क्रमांं�क ठाामपाा/शवि�वि�/क्लस्टरसेेल/अधिि˜सूचनाा/४४०.— ज्यााअर्थीी, ठााणेे शहरााची सुधारि�त वि�काास योजना शासनााने महााराष्ट्र

प्राादेशि�क नि�योोजन व नगररचनाा अधिि˜नि�यम, १९६६ चे कलम ३१ (१) नुसार (याापुढेे यााचा उल्लेख “उक्त अधिि˜नि�यम” असा केला

आहे.) शासन नि�र्णय क्र.टि�पीीएस-१२९७/१३१९/सीआर-१४८/९७/नवि�-१२, दि�नांं�क ४ ऑक्टोबर, १९९९ अन्वये मंजूर केली असून, ती

दि�नांं�क २२ नोव्हेंबर १९९९ पाासून अंमलात आहे. तसेेच सुधारि�त वि�काास योजनेतील वगळलेल्याा क्षेेत्रााची (Excluded portion)

वि�काास योजना शासन नि�र्णय क्र. टि�पीीएस-१२०१/२७४/सीआर-२८/२००१/नवि�-१२, दि�नांं�क ३ एप्रि�ल, २००३ अन्वये शासनााने उक्त

अधिि˜नि�यमाानुसार मंजूर केली असून ती दि�नांं�क १४ मे, २००३ पाासून अंमलात आहे. (याापुढेे “उक्त मंजूर वि�काास योजना” असा उल्लेख

केला आहे.) ;

आणि� ज्यााअर्थीी, ठााणेे महाानगरपाालि£काा प्राारूप वि�काास नि�यंंत्रण नि�यमाावलीत कााही बदल करून शासनााने नि�र्णय क्र.टि�पीीएस

१२९४/१२५९/सीआर-२२२/९४/नवि�-१२, दि�नांं�क २८ एप्रि�ल १९९५ अन्वये उक्त अधिि˜नि�यमााचे कलम ३१(१) अन्वये वि�काास

नि�यंंत्रण नि�यमाावली मंजूर केली होती व सदर नि�यमाावली दि�नांं�क १ जून १९९५ पाासून अंमलात आली आहे ;

आणि� ज्यााअर्थीी, शासन नि�र्णय क्र. टि�पीीएस १८१८/प्र.क्र. २३६/१८/कलम ३७ (१क क) (ग) व कलम २०(४)/नवि�-१३,

दि�नांं�क ०२ डि�सेंंबर २०२० अन्वये शासनााने एकत्रि�कृृत वि�काास नि�यंंत्रण व प्रोत्साहन नि�यमाावली, मंजूर केली आहे आणि� उक्त वि�काास

नि�यंंत्रण नि�यमाावली दि�नांं�क ०३ डि�सेंंबर २०२० पाासून अंमलात आली असून सदर नि�यमाावली ठााणेे महाानगरपाालि£केस लागू आहे.

(याापुढेे “उक्त नि�यमाावली” असा उल्लेख केला आहे) ;

आणि� ज्यााअर्थीी, उक्त नि�यमाावलीतील वि�नि�यम क्र. १४.८.१.(ii) (c) च्याा तरतुदीनुसार जर एखाद्याा योजनेची हद्द मंजूर वि�काास

योजनेवर दर्शवि�लेली नस्ते आणि� अश्याा योजनेचा आराखडा तयाार व्हाायचाा आहे. तर उक्त तरतुदीनुसार खाजगी प्रवर्ततकााकडूून अशी

योजना सादर करू शकताात ;

आणि� ज्यााअर्थीी, उक्त नि�यमाावलीतील वि�नि�यम क्र. १४.८.१.(i) च्याा तरतुदीनुसार नागरी पुनरुत्थाान योजनेच्याा हद्दी प्रस्तावि�त /

सुधारि�त करतेवेळी नव्यााने अंतर्भू�त कराावयााचे क्षेेत्र भौति�क हद्दींनी सि�मीीत नसल्याास अशा जागा उच्चाधिि˜काार समि�तीीच्याा सल्लामसलतीीने

महाापाालि£काा आयुक्त आराखडयााच्याा अधिि˜सूचि�त हद्दीमध्ये अंतर्भू�त करु शकताात ;

आणि� ज्यााअर्थीी, उक्त नि�यमाावलीतील वि�नि�यम क्र. १४.८.१.(i) च्याा तरतुदीनुसार एखाद्याा योजना क्षेेत्राात रस्ते, नाले, नदी,

रेल्वे मार्गा�ने झाालेल्याा उपवि�भाागणीमुळे नागरी पुनरुत्थाान योजनेचे क्षेेत्र कमीी झााल्याास महाापाालि£काा आयुक्त उच्चाधिि˜काार समि�तीीच्याा

सल्लामसलतीीने कि�माान ८०००.० चौ. मी. पर्यंतच्याा क्षेेत्राावर योजना मंजूर करू शकताा ;

आणि� ज्यााअर्थीी, मौजे माजि�वडा येथीथीील सर्वे क्र. १७४/१, १७६/४ आणि� १७६/२/ब येथीथीील जवाहर नगर व आंनद बाजारच्याा

वसाहतीीचे क्षेेत्र नागरी पुनरुत्थाान योजनेमध्ये समाावि�ष्ट करून सदर आराखडयााची हद्द अधिि˜सूचि�त करण्याास दि�नांं�क ६ मार्च २०२४ रोजीच्याा

बैठकीीत उच्चाधिि˜काार समि�तीीने शि�फाारस केली आहे.

