अिधकारांचा वापर कȠन आिण याबाबतीत काढलेले िवǐमान सवɑ िनयम, आदेश िकȽवा संलेख यांचे अिधĸमण कȠन, महाराđłाचे

राùयपाल, याǑारे, महाराđł शासना÷या वैǐकीय िशȦण व औषधीŉďये िवभागा÷या Ōशासकीय िनयंŇणाखालील आयुòत, अąन व औषध

Ōशासन, मुंबई या कायाɑलयातील सह आयुòत (औषधे) गट-अ (राजपिŇत), सहायक आयुòत (औषधे) गट-अ (राजपिŇत) आिण

औषध िनरीȦक, गट-ब (राजपिŇत) या पदाचे सेवाŌवेश िविनयिमत करणारे पुढील िनयम करीत आहे :—

१. या िनयमांना, महाराđł शासना÷या वैǐकीय िशȦण व औषधीŉďये िवभागा÷या अिधपāयाखालील आयुòत, अąन व औषध

Ōशासन, मुंबई या कायाɑलयातील “सह आयुòत (औषधे) गट-अ (राजपिŇत), सहायक आयुòत (औषधे) गट-अ (राजपिŇत) आिण

औषध िनरीȦक, गट-ब (राजपिŇत) (सेवाŌवेश) िनयम, २०२४” असे Ċहणावे.

२. ďयाóया.—या िनयमात संदभाɑनुसार दुसरा अथɑ आवĐयक नसेल तर,—

(क) “अिधिनयम” याचा अथɑ औषधे व सɼदयɑ Ōसाधने अिधिनयम, १९४० (१९४० चा २३), असा आहे;

(ख) “िनयुòती Ōािधकारी” याचा अथɑ, शासकीय सेवेतील संबंिधत पदावर उमेदवाराची िनयुòती करĀयासाठी सȦम असणारा

Ōािधकारी, असा आहे ;

(ग) “आयोग” याचा अथɑ, महाराđł लोकसेवा आयोग, असा आहे ;

(घ) “आयुòत” याचा अथɑ वैǐकीय िशȦण व औषधीŉďये िवभागा÷या अिधपāयाखालील आयुòत, अąन व औषध Ōशासन,

असा आहे ;

(ङ) “पदवी” याचा अथɑ, एखाǐा सांिविधक िवǐापीठाची कोणāयाही शाखेतील पदवी िकȽवा शासनाने ित÷याशी समतुčय

Ċहणून घोिषत कɁलेली अąय कोणतीही अहɑता, असा आहे ;

(च) “शासन” याचा अथɑ, महाराđł शासन, असा आहे ;

(छ) “वैǐकीय िशȦण व औषधीŉďये िवभाग” याचा अथɑ, शासनाचा वैǐकीय िशȦण व औषधीŉďये िवभाग, असा आहे.

३. सह आयुòत (औषधे) गट-अ (राजपिŇत) या पदावरील िनयुòती, ही सहायक आयुòत (औषधे) गट-अ (राजपिŇत) हे

पद धारण करणाķया व उòत पदावर तीन वषाɕपेȦा कमी नसेल इतकी िनयिमत व अखंड सेवा असणाķया ďयòतȮमधून, योôयतेस अधीन

राहून, सेवाùयेđठते÷या आधारे, योôय ďयòती÷या पदोąनतीने करĀयात येईल.

४. सहायक आयुòत (औषधे) गट-अ (राजपिŇत) या पदावरील िनयुòती, एकतर,—

(एक) औषध िनरीȦक, गट-ब (राजपिŇत) हे पद धारण करणाķया व उòत पदावर पाच वषाɕपेȦा कमी नसेल इतकी िनयिमत

व अखंड सेवा असणाķया ďयòतȮमधून, योôयतेस अधीन राहून, सेवाùयेđठते÷या आधारे, योôय ďयòती÷या पदोąनतीने ; िकȽवा

(दोन) आयोगाने आयोिजत कɁलेčया Ēपधाɑ परीȦे÷या िनकाला÷या आधारावर नामिनदɨशनाǑारे अशा ďयòतȮमधून ùया

ďयòती,—

(क) अठरा वषाɕपेȦा कमी वया÷या नाहीत आिण खुčया Ōवगाɑतील उमेदवारां÷या बाबतीत, अडतीस वषाɕपेȦा अिधक

वया÷या नाहीत व राखीव Ōवगाɑतील उमेदवारां÷या बाबतीत, Ňेचाळीस वषाɕपेȦा अिधक वया÷या नाहीत.

