अधिसूचनाा

महाारााष्टट्र दिवााणी न््ययायायालयय अधिनिययम.

क्रमांक सीआरसी २०१८/प्र.क्र.१८०(३)/का.बारा.— महाराष्टट्र दिवाणी न्यायालय अधिनियम, (१८६९ चा १४) याचे कलम १४

आणि १९ याद्ारे प्रदान करण्यात आलेल्या अधिकारांचा आणि याबाबतीत त्यास समर््थ करणाऱ्या इतर सर््व अधिकारांचा वापर करून,

आणि याबाबतीत यापूर्वी काढलेल्या सर््व अधिसूचना, बीड जिल्ह्ातील केज व धारुर महसुली तहसिलाशी जेथवर संबंध असेल तेथवर,

त््ययाांांमध्ये अंशत: फेरबदल करून, महाराष्टट्र शासन, याद्ारे पुढीलप्रमाणे असे निदेश देत आहे की, दिनांक ११ जून, २०२३ पासून,—

(क)  बीड महसुली जिल्ह्ामध्ये केज येथे एक न्यायालय असेल आणि, अतिरिक्त जिल्हा न्यायाधीश हे उक्त न्यायालयाच्या

अध्यक्षस््थथानी असतील; आणि,

(ख)  उक्त न्यायालयाच्या सर््वसाधारण अधिकारितेच्या स््थथानिक सीमा, बीड जिल्ह्ातील केज व धारुर महसुली तालुक्यामध्ये

समाविष््ट असलेल्या क्षेत्ांशी समव्यापी व समाविष््ट असतील; आणि,

(ग)  केज व धारुर महसुली तालुक्याच्या संबंधात प्रमुख जिल्हा न्यायाधीश बीड यांचे सर््व अधिकार, उक्त अधिनियमाच्या

कलम ९ अन्वये प्रमुख जिल्हा न्यायाधीशांकडे निहित असलेल्या अधिकारांव््यतिरिक्त आणि त््ययाांांस योग्य वाटटतील अशी प्रकरणे

अतिरिक्त जिल्हा न्यायाधीश केज यांच्याकडे सोपविण्याच्या किंवा स्वत:हून निकाली काढण्याच्या किंवा सक्षम अधिकारीतेच्या इतर

न्यायालयाकडे सोपविण्याच्या त््ययाांांच्या अधिकारांखेरीज, केज येथील उक्त अतिरिक्त जिल्हा न्यायाधीश यांचेकडे निहीत असतील.

NOTIFICATION

Maharashtra Civil Courts Act.

No. CRC 2018/CR 180(I)/Desk XII.— In exercise of the powers conferred by sections 14 and 19

of the Maharashtra Civil Courts Act (XIV of 1869), and in partial modification of all other earlier

notifications issued in this behalf, in so far as they relate to the revenue tahsils of Kaij and Dharur in

Beed District, the Government of Maharashtra directs that, with effect from the 11th June, 2023, —

(a)  there shall be a Court at Kaij in the revenue district of Beed and the said Court shall

be presided over by the Additional District Judge ;

(b)  the local limits of the ordinary jurisdiction of the said Court shall be co-extensive with

and cover the areas comprising the revenue tahsils of Kaij and Dharur in Beed District ; and

(c)  all the powers of Principal District Judge, Beed in respect of the revenue tahsils of

Kaij and Dharur shall vest in the said Additional District Judge at Kaij except those vested in

the Principal District Judge under section 9 of the said Act and except his power to assign to

the Additional District Judge, Kaij or withdraw unto himself or to assign to another Court of

competent jurisdiction, such matters as he thinks fit.

क्रमांक सीआरसी २०१८/प्र.क्र.१८०(४)/का. १२.— फौजदारी प्रक्रिया संहिता १९७३ (१९७४ चा २) महाराष्टट्र राज्यात अंमलात

असताना, त्याच्या कलम ७ तसेच कलम ९ द्ारे प्रदान करण्यात आलेल्या आणि याबाबतीत त्यास समर््थ करणाऱ्या इतर सर््व अधिकारांचा

वापर करून; आणि याबाबतीत यापूर्वी काढलेल्या सर््व अधिसूचनांचा, बीड जिल्ह्ातील केज व धारुर महसुली तालुक्याशी त््ययाांांचा जेथवर

संबंध असेल तेथवर, त्यामध्ये अंशत: फेरबदल करून, महाराष्टट्र शासन, उच्च न्यायालय मुंबई यांच्याशी विचार विनिमय करून, याद्ारे

दिनांक ११ जून, २०२३ पासून, बीड जिल्ह्ातील केज व धारुर महसुली तालुक्याकरिता सत्र उपविभागाची निर््ममिती करीत आहे आणि

उक्त सत्र उपविभागाच्या हद्ीमध्ये उद्भवणाऱ्या प्रकरणांची न्यायचौकशी करण्यासाठी अतिरिक्त सत्र न्यायाधीश ज््ययाांांचे अध्यक्ष असतील,

असे सत्र न्यायालय केज येथे स््थथापन करीत आहे. प्रमुख सत्र न्यायाधीश, बीड हे केज सत्र उपविभागाचे देखील सत्र न्यायाधीश असतील

आणि त््ययाांांना, उक्त सत्र उपविभागामध्ये प्रकरणांतील अधिकार स्वत:हून काढून घेण्याचे किंवा सलग अधिकारीतेच्या इतर कोणत्याही

न्यायालयास नेमून देण्याचे किंवा त््ययाांांस योग्य वाटटतील अशी कोणतीही प्रकरणे, केज येथील सहायक किंवा अतिरिक्त सत्र न्यायाधीश

यांचेकडे सोपविण्याचे अधिकार असतील.

NOTIFICATION

Code of Criminal Procedure, 1973.

No. CRC 2018/CR 180(II)/Desk XII.— In exercise of the powers conferred by section 7 read

with section 9 of the Code of Criminal Procedure, 1973 (2 of 1974), in its application to the State of

Maharashtra, and of all other powers enabling it in this behalf ; and in partial modification of all

earlier notifications issued in this behalf, in so far as they relate to the revenue tahsils of Kaij and

Dharur in the Beed District, the Government of Maharashtra, after consultation with the High

Court of Judicature at Bombay, hereby creates, with effect from the 11th June, 2023, the sessions

sub-division for the revenue tahsils of Kaij and Dharur in Beed District and establishes a Court

of Sessions at Kaij, to be presided over by the Additional Sessions Judge for trial of cases arising

within the limits of the said sessions sub-division. The Principal Sessions Judge, Beed shall also be

the sessions judge for Kaij session sub-division and shall have the powers to withdraw unto himself

or to assign to any other Court of competent jurisdiction, cases from the said sessions sub-division,

or to assign unto the Assistant or Additional Sessions Judge at Kaij, any such cases as he thinks fit.
