क्रमांंsक राानि�आ /राापनों-२०२३/प्र.क्र.३५/का. ११.—ज्यााअर्थीी, भाारतीीय संंवि¦धाानाच्याा अनुच्छेेद २४३-के व २४३-झेेड ए अन्वयेे;
तसेेच रााज्याातील स्थाानि�क स्वरााज्य संंस्थांंsच्याा संबंंधि�त कायद्याातील तरतुुदींन्वयेे अशाा स्थाानि�क स्वरााज्य संंस्थांंsच्याा सर्वव नि�वडणुुकांंsचे
अधीक्षण, संचाालन व नि�यंंत्रण यााबाबतचेे अधि�काार रााज्य नि�वडणूक आयोगास प्राप्त झाले आहेत ;
आणि� ज्यााअर्थीी, स्थाानि�क स्वरााज्य संंस्थांंsच्याा नि�वडणुुकांंsचे पावि¦त्र्य रााखणे व अशाा नि�वडणुुका मुक्त, नि�:पक्षपातीपणे, प्रभाावीपणे व
कार्ययक्षमतेने पार पाडण्यााच्याा दृष्टीीने रााजकीय पक्षांंsची नोंदणीी व संबंंधि�त बाबींची तरतूूद त्याात करणेे गरजेेचे आणि� आवश्यक असल्यााने,
रााज्य नि�वडणूक आयोगाद्वाारे क्र. एसईसी/एमसी २००९/सी आर-४९/डी.११, दि�नांंsक ३१ मार्चच, २००९ च्याा अधि�सूूचनेेद्वाारे रााजकीय
पक्षांंsची नोंदणीी आदेश, २००९ आणि� महारााष्ट्र नि�वडणूक चि�न्ह (आरक्षण व वाटप) आदेश, २००९ काढण्याात आला आहे ;
आणि� ज्यााअर्थीी, रााजकीय पक्षाच्याा आधााराावर रााज्याातील स्थाानि�क स्वरााज्य संंस्थांंsच्याा घेेतल्याा जाणाऱ्याा सर्वव नि�वडणुुकांंsकरि�ताा
उक्त आदेश लागू असून, केवळ ग्राामपंचाायतींच्याा नि�वडणुुकांंsना जेथेे पक्षवि¦रहि�त
नि�वडणुुका घेेतल्याा जाताात तेथेे हे आदेश लागू नाहीत ;
आणि� ज्यााअर्थीी, रााज्य नि�वडणूक आयोगास उक्त आदेशााप्रमाणे रााजकीय पक्षाची नोंदणीी करण्याापूर्वी महाारााष्ट्र शाासन रााजपत्रात
पक्षाचे नाव आणि� पत्ताा, त्यााचे अध्यक्ष व त्यांंsना जर चि�न्ह देण्याात येणार असेल तर ते चि�न्ह यांंsचा अंतर्भाभाा�व असलेली सूचनाा प्रसि�द्ध करून
सर्ववसाधाारण जनतेकडून अशाा नोंदणीीबाबत हरकती मागवि¦णे आवश्यक आहे ;
आणि� ज्यााअर्थीी, महाारााष्ट्र शाासन रााजपत्रात उपरोक्त प्रमाणे अधि�सूूचनाा प्रसि�द्ध केलेल्याा दि�नांंsकापासून ३० दि�वसांंsच्याा आत
कोणतीीही हरकत प्राप्त न झाल्याास, रााज्य नि�वडणूक आयोग अधि�सूूचनेेत प्रस्ताावि¦त केल्यााप्रमाणे रााजकीय पक्षाची नोंदणीी करण्यााकरि�ताा
सक्षम रााहील ;

आणि� ज्यााअर्थीी, उक्त आदेशााप्रमाणे कोणतीीही हरकत प्राप्त झाली, तर ति�चाा रााज्य नि�वडणूक आयोग वि¦चार करेल व ती क्षुल्लक
आढळल्याास, फेेटाळण्याात येईल व रााजकीय पक्षाची नोंदणीी करण्याात येईल. त्यााचप्रमाणे रााज्य नि�वडणूक आयोगास अशाा हरकतीत
प्रथमदर्शशनी सत्य वाटलेे, तर ती अर्जजदााराास कळवि¦ण्याात येईल आणि� त्याावर त्यााचे अभि�प्रााय मागवि¦ण्याात येतील आणि� अभि�प्रााय प्राप्त
