कमोोडिि’टीीज लि�.) (ज्याचा यापुढेे “उक्त विि¦त्तीीय संंस्थाा” असा उल्लेख करण्यात आला आहे) ही विि¦त्तीीय संंस्थाा आणिि” ति�च्या संंचालनाासाठीी

जबाबदाार असलेेले अध्यक्ष, संंचालक, व्यवस्थाापक, प्रवर्ततक, भागीदाार आणिि” ति�चेे कर्ममचारी यां�नीी ठेवीदाारां�नाा मुदतीीअंती लाभासह ठेवी

परत करण्याचे आश्वासि�त करून ठेवी स्वीकाारल्या होत्या;

आणिि” ज्याअर्थीी, उक्त विि¦त्तीीय संंस्थाा व ति�चेे अध्यक्ष, संंचालक, व्यवस्थाापक, प्रवर्ततक, भागीदाार आणिि” ति�चेे कर्ममचारी यां�नीी

ठेवीदाारां�कडू

ून स्वीकाारलेल्या ठेवी मुदतीीपुर्तीनंंतर परत करण्यास कसूूर केली असल्याने त्यांं�च्याविि¦रुध्द आर्थि�िक गुन्हे शााखा, मुं�बई येथेे

गु.र.क्र. ८९/२०१३ नुसार भारतीय दंड विि¦धाान (१८६० चा ४५) च्या कलम ४०९, ४६५, ४६७, ४६८, ४७१, ४७४, ४७७ ए, १२० बी

सह महााराष्ट्र ठेवीदाारांं�च्या (विि¦त्तीीय संंस्थांं�मधीील) हि�तसंंबंधांं�चे संंरक्षण अधि�नि�यम, १९९९ (महाा. २००० चा १६) च्या कलम ३ व ४

अन्वये गुन्हा दााखल करण्यात आला आहे;

आणिि” ज्याअर्थीी, महााराष्ट्र शाासनााची अशी खात्री झााली आहे की, उक्त विि¦त्तीीय संंस्थाा व ति�चेे अध्यक्ष, संंचालक, व्यवस्थाापक,

प्रवर्ततक, भागीदाार आणिि” ति�चेे कर्ममचारी हे ठेवीदाारां�नाा त्यांं�च्या ठेवी मुदतपुुर्तीनंंतर परत करण्यास अपयशी ठरले असून उक्त विि¦त्तीीय संंस्थेेद्वाारे

ठेवीदाारांं�च्या ठेवी परत करण्याची शक्यताा दि�सूून येत नााही;

आणिि” ज्याअर्थीी, महााराष्ट्र शाासनााला, उक्त विि¦त्तीीय संंस्थाा व ति�चेे अध्यक्ष, संंचालक, व्यवस्थाापक, प्रवर्ततक, भागीदाार आणिि”

कर्ममचारी आणिि” अन्य कोणतीीही व्यक्ती यां�नीी जमा केलेल्या ठेवींमधूून, त्यांं�च्या स्वत:च्या अथवाा अन्य व्यक्तींच्या नाावे, रकमाा व अन्य

मालमत्ता संंपादि�त करण्यात आली असल्याचे अभि�कथि�त असल्याने, उक्त विि¦त्तीीय संंस्थेेच्या ठेवीदाारांं�च्या हि�तााचे संंरक्षण

करण्याकरि�ताा अशाा रकमाा किं�ंवा अन्य मालमत्ता संंरक्षि�त करण्याचे आणिि” अशाा संंरक्षि�त केलेल्या रकमाा किं�ंवा अन्य मालमत्ता

यांं�वर नि�यंंत्रण ठेवण्यासाठीी उप जि�ल्हाधि�काारी तथाा सक्षम प्राधि�काारी (एन.एस.ई.एल.), मुं�बई शहर यां�चीी सक्षम प्राधि�काारी म्हणूून नि�युुक्ती

करणे शाासनाास आवश्यक वाटतेे.