(ख) िकमान शैȦिणक अहɑता आिण अनुभव धारण करणारे—

(एक) उमेदवाराने औषधिनमाɑणशाĒŇामधील पदवी िकȽवा औषधिनमाɑण रसायनशाĒŇामधील पदवी िकȽवा वैǐकशाĒŇामधील

पदवी िचिकāसा औषधशाĒŇ अथवा सुȤमजीवशाĒŇ यामधील िवशेषȧतेसह धारण कɁलेली असावी ;

(दोन) अनुभव - आवĐयक शैȦिणक अहɑता संपादन कɁčयानंतर औषधिनिमɑती िकȽवा चाचणी यांमधील पाच वषाɑपेȦा

कमी नसेल इतका िकȽवा पाच वषाɕ÷या कालावधीसाठी अिधिनयमा÷या तरतुदȮची अंमलबजावणी करĀयामधील अनुभव धारण

करील ; आिण

(तीन) मराठी भाषेतून ďयवȬĒथतपणे बोलता, वाचता व िलहता येणे शòय ďहावे यासाठी मराठी भाषेचे पुरेसे ȧान असावे.

(ग) वयोमयाɑदेची गणना - वयोमयाɑदेची गणना जािहरातीमĄये नमूद कɁलेčया िदनांकानुसार कɁली जाईल.

५. िनयम ४ मĄये नमूद कɁलेčया पदासाठी पदोąनतीने व नामिनदɨशनाने िनयुòती करĀयाचे Ōमाण मंजूर पदां÷या एकȳण संóयेपैकी

अनुĸमे ७० : ३० इतकɁ असेल.

६. औषध िनरीȦक, गट- ब (राजपिŇत) पदाची िनयुòती, आयोगाने आयोिजत कɁलेčया Ēपधाɑ परीȦे÷या िनकाला÷या आधारावर

नामिनदɨशनाने पुढील ďयòतȮमधून करĀयात येईल,-

(क) अठरा वषाɕपेȦा कमी वया÷या नाहीत आिण खुčया Ōवगाɑतील उमेदवारां÷या बाबतीत, अडतीस वषाɕपेȦा अिधक वया÷या

नाहीत व राखीव Ōवगाɑतील उमेदवारां÷या बाबतीत, Ňेचाळीस वषाɕपेȦा अिधक वया÷या नाहीत.

(ख) िकमान शैȦिणक अहɑता - उमेदवाराने औषधिनमाɑणशाĒŇामधील पदवी िकȽवा औषधिनमाɑण रसायनशाĒŇामधील पदवी

िकȽवा वैǐकशाĒŇामधील पदवी िचिकāसा औषधशाĒŇ अथवा सुȤमजीवशाĒŇ यामधील िवशेषȧतेसह धारण कɁलेली असावी ;

७. िनयम ४ व ६ मĄये नमूद कɁलेčया पदांवर नामिनदɨशनाǑारे िनयुòत कɁलेली ďयòती, दोन वषाɕ÷या कालावधीसाठी पȫरिवȦाधीन

असेल. पȫरिवȦाधीन कालावधी िनयुòती Ōािधकाķया÷या Ēवे÷छािनणɑयावर एक वषाɕपयɕत वाढिवता येईल. शासना÷या पȫरिवȦा धोरणानुसार

हा पȫरिवȦा कालावधी (वाढिवलेčया कालावधीसह) समाधानकारकरीāया पूणɑ करणे आिण िविहत कɁलेले ŌिशȦण पुणɑ करणे अिनवायɑ

आहे. जर āया ďयòतीने, शासना÷या पȫरिवȦा धोरणानुसार, पȫरिवȦा कालावधी (वाढिवलेčया कालावधीसह) समाधानकारकरीāया पूणɑ

कɁला नाही िकȽवा िविहत ŌिशȦण पूणɑ कɁले नाही तर, āयाची सेवा समाĆत कɁली जाĀयास पाŇ असेल.

