आत, कोणāयाही ďयòतीकडȴन सूचना/आȦेप मागिवĀयाकȫरता सूचना Ōकािशत कɁली जाईल आिण सुनावणी िदčयानंतर, ŌĒतािवत बदल

राùय शासनाला सादर करĀयात येईल. सदर बदल मंजूर करणे िकȽवा मंजुरी देĀयास नकार देणे हे राùय सरकार÷या अिधकारास अधीन राहील.

ùयाअथȯ, बृहąमुंबई महानगरपािलकɁचे पȫरपŇक ĸ. बीएमसी/एडीएमएन/ ३, िदनांक ७ एिŌल २०२२ नुसार अǐावत सुधाȫरत

मुंबई महानगरपािलका अिधिनयम, १८८८ ÷या कलम ६क (१) अąवये महानगरपािलका आिण महानगरपािलकɁ÷या इतर Ōािधकरणांचे

सवɑ अिधकार आता Ōशासकांकडɂ िनिहत आहेत.

āयाअथȯ, Ōशासक ( सुधार सिमित) यांचा ठराव ĸ. ६८, िदनांक २० जानेवारी २०२४ व Ōशासक (महानगरपािलका) यांचा

ठराव ĸ. १२०२ िदनांक ६ फɁŎुवारी २०२४ ÷या आदेशाąवये एफ/दिȦण िवभागातील दादर-नायगाव िडȬďहजन येथील भू.ĸ. १५/२२३

वरील महाराđł Ōादेिशक व नगररचना अिधिनयम, १९६६ ÷या कलम ३७ (१) मधील तरतुदीनुसार मंजूर िवकास आराखडा, २०३४ मĄये

फɁरबदल करĀया÷या ŌĒतावाची कायɑवाही सुȠ करणे, िविहत कालावधीमĄये सूचना/हरकती मागवणे व ŌाĆत सूचना/हरकतȮवर सुनावणी

देणे आिण महाराđł Ōादेिशक व नगररचना अिधिनयम, १९६६ ÷या कलम ३७ (२) नुसार फɁरबदल ŌĒतावास महाराđł शासनाची अंितम

मंजुरी घेणेकȫरता महाराđł शासना÷या नगर िवकास िवभागाशी पŇďयवहार करणेकȫरता मंजुरी िदली आहे.

आहे) चे कलम ३१, पोट कलम (१) अąवये ŌाĆत अिधकारांचा वापर कȠन राùय शासनाने अिधसूचना ĸ. टीपीबी-४३१७/६२९/

Ō.ĸ.११८/२०१७/िव.यो./निव-११, िदनांक ८ मे २०१८ (यापुढɂ “उòत अिधसूचना” असा उčलेख करĀयात आलेला आहे) Ǒारे

बृहąमुंबई ŌाȠप िवकास योजना-२०३४ ( यापुढɂ “उòत योजना” असा उčलेख करĀयात आलेला आहे) सह िवकास िनयंŇण व Ōोāसाहक

िनयमावली-२०३४ ला मंजुरी िदली आहे.

ùयाअथȯ, मंजूर िवकास आराखडा-२०३४ नुसार एफ/दिȦण िवभागातील दादर-नायगाव िडȬďहजन येथील न.भू.ĸ. १५/२२३ हा

भूभाग ‘मनोरंजन मैदान’ (EOS2.6) या िवǐमान सुिवधेणे बािधत आहे.

ùयाअथȯ, मा. आमदार, Ŗी. कालीदास कोळȾबकर यांनी ŌĒतािवčयानुसार उपरोčलेिखत िवǐमान ‘मनोरंजन मैदानात’ िजčहा

िनयोजन िवभागामाफɒत āयांना ŌाĆत होणाķया िनधीतून ऑिलंिपक दजाɑ÷या जलतरण तलाव बांधĀयासाठी आवĐयक असलेčया भूभागाचे

आवĐयक असलेčया आरȦणात पȫरवतȯत कȠन िमळĀयाकȫरता बृहąमुंबई महानगरपािलकɁकडɂ िवनंती कɁली आहे.

