भारताचेे संविधान.

क्रमांक : सेप्रनि-३०१९/प्र.क्र.११७/१९/वैसेवा-४.—भारतीय संविधानाच्या अनुच््छछेद ३०९ खालील परंतुकान्वये प्रदान करण्यात

आलेल्या शक््तींचा वापर करून आणि या संदर््भभात सध्या अस््ततित्वात असलेले सर््व नियम, आदेश वा अनुदेश यांचे अधिक्रमणण करून,

महाराष्ट्ाचे राज्यपाल याद्ारे महाराष्टट्र शासनाच्या वैद्यकीय शिक्षणण व औषधीद्रव्ये विभागाच्या नियंत्रणणाखालील वैद्यकीय शिक्षणण व

संशोधन संचालनालयांतर्गत शासकीय दंत महाविद्याद्यालय व रुग््णालयातील प्राध्यापक, गट-अ (राजपत्रित), सहयोगी प्राध्यापक, गट-अ

(राजपत्रित) आणि सहायक प्राध्यापक, गट-ब (राजपत्रित) या पदांवरील सेवाप्रवेशाचे विनियमन करण्यासाठी याद्ारे पुढील नियम

करीत आहेत :-

१. या नियमांना महाराष्टट्र शासनाच्या वैद्यकीय शिक्षणण व औषधीद्रव्ये विभागाच्या नियंत्रणणाखालील वैद्यकीय शिक्षणण व

संशोधन संचालनालयांतर्गत यांच्या आस््थापनेवरील शासकीय दंत महाविद्याद्यालय व रुग््णालयातील प्राध्यापक, गट-अ (राजपत्रित),

सहयोगी प्राध्यापक, गट-अ (राजपत्रित) आणि सहायक प्राध्यापक, गट-ब (राजपत्रित) सेवाप्रवेश नियम, २०२३ असे

संबोधण्यात यावे.

२. यय

ा निययमात संदर््भभानुसार दुसरा अर््थ अपेक्षित नसेेल तर,-

(क) “नियुक्ती प्राधिकारी” याचा अर््थ

महाराष्टट्र शासन राजपत्र असाधारण भाग चार-अ, जून ६, २०२३/ ज््ययेष््ठ १६, शके १९४५

(i) शासकीय सेवेतील संबंधित गट-अ च्या पदावर उमेदवारांची नियुक्ती करण्यासाठी सक्षम असणणारे

मुख्यमंत्री, महाराष्टट्र राज्य हे प्राधिकारी असा आहे;

(ii) गट-ब च्या संबंधित पदांवर उमेदवारांची नियुक्ती करण्यासाठी सक्षम असणणारे विभागाचे मंत्री हे

प्राधिकारी असा आहे;

(ख) “सहायक प्राध्यापक” याचा अर््थ वैद्यकीय शिक्षणण व संशोधन संचालनालयाच्या नियंत्रणणाखालील शासकीय दंत

महाविद्याद्यालय व रुग््णालयातील कोणणत्याही दंतशल््यचिकित्सा विषयातील सहायक प्राध्यापक असा आहे;

(ग) “सहयोगी प्राध्यापक” याचा अर््थ वैद्यकीय शिक्षणण व संशोधन संचालनालयाच्या नियंत्रणणाखालील शासकीय दंत

महाविद्याद्यालय व रुग््णालयातील कोणणत्याही दंतशल््यचिकित्सा विषयातील सहयोगी प्राध्यापक असा आहे;

(घ) “आयोग” याचा अर््थ महाराष्टट्र लोकसेवा आयोग असा आहे;

(च) “परिषद” याचा अर््थ भारतीय दंत परिषद, नवी दिल्ली किंवा भारतीय दंत परिषदेच्या जागी केंद्र शासनाने नियुक्त

केलेली इतर कोणणतीही समतुल्य अधिकृत संस््था असा आहे;

(छछ) “ वैद्यकीय शिक्षणण व औषधीद्रव्ये विभाग ” याचा अर््थ भारतीय संविधानाच्या अनुच््छछेद १६६ अन्वये बनविलेल्या

महाराष्टट्र शासन कार््यनियमावलीच्या पहिल्या अनुसुचिमध्ये विनिर््ददिष््ट केलेला“ वैद्यकीय शिक्षणण व औषधीद्रव्ये विभाग ” असा आहे;

(ज) “राष्ट्ीय मंडळाचा विद्यानिपुणण (डीएनबी)” याचा अर््थ भारतीय दंत परिषदेची मान्यता असलेली संबंधित दंत

विषयातील राष्ट्ीय परीक्षा मंडळाने प्रदान केलेली पदवी असा आहे;

