क्रमांं�क एडीीआर-२०१४/प्र.क्र. १३६/तांं�शिि§-६.—भाारतााच्या संंविि¦धाानााच्या अनुच्छेेद ३०९ च्या परंतुकााद्वाारे प्रदाान केलेल्या

अधि�काारांं�चाा वापर करून आणिि” याबाबतीत कााढलेले विि¦द्यमान सर्वव नि�यम, आदेश किं�ंवा संंलेख यां�चेे अधि�क्रमण करून, महााराष्ट्रााचे

राज्यपाल, याद्वाारे, महााराष्ट्र शासनााच्या उच्च व तंत्र शिि§क्षण विि¦भाागाच्या प्रशासकीीय नि�यंंत्रणााखालील कलाा संंचाालनाालयातील कलाा

संंचाालक, गट-अ, महााराष्ट्र कलाा शिि§क्षण सेवा या पदााच्या सेवाप्रवेशाचे विि¦नि�यमन करणारे पुढील नि�यम करीीत आहेत :—

१. या नि�यमांं�स, कलाा संंचाालनाालयामधीील, कलाा संंचाालक, गट-अ, महााराष्ट्र कलाा शिि§क्षण सेवा (सेवाप्रवेश) नि�यम, २०२३

असे म्हणाावे.

२. या नि�यमांं�त, संंदर्भाभाा�नुुसार दुसराा अर्थथ आवश्यक नसेेल तर,—

(क) “आयोग” याचाा अर्थथ, महााराष्ट्र लोकसेेवा आयोग, असा आहे;

(ख) “संंचाालनाालय” याचाा अर्थथ, शासनााच्या उच्च व तंत्र शिि§क्षण विि¦भाागाच्या प्रशासकीीय नि�यंंत्रणााखालील कलाा

संंचाालनाालय, महााराष्ट्र राज्य, मुं�बई, असा आहे;

(ग) “पदोन्नतीीची पात्रताा” याचाा अर्थथ, शासनााच्या सामान्य प्रशासन विि¦भाागाने वेळोोवेळी केलेले नि�यम, कााढलेले शासन

नि�र्णणय किं�ंवा आदेश यांं�मध्ये पदोन्नतीीसाठीी विि¦नि�र्दि�िष्ट केलेल्या अटी व शर्तींनुसार असलेेली पदोन्नतीीची पात्रताा, असा आहे;

(घ) “ललि�त कलाा” याचाा अर्थथ, ललि�त कलाा, असा आहे आणिि” त्यात, दृक कलाा, रेखा व रंगकलाा, उपयोजि�त कलाा,

शिि§ल्पकलाा, अंतर्गगत सजाावट, वस्त्रकला

ा, मातकााम, धाातुकााम यांं�चाा समाावेश होतो;

(ङ) “शासन” याचाा अर्थथ, महााराष्ट्र शासन, असा आहे;

(छ) “ दृक कलाा ” याचाा अर्थथ, दृक कलाा, असा आहे आणिि” त्यात, रेखा व रंगकलाा, उपयोजि�त कलाा, शिि§ल्पकलाा,

मातकााम, धाातूकााम, अंतर्गगत सजाावट व वस्त्रकला

ा, यांं�चाा देखील समाावेश होतो.

संंचाालनाालयातील कलाा संंचाालक, गट-अ, महााराष्ट्र कलाा शिि§क्षण सेवा, या पदाावरील नि�युुक्ती, जे उमेदवाार, पुढील

नि�कषांं�चीी पूर्तताा करताात अशा, त्यासाठीी घेतलेेल्या स्पधाा�त्मक परीक्षेच्या नि�काालाच्या आधाारे आयोगाने शिि§फाारस केलेल्या उमेदवाारां�मधू

ून

नाामनि�र्देेशनााद्वाारे करण्यात येईल :—

(एक) वयोमर्या�दाा—

(क) कि�माान वयोमर्या�दाा.- त्या पदााच्या भरतीच्या जाहि�राातीनुसार, अर्जज स्वीकृतीच्या अंति�म दि�नांं�काास अठराा वर्षांंɕपेक्षा

कमीी वय नसले

ेले.

