महाराष्टट्र दारुबंदी अधिनिययम.

क्रमांक बीपीए ०४२२/प्र.क्र.९१/राउशु-२.—ज्याअर्थी, महाराष्टट्र देशी मद्य नियम, १९७३ मध्ये आणखी सुधारणा करून खालील

नियम तात्काळ अंमलात आणले जावेत आणि म्हणून, महाराष्टट्र दारुबंदी अधिनियम (१९४९ चा २५ वा ) मधील कलम १४३ च्या पोट-

कलम (३) च्या परंतुकाद्ारे तरतूद केल्याप्रमाणे पूर््व प्रसिद्धिशिवाय हे नियम करण्यात यावेत, असे महाराष्टट्र शासनास वाटते.

त्याअर्थी, आता, महाराष्टट्र दारुबंदी अधिनियम (१९४९ चा २५ वा ) चे कलम १४३ चे पोट-कलम (३) च्या परंतुकासह पोट-

कलम (२) च्या खंड (बी), (एफ), (जी), आणि (एच १) द्ारे प्रदान करण्यात आलेल्या अधिकारांचा आणि याबाबत महाराष्टट्र

शासनास समर््थ करणाऱ्या इतर सर््व अधिकारांचा वापर करून महाराष्टट्र शासन, याद्ारे, महाराष्टट्र देशी मद्य नियम, १९७३ मध्ये आणखी

सुधारणा करण्यासाठी खालीलप्रमाणे नियम करीत आहे, ते असे :—

१. या नियमांना महाराष्टट्र देशी मद्य (सुधारणा) नियम, २०२३ असे संबोधण्यात यावे.

२. महाराष्टट्र देशी मद्य नियम, १९७३ (यापुढे यास प्रधान नियम असे संबोधावे) च्या नियम २५ मधील, खंड (क) मध्ये,-

(i) पहिल्या परंतुकातील “१५ टक््कक्ययाांांपेक्ा जास्त असता कामा नये." या शब्द व अंकाऐवजी “३० टक््कक्ययाांांपेक्ा जास्त

असता कामा नये" हे शब्द व अंक समविष््ट करावेत आणि ते दिनांक २९ डिसेंबर,२०१६ पासून बदलले गेले असे मानले

जाईल ;

(ii) दुसऱ्या परंतुकातील “१५ टक््कक्ययाांांपेक्ा जास्त असता कामा नये." या शब्द व अंकाऐवजी “३० टक््कक्ययाांांपेक्ा जास्त

असता कामा नये" हे शब्द व अंक समविष््ट करावा आणि ते दिनाक २९ डिसेंबर,२०१६ पासून बदलले गेले असे मानले

जाईल ;

(iii) तिसऱ्या परंतुकातील “१५ टक््कक्ययाांांपेक्ा जास्त असता कामा नये." या शब्द व अंकाऐवजी “३० टक््कक्ययाांांपेक्ा

जास्त असता कामा नये." हे शब्द व अंक समविष््ट करावा.

NOTIFICATION

Maharashtra Prohibition Act.

No. BPA-0422/CR-91/EXC-2.- Whereas, the Government of Maharashtra considers that the

following rules further to amend the Maharashtra Country Liquor Rules, 1973, should be brought

into force at once, and therefore the rules should be made without previous publication as provided

by the proviso to sub-section (3) of section 143 of the Maharashtra Prohibition Act (XXV of 1949).

Now, therefore, in exercise of the powers conferred by clauses (b), (f), (g) and (hl) of sub-section

(2) read with proviso to sub-section (3) of section 143 of the Maharashtra Prohibition Act and of all

other powers enabling it in that behalf, the Government of Maharashtra hereby makes the following

rules further to amend the Maharashtra Country Liquor Rules, 1973, as follows, namely :—

1. These rules may be called the Maharashtra Country Liquor (Amendment) Rules, 2023.

2. In rule 25 of the Maharashtra Country Liquor Rules, 1973, in clause (c),—

(i) in first proviso, for the words and figure ‘‘not exceed 15 per cent.’’ the words and

figure ‘‘not exceed 30 per cent.’’ shall be substituted and shall be deemed to have been

substituted with effect from the 29th December, 2016 ;

(ii) in second proviso, for the words and figure ‘‘not exceed 15 per cent.’’ the words

and figure ‘‘not exceed 30 per cent.’’ shall be substituted and shall be deemed to have been

substituted with effect from the 29th December, 2016 ;

(iii) in third proviso, for the words and figure ‘‘not exceed 15 per cent.’’ the words and

figure ‘‘not exceed 30 per cent.’’ shall be substituted.