झाल्याावर, आयोग उपलब्ध अभि�लेेखाच्याा आधााराावरीील गुणवत्तेवर नि�र्णय घेेईल किं�ंवा संबंंधि�त पक्षांंsचे म्हणणेे ऐकून त्याानंतर नि�र्णय घेेईल
व रााज्य नि�वडणूक आयोगाचा असा नि�र्णय अंति�म रााहील;
आणि� ज्यााअर्थीी, श्रीी. अनि�ल वि¦नायक सुळााळे, अध्यक्ष, यांंsच्याा प्रस्ताावि¦त ‘मुं�ब्राा कळवाा वि¦कास आघाडी’ पक्षाचा मुख्य
कायाा�लयााचा पत्ताा:- श्रीी. रााजण कि�णे ऑफि�स, मुं�ब्राा पोलीस स्टेेशनच्या जवळ, सम्रााट नगरच्या समोर, मुंं�बई-पुणे रोड, आनंद
कोळीवाडी, मुं�ब्राा ठाणे-४०० ६१२ यांंsनी रााज्य नि�वडणूक आयोगाकडे, ‘मुं�ब्राा कळवाा वि¦कास आघाडी’ अशाा नावाने रााजकीय पक्ष
नोंदणीीसाठीी अर्जज केला आहे ;
आणि� ज्यााअर्थीी, उपरोल्लि�िखि�त पक्ष हा मान्यतााप्राप्त रााष्ट्रीय किं�ंवा मान्यतााप्राप्त रााज्यस्तरीीय पक्ष नसल्यााने, अशाा पक्षासाठीी कोणतेेही
चि�न्ह रााखून ठेवणेे आवश्यक नाही ;
आणि� ज्यााअर्थीी, रााज्याातील स्थाानि�क स्वरााज्य संंस्थांंsच्याा कोणत्यााही नि�वडणुुकांंsत मान्यतााप्राप्त रााजकीय पक्ष यांंsनी उभ्याा केलेल्याा
उमेदवाारााव्यति�रि�क्त उभ्याा रााहि�लेेल्याा कोणत्यााही उमेदवााराास उपरोल्लि�िखि�त आदेशााप्रमाणे रााज्य नि�वडणूक आयोगाव्दाारे मुक्त चि�न्हे म्हणूून
वि¦नि�र्दि�िष्ट केलेल्याा चि�न्हांंsपैकी एका चि�न्हाची नि�वड करताा येईल व त्यााचे वाटप करताा येईल, अशी तरतूूद आहे ;
आणि� ज्यााअर्थीी, मुक्त चि�न्हांंsपैकी एकाच चि�न्हाची नि�वड अनेक उमेदवाारांंsनी केली असेल व अशाा अनेक उमेदवाारांंsपैकी केवळ
एक उमेदवाार नोंदणीीकृत रााजकीय पक्षाव्दाारे उभाा केला असेल आणि� उर्ववरि�त अपक्ष उमेदवाार असल्याास, नि�वडणूक नि�र्णय अधि�काारी ते
मुक्त चि�न्ह त्याा नोंदणीीकृत रााजकीय पक्षाच्याा उमेदवााराास देईल आणि� इतर कोणासही नाही. जर याा अनेक उमेदवाारांंsपैकी दोन किं�ंवा अधि�क
नोंदणीीकृत रााजकीय पक्षांंsचे उमेदवाार असतील आणि� उर्ववरि�त अपक्ष उमेदवाार असल्याास नि�वडणूक नि�र्णय अधि�काारी फक्त नोंदणीीकृत
रााजकीय पक्षाच्याा उमेदवाारांंsच्याा नावाच्याा चि�ठ्ठ्याा टाकेल. ज्याा उमेदवाारााच्याा नावाची चि�ठ्ठीी नि�घेेल, त्याा उमेदवााराास संबंंधि�त मुक्त चि�न्हाचे
वाटप करेल इतर कोणासही नाही ;
आणि� ज्यााअर्थीी, रााज्य नि�वडणूक आयोगाने उपरोक्त पक्षास रााजकीय पक्ष म्हणूून नोंदणीी करण्याापूर्वी सदर नोंदणीीबाबत सर्ववसाधाारण
जनतेकडून हरकती मागवि¦णे आवश्यक आहे.