(ख) कमााल वयोमर्या�दाा.- त्या पदााच्या भरतीच्या जाहि�राातीनुसार, अर्जज स्वीकृतीच्या अंति�म दि�नांं�काास राखीव

प्रवर्गा�तीील नसले

ेल्या व्यक्तींसाठीी पंचेचााळीस वर्षांंɕपेक्षा अधि�क वय नसले

परंतु, आधीच शासकीीय सेवेत असलेेल्या व्यक्तींच्या बाबतीत कमााल वयोमर्या�दाा पाच वर्षांंɕपर्यंंत शिि§थि�ल करण्यात येईल :

परंतु आणखी असे की, पाच वर्षांंɕची शिि§थि�लताा, राखीव प्रवर्गा�तीील शासकीीय कर्ममचााऱ्यास, एकतर शासकीीय कर्ममचाारी

म्हणूून किं�ंवा राखीव प्रवर्गा�तीील म्हणूून उपलब्ध असेल.

(दोन) कि�मान शैक्षणि�क अर्हताा —

(क) भाारताातील कोणत्याही विि¦द्यापीठाने किं�ंवा इतर कोणत्याही देशातील विि¦द्यापीठाने यथोोचि�त मान्यताा दि�लेेल्या

ललि�त कलेेमधीील किं�ंवा दृक् कलेेच्या कोणत्याही शाखेमधीील प्रथम वर्गा�तीील किं�ंवा जेथेे, श्रेेयांं�क प्रणाली अनुसरली जाते

तेथीील, गुणांं�काातील (Point Scale) समतुुल्य श्रेेणीतील पदव्युत्तर-पदवीी :

परंतु, जर आयोगाने घेतलेेल्या स्पधाा�त्मक परीक्षेत समसमा

ान गुण मि�ळााल्यास, उच्च शैक्षणिि”क अर्हहताा धाारण करणाऱ्या

उमेदवाारास प्राधाान्य देण्यात येईल.

स्पष्टीीकरण.- जेव्हा संंबंधि�त शैक्षणिि”क अर्हतेेच्या प्रमाणपत्राात उत्तीर्णण झााल्याचाा वर्गग नमूूद केलेला नसेेल आणिि” त्या

प्रकरणात श्रेेयांं�क प्रणाली अनुसरली जात असेल त्याबाबतीत गुणांं�काातील (Point Scale) समतूूल्य श्रेेणी किं�ंवा अखि�ल

भाारतीय तंत्रशिि§क्षण परि�षदेेने (एआयसीटीई) विि¦हि�त केल्यानुसार सराासरीी वाढीव श्रेेणी गुण (सीजीपीए) विि¦चाारात घेण्यात येईल.

(तीन) अनुभव.—

(क) उमेदवााराकडेे, शासन मान्य कलाा संंस्थेेतील दहाा वर्षांंɕपेक्षा कमीी नसेेल इतकाा अध्यापनााचाा अनुभव किं�ंवा शासन

मान्य कलाा संंस्थेेतील प्रशासकीीय काामाचाा दहाा वर्षांंɕपेक्षा कमीी नसेेल इतकाा अनुभव किं�ंवा अध्यापन व प्रशासकीीय काामातील

एकत्रि�तपणे दहाा वर्षांंɕपेक्षा कमीी नसेेल इतकाा अनुभव असावा:

परंतु, विि¦हि�त केलेल्या अनुभवााची गणनाा करण्याच्या प्रयोजनाार्थथ, व्यक्तीने, विि¦हि�त केलेली कि�माान शैक्षणिि”क अर्हहताा

संंपादन केल्यानंंतर मि�ळविि¦लेला अनुभवच

केवळ विि¦चाारात घेण्यात येईल.

(ख) शासन मान्य कलाा संंस्थेेच्या प्रमुखाने दि�लेेले अनुभव प्रमाणपत्रच केवळ स्वीकाारण्यात येईल.

४. नि�यम ३ मध्ये नमूूद केलेल्या पदाावर नाामनि�र्देेशनााद्वाारे नि�युुक्त केलेली व्यक्ती, दोन वर्षांंɕच्या काालावधीीसाठीी

परि�वीक्षाधीन असेल. परि�वीक्षा काालावधीी जास्तीतजाास्त एक वर्षांंɕपर्यंंत वाढविि¦ताा येईल. शासनााच्या परि�वीक्षा धोरणानुसार,

परि�वीक्षा काालावधीी (वाढविि¦लेल्या काालावधीीसह) समााधाानकाारकपणे पूर्णण करणे आवश्यक असेल. शासनााच्या परि�वीक्षा

धोरणानुसार परि�वीक्षा काालावधीी, (वाढविि¦लेल्या काालावधीीसह) समााधाानकाारकपणे पूर्णण करण्यात नि�ष्फळ ठरल्यास, त्याची

सेवा समााप्त केली जाण्यास पात्र असेल.

