क्र. टीी पी एस-१२०४/९४१/ सीआर-१६३/०४/नवि�-१२, दि�नांंsक २५ जुलै २००५ अन्वये शाासनाने मंजूूर केली आहे आणिि” उक्त वि�काास

योजना दि�नांंsक १२ ऑगस्ट २००५ पाासून अंंमलात आलेली आहे (यात या पुढेे ज्याचा उल्लेख “उक्त अंंबरनााथ – कुळगांंsव बदलाापूर

व परि�सर अधिि˜सूचिि‹त वि�काास योजना” असा करण्यात आला आहे);

आणिि” ज्याअर्थीी, महाारााष्ट्र प्रादेशि�क नि�योजन व नगररचना

ा अधिि˜नि�यम, १९६६ (यात यापुढेे ज्याच्या नि�र्देश “उक्त अधिि˜नि�यम” असा

करण्यात आला आहे) चे कलम ११३(१) द्वाारे प्रदान करण्यात आलेल्या अधिि˜काारांंsचा वापर करून शाासनाने नगरवि�काास, साववजनि�क

आरोग्य व गृहनि�र्मा�ण वि�भाागाची अधिि˜सूचना क्रमांंsक आरपीीबी. ११७१/१८१२४/११३/आय डब्ल्यू, दि�नांंsक २० मार्चच १९७१ द्वाारे, यात

नमूद करण्यात आलेले क्षेेत्र हे नवी मुंंsबई ह्याा नवीन नगरााचे क्षेेत्र म्हणूून घोोषिि¨त केले आहे व सि�डकोस नगरवि�काास, साववजनि�क आरोग्य

व गृहनि�र्मा�ण वि�भाागाची अधिि˜सूचना क्रमांंsक आरपीीबी. १८१२४/II डब्ल्यू, दि�नांंsक २० मार्चच १९७१ अन्वये, उक्त अधिि˜नि�यमांंsच्या कलम

११३(३अ) नुसार नवी मुंंsबई या नवीन नगर क्षेेत्राासाठीी (उक्त नवनगरक्षेेत्र) नवनगर वि�काास प्राधिि˜करण

म्हणूून नि�युक्त केले आहे ;

आणिि” ज्याअर्थीी, उक्त अधिि˜नि�यमाच्या कलम ३१(१) द्वाारे प्रदान करण्यात आलेल्या अधिि˜काारांंsचा वापर करून, शाासनाने उक्त

नवनगर क्षेेत्राासाठीी सि�डकोने सादर केलेल्या रचनााबद्ध आरााखड्यााच्या (Structural Plan) स्वरूपाात असलेल्या प्रारूप वि�काास

योजनेस ( उक्त अंति�म वि�काास योजना) नगरवि�काास व साववजनि�क आरोग्य वि�भााग अधिि˜सूचना क्रमांंsक आरपीीबी. ११७५/६३५/

यूडी -५, दि�नांंsक १८ ऑगस्ट १९७९ सह अधिि˜सूचना क्रमांंsक आरपीीबी. ११७५/६३५/यूडी-५, दि�नांंsक १८ जानेवारी १९८० अन्वये मंजुुरी

दि�लेेली आहे आणिि” उक्त वि�काास योजना दि�नांंsक १ मार्चच १९८० पाासून अंंमलात आलेली आहे ;

आणिि” ज्याअर्थीी, महाारााष्ट्र महाानगरपाालि£काा अधिि˜नि�यम (यात यापुढेे ज्याचा उल्लेख “उक्त महाानगरपाालि£काा अधिि˜नि�यम” असा

करण्यात आला आहे) चे कलम ३ च्या पोट-कलम (४) नुसार महाारााष्ट्र शाासन नगरवि�काास वि�भााग अधिि˜सूचना क्रमांंsक पनप – २९१४/

व्ही आय फीी संं.क्र. ३०१/प्र. क्र. ३५४/नवि�-२३, दि�नांंsक २६ सप्टेंबर २०१६ अन्वये पनवेल नगरपरि�षदेेचे संपूूर्णण क्षेेत्र व २९ महसुुली

गावांंsच्या क्षेेत्राासाठीी पनवेल महाानगरपाालि£केची स्थाापनाा करण्यात आली असून ती दि�नांंsक १ ऑक्टोबर २०१६ पाासून अस्ति�ित्वात आली आहे ;

आणिि” ज्याअर्थीी, पनवेल महाानगरपाालि£काा हद्दीीमध्ये उक्त अंंबरनााथ – कुळगांंsव बदलाापूर व परि�सर अधिि˜सूचिि‹त क्षेेत्रााची वि�काास

