(१९६५ चा महा. ४०) (यात यापुढɂ ùयाचा उčलेख “उòत अिधिनयम” असा करĀयात आला आहे) या÷या कलम ३४१अ चे

पोट-कलम (१ब) आिण कलम ३ चे पोट-कलम (३) मधील तरतुदीनुसार, महाराđł शासन याǑारे नागपूर िजčǡातील ĺामपंचायत

येरखेडा या ĺामपंचायतीचे Ēथािनक ȦेŇ, ĺामीण ȦेŇातून नागरी ȦेŇामĄये संĸिमत होणारे संĸमणाāमक ȦेŇ Ċहणुन िविनिदɑđट करĀया÷या

आिण उòत Ēथािनक ȦेŇासाठी “येरखेडा नगरपंचायत” या नावाने नगरपंचायत घटीत करĀया÷या दृđटीने, उòत अिधिनयमाचे कलम

३४१अ चे पोट-कलम (१) (१ब) आिण (२) मधील Ōदान करĀयात आलेčया अिधकारांचा वापर कȠन, अिधसूचना काढĀयाचा

आपला हेतू घोिषत करीत आहे.

२. उòत उăघोषणेला आȦेप घेणाķया कोणāयाही ďयòतीने, ही उăघोषणा महाराđł शासना÷या राजपŇात Ōिसǌ झाčया÷या

िदनांकापासून तीस िदवसां÷या कालावधीत िजčहािधकारी, नागपूर, रिवंŉनाथ टागोर मागɑ, िसȬďहल लाईąस, नागपूर ४४० ००१ यां÷याकडɂ

āयाची लेखी कारणे सादर करणे आवĐयक असेल.

३. उòत कालावधीमĄये िमळालेčया अशा कोणāयाही आȦेपावर शासनाकडȴन िवचार करĀयात येईल.

ȦेŇातून नागरी ȦेŇामĄये संĸिमत होणारे संĸमणाāमक ȦेŇ Ċहणुन िविनिदɑđट करĀयासाठी व उòत संĸमणाāमक ȦेŇासाठी “येरखेडा

नगरपंचायत” या नावाने नगरपंचायत घटीत करĀयासाठी, उòत अिधिनयमाचे कलम ३४१ अ चे पोट-कलम (१), (१ब) आिण (२)

या अąवये अिधसूचना काढĀया÷या आपčया ŌĒतावावर आȦेप मागिवले आहेत;

आिण ùयाअथȯ Ōाथिमक उăघोषणा, नगरिवकास िवभाग, एमयुएन-२०२४/Ō.ĸ.३५१/निव-१८, िदनांक ०४ ऑòटोबर, २०२४

Ēथािनक वतɑमानपŇात Ōिसǌ करĀयात आली;

आिण ùयाअथȯ, अिधसूचनेत नमूद कालावधीत िजčहािधकारी, नागपूर यां÷याकडɂ ŌाĆत होणाķया आȦेपांचा शासनाकडȴन िवचार

करĀयात आला;

आिण ùयाअथȯ, भारताचे संिवधाना÷या अनु÷छɂद २४३-थ ÷या खंड (२) मĄये नमूद कɁलेčया बाबी िवचारात घेऊन महाराđł

शासनाला, यासोबत जोडलेčया अनुसूची "अ" मĄये अिधक तपशीलवारपणे वणɑन कɁलेले उòत Ēथािनक ȦेŇ हे, संĸमणाāमक ȦेŇ

Ċहणून िविनिदɑđट करणे इđट वाटते.

āयाअथȯ आता, उòत अिधिनयमाचे कलम ३४१ अ चे पोट-कलम (१), (१ब) आिण (२) अąवये Ōदान कɁलेčया अिधकारांचा

वापर कȠन व āयाबाबतीत समथɑ करणाķया इतर सवɑ अिधकारांचा वापर कȠन, महाराđł शासन, याǑारे उòत Ēथािनक ȦेŇ हे, संĸमणाāमक

ȦेŇ Ċहणून िविनिदɑđट करीत असून, āयासाठी उòत अिधिनयमा÷या कलम ३४१ अ चे पोट-कलम (२) मĄये तरतूद कɁčयाŌमाणे, “येरखेडा

नगरपंचायत” या नावाने एक नगरपंचायत घटीत करĀयात येत आहे. उòत संĸमणाāमक ȦेŇा÷या हǋी यासोबत जोडलेčया अनुसूची

“ब” मĄये िविनिदɑđट कɁčयाŌमाणे असतील.

PROCLAMATION

No. MUN-2024/C.R.351/UD-18.— In pursuance of the provisions of sub-section (1B) of section

341A read with sub-section (3) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats

and Industrial Townships Act, 1965 (Mah. XL of 1965) (hereinafter referred to as "the said Act"),

the Government of Maharashtra hereby announces its intention to issue a notification in exercise

of the powers conferred by sub-sections (1), (1B) and (2) of section 341A of the said Act, with a view

to specify the local area of the village panchayat Yerkheda in Nagpur District, being an area in

transition from a rural area to an urban area and to constitute a Nagar Panchayat by the name of

"the Yerkheda Nagar Panchayat" for the said transitional area.

2. Any person who entertains any objections to the said Proclamation is hereby required to

submit the same in writing with the reasons thereof, to the Collector, District Nagpur, Ravindra

Nath Tagore Marg, Civil Lines, Nagpur, Maharashtra, Pin code - 440 001 within a period of thirty

days from the date of publication of this Proclamation in the Maharashtra Government Gazette.

3. Any such objection which may be received during the said period will be considered by the

Government.

DRAFT NOTIFICATION

No. MUN-2024/C.R.351/UD-18.— Whereas, by the Government Proclamation, Urban

Development Department, No. MUN-2024/C.R.351/UD-18, dated the 4th October, 2024 published

in the Maharashtra Government Gazette, Part-I-A, Extraordinary, Central Division Supplement,

dated the 4th October 2024 issued in pursuance of the provisions of sub-section (1B) of section 341A

read with sub-section (3) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats

and Industrial Townships Act, 1965 (Mah. XL of 1965) (hereinafter referred to as "the said Act"),

the Government of Maharashtra had invited objections within a period of thirty days, from the date

of publication thereof in the Maharashtra Government Gazette, to its proposal to issue a notification

under sub-sections (1), (1B) and (2) of section 341A of the said Act, to specify the local area of the

village panchayat Yerkheda in Nagpur District, being an area in transition from a rural area to an

urban area and to be a transitional area and to constitute a Nagar Panchayat by the name of "the

Yerkheda Nagar Panchayat" for the said transitional area ;

And whereas, the Government Proclamation, Urban Development Department, No. MUN-

2024/C.R.351/UD-18, dated the 4th October 2024 was published in the local newspaper;

And whereas, the objections received in pursuant to the said Proclamation by the Collector of

Nagpur District, within the specified period, have been considered by the Government;

And whereas, having regard to the factors mentioned in clause (2) of article 243-Q of the

Constitution of India, the Government of Maharashtra considers it expedient to specify the said local

area, more particularly described in the Schedule "A" appended hereto, to be a transitional area.

Now, therefore, in exercise of the powers conferred by sub-sections (1), (1B) and (2) of section

341A of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra

hereby, specifies the said local area to be a transitional area, for which there shall be constituted a

Nagar Panchayat, as provided in sub-section (2) of said section 341A of the said Act, by the name of

the "Yerkheda Nagar Panchayat." The boundaries of the said transitional area shall be such as are

specified in Schedule "B" appended hereto.