५. नि�यम ३ मध्ये नमूूद केलेल्या पदाावर नाामनि�र्देेशनााद्वाारे नि�युुक्त केलेली व्यक्ती, अगोदरच हिं�ंदी भााषाा व मरााठीी भााषाा परीक्षा

उत्तीर्णण नसेेल किं�ंवा त्या परीक्षा उत्तीर्णण होण्यापासून ति�लाा सूट देण्यात आलेली नसेेल तर, ती, त्याबाबतीत शासनााने वेळोोवेळी केलेल्या

नि�यमांं�नुसार, नि�युुक्तीनंंतर विि¦हि�त काालमर्या�देेत हिं�ंदी व मरााठीी भााषाा परीक्षा उत्तीर्णण करीील. ती व्यक्ती, या परीक्षा उत्तीर्णण होईपर्यंंत, वार्षि�िक

वेतन वाढीसाठीी पात्र असणाार नााही.

६. नि�यम ३ मध्ये नमूूद पदाावर नाामनि�र्देेशनााद्वाारे नि�युुक्त केलेली व्यक्ती, ती अगोदरच संंगणक हातााळणीी प्रमाणपत्र धाारण करीीत

नसेेल किं�ंवा ते धाारण करण्यापासून ति�लाा सूट देण्यात आली नसेेल तर, ती, याबाबतीत शासनााने वेळोोवेळी विि¦हि�त केलेले असे संंगणक

हातााळणीी प्रमाणपत्र, नि�युुक्तीनंंतर विि¦हि�त काालमर्या�देेत धाारण करीील, अन्यथाा, ती व्यक्ती, ते प्रमाणपत्र धाारण करीीपर्यंंत, वार्षि�िक वेतन

वाढीसाठीी किं�ंवा पुढील पदोन्नतीीच्या पदाावरील पदोन्नतीीसाठीी पात्र असणाार नााही.

७. (१) नि�यम ३ मध्ये नमूूद केलेल्या पदाावर नाामनि�र्देेशनााद्वाारे नि�युुक्तीसाठीी शिि§फाारस केलेली व्यक्ती, महााराष्ट्र नाागरी सेवा

(लहान कुटुंȾबाचे प्रति�ज्ञाापन) नि�यम, २००५ याच्या तरतुदींनुसार आणिि” याबाबत शासनााने वेळोोवेळी केलेले अन्य कोणतेेही नि�यम, कााढलेले

आदेश किं�ंवा कोणतेेही संंलेख यां�नुुसार, लहान कुटुंȾबाचे प्रति�ज्ञाापन सादर करीील.

(२) लहान कुटुंȾबाचे प्रति�ज्ञाापन सादर करण्याच्या दि�नांं�कााला दोनपेेक्षा अधि�क अपत्ये असणाारी व्यक्ती, शासकीीय सेवेतील

नि�युुक्तीसाठीी अपात्र असेल.

(३) एखाद्या व्यक्तीची शासकीीय सेवेत नि�युुक्ती झााल्यानंंतर, जर ति�लाा नि�युुक्तीच्या वेळी किं�ंवा त्यानंंतर दोनपेेक्षा अधि�क

अपत्ये असल्याचे सि�द्ध झााले तर, ती व्यक्ती, शासकीीय सेवेतील उक्त पदाावर काायम राहण्यासाठीी अपात्र असेल.

८. कोोणत्याही शासकीीय कर्ममचााऱ्याच्या नि�युुक्तीनंंतर, शासनााने वेळोोवेळी केलेले कोणतेेही नि�यम, कााढलेले आदेश किं�ंवा नि�र्णणय

यांं�मध्ये शासनााने विि¦नि�र्दि�िष्ट केलेल्या अटी व शर्ती देखील अशा शासकीीय कर्ममचााऱ्यास लागू असतीील.

NOTIFICATION

Constitution of India.

No. ADR-2014/C.R.No-136/TE-6.—In exercise of the powers conferred by the proviso to article 309

of the Constitution of India and in supersession of all the existing rules, orders or instruments made

in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating

recruitment to the post of Director of Art, Group-A in the Directorate of Art, in the Maharashtra Art

Education Service, under administrative control of the Higher and Technical Education Department

of the Government of Maharashtra, namely :—

1. These rules may be called the Director of Art, Group-A, in the Directorate of Art, in the

Maharashtra Art Education Service (Recruitment) Rules, 2023.