(झ) “संचालनालय” याचा अर््थ शासनाच्या वैद्यकीय शिक्षणण व औषधीद्रव्ये विभागाच्या नियंत्रणणाखालील वैद्यकीय

शिक्षणण व संशोधन संचालनालय असा आहे;

(ट) “शासन” याचा अर््थ महाराष्टट्र शासन असा आहे;

(ठ) “ज्येष्ठतेच्या अधिन राहून पात्रता” म््हणणजे सामान्य प्रशासन विभागाच्या दि.०१.०८.२०१९ रोजीचा शासन निर््णय

तसेच वेळोवेळी निर्गमित होणणाऱ्या आदेशातील अटी व शर्तीनुसार पदोन्नतीकरिता पात्रता निश््चचित केली जाईल;

(ड) “दंतशल््यचिकित्सेशी संबंधित विषयातील पदव्युत्तर पदवी (एम.डि.एस)” याचा अर््थ सांविधानिक विद्याद्यापीठाची

पदव्युत्तर पदवी असा आहे;

(ढ) “प्राध्यापक” याचा अर््थ वैद्यकीय शिक्षणण व संशोधन संचालनालयाच्या नियंत्रणणाखालील शासकीय दंत महाविद्याद्यालय

व रुग््णालयातील कोणणत्याही दंतशल््यचिकित्सा विषयातील प्राध्यापक असा आहे;

(णण) “मान्यताप्राप्त दंत महाविद्याद्यालय” याचा अर््थ भारतीय दंत परिषदेने किंवा भारतीय दंत परिषदेच्या जागी केंद्र शासनाने

नियुक्त केलेल्या इतर कोणणत्याही समतुल्य अधिकृत संस््थेने मान्यता प्रदान केलेले दंत महाविद्याद्यालय असा आहे;

(त) “मान्यताप्राप्त वैद्यकीय महाविद्याद्यालय” याचा अर््थ भारतीय आर्युविज्ान परिषदेने किंवा राष्ट्ीय आर्युविज्ान आयोग

यांनी मान्यता प्रदान केलेले वैद्यकीय महाविद्याद्यालय असा आहे;

(थथ) अनुसूची- I” याचा अर््थ या नियमांना जोडलेली अनुसूची-I असा आहे;

(द) “अनुसूची- II” याचा अर््थ या नियमांना जोडलेली अनुसूची-II असा आहे;

३. प्ाध््यापक, गट-अ (राजपत्रित) यया पदावरीील निययुक््ततीी एकतर,-

(क) शासकीय दंत महाविद्याद्यालय व रुग््णालयातील संबंधित दंत विषयातील सहयोगी प्राध्यापक, गट-अ हे पद धारणण

करणणाऱ्या तसेच अनुसूची-I मधील अनुक्रमांक -१ समोरील ्ततंभ क्रमांक ३ व ४ मधील अनुक्रमे शैक्षणिक अर््हता व अनुभव

धारणण करणणाऱ्या आणि अनुसूची-II मधील तरतुदीनुसार शोधनिबंध प्रसिद्ीच्या अनुषंगाने किमान तीस गुणणांची प्राप्ती करणणाऱ्या

व्यक््तींमधून ज्येष्ठता अधिन पात्रता या निकषावर सुयोग्य व्यक्तीच्या पदोन्नतीने ; किंवा

(ख) स््पर््धधात्मक परीक्षेच्या निकालाच्या आधारावर आयोगाने शिफारस केलेले उमेदवार जे खालील अर््हता धारणण करत

आहेत त््ययाांांच्यामधून नामनिर्देशनाद्ारे,—

(एक) वययोमर््ययादा-

(क) किमान वयोमर््यादा : ज्याचे वय अठरा वर््षषाहून कमी नाही.

(ख) कमाल वयोमर््यादा : खुल्या प्रवर््गगातील उमेदवारांसाठी वयाची पन्नास वर्षेे आणि मागास प्रवर््गगातील उमेदवारांसाठी

वयाची पंचावन्न वर्षेे.

परंतु, विहीत मार््गगाने नियमित तत्वावर शासनाच्या सेवेत अगोदरच कार््यरत असलेल्या उमेदवारांच्या बाबतीत कमाल

वयोमर््यादा पाच वषाांपर््यत शिथथील करण्यात येईल ;

परंतु, आणणखी असे की, शासन सेवेत आधीच कार््यरत असणणाऱ्या मागासवर्गीीय उमेदवारांना वयोमर््यादेतील शिथिलतेची

सवलत ते शासन सेवेतील कर््मचारी किंवा मागासवर्गीीय कर््मचारी यापैकी केवळ एकाच कारणणाकरिता घेता येईल.

