लागू आहे. (ययापुढे

"उक्त निययमावली" असा उल््ललेख केला आहे);

आणि ज््याअर्थी, ययोजनेच््या ययोग््य व सुनिययोजितरित््या अंमलबजावणीकरिता ययु. आर. पी. क्र. १२ किसननगरच््या अधिसूचित हद्ीस

संलग्न असलेले क्षेत्र उक्त निययमावलीतील विनिययम क्र. १४.८.१ (ii)(b) मधील तरतुदीनुसार ययु. आर. पी. क्र. १२ च््या अधिसूचित

हद्ीमध््ये नव््याने समाविष््ट करणे तसेच हद्ीपासून ४०० मी. अंतरात ययेत असलेले महानगरपालिका / सार््वजनिक प्राधिकरण जसे महाराष्टट्र

औद्योगिक विकास महामंडळ, बृहन््ममुुंुंबई महानगरपालिका, कृषी विभाग, कौशल््य विकास विभाग ययांच््या मालकीचे भुखंड निययमावलीतील

विनिययम क्र. १४.८.१ (i) मधील तरतुदीनुसार उच््चचाधिकार समितीशी सल््ललामसलत करून ययु.आर.पी. क्र. १२ किसननगरच््या ययापूर्वीीच््या

अधिसूचित हद्ीमध््ये नव््याने समाविष््ट करण््याचे प्रस््ततावित आहे (ययापुढे “प्रस्तावाधिन क्षेत्र” असा उल््ललेख केला आहे) ;

आणि ज््याअर्थी, उक्त निययमावलीतील विनिययम क्र. १४.८.१.(i) च््या तरतुदीनुसार नागरी पुनरुत््थथान ययोजनेच््या हद्ीपासन ४००

मी. अंतरात ययेत असलेल््या महानगरपालिका/सार््वजनिक प्राधिकरण इत््ययादींच््या जागा ययोजना क्ेत्ात संलग्न नसल््या तरी अशा जागा यय

ोजना क्ेत्ामध््ये अंतर्भभूत करण््यास उच््चचाधिकार समितीशी सल््ललामसलत करून, नागरी पुनरुत््थथान ययोजनेच््या हद्ी महापालिका आययुक्त

निश््चचित करू शकतात ;

आणि ज््याअर्थी, वर नमूद केल््ययाप्रमाणे प्रस्तावाधीन क्षेत्र, ज््याचे अंदाजित क्षेत्र १९.०७ हेक््टर आहे. ते ययु.आर.पी.क्र.१२ किसननगरच््या यय

ापूर्वीीच््या अधिसूचित हद्ीत नव््याने समाविष््ट करणेबाबतचा प्रस्ताव सल््ललामसलतीकरिता उच््चचाधिकार समितीच््या बैठकीत दिनांक १७

मे २०२३ रोजी ठेवण््यात आला. उक्त बैठकीमध््ये सदरहू क्षेत्र नागरी पुनरुत््थथान आराखडा क्र.१२ किसननगरच््या ययापूर्वीीच््या अधिसूचित

हद्ीमध््ये समाविष््ट करण््यास उच््चचाधिकार समितीने शिफारस केली आहे.

आणि, त््याअर्थी, उक्त निययमावलीतील विनिययम क्र. १४.८.१ (ii) (b) अन््वयये मला प्रदान केलेल््या अधिकारान््वयये, ठाणे शहराच््या

हद्ीतील ययु. आर. पी. क्र. १२ किसननगरच््या ययापूर्वीीच््या अधिसूचित हद्ीमध््ये प्रस्तावाधिन क्षेत्र नव््याने अंतर्भभूत करून सुधारीत हद्ीचा

आराखडा ययु. आर. पी. क्र. १२ किसननगर (सुधारीत क्षेत्र अंदाजे १५९.८८ हेक््टर) म्हणून अधिसूचित करीत आहे.

सदर अधिसूचित आराखड्ाची सुधारीत हद्द दर््शविणारा नकाशा जनतेच््या अवलोकनार््थ खालील ठिकाणी, पुढील तीस दिवसांकरिता

ठेवण््यात ययेत आहे :—

(१) उप संचालक, नगररचना, क््लस््टरसेल, ययांचे कार््ययालयय, माजीवाडा, ठाणे.

(२) शहर विकास विभाग, चौथा मजला, ठाणे महानगरपालिका, ठाणे.