भाग चार-अ-९–२

८. (क) िनयम ३ व ४ मĄये नमूद कɁलेčया पदांवर पदोąनतीǑारे िनयुòत होणाķया ďयòतीने, मराठी व िहंदी भाषा परीȦा, या दोąही

परीȦां÷या बाबतीत, शासनाने वेळोवेळी कɁलेčया िनयमांनुसार, उƫीणɑ कɁčया नसतील अथवा अशा परीȦा उƫीणɑ होĀयापासून ितला सूट

देĀयात आली नसेल तर, उòत पदावर पदोąनती िमळĀयापुवȯ सदर परीȦा, उƫीणɑ होणे आवĐयक असेल.

(ख) िनयम ४ व ६ मĄये नमूद कɁलेčया पदावर नामिनदɨशनाǑारे िनयुòत झालेčया ďयòतीने, मराठी व िहंदी भाषा परीȦा, āयाबाबतीत

शासनाने वेळोवेळी कɁलेčया िनयमांनुसार, āया अगोदरच उƫीणɑ कɁčया नसतील िकȽवा अशा परीȦा उƫीणɑ होĀयापासून सूट देĀयात आली

नसेल तर, ती ďयòती िनयुòतीनंतर िविहत कालमयाɕदेत या परीȦा उƫीणɑ करील, अąयथा, या परीȦा उƫीणɑ होईपयɕत, ती ďयòती, वािषɑक

वेतनवाढ िकȽवा पुढील पदोąनती÷या पदावर पदोąनती िमळĀयास पाŇ असणार नाही.

९. (क) िनयम ३ व ४ मĄये नमूद कɁलेčया पदांवर पदोąनतीǑारे िनयुòत झालेले ďयòती, शासनाने वेळोवेळी िविहत कɁलेले संगणक

हाताळणी ȧान ŌमाणपŇ, धारण करĀयापासून ितला सूट देĀयात आली नसेल तर, उòत पदावर पदोąनती देĀयापूवȯ धारण करील.

(ख) िनयम ४ व ६ मĄये नमूद कɁलेčया पदावर नामिनदɨशनाǑारे िनयुòत झालेली ďयòती, िनयुòतीपूवȯ शासनाने वेळोवेळी िविहत

कɁलेले संगणक हाताळणी ȧान ŌमाणपŇ, धारण करील िकȽवा िनयुòतीनंतर उòत ŌमाणपŇ िविहत मुदतीत धारण करील िकȽवा ितला असे

ŌमाणपŇ धारण करĀयापासून सूट देĀयात आली नसेल तर, असे ŌमाणपŇ धारण करीपयɕत अąयथा, ती, वािषɑक वेतनवाढीस िकȽवा पुढील

पदोąनती÷या पदावरील पदोąनतीस पाŇ असणार नाही.

१०. (१) िनयम ४ व ६ मĄये नमूद कɁलेčया पदांवर नामिनदɨशनाǑारे िनयुòत झालेली ďयòती, महाराđł नागरी सेवा (लहान कȱटȲȾबाचे

Ōितȧापन) िनयम, २००५ या÷या तरतुदȮनुसार िकȽवा याबाबतीत शासनाने वेळोवेळी िनगɑिमत कɁलेले अąय कोणतेही िनयम, आदेश िकȽवा

संलेख यांनुसार, लहान कȱटȲȾबाचे Ōितȧापन सादर करील, अąयथा ती, āया पदावर िनयुòतीसाठी पाŇ असणार नाही.

(२) लहान कȱटȲȾबाचे Ōितȧापन सादर करĀया÷या िदनांकास दोनपेȦा अिधक अपāये हयात असणारी ďयòती, शासकीय सेवेत

िनयुòतीसाठी अपाŇ असेल.

(३) एखाǐा ďयòतीची शासकीय सेवेत िनयुòती कɁčयानंतर, जर ितला दोन पेȦा अिधक हयात अपāये असčयाचे िसǌ झाले तर,

ती, शासकीय सेवेत िनयुòत कɁलेčया पदासाठी अपाŇ ठरेल.

११. ùया ďयòतȮना िनयम ३, ४ व ६ मĄये नमूद कɁलेčया पदावर िनयुòत कɁले आहे अशा ďयòतीची, सेवाùयेđठता यादी राùयĒतरावर

ठɂवĀयात येईल. Ċहणून, अशी ďयòती, महाराđł राùयात कोठɂही बदलीस पाŇ असेल.