(ग) वयाची परिगणणना: सदर पदावरील भरतीसाठी आयोगाच्या जाहिरातीत नमूद केल्याप्रमाणणे अर््जजाच्या शेवटच्या

तारखेला अर््जदारांनी वयाची किमान आणि कमाल वयोमर््यादेची अट पूर््ण करणणे आवश््यक राहील.

(दोन) किमान शैक्षिाणिक पात्रता: ज््ययाांांनी अनुसूची-I मधील अनुक्रमांक-१ समोरील ्ततंभ क्रमांक ३ व ४ मधील अनुक्रमे

अर््हता व अनुभव धारणण केला आहे आणि जे अनुसूची-II मधील तरतुदीनुसार शोधनिबंध प्रसिद्ीच्या अनुषंगाने किमान तीस गुणण

धारणण करतात;

४. सहययोगीी प्ाध््यापक, गट-अ (राजपत्रित) यया पदावरीील निययुक््ततीी एकतर,-

(क) शासकीय दंत महाविद्याद्यालय व रुग््णालयातील संबंधित दंत विषयातील सहायक प्राध्यापक, गट-ब हे पद धारणण

करणणाऱ्या तसेच अनुसूची-I मधील अनुक्रमांक -२ समोरील ्ततंभ क्रमांक ३ व ४ मधील अनुक्रमे शैक्षणिक अर््हता व अनुभव

धारणण करणणाऱ्या आणि अनुसूची-II मधील तरतुदीनुसार शोधनिबंध प्रसिद्ीच्या अनुषंगाने किमान वीस गुणणांची प्राप्ती करणणाऱ्या

व्यक््तींमधून ज्येष्ठता अधिन पात्रता या निकषांवर सुयोग्य व्यक्तीच्या पदोन्नतीने; किंवा

आहेत त््ययाांांच्यामधून नामनिर्देशनाद्ारे;-

(एक) वययोमर््ययादा-

(क) किमान वयोमर््यादा : ज्याचे वय अठरा वर््षषाहून कमी नाही.

(ख)

कमाल वयोमर््यादा : खुल्या प्रवर््गगातील उमेदवारांसाठी वयाची पंचेचाळीस वर्षेे आणि मागास प्रवर््गगातील

उमेदवारांसाठी वयाची पन्नास वर्षेे.

वयोमर््यादा पाच वषाांपर््यत शिथथील करण्यात येईल ;

परंतु आणणखी असे की, शासन सेवेत आधीच कार््यरत असणणाऱ्या मागासवर्गीीय उमेदवारांना वयोमर््यादेतील शिथिलतेची

(ग) किमान वयाची परिगणणना: सदर पदावरील भरतीसाठी जाहिरातीत नमूद केल्याप्रमाणणे अर््जजाच्या शेवटच्या तारखेला

अर््जदारांनी वयाची किमान आणि कमाल वयोमर््यादेची अट पूर््ण करणणे आवश््यक राहील.

(दोन) शैक्षणिक अर््हता: ज््ययाांांनी अनुसूची-I मधील अनुक्रमांक-२ समोरील ्ततंभ क्रमांक ३ व ४ मधील अनुक्रमे अर््हता व

अनुभव धारणण केला आहे आणि जे अनुसूची-II मधील तरतुदीनुसार शोधनिबंध प्रसिद्ीच्या अनुषंगाने किमान वीस गुणणांची प्राप्ती करतात;

५. सहाययक प्ाध््यापक, गट-ब यया पदावरीील निययुक््ततीी एकतर,-

(क) शासकीय दंत किंवा वैद्यकीय महाविद्याद्यालय व रुग््णालयातील दंतशल््यचिकित्सक, गट-ब हे पद धारणण करणणाऱ्या

भाग चार-अ-११६–१अ

तसेच अनुसूची-I मधील अनुक्रमांक -३ समोरील ्ततंभ क्रमांक ३ व ४ मधील अनुक्रमे शैक्षणिक अर््हता व अनुभव धारणण

करणणाऱ्या व्यक््तींमधून ज्येष्ठता अधिन पात्रता या निकषावर सुयोग्य व्यक्तीच्या पदोन्नतीने; किंवा

आहेत त््ययाांांच्यामधून नामनिर्देशनाद्ारे,-

(एक) वययोमर््ययादा-

(क) किमान वयाची मर््यादा : ज्याचे वय अठरा वर््षषाहून कमी नाही.

