AN ORDINANCE

further to amend Shree Siddhi Vinayak Ganpati Temple Trust

(Prabhadevi) Act, 1980.

WHEREAS both Houses of the State Legislature are not in session;

AND WHEREAS the Governor of Maharashtra is satisfied that

circumstances exist which render it necessary for him to take immediate

action further to amend Shree Siddhi Vinayak Ganpati Temple Trust

(Prabhadevi) Act, 1980, for the purposes hereinafter appearing ;

NOW, THEREFORE, in exercise of the powers conferred by clause (1)

of article 213 of the Constitution of India, the Governor of Maharashtra is

hereby pleased to promulgate the following Ordinance, namely :—

1. (1) This Ordinance may be called Shree Siddhi Vinayak Ganpati

Temple Trust (Prabhadevi) (Amendment) Ordinance, 2024.

(2) It shall come into force at once.

2024 (Mah. Ord. XV of 2024), is hereby published under the authority of the Governor.

2. In section 5 of Shree Siddhi Vinayak Ganpati Temple Trust

(Prabhadevi) Act, 1980 (hereinafter referred to as “the principal Act”), for

sub-section (3), the following sub-section shall be substituted, namely :—

“ (3) The State Government shall, by notification published in the

Official Gazette, appoint a Chairman, a treasurer and not more than

fifteen other members to form the Committee.”.

3. In section 7 of the principal Act, in sub-section (1), for the words

“ three years ” the words “ five years” shall be substituted.

4. For removal of doubt, it is hereby declared that the amendment made,

with respect to increase the term of office of members of the Committee, by

Shree Siddhi Vinayak Ganpati Temple Trust (Prabhadevi) (Amendment)

Ordinance, 2024, shall be applicable to all the members, including Chairman

and treasurer, appointed before the commencement of the said Ordinance.

STATEMENT

Section 5 of Shree Siddhi Vinayak Ganpati Temple Trust (Prabhadevi)

Act, 1980 (Mah. VI of 1981) provides for Shree Siddhi Vinayak Ganpati Temple

Trust Management Committee which looks after the management of Shree

Siddhi Vinayak Ganpati Temple Trust (Prabhadevi). Sub-section (3) of said

section 5, provides for a Committee consists of a Chairman, a treasurer and

not more than seven other members appointed by the State Government, by

notification published in the Official Gazette.

Sub-section (1) of section 7 provides for term of office of members of the

Committee, including the Chairman and the treasurer, for three years.

2. To enable the Trust to provide for better facilities as well as for

implementing various schemes for the welfare of devotees and for effective

management and better administration of the said Trust, it is considered

expedient, to increase the total number of other members of the Committee

from nine to fifteen and to increase the term of office of members of the

Committee from three years to five years.

3. The Government, therefore, considers it expedient to amend the

sub-section (3) of section 5 and sub-section (1) of section 7 of Shree Siddhi

Vinayak Ganpati Temple Trust (Prabhadevi) Act, 1980, suitably.

4. As both Houses of the State Legislature are not in session and the

Governor of Maharashtra is satisfied that circumstances exist which render

it necessary for him to take immediate action further to amend Shree Siddhi

Vinayak Ganpati Temple Trust (Prabhadevi) Act, 1980, for the purposes

aforesaid, this Ordinance is promulgated.