१२. शासकीय सेवेतील िनयुòतीसाठी या िनयमांमĄये िविहत कɁलेčया अटी व शतȰचे अनुपालन करĀयात येईल. शासकीय सेवेत

िनयुòती झाčयानंतर संबंिधत शासकीय कमɑचाķयास, वेळोवेळी, िविहत कɁलेčया सेवे÷या बाबीसंबंधात, महाराđł नागरी सेवा िनयम आिण

इतर Ōचिलत अिधिनयम िकȽवा शासन िनणɑय िकȽवा शासन आदेश लागू असतील.

१३. िनयम ४ व ६ मĄये नमूद कɁलेčया पदांवर नामिनदɨशनाǑारे िनयुòतीसाठी िनवड झालेčया वैǐकीय पदवीधराने, राđłीय वैǐकीय

आयोग कायदा, २०१९ (२०१९ चा ३०) अąवये ठɂवलेčया भारतीय वैǐकीय नɻदवहीमĄये, अशा Ōकारे अगोदरच नɻदणी कɁलेली नसेल

िकȽवा āयाचे नाव दाखल कɁलेले नसेल तर, पदावर ȟजू होĀयापूवȯ, महाराđł वैǐकीय पȫरषद अिधिनयम, १९६५ (१९६५ चा महा.४६)

अąवये, Ēवत:ची नɻदणी कȠन घेणे आवĐयक असेल.

१४. िनयम ४ व ६ मĄये नमूद कɁलेčया पदांवर नामिनदɨशनाǑारे िनयुòतीसाठी िनवड झालेčया औषधिनमाɑणशाĒŇ पदवीधराने,

जर अगोदरच अशी नɻदणी कɁलेली नसेल तर, पद धारण करĀयापूवȯ, औषधिनमाɑणशाĒŇ अिधिनयम, १९४८ (१९४८ चा ८) अąवये

Ēवत:ची नɻदणी कȠन घेणे आवĐयक असेल.

CONSTITUTION OF INDIA.

No.FDS-2017/C.R.193/17/Drugs-1.—In exercise of the powers conferred by proviso to article

309 of the Constitution of India and in supersession of all the existing rules, orders or instruments

issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules

regulating recruitment to the post of Joint Commissioner (Drugs), Group-A (Gazetted), Assistant

Commissioner (Drugs), Group-A (Gazetted) and Drug Inspector, Group-B (Gazetted) in the Office

of the Commissioner, Food and Drugs Administration under the administrative control of Medical

Education and Drugs Department of the Government of Maharashtra, namely :—

1. These rules may be called the Joint Commissioner (Drugs), Group-A (Gazetted), Assistant

Commissioner (Drugs), Group-A (Gazetted) and Drug Inspector, Group-B (Gazetted) in the Office

of the Commissioner, Food and Drugs Administration under the Medical Education and Drugs

Department (Recruitment) Rules, 2024.

2. Definition.—In these rules unless the context requires otherwise,—

(a) “Act” means the Drugs and Cosmetics Act, 1940 (23 of 1940) ;

(b) “Appointing Authority” means the authority which is competent to appoint a candidate

to the concerned post in the Government Service ;

(d) “Commissioner” means the Commissioner, Food and Drugs Administration under the

Medical Education and Drugs Department ;

(e) “Degree” means a degree of any faculty of a statutory University or any other qualification

declared by the Government as equivalent thereto ;

(f) “Government” means the Government of Maharashtra ;

(g) “Medical Education and Drugs Department” means the Medical Education and Drugs

Department of the Government.

3. Appointment to the post of Joint Commissioner (Drugs), Group-A (Gazetted) shall be made by

promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons

holding the post of Assistant Commissioner (Drugs), Group-A (Gazetted) having not less than three

years regular and continuous service in the said post.

4. Appointment to the post of Assistant commissioner (Drugs), Group-A (Gazetted) shall be

made either,—

(i) by promotion of a suitable person on the basis of seniority subject to fitness from amongst

the persons holding the post of Drug Inspector, Group-B (Gazetted) having not less than five

years of regular and continuous service in the said post ; or

(ii) by nomination, on the basis of result of Competitive Examination held by the Commission

from amongst the persons who,—

(a) are not less than eighteen years and not more than thirty-eight years of age in case

of persons belonging to General Category and not more than forty-three years of age for

the persons belonging to Reserved Category.

(b) Minimum educational qualification and experience.