(ख)

कमाल वयाची मर््यादा : खुल्या प्रवर््गगातील उमेदवारांसाठी वयाची चाळीस वर्षेे आणि मागास प्रवर््गगातील

उमेदवारांसाठी वयाची पंचेचाळीस वर्षेे.

वयोमर््यादा पाच वषाांपर््यत शिथथील करण्यात येईल ;

(ग) किमान वयाची परिगणणना: सदर पदावरील भरतीसाठी आयोगाच्या जाहिरातीत नमूद केल्याप्रमाणणे अर््जजाच्या शेवटच्या

(दोन) किमान शैक्षणिक अर््हता: ज््ययाांांनी अनुसूची-I मधील अनुक्रमांक-४ समोरील ्ततंभ क्रमांक ३ व ४ मधील

अनुक्रमे अर््हता व अनुभव धारणण केला आहे;

६. नियम ३ व ४ मध्ये उल््लेखिलेल्या पदांवर पदोन्नती आणि नामनिर्देशनाने करावयाच्या नियुक््तत्ययाांांचे प्रमाणण अनुक्रमे ५०:५०

असे असेल.

नियम ५ मध्ये उल््लेखिलेल्या पदावर पदोन्नती आणि नामनिर्देशनाने करावयाच्या नियुक््तत्ययाांांचे प्रमाणण १५:८५ असे असेल.

परंतु, पदोन्नतीद्ारे नियुक्ती देण्याकरिता योग्य उमेदवार उपलब्ध नसतील तर नियुक्ती प्राधिकाऱ्याच्या सहमतीने पदेान्नती व

नामनिर्देशन याद्ारे करावयाच्या नियुक्तीकरिता विहीत करण्यात आलेले प्रमाणण त्या भरती वर््षषापुरते शिथथील करून सदर पदे नामनिर्देशनाद्ारे

भरता येतील.

७. नियम ३,४ व ५ मध्ये उल््लेखिलेल्या पदांवर नामनिर्देशनाद्ारे नियुक्त केलेली व्यक्ती दोन वषाांच्या कालावधीकरिता

परिविक्षाक्षाधीन राहील. परिविक्षाक्षाधीन कालावधी जा्ततीत जास््त एक वर््षषापर्यंंत वाढविता येईल. शासनाच्या परिविक्षाक्षा धोरणणानुसार सदर

परिविक्षाक्षा कालावधी (वाढीव कालावधीसह) तसेच विहीत प्रशिक्षणण (असल्यास) त्यासह पूर््ण करणणे आवश््यक असेल. तथथापि,

शासनाच्या परिविक्षाक्षा धोरणणानुसार सदर परिविक्षाक्षा कालावधी (वाढीव कालावधीसह) तसेच विहीत प्रशिक्षणण (असल्यास) त्यासह

समाधानकारकरित्या पूर््ण न केल्यास संबंधित व्यक्तीची सेवा समाप्त करण्यात येईल.

८(क).

नियम ३ ते ५ येथथे नमूद पदावर पदोन्नतीने नियुक्त होणणाऱ्या व्यक्तीने, पदोन्नतीपूर्वीी हिंदी भाषा परीक्षा व मराठी भाषा

परीक्षा या दोन्ही परीक््षाांांसदर््भभात शासनाने वेळोवेळी केलेल्या नियमांनुसार, हिंदी भाषा व मराठी भाषा परीक्षा अगोदरच उत्तीर््ण केली असणणे

अथथवा उत्तीर््ण होण्यापासून सूट मिळविलेली असणणे आवश््यक असेल. अन््यथथा वरिष्ठ पदावर पदोन्नती अनुज्ेय असणणार नाही.

८(ख).

नियम ३ ते ५ येथथे नमूद पदावर नामनिर्देशनाने नियुक्त होणणाऱ्या व्यक्तीने हिंदी भाषा परीक्षा व मराठी भाषा परीक्षा या

दोन्ही परीक््षाांांसदर््भभात शासनाने वेळोवेळी केलेल्या नियमांनुसार, हिंदी भाषा व मराठी भाषा परीक्षा नियुक्तीपूर्वीी उत्तीर््ण केलेल्या नसतील

तर, हिंदी भाषा व मराठी भाषा परीक्षा नियमात नमूद केलेल्या विहित मुदतीत हिंदी भाषा व मराठी भाषा परीक्षा उत्तीर््ण होणणे आवश््यक

राहील. त्याचप्रमाणणे विहित मुदतीत हिंदी भाषा व मराठी भाषा परीक्षा उत्तीर््ण न झाल्यास सदर परीक्षा उत्तीर््ण होईपर््यत वार््षषिक वेतनवाढ

अनुज्ेय राहणणार नाही. तसेच, वरिष्ठ पदावर पदोन्नती अनुज्ेय राहणणार नाही.