योजना ११ महसुुली गावांंsचा समावेश करणेेत आलेला आहे. तसेेच, मौजे-कोयनावेळे व मौजे-तळोोजे मजकूर या गावातील वाहतूूक

सोयीची व दळणवळण सुकर होण्याकरि�ताा नवीन रस्तेे प्रस्तावि�त करून Missing Links जोडणे गरजेेचे आहे ;

आणिि” ज्याअर्थीी, उक्त मंजूूर अंंबरनााथ – कुळगांंsव बदलाापूर व परि�सर अधिि˜सूचिि‹त क्षेेत्रााची वि�काास योजनामध्ये Missing Links

असल्याने पनवेल महाानगरपाालि£काा क्षेेत्राातील वाहतूूक सोयीची व दळणवळण सुकर होण्यासाठीी नवीन जोड रस्तेे तयाार करणेे गरजेेचे

आहे. तसेेच, काार्या�सन अधिि˜काारी, नगरवि�काास वि�भााग यांंsनी संदर्भीय पत्र जा.क्र.टि�पीीएस-१२२१/१५७३/प्र.क्र.७६/२१/नवि�-१२,

दि�नांंsक २३ जुलै २०२१ अन्वये “वि�काास परवाानगी देताना पनवेल महाानगरपाालि£केने उपलब्ध मूलभूूत सुवि�धांंsचा वि�चार करण्यात यावा”

असे कळवि�ले आहे. त्याअनुषंगााने वि�काास परवाानगी देण्यापूर्वी रस्तेे व मुलभूूत सुवि�धा उपलब्ध असणे आवश्यक आहे ;

आणिि” ज्याअर्थीी, महाारााष्ट्र महाानगरपाालि£काा अधिि˜नि�यमाचे कलम २०५, २०६ व २०९ अन्वये महाानगरपाालि£काा क्षेेत्राामध्ये नवीन रस्तेे

तयाार करणेे, रस्त्याची रूंदी नि�श्चि�ित करणेे व रस्त्यांंsची सुधारणाा करणेेचा अधिि˜काार महाानगरपाालि£केला आहे ;

आणिि” ज्याअर्थीी, वरील संदर्भभ उक्त करण्यासाठीी पनवेल महाानगरपाालि£केच्या सववसाधारण सभेने ठरााव क्र. १९०, दि�नांंsक ५ सप्टेंबर

२०१९ अन्वये आयुक्त, पनवेल महाानगरपाालि£काा यांंsना प्राधिि˜कृत केले आहे ;

आणिि” ज्याअर्थीी, पनवेल महाानगरपाालि£केच्या सववसाधारण सभेने ठरााव क्र. ४९६ दि�नांंsक ६ जुलै २०२२ अन्वये महाारााष्ट्र

महाानगरपाालि£काा अधिि˜नि�यमातील तरतुुदीनुसार पनवेल महाानगरपाालि£काा हद्दीीमध्ये खालील नमूद नवीन रस्ता प्रस्तावि�त करून नवीन रस्त्यांंsची

आखणी अंति�म करणेे व सदर रस्त्याखालील जागांंsचे हस्तांंsतरणीीय वि�काास हक्क (TDR) च्या माध्यमातून भूसंंपाादन व वि�काास करणेे

या काामासाठीी मा. आयुक्त, पनवेल महाानगरपाालि£काा यांंsना प्राधिि˜कृत करण्यास सर्वा�नुमतेे मान्यता दि�लीी आहे ;

PANVEL MUNICIPAL CORPORATION

Public Notice

Maharashtra Municipal Corporation Act,1949 Section 205, 206 & 209

No. PMC/TPD/ROADS/26 -24/S.NO. 01/186/2024

Whereas the Ambarnath - Kulgaon - Badlapur & Surrounding Notified area Development Plan

has been sanctioned by the Government of Maharashtra in Urban Development Department vide

notification no. TPS–1204/941/CR–1630/UD-12, dated 25th July 2005 and it has come into force

with effect from 12th August 2005 (hereinafter referred as the said Ambarnath-Kulgaon-Badlapur

& Surrounding Notified area Development plan);

And whereas, the Govt., in exercise of the powers conferred by Section 113(1) of the Maharashtra

Regional and Town Planning Act, 1966 (hereinafter referred to as “said Act”) has designated site for

New – Town of Navi Mumbai (hereinafter referred to as “Said New Town”) vide Urban Development

and Public Health Department’s (UD and PH) Notification No. RPB. 1171/18124/I.W., dated the

20th March 1971 and CIDCO has been appointed as New Town Department Authority (NTDA) for

the said New Town Under Section 113(3A) of the said Act vide Urban Development and Public Health

Department’s Notification No.RPB. 117/18124/II.W., dated the 20th March 1971;