आताा त्यााअर्थीी, रााज्य नि�वडणूक आयोग, महारााष्ट्र सदर अधि�सूूचनाा महाारााष्ट्र शाासन रााजपत्रात प्रसि�
द्ध झााल्याच्या
दि�नांं�कापासून ३० दि�वसांं�चे आत सदर नोंदणीीबाबत सर्ववसाधाारण जनतेकडून कोणतीही हरकत असल्यास, ती परस्पर
आयोगाच्या कार्या�लयााकडे दााखल कराावी, असे जाहीर करीत आहे.

STATE ELECTION COMMISSION, MAHARASHTRA

NOTIFICATION
No.SEC/RPP-2023/CR-35/D-11.—Whereas, the superintendence, direction and control of
all elections to the Panchayats and Municipalities in the State are vested in the State Election
Commission, Maharashtra by virtue of Article 243-K and 243-ZA of the Constitution of India, and
the provisions of the relevant State law as applicable to such Panchayats and Municipalities;
And Whereas, with a view to provide, in the interest of sanctity of elections to the local bodies,
and in the interest of conduct of such elections, in a free, fair, effective and efficient manner, for the
registration of political parties and for matters connected therewith; the Registration of political
Parties Order, 2009 and Maharashtra Election Symbols (Reservation and Allotment ) Order, 2009
has been made by the State Election Commission, Maharashtra vide the State Election Commission,
Maharashtra, Notification No. SEC/MC-2009/CR-49/D-11, dated 31st March , 2009 ;
And Whereas, the said Order applies to all elections held to local bodies in the State on party
basis except elections to Village Panchayats where elections are held on party less basis;
And Whereas, before registering a political party under this Order, it is necessary to publish
a notice in the Maharashtra Government Gazette indicating therein , the name and address of the
political party, its President and the symbol proposed to be allotted, if any, and calling for objections,
if any, for such registration from the general public ;
And Whereas, as per the said Order, if no objection is received within 30 days from the date of
publication of such notification in the Maharashtra Government Gazette, it shall be competent for
the State Election Commission to register the political party, as proposed in the notification;
And whereas, if any objection is so received, the State Election Commission may consider the
same and in case it is found to be without substance, it may reject the same and register the political
party. If on the other hand, the State Election Commission considers that the objection is prima facie
genuine, then the same shall be communicated to the applicant and his remarks shall be called for.
After receipt of the remarks, the Commission may either decide the matter on merits on the basis
of the records available or it may give personal hearing to the parties concerned and take a decision
thereafter. The decision of the State Election Commission shall be final;
And Whereas, Shri Anil Vinayak Sukale, President of proposed ‘Mumbra Kalwa Vikas
Aaghadi’ having main office address:- Shri Rajan Kine Office, Near Mumbra Police Station
Opp. Samrat Nagar, Mumbra-Pune Road, Anand Koliwada, Mumbra Thane-400612 has
applied to the State Election Commission for registering ‘Mumbra Kalwa Vikas Aaghadi’ as a
political party;
And Whereas, the said party being neither a recognized National Party nor a State Party, it is
not imperative to reserve symbol to it from the list of free symbols;
And Whereas, as per the aforesaid Order a candidate at an election to local bodies in the State,
other than a candidate set-up by a recognized political party shall choose and shall be allotted one
of the symbols specified as free symbols by the State Election Commission ;
And Whereas, as per the said Order if the same free symbol has been chosen by several candidates
at such election, then, if of those several candidates only one is a candidate set-up by registered
political party and all the rest are independent candidates, the returning officer shall allot that free
symbol to the candidate set up by the registered political party and to no one else, and if of those
several candidates two or more candidates are set up by different registered political parties and
the rest are independent candidates, the returning officer shall decide by lot to which of the two or
more candidates set up by the different registered political parties that free symbol shall be allotted
and allot that symbol to the candidate on whom the lot falls and to no one else;

notification in Maharashtra Government Gazette.