९(क).

नियम ३ ते ५येथथे नमूद पदावर पदोन्नतीने नियुक्त होणणाऱ्या व्यक्तीने, पदोन्नतीपूर्वीी संगणणक हाताळणणी ज्ान प्राप्त

करण्यासंदर््भभात शासन (सामान्य प्रशासन विभाग / माहिती तंत्रज्ान संचालनालयाच्या) यांनी वेळोवेळी केलेल्या नियमांनुसार संगणणक

हाताळणणी ज्ान अर््हता प्रमाणणपत्र प्राप्त करणणे अथथवा सदर प्रमाणणपत्र प्राप्त करण्यापासून सूट मिळविलेली असणणे आवश््यक राहील.

अन््यथथा वरिष्ठ पदावर पदोन्नती अनुज्ेय असणणार नाही.

९(ख).

नियम ३ ते ५ येथथे नमूद पदावर नामनिर्देशनाने नियुक्त होणणाऱ्या व्यक्तीने संगणणक हाताळणणी ज्ान प्राप्त करण्यासंदर््भभात

शासनाने वेळोवेळी केलेल्या नियमानुसार, नियुक्तीपूर्वीी संगणणक हाताळणणी ज्ान अर््हता प्रमाणणपत्र धारणण केले नसल्यास, याबाबतच्या

नियमात नमूद केलेल्या विहित मुदतीत संगणणक हाताळणणी ज्ान अर््हता प्रमाणणपत्र धारणण करणणे आवश््यक असेल. त्याचप्रमाणणे विहित

मुदतीत संगणणक हाताळणणी ज्ान अर््हता प्रमाणणपत्र धारणण न केल्यास सदर संगणणक हाताळणणी ज्ान अर््हता प्रमाणणपत्र धारणण करेपर््यत वार््षषिक

वेतनवाढ अनुज्ेय असणणार नाही. तसेच, वरिष्ठ पदावर पदोन्नती देखील अनुज्ेय असणणार नाही.

१०. नियम ३ ते ५ येथथील पदावर नामनिर्देशनाद्ारे नियुक्त होणणाऱ्या व्यक्तीने, महाराष्टट्र नागरी सेवा (लहान कुटुंबाचे प्रतिज्ापत्र)

नियम, २००५ मधील तरतुदीनुसार व त्याबाबत वेळोवेळी करण्यात येणणाऱ्या नियमानुसार, नियुक्तीच्या वेळी लहान कुटुंबाचे प्रतिज्ापत्र

सादर करणणे आवश््यक असेल. तसेच, लहान कुटुंबाचे प्रतिज्ापत्र सादर करताना त्यामध्ये दोनपेक्षा अधिक अपत्ये नियुक्तीच्या वेळेेस

हयात असल्यास संबंधित उमेदवार शासकीय नियुक्तीसाठी अपात्र असेल. त्याचप्रमाणणे शासकीय सेवेत नियुक्तीनंतर संबंधित उमेदवारांस

भविष्यात दोनपेक्षा अधिक हयात मुले असल्याचे सिध््द झाल्यास तो उमेदवार संबंधित पदासाठी अनर््ह ठरेल.

११. अनुसूची-I मध्ये नमूद केलेली शैक्षणिक अर््हता व अनुभव यामध्ये भारतीय दंत परिषदेने किंवा भारत सरकारद्ारे स््थथापित

समतुल्य संस््थेने, वेळोवेळी दिलेल्या मान्यतेनुसार किंवा यथथास््थथितीनुसार सुधारित झाल्याचे मानण्यात येईल.

१२. वरील नियम ३ ते ५ येथथील अध्यापकीय संवर््गगातील पदावर नियुक्ती केलेली व्यक्ती विभागाच्या अधिपत्याखालील

महाराष्टट्र राज्यातील कोणणत्याही शासकीय दंत महाविद्याद्यालय व रुग््णालयात बदली होण्यास पात्र असेल.

१३. नियम ३ ते ५ येथथील पदांवर नियुक्त झालेल्या व्यक््तींच्या नावाची नोंद दंतवैद्य अधिनियम, १९४८ (१९४८ चा १६) च्या

तरतुदीनुसार झालेली असावी अथथवा या अधिनियमानुसार ठेेवल्या जाणणाऱ्या नोंदवहीत त््ययाांांची नावे नोंदणणीकृत असणणे आवश््यक आहे.