(३) वागळे प्रभाग समिती कार््ययालयय.

ही अधिसूचना व अधिसूचित नकाशा www.tmctp.thanecity.gov.in यया संकेत स््थळावर सुद्धा उपलब््ध आहे.

THANE MUNICIPAL CORPORATION

NOTIFICATION

Maharashtra Regional and Town Planning Act, 1966.

No. TMC/TDO/Cluster Cell/Notification/80.—Whereas, the Revised Development Plan of

the Thane City has been sanctioned by the Government under section 31(1) of the Maharashtra

Regional and Town Planning Act 1966, (hereinafter referred to as “the said Act”) vide Notification

No.TPS-1297/1319/CR-148/97/UD-12, dated 4th October 1999, which has come into force with effect

from 22nd November 1999, and the Excluded Part (EP) of the said Development Plan has been

sanctioned under the said Act vide Government Notification No. TPS/1201/274/CR-28/2001/UD-12,

dated 3rd April 2003 which has come into force with effect from the 14th May 2003; (hereinafter

referred to as “the said sanctioned Development Plan”) ;

And whereas, the Development Control Regulations of Thane Municipal Corporation has been

sanctioned by the Government after making some modifications in draft Development Control

Regulations of Thane City vide Urban Development Department, vide Notification No. TPS 1294/1259/

CR-222/94/UD-12, date 28th April 1995 under section 31(1) of the said act which had come into force

with effect from the 1st June 1995 ;

And whereas, in pursuant to the provisions of erstwhile sanctioned Development Control

Regulations, 44 Urban Renewal Plans (hereinafter referred to as “URP”) are notified in Government

Gazette dated 5th May 2018 within the limits of Thane Municipal Corporation ;

And whereas, the Government has sanctioned Unified Development Control and Promotion

Regulations vide resolution no.TPS-1818/CR236/18/DP&RP/sec.37 (1AA) (c) & sec. 20(4)/UD-13, dated

2nd December 2020 (hereinafter referred to as “the said Regulations”) and the said Regulation are

in force from dated 3rd December 2020 and are applicable to Thane Municipal Corporation ;

And whereas, for smooth implementation of the URP, areas adjacent to the notified boundary

of URP No.12 are proposed to be included in the notified boundary of URP No.12 as per regulation

no.14.8.1 (ii)(b) of the said Regulations and areas belonging to Municipal Corporation /any Public

Authority, such as Maharashtra Industrial Development Corporation, Municipal Corporation of

Greater Mumbai, Agriculture Department, Skill Development Department, situated in the periphery

of 400.0 mt., which are not contiguous to the notified boundary of URP No.12, are proposed to be

included in the notified boundary of URP No.12 after consultation with High Power Committee

(H.P.C.) as per regulation no.14.8.1(i) of the said Regulations (hereinafter referred as “the area

under proposal”) ;

And whereas, as mentioned in the Regulation No. 14.8.1(i) of the said Regulations, that areas

of any vacant or encroached land situated in the periphery of 400.0 mt. belonging to Municipal

Corporation/any Public Authority/ Planning Authority Special Planning Authority, which is not

contiguous, is proposed to be included in URS, then the boundaries of such cluster having non-

contiguous area can be decided/ finalized by Municipal Commissioner, in consultation with High

Power Committee (H.P.C.) ;

And whereas, the said area under proposal admeasuring approx.19.07 Hect.. to be included

in the earlier notified boundary of URP No.12 Kisan Nagar is kept before High Power Committee

meeting on 17th May 2023 and High Power Committee has recommended to include the said area

in the earlier notified boundary of URP No.12 Kisan Nagar.

Now therefore, as per powers conferred to me vide Regulation no.14.8.1 (ii)(b) of the said

Regulations, the notified boundaries of URP No.12 Kisan Nagar are changed and revised boundary

of URP No.12 Kisan Nagar (Revised area approx. 159.88 Hect.) is hereby notified.

The plans showing boundaries of revised Urban Renewal Plan area is kept for inspection by

general public at following places for next thirty days :—

(1) Office of the Deputy Director of Town Planning, Cluster Cell. Majiwada, Thane

(2) Town Development Department, 4th floor, Thane Municipal Corporation, Thane

(3) Wagale Ward office.

This notification along with notified plan is also available on website www.tmctp.thanecity.gov.in