ùयाअथȯ, एफ/दिȦण िवभागातील दादर नायगाव िडȬďहजन येथील न.भू.ĸ. १५/२२३ धारण करणाķया, ‘मनोरंजन मैदान’(EOS2.6)

ही िवǐमान सुिवधा दशɑिवलेčया एकȳण ३२८२९.०२ चौ.मी. ȦेŇफळा÷या भूखंडापैकी िदनांक १६ जानेवारी २०२४ चा नकाशा ĸ. Ō.अ./

िव.िन./१९५३४/शहर ǡावर िनĎया रंगा÷या रेषेने सीमांिकत कȠन आिण A-B-C-D-E-F-G-A ǡा इंĺजी आǐाȦरांनी दशɑिवčयानुसार,

६५००.०० चौ. मी. इतòया ȦेŇफळा÷या भूखंडावरील ‘मनोरंजन मैदान’ (EOS2.6) ही िवǐमान सुिवधा रǋ कȠन, सदर भूभागावर

ŌĒतािवत जलतरण तलाव हा अनुȧेय वापर असलेčया ‘महानगरपािलका िĸडासंकȱल’ (ROS2.4) या कȫरता आरिȦत करĀयाबाबत,

िवकास योजनेमĄये फɁरबǋल करĀयासाठी बृहąमुंबई महानगरपािलकɁने महाराđł Ōादेिशक व नगररचना अिधिनयम, १९६६ चे कलम ३७

(१) अąवये फɁरबदलाची वैधािनक कायɑवाही कȠन, तसा फɁरबदलाचा ŌĒताव शासनास अंितम मंजूरीसाठी सादर करावा असे ŌĒतािवत

आहे. सदर भूभागाचा तपशील खालील पȫरिशđटामĄये दशɑिवलेला आहे;

आिण āयाअथȯ, उपरोòत पȫरȬĒथती व वĒतुȬĒथती िवचारात घेता आिण उòत अिधिनयमा÷या कलम ३७ (१) ŌाĆत अिधकार आिण

āया संदभाɑतील सवɑ शòतȮचा वापर कȠन, बृहąमुंबई महानगरपािलकɁǑारे ŌĒतािवत फɁरबदलािवषयी उòत अिधिनयमा÷या कलम ३७ (१)

नुसार कोणāयाही ďयòतीकडȴन हरकती/सूचना मागवĀयासाठी तसेच संभाďय बािधत होणाķया ďयòतȮ÷या मिहतीसाठी सदर सूचना Ōिसǌ

करीत आहे. बृहąमुंबई महानगरपािलकɁकडȴन असेही कळिवĀयात येत आहे की, खालील पȫरिशđटात नमूद ŌĒतािवत फɁरबदलािवषयी

कोणāयाही हरकती/सूचना, सदर सूचना Ōिसǌ झाčया÷या िदनांकापासून एक मिहąया÷या आत लेखी Ēवȟपात Ōमुख अिभयंता

(िवकास िनयोजन), बृहąमुंबई महानगरपािलका यांचेकडɂ महानगरपािलका मुóयालय, ५ वा मजला, िवĒतारीत इमारत, महापािलका मागɑ,

फोटɓ, मुंबई ४०० ००१ या कायाɑलया÷या पāयावर पाठिवĀयात याďयात. सदर÷या कलावधीत ŌाĆत होणाķया हरकती/सूचना यावर उòत

अिधिनयमा÷या कलम ३७ (१) अąवये कायɑवाही करĀयात येईल;

BRIHAN MUMBAI MUNICIPAL CORPORATION

NOTIFICATION

No. Ch.E/D.P./27775/city, dated 7th March 2024

Whereas, in exercise of the powers conferred by sub-section (1) and (2) of Section 37 of the

Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as ‘MR & TP Act, 1966’),

the Planning Authority may, or when so directed by the State Government shall within one month

from date of such directions publish a notice inviting suggestions/objections from any person, as

mentioned therein and after giving hearing, submit the proposed modification to the State Government

and the State Government subject to such condition as it may deem fit sanction the modification or

refuse to accord sanction.