And whereas, the Govt. in exercise of the Powers conferred by Section 31(1) of the said Act vide

UD and PHD’s Notification No.RPB. 1175/635/UD-5, dated the 18th January 1980 has been sanctioned

the Draft Development Plan (hereinafter referred to as said Final Development Plan) in the form of

structural plan submitted by CIDCO for the said New Town area and the said Final Development

Plan came into force with effect from 1st March 1980 ;

And whereas, the Government in exercise of the power conferred by Section 3 of the Maharashtra

Municipal Corporation Act, 1949 (hereinafter referred to as the “said MMC Act”) vide the Urban

Development Department notification no. PNP.2014/VIP No. 301/CR. 354/UD/23 dated the

26th September, 2016 constituted the Panvel Municipal Corporation for the areas of whole area of

Panvel Municipal Council & 29 revenue villages specified therein, which came into force with effect

from 1st October 2016.

And whereas, the said Ambarnath-Kulgaon-Badlapur & Surrounding Notified area Development

Plan’s 11 revenue villages has been included in the Panvel Municipal Corporation Area. However,

it needs to enable the traffic Smoothly, to make the conveniently traffic and to propose new public

roads and to join the missing links within the Koyanavele and Taloje majkur revenue villages ;

And whereas there are Missing links in the said Final Development Plan & the said Ambarnath-

Kulgaon-Badlapur & Surrounding Notified area Development Plan it has become expedient to

connect the Missing Links by preparing new roads so as to enable the traffic Smoothly & to make the

conveniently traffic within the Panvel Municipal Corporation. Also, Desk Officer, Urban Development

Department, Government of Maharashtra has directed Panvel Municipal Corporation to consider

and fulfill the needs of basic amenities before sanctioning Development Permissions by vide letter

No.TPS-1221/1573/S.No.76/21/UD-12, Dated 23/07/2021. So that, it is needed to propose roads and

basic amenities before sanctioning Development Permissions ;

And whereas, as per the provisions of the said MMC Act, Sections 205, 206, & 209 empowers

the Municipal Corporation to prepare the new roads, to decide the width of the roads and to improve

the roads within the Municipal Corporation Area ;

And whereas, the Panvel Municipal Corporation vide General Body Resolution no. 190 dated

05/09/2019 delegated the powers under Section 205, 206 & 209 of the said MMC Act to Commissioner,

Panvel Municipal Corporation ;

And whereas, the Panvel Municipal Corporation vide General Body Resolution no. 496 dated

06/07/2022 approved and delegated powers to The Commissioner, Panvel Municipal Corporation to

prepare the new roads and decide its alignment and to acquire lands affected by new roads in lieu of

Transferable Development Right (TDR) within the Municipal Corporation Area as per the provisions

of the said MMC Act ;

And whereas, Panvel Municipal Corporation has published the Notice vide No. PMC/TPD/

Roads/26-23/S.No.-02/3015/2023 in Maharashtra Government Extra-Ordinary Gazette No.91, dated

19th October 2023 and published in Daily Tarun Bharat, Daily My Mahanagar, Daily Raigad Nagari

and Daily Maharashtra Samrat newspapers on dated 21st October 2023 for inviting suggestions and

objections to the said proposed alignment in the revenue villages Mouje-Koyanavele and Mouje-Taloje

Majkur as per the provisions under section 205, 206 and 209 of Maharashtra Municipal Corporation

Act, 1949 shown in Schedule ‘A’ and Schedule ‘B’;

And whereas, 02 suggestions and objections received from public within prescribed period

regarding Sr.no.01 of Schedule ‘A’ and Schedule ‘B’ and hearing has been held on dt.13/12/2023 in

the office of Town Planning Department, Panvel Municipal Corporation and It is necessary to finalize

the layout of the roads by making minor changes in Sr.no.01 of Schedule ‘A’ and Schedule ‘B’;

Therefore, as per the powers delegated by Panvel Municipal Corporation to the Commissioner,

Panvel Municipal Corporation and in exercise of the powers, I, Ganesh Deshmukh, Commissioner,

Panvel Municipal Corporation hereby sanctions the alignment of sanctioned new road as mentioned

in the Schedule ‘A’ and plan appended hereto Schedule ‘B’ showing the alignment of new road is kept

open for the inspection of general public on all working days and in working hours in the office of the

Town Planning Department, Panvel Municipal Corporation for a period of one month.

(1) Layout and make final alignment of 24.00 m wide new public road from Existing 45.00 m

wide Taloja MIDC road adjacent to S.No.7 of Mouje-Koyanavele revenue village to S.No.21 adjacent

to river and Layout and make final alignment of 18.00 m wide new public road from S. No.4 to S.No.2

to S.No.6 of Mouje-Koyanavele revenue village.