१४. कोणणत्याही भारतीय संरक्षणण सेवेमध्ये किंवा भारताच्या संरक्षणणाशी निगडीत असलेल्या पदावर भारतात किंवा भारताबाहेर

चार वर्षेे/चार वर््षषापेक्षा कमी नाही इतक्या कालावधीसाठी केंद्र शासनाने विहित केलेल्या अटीनुसार सेवा करणणे :-

शासनास आवश््यकता वाटली तर उपरोक्त पदावर नेमणणूक केलेल्या व्यक्तीस कोणणत्याही भारतीय संरक्षणण सेवेमध्ये

किंवा भारताच्या संरक्षणणाशी निगडीत असलेल्या पदावर भारतात किंवा भारताबाहेर चार वर्षेे/चार वर््षषापेक्षा कमी नाही इतक्या

कालावधीसाठी(प्रशिक्षणणासाठी घालविलेला कालावधी जमेस धरुन) वेळोवेळी केंद्र शासनाने विहित केलेल्या अटीनुसार सेवा

करावी लागेल.

परंतु, ज्या व्यक्तीची नियुक्ती झाल्याच्या दिनांकापासून १० वषाांचा कालावधी समाप्त झाल्या आहे किंवा सर््वसाधारणणपणणे

तिच्या वयाची ५५ वर्षेे पूर््ण केल्यानंतर, त्यापैकी जे अगोदर घडेेल, त्यानंतर अशा व्यक्तीला वरील प्रमाणणे सेवा करण्याची

आवश््यकता असणणार नाही.

१५. शासकीय सेवेत प्रवेश केल्यानंतर सेवाविषयक अन्य आदेश/नियम लागू होतील :-

Constitution of India.

No.SEPRANI-3019/C.R.117/VAISEVA-4.— In exercise of the powers conferred by the proviso

to article 309 of the Constitution of India, and in supersession of all the existing rules, orders or

instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the

following rules regulating recruitment to the posts of Professor, Group-A (Gazetted), Associate

Professor, Group-A (Gazetted) and Assistant Professor, Group-B (Gazetted) in a Government

Dental College and Hospital on the establishment of Directorate of Medical Education and Research

under the Medical Education and Drugs Department of Government of Maharashtra, namely :—

1. These rules may be called Professor, Group-A (Gazetted), Associate Professor, Group-A

(Gazetted) and Assistant Professor, Group-B (Gazetted) in a Government Dental College and

Hospital on the establishment of the Directorate of Medical Education and Research under the

Medical Education and Drugs Department of Government of Maharashtra, (Recruitment) Rules,

2023.

2. In these rules unless the context requires otherwise,—

(a) “Appointing Authority” means

(i) The Hon’ble Chief Minister, State of Maharashtra is the competent authority

to appoint candidates to the respective posts of Group-A in the Government Service ;

(ii) The Hon’ble Minister of the Department is the competent authority to appoint

candidates to the respective posts of Group-B in the Government service ;

(b) “Assistant Professor” means a Assistant Professor in a Government Dental College

and Hospital under the Directorate of Medical Education and Research in any subject of

Dental Surgery ;

and Hospital under the Directorate of Medical Education and Research in any subject of

Dental Surgery ;

(d) “Commission” means the Maharashtra Public Service Commission ;

(e) “Council” means the Dental Council of India, New Delhi or any other equivalent

authorized body appointed by Government of India in place of Dental Council of India ;

(f) “Department” means the Department of Medical Education and Drugs Department

as specified in the First Schedule to the Government of Maharashtra Rules of Procedure made

under Article- 166 of the Constitution of India ;

(g) “Diplomate of National Board” means the degree awarded by the National Board

of Examinations ;

(h) “Directorate” means the Directorate of Medical Education and Research, State of

Maharashtra under the administration of Medical Education and Drugs Department ;

(i) “Government” means the Government of Maharashtra ;

(j) “Eligibility Subject to the Seniority” means the eligibility in accordance with the terms

and conditions prescribed for promotion vide General Administration Department Government

Resolution dated 01.08.2019 and further orders issued in this behalf from time to time ;

(k) “Master of Dental Surgery (M.Ds)” means the post graduate degree in Dental Surgery

of a statutory University ;

(l)

“Professor” means a Professor in a Government Dental College and Hospital under

the Directorate of Medical Education and Research in any subject of Dental Surgery ;

(m) “Recognized Dental College” means a Dental College recognized by the Dental Council

of India or any other equivalent authorized body appointed by Government of India, in place

of the Dental Council of India ;

(n) “Recognized Medical College” means a Medical College recognized by the Medical

Council of India or National Medical Commission ;

(o) “Schedule-I” means the Schedule-I appended to these rules ;

(p) “Schedule-II” means the Schedule-II appended to these rules.