And whereas, as per circular u/no. BMC/ADMN/3, dated 7th April 2022, under section 6C (1) of

Mumbai Municipal Corporation Act, 1888 (hereinafter referred as ‘MMC Act, 1888’) all the powers

of the Corporation are now vested with the Administrator.

And whereas, Administrator (Improvement Committee) vide resolution No. 68 dated 20th

January 2024 & Administrator (Corporation) vide resolution No. 1202 dated 6th February 2024 have

accorded, sanction to the proposal to take further action to modify the plot bearing CS No. 15/223 of

Dadar-Naigaon Division in Sanctioned DP 2034 to invite suggestions/ objections from general public

u/s. 37(1) of MRTP Act, 1966 and approach State Govt. in Urban Development Dept for final sanction

u/s. 37(2) of MRTP Act, 1966 for modification in Sanctioned DP 2034.

And whereas, as per the powers conferred by sub-section (1) of Section 31 of the MR & TP Act,

1966, State Government has accorded sanction to the Draft Development Plan-2034 of Greater

Mumbai (hereinafter referred to as “the said Development Plan”) vide Notification No. TPB- 4317/629/

CR-118/2017/DP/UD-11, dated 8th May 2018 (hereinafter referred to as "the said Notification") along

with the Development Control and Promotion Regulations-2034 for Greater Mumbai.

And whereas, the plot bearing CS No 15/223 of Dadar-Naigaon Division is affected by Existing

Amenity of 'Recreation Ground' (EOS2.6) as per Sanction D.P.-2034.

And whereas, Hon'ble MLA, Shri. Kalidas Kolambakar has requested BMC for modification of

requisite portion of said plot to the requisite reservation, so as to construct Olympic-Grade swimming

pool in the aforesaid Recreation Ground' from the funds available to him through the District Planning

Department.

And whereas, it is proposed to delete the Existing Amenity of ‘Recreation Ground’ (EOS2.6)

area admeasuring 6500.00 Sq.m. out of total amenity area admeasuring 32829.02 Sq.m on plot

bearing C.S. No. 15/223 of Dadar-Naigaon Division in F/South ward and to propose the reservation

of “Municipal Sports Complex” (ROS2.4) on said portion of land which is marked A-B-C-D-E-F-G-A

and shown as bounded blue on plan u/no.Ch.E./D.P./19534/City, dated 16th January 2024, as having

the permissible use of ‘Swimming Pool’ in the said reservation by following due process of section

37(1) of MR&TP Act, 1966. The details of the plot are as given in following schedule;

Now, therefore, after considering the above facts and circumstances and in exercise of the powers

conferred by sub-section (1) of Section 37 of the MR & TP Act, 1966; and of all other powers enabling

it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby

publishes a Notice for inviting objections/suggestions from any persons with respect to proposed

modification, as required by Section 37(1) of the said Act, for information of all persons likely to be

affected thereby BMC is further pleased to inform that any objections/suggestions in respect of the

proposed modification mentioned in the Schedule given below may be forwarded, in writing before

the expiry of one month from the date of publication of this notification, to the office of Chief Engineer

(Development Plan), Brihanmumbai Municipal Corporation, 5th Floor, Municipal Head office,

Mahapalika Marg, Fort, Mumbai 400 001.

Any objections or suggestions, which may be received within the said period will be dealt with

in accordance with the provisions of Section 37(1) of the said Act by the Chief Engineer (Development

Plan) BMC.

A part plan showing the proposed modification is kept open for the inspection of the general