आता त्यााअर्थीी, उक्त नि�यमाावलीतील वि�नि�यम क्र. १४.८.११ (i) नुसार मला प्रदाान अधिि˜काारान्वये, ठााणेे शहरााच्याा हद्दीतील मौजे

माजि�वडा येथीथीील सर्वे क्र.१७४/१, १७६/४ आणि� १७६/२/ब येथीथीील जवाहर नगर व आंनद बाजारच्याा वसाहतीीचे क्षेेत्र नागरी पुनरुत्थाान

योजनेमध्ये समाावि�ष्ट करून त्यााची हद्द नागरी पुनरुत्थाान आराखडाा क्र. ४६ जवाहर नगर (क्षेेत्र १.३६ हे.) म्हणूून घोोषिि¨त करून

अधिि˜सूचनेेद्वाारे नव्यााने अधिि˜सूचि�त करीीत आहे.

सदर अधिि˜सुचि�त आराखड्यााची सुधारि�त हद्द दर्शवि�णारा नकााशा जनतेच्याा अवलोकनाार्थथ खालील ठि�कााणी, पुढील तीस दि�वसांं�करि�ता

ठेवण्याात येत आहे.

(१)  उपसंंचालक नगररचनाा, क्लस्टर सेेल, ठााणेे महाानगरपाालि£काा, ठााणेे यांं�चे काायाा�लय, चौथाा मजला, धर्ममवीर आनंद दि�घेे

प्रशाासकीीय इमारत, कशि�श पाार्क, ठााणेे.

(२)  शहर वि�काास वि�भााग, चौथाा मजला, ठााणेे महाानगरपाालि£काा, ठााणेे.

(३)  वर्ततकनगर प्रभााग समि�तीी काायाा�लय.

NOTIFICATION

Maharashtra Regional and Town Planning Act 1966.

No. TMC/TDO/Cluster Cell/Notification/440.— Whereas, the Revised Development Plan of

the Thane City has been sanctioned by the Government under section 31(1) of the Maharashtra

Regional and Town Planning Act 1966, (hereinafter referred to as “the said Act”) vide Notification

No.TPS-1297/1319/CR-148/97/UD-12, dated 4th October 1999, which has come into force with effect

from 22nd November 1999, and the Excluded Part (EP) of the said Development Plan has been

sanctioned under the said Act vide Government Notification No.TPS/1201/274/CR-28/2001/UD-12,

dated 3rd April 2003 which has come into force with effect from the 14th May 2003; (hereinafter

referred to as “the said sanctioned Development Plan”) ;

And whereas, the Development Control Regulations of Thane Municipal Corporation has been

sanctioned by the Government after making some modifications in draft Development Control

Regulations of Thane City vide Urban Development Department, vide Notification No. TPS 1294/1259/

CR-222/94/UD-12, date 28th April 1995 under section 31(1) of the said act which had come into force

with effect from the 1st June 1995 ;

And whereas, the Government has sanctioned Unified Development Control and Promotion

Regulations vide resolution no.TPS-1818/CR236/18/DPand RP/sec.37 (1AA) (c) & sec. 20(4)/UD-13,

dated 02 December 2020 (hereinafter referred to as “the said Regulations”) and the said Regulations

came into force from dated 3rd December 2020 and are applicable to Thane Municipal Corporation ;

And whereas, as mentioned in the Regulation No.14.8.1 (ii) (c) of the said Regulations, that

Promoter may prepare the Urban Renewal Scheme over a cluster or clusters of buildings, where

such clusters are not shown on the D.P. and the URP is yet to be prepared ;

And whereas, as mentioned in the Regulation No.14.8.1 (i) specific cases, in which URS is not

bounded by roads, Nallahs and railway lines etc. then the boundaries of such cluster area can be

decided/ finalised the by Municipal Commissioner, in consultation with High Power Committee

(H.P.C.) ;

And whereas, as mentioned in the Regulation No.14.8.1 (i) specific cases, in which URS is not

bounded by roads, Nallahs and railway lines, area of the cluster can be allowed up to an area of 8000

Sq.m. in noncongested area which shall be allowed by Municipal Commissioner in consultation with

H.P.C.;

And whereas, High Power Committee has recommended to notify the Jawahar Nagar & Anand

Bajar as new Cluster at Sr. No. 174/1, 176/4, 176/2/B, village Majiwada in High Power Committee

meeting on date 6th March 2024.

Now therefore, as per powers conferred to me vide Regulation No.14.8.11(i) of the said

Regulations, the boundary of Jawahar Nagar & Anand Bajar as new Cluster at Sr. No. 174/1, 176/4,

176/2/B, village Majiwada are hereby declared & notified as Urban Renewal Plan No. 46 Jawahar

Nagar (Area – 1.36 Ha.)

The plans showing boundaries of revised Urban Renewal Plan area is kept for inspection by

general public at following places for next thirty days.