3. Appointment to the post of Professor (Group-A), (Gazetted)shall be made either,—

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst

the persons holding the post of Associate Professor, Group-A in concerned subject in Government

Dental Colleges and Hospitals, possessing educational qualifications and experience mentioned

in columns (3) and (4), respectively against entry at serial No. 1 of the schedule-I, and should

have acquired total score of minimum Thirty points regarding Research publications as per the

provisions of the Schedule-II; or

(b) by nomination from amongst the candidates recommended by the Commission on the

basis of result of Competitive Examination conducted therefor / who fulfills the following criteria,

namely:—

(i) Age Limit—

(A) Lower Age Limit : eighteen years completed.

(B) Upper Age Limit : fifty years of age completed for the persons belonging to open category

and fifty-five years of age completed for the persons belonging to reserved category:

Provided that the age limit for candidate who are already in Government service shall be

relaxed for further five years:

Provided further that, the reserved category candidates who are already working in the

Government service can avail relaxation of age limit either for Government service employees or

for reserved class employees.

on the final date of receipt of applications as stated in the advertisement of the Commission for

the recruitment to the concerned post.

(ii) Minimum Educational Qualification—

Possess qualifications and experience mentioned in columns (3) and (4), respectively, against

entry at serial no. 1 of the Schedule-I and should have acquired total score of minimum Thirty

points regarding research publications as per the provisions of the Schedule-II.

4. Appointment to the post of Associate Professor (Group-A), (Gazetted) shall be

made either,—

(a) by promotion of a suitable person on the basis of seniority subject to fitness, from amongst

the persons holding the post of Assistant Professor (Group-B) in the concerned subject in the

Government Dental Colleges and Hospitals, possessing educational qualifications and experience

mentioned in columns (3) and (4), respectively, against entry at serial No. 2 of the Schedule-I and

should have acquired total score of minimum Twenty points regarding Research Publications as

per the provisions of the Schedule-II; or

(b) by nomination from amongst the candidates recommended by the Commission on the

basis of result of Competitive Examination conducted therefor, who fulfills the following criteria,

namely:—

(i) Age Limit—

(A) Lower Age Limit : eighteen years completed.

(B) Upper Age Limit: fortyfive years completed for the persons belonging to open category

and fifty years completed for the persons belonging to reserved category:

Provided that the age limit for candidates who are already in government service shall

be relaxed for further five years :

Provided further that, the reserved category candidates who are already working in the

Government service can avail relaxation of age limit either for Government service employees

or for reserved category employees.

to the concerned post.

(ii) Minimum Educational Qualification—

Candidate should possess qualifications and experience mentioned in columns (3) and (4),

respectively, against entry at Serial No. 2 of the Schedule-I and should have acquired total score

of minimum twenty points regarding Research Publications as per the provisions of the Schedule-II.

5. Appointment to the post of Assistant Professor (group-B), (Gazetted) shall be

made either,—

(A) (a) by promotion of a suitable person on the basis of seniority subject to fitness from

amongst the persons holding the post of Dental Surgeon, (Group-B) in the Government Dental or

Medical Colleges and Hospitals, possessing educational qualifications and experience mentioned

in columns (3) and (4), respectively, against entry at Serial no. 3 of the Schedule-I ; or

(B) by nomination of candidates recommended by the Commission on the basis of result of

Competitive examination conducted therefor, who fulfills the following criteria, namely :—

(i) Age Limit—

(A) Lower Age Limit: eighteen years completed.

(B) Upper Age Limit : forty years completed for the persons belonging to open category

and forty-five years completed for the persons belonging to reserved category:

Provided that the age limit for candidates who are already in Government service

shall be relaxed for further five years :

Provided further that, the reserved category candidates who are already working in the

Government service can avail relaxation of age limit either for Government service employees

or reserved class employees.

on the final date of receipt of applications as stated in the advertisement of the Commission

for the recruitment to the concerned post.

(ii) Minimum Education Qualification—

candidate should possess qualifications and experience mentioned in columns (3) and (4),

respectively, against entry at Serial No. 4 of the Schedule-I.

6. Appointment to the posts mentioned in rules 3 and 4 shall be made by promotion and

nomination in the ratio of 50:50 respectively.

Appointment to the posts mentioned in rules 5 shall be made by promotion and nomination

in the ratio of 15:85 respectively :

Provided that, if the suitable candidates for appointment are not available, the ratio of

appointment by promotion and by nomination may be relaxed for that particular appointment year

after the consent of the Appointment Authority.

