hereby appoints Adv. Ujjwal Nikam as “ Special Public Prosecutor ” for conducting the case/s pending
before Sessions Court, Ahmednagar, which is / are arising out of C. R. No. 75/2024 registered at Rahuri
Police Station, Ahmednagar.
The fees of Adv. Ujjwal Nikam as “Special Public Prosecutor ” shall be paid by Home Department as
per the fee proposal agreed by Home Department and approved by this Department.
His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law

The Maharashtra Regional Planning and Town Planning Act, 1966
ORDER
No. TPS-1123/721/C.R. 24/2024/UD-9.– Whereas, the Government of Maharashtra in Urban
Development Department vide Notifi cation No. TPS-1191/35/CR-88/UD-9, dated 28th June 1993 has
sanctioned the Development Plan of Nashik City (hereinafter referred to as “the said Development
Plan”) partly under Section 31 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966
(Mah. Act No. XXXVII of 1966) (hereinafter referred to as “the said Act”) and the same came into
force with eff ect from the 16th November 1993 and the Excluded Part of the said Development Plan
has been sanctioned under Section 31 (1) of the said Act, vide Notifi caction No. TPS-1191/35/CR-
88/UD-9, dated 15th May 1995 and the same came into force with eff ect from the 29th June 1995 ;
and Whereas, in the said Development Plan, as mentioned in the Schedule, land bearing Survey
Nos. 892(Pt.), 898 (Pt.), 899 (Pt.), 906 (Pt.) and 907 (Pt.) of mouza Nashik, taluka and district
Nashik are reserved as Site No. 390 "Housing for Dis-housed" (hereinafter referred to as "the said
Reservation").
The Appropriate Authority for the said Reservation is Nashik Municipal Corporation, Nashik
(hereinafter referred to as “the said Authority”) ;
and whereas, the said Land has not been acquired by the said Authority within Ten (10) years
from the date on which the said Development Plan came into force ;
and whereas, the various Owners of the said Land bearing Survey No. 898, Hissa Nos. 1, 2
and 3 (hereinafter referred to as “the said Land”) had served a Notice, dated 14th July 2015 for area
under reservation totalling about 34005 sq. mtrs. under Section 127 (1) of the said Act, (hereinafter
referred to as "the said Notice") to the said Authority, informing that the said Land has not been
acquired by the said Authority within the stipulated period ;
and whereas, even after service of the said Notice as aforesaid, the said Land has not been
acquired within a stipulated time limit from the date of the service of said Notice under sub-
section (1) of Section 127 of the said Act, by the said Authority ;
and whereas, Hon'ble High Court in Writ Petition Nos. 8756/2018, 8757/2018, 8758/2018 and
9000/2018 fi led by the respective owner of the said Land vide it's order dated 18th December 2022,

held that, the said Reservation to the extent of the said Land stands lapsed, under Section 127 of
the said Act.
and whereas, Hon'ble Supreme Court in Special Leave Petition (Civil) Nos. 13060/2023,
16896/2023, 15370/2023 and 15369/2023 fi led by the said Authority against the order dated 18th
November 2022 of the Hon'ble High Court vide it's order dated 3rd July 2023, dated 4th August 2023,
dated 17th July 2023 and 17th July 2023 respectively has dismissed the said Special Leave Petition".
and whereas, in the meantime the Government of Maharashtra in Urban Development Department
vide Notifi cation No. TPS-1116/CR-140 (A)/UD-9, dated 9th January 2017 has sanctioned the Revised
Development Plan of Nashik City (hereinafter referred to as “the said Revised Development Plan”)
partly under Section 31 (1) of the said Act and the same came into force with eff ect from the 9th
February 2017 ;
and whereas, in the said Revised Development Plan the said Land alongwith other Lands is
reserved for the said Authority as Site No. 205 “Public Housing” (hereinafter referred to as “the said
Revised Reservation”) ;
and whereas, Now, it becomes expedient to notify by an Order under Section 127 (2) of the
said Act that the said Reservation on the said Land in the said Development Plan has been lapsed.
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the
said Act and of all other powers enabling it in that behalf, the Government of Maharashtra, hereby
notifi es that the said Reservation on the said Land stands lapsed from the said Development Plan
and Consequently, the said Revised Reservation on the said Land, in the said Revised Development
Plan has become redundant. The said Land so released shall be available to the Land Owner for
the purpose of Development as otherwise permissible in the case of adjacent land under the said
Revised Development Plan.
(1) A copy of the Part Plan showing the details of land released from Reservation in the
said Development Plan and redundant Reservation on the said Land, in the said Revised
Development Plan vide this Order is available in the Offi ce of the Commissioner, Nashik
Municipal Corporation, Nashik during the Offi ce hours on all working days for inspection of
the public upto one month.
(2) This Order shall also be available on the Government website www.maharashtra.gov.in

it has been decided to delineate the area of
operation of Water User Association (WUA's)
on hydraulic basis and as per administrative
convenience under Section 6.00 and Rule 3
of the Maharashtra Management of Irrigation
System by Farmers Act, 2005.
I, Vaibhav Shantaram Bhagwat, the Executive
Engineer, Palkhed Irrigation Division, Nashik
hereby, delineate area of operation of following
WUA's and direct that the certifi ed copy of the
updated map and list of land holders and / or
occupiers of said WUA's shall be displayed on
the notice board of the offi ces of Vanarwadi and
Indore Grampanchayat, Dindori Tahasil Offi ce,
Dindori -2, Irrigation Section, Waghad canal Sub
Division, Dindori, taluka Dindori, district Nashik
and Division Offi ce Nashik.

hereby declare that no water shall be suppplied
by the Appropriate Authority to an individual
holder or occupier of such land and system
of supply of Water User's Association shall by