त्याअर्थीी आताा, महााराष्ट्र ठेवीदाारांं�च्या (विि¦त्तीीय संंस्थांं�मधीील) हि�तसंंबंधांं�चे संंरक्षण अधि�नि�यम, १९९९ (महाा. २००० चा १६)

च्या कलम ४ चे पोट-कलम (१) व कलम ५ चे पोट-कलम (१) याद्वाारे प्रदाान करण्यात आलेल्या अधि�काारां�चाा वापर करून महााराष्ट्र

शाासन याद्वाारे -

(अ) मे. आयआयएफएल कमोोडिि’टीीज लि�., आय.आय.एफ.एल. सेंंटर, कमलाा सि�टीी, सेनाापतीी बापट मागग, लोअर परेेल,

पश्चि�िम, मुं�बई ४०००१३ ही विि¦त्तीीय संंस्थाा व ति�चेे अध्यक्ष, संंचालक, व्यवस्थाापक, प्रवर्ततक, भागीदाार आणिि” कर्ममचारी आणिि” अन्य

कोणतीीही व्यक्ती यांं�च्या नाावे असलेेल्या, सोबतच्या अनुसूचि�त विि¦नि�र्दि�िष्ट केलेल्या रकमाा किं�ंवा अन्य मालमत्ता संंरक्षि�त करीीत

आहे; आणिि”

(ब) अशाा संंरक्षि�त रकमाा किं�ंवा अन्य मालमत्ता यांं�च्यावर नि�यंंत्रण ठेवण्यासाठीी उप जि�ल्हाधि�काारी तथाा सक्षम प्राधि�काारी

(एन.एस.ई.एल.), मुं�बई शहर यां�चीी सक्षम प्राधि�काारी म्हणूून नि�युुक्ती करीीत आहे.

Order

Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999.

No. MPI-1123/C.R.752/Part-1/Pol-11. - Whereas, M/s. IIFL Commodities Ltd. (formerly known

as India Infoline Commodities Ltd.) (hereinafter referred to as “the said Financial Establishment”),

and its Chairman, Directors, Managers, Promoters, Partners, and its employee responsible for its

management have received deposits from depositors under the scheme to repay the deposits on

maturity along with benefits promised thereof to the depositors;

And whereas, an offence has been registered against the said Financial Establishment and its

Chairman, Directors, Managers, Promoters, Partners and its employee at Economic Offence Wing,

Mumbai vide Complaint Register No. 89/2013, under sections 409, 465, 467, 468, 471, 474, 477A,

120 B of Indian Penal Code (45 of 1860) read with sections 3 and 4 of the Maharashtra Protection of

Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), that they have

collected the deposits and have failed to repay the deposits after maturity;

And whereas, the Government of Maharashtra is satisfied that the said Financial Establishment

and its Chairman, Directors, Managers, Promoters, Partners and employee have failed to repay the

deposits after maturity and the said Financial Establishment is not likely to return the deposits to

the depositors;

And whereas, the Government of Maharashtra considers it expedient to attach the monies or

other properties believed to have been acquired by said Financial Establishment and its Chairman,

Directors, Managers, Promoters, Partners and employee and any other person, either in their own

name or in the name of any other person from out of the deposits collected by the said Financial

Establishment, in order to protect the interest of the depositors of the said Financial Establishment

and to appoint Deputy Collector and Competent Authority (NSEL), Mumbai City as the Competent

Authority to exercise control over the monies and the other properties attached.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4 and sub-section

(1) of section 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments)

Act, 1999 (Mah. XVI of 2000), the Government of Maharashtra hereby—

(a) attaches the monies and other properties in the name of M/s. IIFL Commodities Ltd.,

IIFL Centre, Kamala City, Senapati Bapat Marg, Lower Parel West, Mumbai 400013 and its

Chairman, Directors, Managers, Promoters, Partners and employees or any other person, as

specified in the Schedule appended hereto; and

(b) appoints the Deputy Collector and Competent Authority (NSEL), Mumbai City to be

the Competent Authority to exercise control over the monies and other properties attached.