2. In these rules, unless the context requires otherwise,—

(a) “Commission” means the Maharashtra Public Service Commission;

(b) “Directorate” means the Directorate of Art, Maharashtra State, Mumbai under the

administrative control of the Higher and Technical Education Department of the Government;

terms and conditions specified for promotion in rules, resolutions or orders issued by the General

Administration Department of the Government, from time to time ;

(d) “Fine Art” means a Fine Art and also includes Visual Art, Drawing and Painting,

Applied Art Sculpture, Interior Decoration, Textile Design, Pottery, Metal work;

(e) “Government” means the Government of Maharashtra;

(f) “Government recognized Art institution” means a Government Art institution or a

Non-Government aided Art institution or an unaided Art institution or a permanent unaided

Art institution;

(g) “Visual Art” means a Visual Art and also includes Drawing and Painting, Applied Art,

Sculpture, Pottery, Metal work, Interior Decoration and Textile Design.

3. Appointment to the post of the Director of Art, Group-A, in the Directorate, in the

Maharashtra Art Education Service, shall be made by nomination from amongst the candidates

recommended by the Commission on the basis of result of the Competitive Examination conducted

therefor, who fulfills the following criteria, namely :—

(i) Age Limit—

(A) Lower Age Limit—Not less than eighteen years of age as on the last date of receipt

of application as per the advertisement for recruitment to the post.

(B) Upper Age Limit—Not more than fourty-five years of age for the persons not

belonging to reserved categories and not more than fifty years of age for the persons

belonging to reserved categories as on the last date of receipt of application as per the

advertisement for recruitment to the post :

Provided that, the maximum age limit shall be relaxed upto five years in case of person

already in the Government Service :

Provided also that, relaxation of five years shall be available to the reserved category

Government employee either for being Government employee or for belonging to the reserved

category.

(ii) Minimum Educational Qualification—

(A) A Master’s Degree, in first class or an equivalent grade in a point scale wherever

grading system is followed, in Fine Art or any branch of Visual Art duly recognized by any

University in India or University in any other country :

Provided that, in case of equal marks in the competitive examination conducted by the

Commission, preference shall be given to the candidate possessing the higher educational

qualification.

Explanation.—Wherever class of passing is not mentioned in the certificate of the

concerned educational qualification and the grading system is followed in that case the

equivalent grade in to point scale or the Cumulative Grade Point Average (CGPA) as

prescribed by the All India Council of Technical Education (AICTE) shall be considered.

(iii) Experience—

(A) The candidate shall have not less than ten years’ teaching experience in

a Government recognized Art institution or not less than ten years’ experience in

administrative work in a Government recognized Art institution or not less than ten years’

combined experience in teaching and administrative work :

Provided that, for the purpose of calculating the prescribed experience, the experience

gained only after acquiring the prescribed minimum educational qualification by the person,

shall be considered.

(B) The experience certificate issued by the Head of a Government recognized art

institution shall only be accepted.

4. A person appointed by nomination to the post mentioned in rule 3 shall be on probation

for a period of two years. Probation period may be extended maximum up to one year. Completion

of the probation period (including extended period) satisfactorily as per the probation policy of the

Government. In the event of failing to complete the probation period (including extended period)

satisfactorily as per the probation policy of the Government during the probation period, his services

shall liable to be terminated.

5. A person appointed to the post mentioned in rule 3 by nomination shall pass the Marathi

and Hindi languages examinations as per the rules made in that behalf by the Government, from

time to time, within the prescribed time limit after appointment, unless he has already passed or

has been exempted from passing those examinations. He shall not be eligible for annual increment

until he passes those examinations.

6. A person appointed to the post mentioned in rule 3 by nomination shall possess a Certificate

of Computer Operations prescribed by the Government, from time to time, within the prescribed

time limit after appointment, unless he already possesses or has been exempted from possessing

such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or

promotion to the next promotional post until he possess the same.

7. (1) A person recommended for appointment by nomination to the post mentioned in rule 3

shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services

(Declaration of Small Family) Rules, 2005 or any other rules, orders or any instruments issued in

this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of

Small Family shall be disqualified for the appointment in Government Service.

(3) After appointment of a person in the Government service, if it is proved that he has

more than two children at the time of appointment or thereafter, then he shall be disqualified

for continuing on the said post in Government service.

8. The terms and conditions specified by the Government, subsequent to the appointment of

any Government Servant, in any rules, orders or resolutions issued by the Government, from time

to time, shall also be applicable to the Government Servant.
