A BILL

to amend the Maharashtra Private Universities (Establishment and

Regulation) Act, 2023.

WHEREAS it is expedient to amend the Maharashtra Private

Universities (Establishment and Regulation) Act, 2023, for the purposes

hereinafter appearing; it is hereby enacted in the Seventy-fifth Year of the

Republic of India, as follows :–

This Act may be called the Maharashtra Private Universities

(Establishment and Regulation) (Amendment) Act, 2024.

In section 6 of the Maharashtra Private Universities (Establishment

and Regulation) Act, 2023 (hereinafter referred to as “the principal Act”), to

sub-section (1), the following proviso shall be inserted, namely :—

“Provided that, the universities specified in Part II of the Schedule

on the date of commencement of this Act shall be deemed to have been

established on that date.”.

In SCHEDULE appended to the principal Act, in Part II, after entry

2, the following entries shall be added, namely :—

STATEMENT OF OBJECTS AND REASONS

The Maharashtra Private Universities (Establishment and Regulation)

Act, 2023 (Mah. VIII of 2024) provides for establishment, incorporation and

regulation of self-financed private universities in the State for development

and advancement of higher education in the State of Maharashtra.

Section 6 of the said Act provides that the Government may after

considering the report submitted by the Verification Committee under sub-

section (4) of section 5, if satisfied that the sponsoring body has complied

with the provisions of section 5, permit the establishment of a private

university, by inclusion of the name, location and headquarters of the private

university and their sponsoring bodies in Part II of the Schedule, by amending

the Schedule by enacting a law by the State Legislature.

The Government, after considering the report submitted by the

Verification Committee under sub-section (4) of section 5, is satisfied that

the sponsoring bodies Sanjivani Rural Education Society, Kopargaon, Taluka

Kopargaon, District Ahmednagar 423 601 and Dr. D. Y. Patil Unitech Society,

Flat No. 101, Shri. Motisagar Apartment, Survey No. 473A, G. G. Thakkar

Road, Pune 411 001, have complied with the provisions of section 5 for

establishment of private universities by the names of “Sanjivani University,

Kopargaon” and “Dr. D. Y. Patil Dnyan Prasad University, Pune”,

respectively.

Therefore, the Government of Maharashtra considers it expedient

to amend Part II of the Schedule appended to the Maharashtra Private

Universities (Establishment and Regulation) Act, 2023, to permit

establishment of the said proposed private universities and to include therein

the names, locations and headquarters of the Sanjivani University,

Kopargaon and Dr. D. Y. Patil Dnyan Prasad University, Pune and their

sponsoring bodies, by enacting a law.

The Bill seeks to achieve the above objectives.