7. The person who has been appointed on the posts mentioned in rules 3 to 5 Group-A

(Gazetted) and Group-B(Gazetted) , by nomination shall be on probation for the period of two years.

The probation period may be extended up to maximum one year at the discretion of the Competent

Authority. Completion of this probation period (including extended period) satisfactorily, as per the

probation policy of the Government and completion of prescribed training, if any, is mandatory.

In the event of failing to complete the probation period (including extended period) satisfactorily,

as per the probation policy of the Government or in the event of not completing the prescribed

training, his/her services shall liable to be terminated.

8(A) It shall be mandatory for the Government Servant who has been appointed by promotion

to the posts mentioned in the rules 3 to 5, either to pass Hindi and Marathi Language Examination

as regulated by the Government (Marathi Language Department), from time to time, regarding

passing of these examinations or to get exemption from passing of these examinations before

getting promoted to the said posts. Otherwise, such Government Servants shall not be eligible for

promotion on higher post.

8(B) If any Government servant who has been appointed by nomination to the posts

mentioned in rules 3 to 5, has not passed the Hindi and Marathi Language Examination before

appointment, as regulated by the Government (Marathi Language Department), from time to

time, regarding passing these examination or he/she has not been exempted from passing of these

examinations, then he/she is required to pass these examination, within the prescribed time limit.

If such Government Servant fails to pass Hindi and Marathi Language Examinations within the

prescribed time limit, then he/she shall not be entitled for annual increment till passing of these

examinations. Further he/she shall not be entitled for promotion till passing these examinations.

9(A). It shall be mandatory for the Government Servant who has been appointed by promotion

to the posts mentioned in rules 3 to 5, either to possess the Computer Operation Certificate as

regulated by the Government (General Administration Department / Directorate Information

Technology) from time to time or to obtain exemption from passing of the examination of Computer

Operation on the grounds of age criteria prescribed by Orders issued by the General Administration

Department / Directorate I Information Technology, from time to time, before being promoted to

the said posts.

9(B) If any Government Servant who has been appointed by nomination to the posts

mentioned in rules 3 to 5 fails to possess the Computer Operation Certificate, as regulated by the

Government from time to time, before appointment, then he/she is required to possess the said

certificate within the prescribed time limit. If any Government Servant fails to possess Computer

operation Certificate within the prescribed time limit, then he/she shall not be entitled for annual

increment till possessing the said certificate. Further he/she shall not be entitled for promotion

till possessing Computer Operation Certificate.

10. It shall be mandatory for the person who is appointed by nomination to the post mentioned

in rules 3 to 5, to submit a small family certificate as prescribed under Declaration of Small Family

Rules, 2005 and the rules made thereunder from time to time, at the time of appointment to the

concerned post. A person having more than two children on the date of submission of Declaration

of Small Family, shall be disqualified for the appointment in Government Service. Moreover, the

person shall be governed by Government orders issued from time to time, in this behalf.

11. Educational qualification and experienced mentioned in the Schedule–I shall stand

amended in accordance with the recognition or de-recognition, as the case may be, of such

educational qualification and experience by Dental Council of India or equivalent body established

by Government of India, from time to time.

12. A person appointed to the posts mentioned in rules 3 to 5 shall be liable to transfer in

any of the Government Dental Colleges under the Department in the State of Maharashtra.

13. Persons selected on the posts mentioned in rules 3 to 5 should have registered their names

as per provisions of the Dental Act, 1948 (16 of 1948) or their names should have been registered

in the register maintained under the said Act.

14. A person appointed on the post, if so required, be liable to serve in any Defense services

of India or in post connected with the Defense of India anywhere in or outside India for a period

of not less than four years (including the period spent on training by such candidates), as may be

determined from time to time by the Government of India:

Provided that such person shall not be required to serve as aforesaid after expiry of ten years

from the date of his appointment and ordinarily after he has attended the age of fifty-five years.

15. The terms and conditions prescribed in these Rules shall be complied with for appointment

in the Government Service. Subsequently, the Maharashtra Civil Services Rules and other

prevailing enactments/Government Resolutions/ Government Orders with regard to service matters

as prescribed from time to time, shall be applicable to the concerned Government servant.

1. For any publication, except original research, first author (principal author) shall be

authors shall be considered.

3. Maximum of 3 publications shall be considered for allotting points in Category III.

4. Publication in tabloids or souvenirs or dental news magazines or abstracts of conference

proceedings or letter of acceptance shall not be considered for allotment of marks.

5. The candidate must have to secure minimum 30 and 20 marks from any one, two or all

three categories mentioned in column-2 for the post of professor and Associate professor

respectively.