(i) shall possess a Degree in Pharmacy or Pharmaceutical Chemistry or in Medicine with

specialization in Clinical Pharmacology or Microbiology ;

(ii) Experience.- shall possess an experience for not less than five years after acquiring

essential educational qualification in the manufacture or testing of drugs or enforcement of the

provision of the Act for a minimum period of five years ; and

(iii) have adequate knowledge of Marathi so as to be able to speak, read, write in Marathi

with facility.

5. The proportion for appointment by promotion and nomination for the post mentioned in rule 4

shall be in the ratio of 70:30, respectively, for the total number of sanctioned posts of a post to be filled.

6. Appointment to the post of Drug Inspector, Group- B (Gazetted) shall be made by nomination

on the basis of result of Competitive Examination held by the Commission, who,—

(a) are not less than eighteen years and not more than thirty-eight years of age

in case of persons belonging to General Category and not more than forty three years

of age for the persons belonging to Reserved Category.

(b) shall possess a Degree in Pharmacy or Pharmaceutical Sciences or Medicine with

specialization in Clinical Pharmacology or Microbiology.

7. The person appointed to the posts mentioned in rules 4 and 6, by nomination shall be on

probation for a period of two years. The probation period may be extended further for a period of one

year at the discretion of the Appointing Authority. Completion of this probation period (including

extended period) satisfactorily as per the probation policy of Government and completion of prescribed

training, are mandatory. In the event of failing to complete the probation period (including extended

period) satisfactorily as per the probation policy of Government or in the event of not completing the

prescribed training, his services shall be liable to be terminated.

8. (a) A person appointed to the post mentioned in rules 3 and 4 by promotion shall pass the

Marathi and Hindi languages examinations as per the rules made in that behalf by the Government,

from time to time, unless he has already passed or has been exempted from passing those examinations

before getting promoted to the said post.

(b) A person appointed to the post mentioned in the rules 4 and 6 by nomination, shall pass the

Marathi and Hindi languages examinations as per the rules made in that behalf by the Government,

from time to time unless he has already passed the said examinations within the prescribed time

limit after appointment or has been exempted from passing these examinations, otherwise he shall

not be eligible for annual increment or promotion to the next promotional post till he passes such

examinations.

9. (a) A person appointed to the post mentioned in rules 3 and 4 by promotion shall possess a

Certificate in Knowledge of Computer Operations prescribed by the Government, from time to time,

unless he has been exempted from possessing such certificate before promoted to the said post.

(b) A person appointed to the post mentioned in rules 4 and 6, by nomination, shall possess

a Certificate in Knowledge of Computer Operations prescribed by the Government, from time to

time, before appointment or shall possess the said certificate within the prescribed time limit after

appointment or has been exempted from possessing such certificate, otherwise he shall not be eligible

for annual increment or promotion to the next promotional post till he possess such certificate.

10. (1) A person appointed to the post mentioned in rules 4 and 6, by nomination, shall submit

a Declaration of Small Family as per the provisions of the Maharashtra Civil Services (Declaration

of Small Family) Rules, 2005 or any other rules, orders or any instruments issued in this behalf, by

the Government, from time to time, otherwise he shall not be eligible for the appointment to the post.

(2) A person having more than two children on the date of submission of Declaration of Small

Family, shall be disqualified for the appointment in Government Service.

(3) After appointment of a person in the Government Service, if it is proved that he has more

than two children, then he shall be disqualified for the appointed post in the Government Service.

11. The seniority list of the persons who are appointed to the post mentioned in rules 3, 4 and 6

shall be maintained at State level. Therefore, such person shall be eligible to be transfer any where

in the Maharashtra State.

12. The terms and conditions prescribed in these Rules shall be complied with for appointment

in the Government Service. Subsequent to appointment in Government Service, the Maharashtra

Civil Services Rules and other prevailing enactments or Government Resolutions or Government

Orders with regard to service matters as prescribed from time to time, shall be applicable to the

concerned Government Servant.

13. A medical graduate selected for the appointment to the posts mentioned in rules 4 and 6

by nomination, shall be required to got himself registered under the Maharashtra Medical Council

Act, 1965 (Mah. XLVI of 1965), before joining the post, unless he has already so registered or his

name is borne in the Indian Medical Register maintained under the National Medical Commission

Act, 2019 (30 of 2019).

14. A pharmacy graduate selected for the appointment to the posts mentioned in rules 4 and 6

by nomination shall be required to got himself registered under the Pharmacy Act, 1948 (8 of 1948)

before joining the post, unless he has already so registered.
